Ex-lesbian Ex-wife, Now Man, Ruled De Facto Parent

Brittany Conover gave birth to her son Jaxon Conover in 2010, who was conceived by artificial insemination without a legal father, and thereafter "married" her lesbian lover Michelle Conover, from whom she is now divorced.  However, last week, the Maryland Court of Appeals ruled that Michelle Conover, who now claims to be a transgender named Michael and is suing for visitation rights to Jaxon, is the child's "de facto" parent.
“Gays and lesbians are particularly 'ill-served by rigid definitions of parenthood'...When gay or lesbian relationships end, at least one member will find itself in a court system ill-prepared to recognize its existence and to formulate rules to resolve its disputes.”

Maryland's highest court has ruled an adult who is intimately connected to a child's upbringing is entitled to visitation and a share of custody, if the child's best interests are served.

The Court of Appeals decision overturns an eight-year-old ruling. In that decision, judges declined to grant de facto parental rights to unrelated individuals, unless they could prove exceptional circumstances.

The boy [Jaxon] was born six months before [the two women] married and 17 months before they divorced.

De facto parents can include the partner of a lesbian who undergoes artificial insemination, a gay man whose partner adopts a child from a country that does not allow same-sex couples to jointly adopt, or a straight man who raises a child with a woman for years without formal adoption.

R. Martin Palmer Jr., an attorney for Brittany Conover, said the court usurped the role of lawmakers in defining a parent and may have created a situation in which stepfathers can take control of children from capable mothers.

“Seeking to serve the needs of the LGBT community has created a bad situation for traditional families and their children,” Palmer said.

Nancy Polikoff, a family-law professor at American University who studies LGBT issues, said the ruling does not address all issues nontraditional parents face, including what happens when parent split up before an artificially conceived child is born and whether the children of non-biological parents qualify for benefits after their death.

In the decision, the court established de facto parenthood for a person who formed a “parent-like” relationship with the child that “the biological or adoptive parent consented to and fostered,” provided that “the petitioner and the child lived together in the same household, that the petitioner assumed obligations of parenthood by taking significant responsibility for the child’s care, education and development, including contributing towards the child’s support, without expectation of financial compensation, and that the petitioner has been in a parental role for a length of time sufficient to have established with the child a bonded, dependent relationship parental in nature.”

Michelle/Michael filed a court request for visitation rights claiming that she had standing as a parent under Maryland’s definition of “father” for children of unmarried parents. Michelle still identified as a woman at that time.

In 2013, the circuit court ruled that “[Michelle] is in fact a female, had not adopted the child, and in no way was related to the child, thus not sufficiently establishing that she could be the ‘father’ of the child.”

The lower court ruled that Michelle did not have parental standing, but as a third party, must first show that Brittany was an unfit parent or that exceptional circumstances existed in order to claim visitation rights.

Since the issue of de facto parenting isn't addressed under existing statute, the court endorsed standards set forth under a Wisconsin Supreme Court decision: That the biological or adoptive parent consented to and fostered the third party's parent-like relationship, that they lived together in the same household, that the de facto parent took on significant responsibility for the child's care, education and development without expectation of financial reward, and the parental relationship lasted long enough for them to be bonded and the child to feel dependent.

Divorce and child custody decisions have always been a messy and difficult business with, as Judge Sally Adkins writes in the opinion, "grave implications for all parties." The case isn't resolved by the Court of Appeals ruling, only the legal standing of Michelle Conover who, according to a court filing, transitioned to living as a transgender man after the divorce. Now, the matter of visitation will be back in the hands of the lower court.

What constitutes a parent? Clearly, the answer to that question has evolved over time, and the law has failed to keep up with that social progress. . . .

Lesbian Arrested for Molesting Woman on Airplane

The Port of Portland police arrested Heidi F. McKinney, 26, of Banks, Oregon from Alaska Airlines flight 621 from Las Vegas when it landed at Portland Sunday, for fondling the breasts and genitals of another passenger without consent.  The Multnomah County District Attorney's Office has referred the case to the U.S. Attorney's Office for federal prosecution.

A Banks woman faces a sex crime accusation after police said she inappropriately touched a passenger on a flight from Las Vegas to Portland on Sunday.

McKinney was arrested and booked into a Multnomah County jail on a third-degree sex abuse accusation. She was later released on bail, according to the sheriff's office.

State prosecutors are no longer pursuing a third-degree sexual abuse charge against Heidi McKinney, court records show. The case has been referred to the U.S. Attorney's Office for review, according to the Multnomah County District Attorney's Office.

