Women's Breasts vs. Men's: Could Police Discern?

After a New Hampshire judge essentially legalized topless female nudity, state lawmakers considered a bill banning bare female breasts/nipples in public, but critics explained that such a law would require police officers to determine if the offender is a man or a woman and because of the myriad new transgender rights, any apparent female offender could simply claim to "identify as a man" and thus negate the infraction.

"It's a shame that some folks are more concerned with exposing their breasts in public places than they are concerned about how families and children may be impacted by being forced to experience this evolving societal behavior.  This is about a movement to change the values of New Hampshire society."

The House Criminal Justice and Public Safety Committee had voted last week, 18-0, to kill the bill, with several members saying passing the bill would guarantee the law would be challenged in federal court because it violated equal protection rights under the Constitution.

Some on the committee said the place to enact restrictions is at the local level, not statewide, and others noted that if a women had commited a second offense under the proposal she would have had to register as a sex offender and could have spent up to seven years in jail.

New Hampshire, like most states, does not have laws prohibiting women from going topless if men are allowed the same privilege.

The House voted against making it a misdemeanor for women to show their breasts with "reckless disregard" for whether it would offend someone. The bill was partly a response to a "Free the Nipple" movement that led to two women being cited for going topless at a Gilford beach. A judge dismissed that case in February.

Bill supporters had cautioned that allowing women to go topless at beaches could lead to them also going topless at libraries and Little League games. They said they were trying to shield families and children.

At Monday's public hearing, backers of the legislation cautioned that allowing women to go topless at beaches will create a slippery slope where women are going topless at public libraries and Little League baseball games. [Rep. Brian] Gallagher and Rep. Peter Spanos, a co-sponsor of the bill, said New Hampshire could lose tourism dollars if women are wandering public places with their breasts uncovered. Both said they brought the legislation in response to concern from constituents over the incident in Gilford.

But opponents charge such a ban violates the constitution by creating different standards for men and women. Kari Stephens, a Hampton resident who said she goes topless at the beach, argued lawmakers shouldn't be taking away a right that women in New Hampshire already have.

The New Hampshire chapter of the American Civil Liberties Union also opposes the bill.

Christmas Tree Flyer Censored by NH School Supt.

A few days after Veterans' Day, Superintendent Robert Malay of School Administrative Unit 29 (Keene, New Hampshire) put Air Force veteran John Fletcher on notice that if he wanted to distribute invitation flyers in district schools for any civic events, the word "Christmas" is strictly forbidden.  The Lions Club and American Legion had previously sponsored the annual Christmas tree lighting in Marlborough, NH for over 15 years without incident.

"I was very upset, I really was.  If it's not a school sponsored activity, I don't understand why 'Christmas' had to come out of 'Christmas Tree'."

NH School Teaches Porn, Complaining Dad Arrested

William Baer told the Gilford, New Hampshire school board they had no right to require his 14-year-old daughter to read a pornographic novel, but when he spoke beyond the 2-minute limit, he was handcuffed, arrested, required to post $700 bond to get out of jail, and faces a potential $1,200 misdemeanor fine.

The superintendent said Baer did follow school policy and met with Gilford High School Principal Peter Sawyer about the issue Monday afternoon, before the [school board] meeting.

[Then, Baer] went to the school board meeting and pointed out the school erred in not giving notice to parents about the book’s use in class.

After exceeding his allotted two minutes to speak Monday night, Baer began arguing with another resident at the meeting . . .  [then] Lt. James Leach, who is the town’s acting police chief, arrested him on a charge of disorderly conduct.

Baer said the video, which was posted on YouTube Tuesday afternoon, shows Superintendent Kent Hemingway pointing to Leach when Baer began arguing with the other parent. He claims that is evidence that Hemingway organized the arrest.

“I was set up. The cop got the high sign, and I was arrested,” Baer said.

. . . Jodi Picoult’s Nineteen Minutes, [is] an award-winning novel based on a school shooting in a fictional New Hampshire high school. The novel contains depictions of physical violence in public schools and a scene of graphic sexual activity, and it has been a reading selection available to Gilford High School staff since 2007.

The school district has acted swiftly since some parents’ concerns were brought to their attention, Hemingway said. “We’ve tried to be as transparent as possible through all of this,” he said yesterday. Informational notices were sent home with students and posted on the district website [on the school day] before and after the meeting.