Lesbian Pedophile Arrested over 2-year-old Girl

Peggy Louise Atkins
Police in Simpsonville, South Carolina have charged Peggy Louise Atkins with third-degree criminal sexual conduct for abusing a toddler while employed as a nurse for a company hired by Medicare and paid by the state Department of Social Services.  The offender was observed by foster parents with the 2-year-old girl in an "inappropriate position" in order to sexually stimulate Atkins.

Lt. Timmie Williams of the Simpsonville Police Department said the nurse was taken into custody Wednesday after a 2-year-old was abused at a home in the Westwood subdivision on April 18.

The warrant alleges Atkins committed a "lewd or lascivious act" upon the body of a 2-year-old girl.

A foster parent filed the complaint, saying the nurse had the child in an "inappropriate position," Williams said.

The [arrest] warrant says Atkins “… willfully and lewdly commit lewd or lascivious act upon or with the body of a 2-year-old female victim (EM), with the intent of arousing, appealing to, or gratifying the list, passions, or sexual desires of the defendant.”

The warrant says probable cause came from witness statements and photographic evidence.

. . . The 2-year-old’s birth mother tells us she believes her daughter’s suffering could have been prevented . . . [and] says her 2-year-old daughter can’t move or speak and needs daily medical care. Last year, she was left paralyzed from her father’s abuse. After her baby went to the hospital, the state never let her bring her home.

Court OKs Firing Lesbian by Mo. Catholic Diocese

A Missouri judge has ruled in favor of the Catholic Diocese of Kansas City–St. Joseph in a summary judgment order regarding the case of lesbian Colleen Simon suing for being fired in May 2014 from the St. Francis Xavier Parish food pantry for espousing her same-sex "marriage," which the Diocese said "contradicts Church laws, discipline, and teaching and the diocesan Policy on Ethics and Integrity in Ministry."
“[Because Ms. Simon's claims are] essentially religious questions, this Court shall instead rely on the Free Exercise Clause of the First Amendment.”

Terms of the settlement with Colleen Simon, a former church food pantry worker, were not disclosed. But the settlement came two days after a Jackson County judge threw out her fraud claim against the church but declined to throw out two other claims alleging violations of Missouri’s service letter statute and Missouri’s minimum wage law.

Jack Smith, a spokesman for the diocese, said the church “just decided to settle” on those other counts.

E.E. Keenan and Sonal Bhatia, the husband-and-wife team who represented Simon, said the parties had resolved the case “to their mutual satisfaction.”

[Judge] Garrett said that inquiring into that claim “would impermissibly entangle the Court in matters and decisions purely canonical, since the Court must necessarily examine the religious views and practices of the Diocese in an attempt to perceive the reasonableness of Plaintiff’s reliance on the Diocese’s representations.”

The court ruled that the First Amendment’s guarantee of the free exercise of religion means the Catholic Diocese of Kansas City–St. Joseph is free to make its employment decisions without court interference. Alliance Defending Freedom [ADF] attorneys representing the diocese filed a motion for summary judgment last year asking for this result.

“A church isn’t obligated to employ those who act contrary to the church’s teachings. The U.S. Supreme Court affirmed this as recently as four years ago,” said ADF Senior Counsel Erik Stanley. “The district court was on very firm constitutional ground to reject this attempt to drag the government into a church’s theological decisions – the very line the First Amendment says the government cannot cross.”

“If churches are forced to employ people who do not follow the religious teachings of those churches, the church will no longer be able to minister consistently or freely in accordance with its faith,” added ADF Legal Counsel Jeremiah Galus.

Colleen Simon alleges in her lawsuit that she had told two priests at St. Francis Xavier Church that she was married to another woman and they had informed her that her sexual orientation would not be a problem.

However, an April [2014] article in The Kansas City Star’s 816 news magazine mentioned her marriage to the Rev. Donna Simon of St. Mark Hope and Peace Lutheran Church. Within a month, Colleen Simon had been fired at [Bishop Robert J.] Finn’s direction, she alleges.

She said the church fraudulently encouraged her to take the food pantry position at St. Francis Xavier in July 2013, knowing the diocese had no intention of keeping its commitments to her.

Colleen Simon alleges in her lawsuit that she mentioned her sexual orientation to the priest at St. Francis Xavier during a job interview in May 2013. The priest purportedly “was nonplussed, and expressed no objection to Ms. Simon’s sexual orientation or her relationship with Donna,” the suit alleges.

The plaintiff and Donna Simon were married in Iowa, as same-sex marriages are illegal in Missouri.