During the meeting, the board heard from administrators, parents, students and community members about the Nineteen Minutes assignment. Afterward, high school Principal Peter Sawyer personally contacted more than 100 parents whose children were given the book, Gilford Superintendent Kent Hemingway said. Eighty percent of those parents consented directly, 10 percent said they didn’t want their child to read the book and 10 percent were undecided.

About eight to 10 students were given alternate assignments, but Nineteen Minutes will not be removed as an option for teachers, Hemingway said.

[Baer] challenged Superintendent Kent Hemingway to read a copy of the controversial passage aloud at the public input session of last night's meeting. But Sue Allen, School Board chairman, who had earlier set a limit of two minutes on public input on the issue and ruled that no one could speak a second time, said no one from the board or administration would be reading any material submitted at the meeting aloud.

Doug Lambert later read the offending page, which described a sex act between teenagers, and later in the meeting, when a second public input session was held, read a passage from the Bible which said that those who sinned against the innocent be cast into the sea with a millstone around their neck.

Other parents supported Baer's stance. Sarah Carrignan said that she was "utterly appalled that this was acceptable. My son should never have had the book in his hand" and said that the waiver sent home which would allow their children to read the book was "garbage."

. . . [School] officials said that when "Nineteen Minutes" was assigned in past years, parents were notified for their approval and conceded this procedure was not followed last week. A statement was sent to parents yesterday notifying them of the book and its content and acknowledging the oversight.

Baer admits to both claims. A birther is slang for a person who does not believe President Barack Obama was born a U.S. citizen.

Meanwhile, at other websites and new[s] programs which tend to favor liberal causes, he was labeled as a “Fox and Tea Party Hero.”

Baer readily admitted that he was once active in a New Jersey political group that questioned whether Obama was really born in America. He said he’s still not sure about the President’s birthplace, but is no longer heavily invested in the cause.

Dartmouth Dumps African in Support of Homosexuals

Backed by the NAACP, Dartmouth College has rescinded the appointment of Dr. James Tengatenga, the former bishop for the Anglican diocese of Southern Malawi, because of past statements he made critical of homosexuality, although more recently, he HAS embraced "gay marriage."  Having thus been accused of not being gay-supporting enough, Dr. Tengatenga plans to engage legal counsel.

This is an intriguing saga of a battle between several leftist homosexualist institutions . . .

Tengatenga released a statement saying that his views on gay rights had evolved over time and that he now supports marriage equality and considers discrimination of any kind sinful.

Praying Mother Banned from School Grounds in N.H.

Lizarda Urena was alarmed and concerned for her two children at Concord (New Hampshire) High School when ammunition was found in the school restroom, so she began to pray aloud outside the school every morning, but when atheists in Wisconsin learned of her actions, their lawyers threatened the school, so the superintendent promptly banished Urena.

Lizarda Urena, the mother of two students, began praying on the steps outside the high school auditorium every morning after two bullets were found in a school toilet in February. She would spend about 15 minutes reading Bible verses and calling out prayers for the safety of the students. When the Monitor wrote a story about Urena in mid-May, both Principal Gene Connolly and school board President Kass Ardinger said they hadn’t received any complaints about her actions.

But that month a Concord resident contacted the Freedom From Religion Foundation [FFRF] to express concern about Urena’s actions. After requesting information about Concord High policies, the group’s attorney sent a letter to [Superintendent Chris] Rath saying the district should not allow Urena to continue praying at the school. Rath responded July 12, saying the district would tell Urena she could no longer pray on school district property.

Urena plans to continue praying for the students’ safety even if she can’t do so on campus. She will pray at her home or at the gas station across the street from the school, she said. Although she is sad she will be asked to leave, she said she appreciates that Connolly let her pray there for several months.

A lawyer for a group that defends religious speech says if the school district didn't initially object to Urena speaking at the Concord High front door, and later responded to the content of her speech, then it has engaged in illegal viewpoint discrimination.

"Students and community members that are allowed to come on campus and participate in a neutral thing are allowed to express religious viewpoints," said Matthew Sharp, general counsel for Alliance Defending Freedom. "The students know it's the mother and her own speech — something that the First Amendment protects — and that it is not the school mandating this woman to do it."

It is unclear whether the school district will ultimately have to defend the ban in court.

Sharp of the pro-prayer Alliance Defending Freedom says the group hasn't decided whether to take up Urena's cause.

The federal agency said it will award $1 million to Planned Parenthood of Northern New England to restore family planning services, which include contraception and cancer screenings, in uncovered areas of New Hampshire through December 2012. The state health commissioner had said he was unable to find alternative providers after the Executive Council voted 3-2 in June against renewing a contract with Planned Parenthood. The two-year contract would have subsidized care for 16,000 residents, many of them poor women.

The award of the federal grant was non-competitive because Planned Parenthood has experience providing federally subsidized family planning services, the Department of Health and Human Services said in its announcement. All public and private nonprofit organizations can compete for the contract in 2013, the announcement said.

The question of the Planned Parenthood contract divided the all-Republican Executive Council. Yesterday, Councilor David Wheeler, one of the three councilors who voted against the contract, said the federal decision reveals the "arrogance" of the Obama administration. Wheeler, who lives in Milford, said he voted against all 11 family planning contracts decided in June because the federal family planning program allows referrals for abortion.

NH Gov. Vetoes Abortion Parental Notification

The New Hampshire Catholic bishop is appealing to the state legislature to override Gov. John Lynch's veto of a bill requiring abortionists to inform parents, or a judge (48 hours in advance), of the intention of any girl under age 18 to kill her unborn child.

The Democratic governor said he was prepared to sign a parental notification bill if it contained commonsense changes. He said a young woman should not be forced to involve the person who abused her in the decision.

He also noted that if doctors performed abortions and it was later determined to be the wrong decision, they would have faced criminal liability.

Four years ago, Lynch made New Hampshire the first state to repeal a law requiring parental notification for minors to get abortions. He said the unenforced law was unconstitutional because it failed to protect the safety of young women.

In what way does it make sense that a child cannot be given an aspirin by a school nurse without the consent of the parent,” McCormack said, “but that same child can have an abortion, serious surgery with life-changing consequences, without the parent even knowing that it has happened?”

The Republican-dominated Legislature appears to have strength to muster an override. The House passed the bill 256 to 102 and the Senate passed it 17 to 7.

Parental notification has been a hot-button issue for as long as John Lynch has been Governor, and throughout Lynch’s almost 7 years in office his stance has been pretty consistent: He didn’t think a notice law was needed but did think that parents would ideally be involved in a minor's decision to have an abortion. Lynch’s veto message, though, says something a little different.

“I support parental notification. I think parents should be involved in decision of this significance, but I also recognize that are situation where parents can’t be involved, particularly where there are minors who are victims of rape and incest.”

Parental notification bills have historically had a hard time in Concord. The one passed in 2003 and later repealed after a legal battle that stretched all the way to the US Supreme Court cleared the state senate by just a single vote. But republican leaders made this bill a top priority, and it cleared both chambers more than 2 to 1 margins.

. . . 2/3rd votes in both chambers are required for an override. But neither the governor, nor lawmakers may have the final word. Diana Kasdan of an ACLU lawyer who monitors abortion issues nationwide. She says a court challenge would examine more than case law and statutory construction.

Following a Senate vote earlier this month in Indiana, the House on Wednesday voted 66-32 to cut off $3 million in federal money the state distributes to the family planning group. The bill is now in Gov. Mitch Daniels' hands, and some say he risks losing $4 million in federal Medicaid money if he signs it into law, a claim that is in dispute. Planned Parenthood officials are urging Daniels to veto the bill or face a court challenge to the defunding.

In Kansas, Gov. Sam Brownback has proposed in his 2012 budget stripping Planned Parenthood of $300,000 in federal family planning funds and redirecting it to state and local health clinics. Lawmakers are expected to vote on the proposed budget in the coming weeks. If passed, it will take effect on July 1.

In North Carolina, the proposed state budget includes a ban on state contracts with Planned Parenthood for teen pregnancy prevention and family planning that would cause the organization to lose $473,000.

In New Hampshire, where Republicans took control of the Legislature in November, the House is considering a bill that would cut $700,000 in public money state sends to Planned Parenthood. The legislation bans all state contracts with any service provider that offers abortions.

[Gov.] Daniels has not yet commented on whether or when he will sign the bill. However, regarding the presidential campaign, he has said he will announce his decision following the end of the legislative session, which is Friday.

Daniels is considered a moderate Republican who last summer told The Weekly Standard that the next president needs to declare “a truce on the so-called social issues” in favor of tackling America’s economic woes. During his two terms as governor, Daniels has preferred to focus on union issues, budgeting, and education.

According to state law, a veto from Daniels could be overridden by the state Senate, which is majority Republican. That could provide him the convenience of not bearing direct responsibility for the measure becoming law.

Indiana’s Planned Parenthood chapter says it will seek an injunction against the bill if it becomes law.

Town Allows 'Signs for Jesus' after Lawsuit

A New Hampshire planning board has cleared the way for a man to display an electric sign on U.S. Route 4 in Chichester that would display a bible verse.

The town's planning board voted 5-2 Thursday to allow construction of the Bible verse-displaying sign at the intersection of Route 4 and Main Street. The board originally voted 4-3 in February not to allow the sign, but changed its mind after the project's applicant, Fabrizio Cusson of Barnstead, filed a federal lawsuit against the planning board alleging religious discrimination and not following land use laws.

Chichester planning officials approached Cusson's attorney shortly after he filed a motion for a hearing Monday in federal court, Cusson said.

Planning Board Chairman Thomas Jameson . . . said the board members who changed their minds likely did so because there was no hard evidence that a "Sign for Jesus" would cause traffic crashes by drivers distracted by it, which was the justification for denial.

A new Bible verse will be displayed on the sign each day, and Cusson will change those messages remotely from a computer.

Rep. David Bates, R-Windham, has already filed two bills to return the marriage law to exactly what it was four years ago. His bill strictly defines marriage as between a man and a woman, but also has a caveat so marriages performed the past year would remain legal.

If Democratic Gov. John Lynch does veto the bill, the Legislature needs two-thirds of members present to override his veto.

The bill's preamble states, "Marriage is not a creature of statute but rather a social institution which predates organized government." It says marriage serves "important social goods" in which government has an interest.

It continues, "The vast majority of children are conceived by acts of passion between men and women - sometimes unintentionally." Because of that, the bill states, the state has an interest in protecting the union of men and women to increase the likelihood that children will be born and raised by their natural parents.

Bates's bill lists the marriages that would be prohibited to all men and women. Besides same-sex partners, they include marriages to their children, aunts, uncles, nieces and nephews.

House Majority Leader D.J. Bettencourt said recently that repealing gay marriage is not a priority for House leadership, and he will ask the House Judiciary Committee to retain Bates's bill until 2012. The final decision will be up to the committee, which is led by Amherst Republican Rep. Robert Rowe. A public hearing has not yet been scheduled.

"The author is a known social Marxist, hates everything American, everything that America stands for or was built on," Aimee Taylor said. "I mean when you read the book you see that strongly in this woman's agenda. It's horrible."

In response to the Taylors' complaint, school district officials convened a materials review committee of teachers, administrators and community members to assess the book. Upon review, the committee ruled that the book's educational merit outweighed its shortcomings.

The U.S. Court of Appeals for the First Circuit has upheld the constitutionality of public school children reciting "under God" in Pledge of Allegiance, rebuffing a prominent atheist group's attempt to stop the practice.

The ruling came in a lawsuit filed by The Freedom From Religion Foundation, a Madison, Wis., educational group working for the separation of church and state; two group members, identified as Jan and Pat Doe; and their three children, who attend public schools in the Hanover school district in New Hampshire and the Dresden district in New Hampshire and Vermont.

Gay Gene, Episcopal Bishop Retires Early

The rift in the Anglican communion over homosexuality was reopened today after its first openly gay bishop, Gene Robinson, said he was retiring early because seven years of controversy had "taken their toll" on him, his family and followers.

He cited death threats and the considerable strain that the worldwide rift has placed on him, his family, and the church.

Robinson's state-level election and national ratification by the Episcopal Church in 2003 exposed a growing division in the Anglican Communion, or worldwide Church of England, among religious liberals and conservatives. It also made Robinson an international figure. In January 2009, then-president-elect Barack Obama selected Robinson to deliver a pre-inauguration prayer at an event at the Lincoln Memorial.

But in New Hampshire, where Robinson has lived and worked for 35 years, there was less fallout to his selection.

Same-sex 'Marriage' Loser in 2010 Elections

The issue of "gay marriage" technically was not on any ballot Nov. 2 but it nevertheless was a big loser again on the state level, as Iowa voters ousted three state Supreme Court justices in an unprecedented vote, and several key state legislatures and governor's offices flipped from liberal to conservative.

The result is that on the national level, the legalization of "gay marriage" could be slowed, halted or -- in the cases of Iowa and New Hampshire -- altogether reversed.

An amendment likely now will clear the House, while its prospects in the Senate remain unclear but are probably improving. . . .

. . . In Maine, Republican Paul LePage, who opposes "gay marriage," won an open seat to succeed outgoing Democratic Gov. John Baldacci, who signed a "gay marriage" law in 2009, only to see voters reverse it. Additionally, Republicans took the Maine House and Senate from the Democrats for the first time since the early 1970s. Homosexual activists had hoped to push a "gay marriage" law there again in the near future.

In Minnesota, Republicans shocked political pundits in the state by taking both the House and Senate for the first time in 38 years, likely thwarting hopes by homosexual groups to pass a "gay marriage" law and perhaps setting the stage for a marriage amendment to be placed on the ballot. In the governor's race, "gay marriage" supporter and Democrat Mark Dayton was clinging to a small lead over "gay marriage" opponent and Republican Tom Emmer.

In Indiana, Republicans retook the House, an action that could put a constitutional marriage amendment -- which appeared to be sailing along several years ago until it was blocked by the now-outgoing Democratic House speaker -- back on track. Gay Agenda Counters Freedom of Press

The refusal by [New Hampshire's] largest newspaper to run a wedding announcement from a gay couple has drawn the ire of one of New Hampshire’s Democratic congressmen, among others.

The New Hampshire Union Leader of Manchester says it has a constitutional right to choose what to print. Publisher Joe McQuaid says the paper isn’t "anti-gay," but believes that marriage is between a man and a woman. He said the paper is opposed to a recent state law legalizing gay marriage.

Democratic U.S. Senate candidate Paul Hodes called on the paper to change its policy and respect the state law. He challenged Republican opponent Kelly Ayotte to denounce its decision. An Ayotte spokesman said government officials have no business telling a free press what to do.

It would be hypocritical of us to do so, given our belief that marriage is and needs to remain a social and civil structure between men and women and our opposition to the recent state law legalizing gay marriage.”

An Epsom [New Hampshire] couple says state social workers seized their newborn baby hours after her birth because of the father's affiliation with an organization that opposes government tyranny.

A baby girl [Cheyenne Irish] was taken into state custody at Concord Hospital by child welfare officials [DCYF] on Thursday, just hours after she was born, according to her parents. And now the parents are at the center of an Internet-fueled fire storm over government intervention and parental rights.

In an affidavit supporting its actions, the DCYF . . . notes [the baby's father, Johnathon] Irish's affiliation with Oath Keepers, which it describes as "a militia," and his purchase of "several different types of weapons including a rifle, handgun and Taser."

Irish said he and the baby's mother, Stephanie Taylor, have been flooded with messages of support and requests for interviews since an interview he did with a self-described "independent journalist" was posted on the oathkeepers.org website. By 5 p.m. yesterday, the audio recording of that interview had gotten more than 17,000 hits on YouTube and sparked a protest outside Concord Hospital.

Irish and Taylor stood at the hospital entrance yesterday, talking with about a half-dozen supporters who were alerted to their case by media and social media reports. Irish wore a "Don't Tread on Me" hat; both were still wearing their hospital wristbands from the baby's birth.

There will be a hearing in the case on Thursday in Rochester Family Court. And Irish said he expects the courtroom will be "packed with a bunch of tea partiers."

The group's website describes it as an affiliation of current and former military and law enforcement members who promise to resist totalitarian actions by the government.

Irish said that on Thursday, one day after Taylor gave birth to their daughter, a group of police officers and state social workers took her from them. He said he and Taylor did not know where their daughter had been taken.

"She's either in the nursery there or in a foster home," said Taylor, who was on hand with Irish to greet protesters and grant interviews.

A New Hampshire town has voted to reject a Christian sign -- a decision at odds with ordinance provisions and treatment of other business signage.

CHICHESTER [NH] – The Board of Adjustment . . . rejected an appeal for a "Sign for Jesus" electronic sign proposal near a Route 4 intersection.

. . . Fab Cusson of Barnstead . . . purchased land near the corner of Route 4 and Main Street in November with plans to install a 12-foot tall electronic sign that would display one message from the Bible each day.

Cusson argued that the town's zoning ordinances are "contradictory" and a provision allowed for approval of an electronic sign after a public review. His proposal was also 20 square-feet smaller than the maximum allowed for a sign outside a business, officials said.

. . . the 38-year-old Barnstead father of three wants to help others by spreading the word of God via a 12-foot electronic message board on Route 4. Cusson said his ultimate goal is to launch a nationwide program called "Signs for Jesus," with electronic signs in other areas.

"My intention is to encourage people driving by with the word of God," Cusson said. "I strongly feel the Lord spoke for me to do that."