During a face-to-face interview, Simon says, she told the first pastor that she and her wife were "well known in the community, and were known to be an open, out, married couple in the community."

In January 2014, after the pastor who had interviewed her moved away, Simon says she revealed her sexual orientation to the new pastor of St. Francis Xavier, who "looked surprised. He said 'Oh, okay. It's okay.'"

Simon says the pastor of St. Francis Xavier [later] emailed her, expressing concern about the information in the [Kansas City Star] article, and also called the reporter and "asked [her] if she was a Catholic, and when the reporter answered that she was not, the new pastor stated to her that she didn't know what she had done."

"The new pastor stated that now that Ms. Simon's marital status was public, he had no choice but to ask her to submit a letter of resignation," the complaint states.

In late June [2014], the diocesan Human Resources Director Bob Roper informed Simon of her dismissal from her position at St. Francis Xavier.

Provided to CP by Diocese Director of Communications Jack Smith, the letter explained that she was being terminated for being involved in a gay marriage.

"The reason … was based upon an irreconcilable conflict between the laws, discipline, and teaching of the Catholic Church and your relationship — formalized by an act of marriage in Iowa — to a person of the same-sex," wrote Roper to Simon.

A representative of Simon provided The Christian Post with a copy of the lawsuit, filed in Circuit Court of Jackson County, Missouri, at the Independence Courthouse.

. . . [Simon's demands] according to the suit, include "all economic loss, including unpaid wages and fringe benefit; nominal and/or statutory damages for violation of the Missouri Service Letter Law; the costs of this action; and any other and further legal and/or equitable relief that this court deems just and proper."

LA Lesbian Teacher Arrested: Sex with Minor Girl

Kimberly Naquin, a 26-year-old teacher at Destrehan (Louisiana) High School and a daughter of St. Charles Parish School Board President Dennis Naquin, has been charged with carnal knowledge of a juvenile (statutory rape) for a year-long lesbian sexual affair with a student.  The school is notorious for three teacher-student sex arrests over the past two years, including one pair of female teachers engaging in a tryst with a student.

The St. Charles Parish Sheriff’s Office investigation began after a family member of the student provided information about the alleged crime. Detectives interviewed the student, who said that she did have a sexual relationship with a DHS teacher named Kimberly Naquin, according to the Sheriff’s Office.

According to the student, the relationship began in September 2014 and lasted until August 2015.

The student advised most of the inappropriate contact occurred at the teacher’s prior residence, which was located in Kenner; however an undetermined amount of incidents occurred within St. Charles Parish at a Destrehan High School classroom and a Destrehan residence, according to investigators.

Naquin is being held without bond at the Nelson Coleman Corrections facility in Killona. Her Facebook page says her mother, Karen Naquin, is a teacher in the St. Charles Parish public school system.

Her arrest comes three months after Destrehan High teachers Shelly Dufresne and Rachel Respess were accused of having sex with a 16-year-old male student. Dufresne pleaded guilty to a felony obscenity charge in St. Charles for having sex with the student at a home in Montz, where she lives. She received a three-year deferred prison sentence, three years of probation and a $1,000 fine.

For allegedly having sex with the same student at Respess' apartment in Kenner, Dufresene has pleaded not guilty in Jefferson Parish to two counts of carnal knowledge. Respess, originally accused of engagaing in group sex there with Dufresene and the student, was charged by prosecutors with failing to report a felony. She, too,has pleaded not guilty.

Louisiana already had a bad reputation for inappropriate relationships between school staff and students: In 2014, it ranked third in the United States, counting both convictions and arrests. That included Shelley Dufresne and Rachel Respess, who taught English at Destrehan High until their arrests that fall on charges of having group sex with a 16-year-old boy.

Louisiana law generally forbids sex between an adult and a person younger than 17. It strictly prohibits sexual contact between a teacher and a student through the age of 20, and it's very clear how seriously school systems should treat abuse.

But the laws and policies do not necessarily include consequences for the higher-ups. Destrehan High Principal Stephen Weber, for example, kept his job after the 2014 abuse came to light. And the state Education Department did not contact, sanction, reprimand or intervene at the school, spokesman Barry Landry said. He would not release Weber's annual evaluation results, saying they were not public information; the 2014-15 results aren't complete yet anyway.

'Gay Gene' Theory Countered by Federal Gov't Study

Once again, President Obama's health agency couldn't find even 2% of America as homosexual, and the agency's just-released study even raises doubts that sexual orientation is "hard wired."

Women in the United States are about three times as likely as men to say they are bisexual, and increasing numbers of them say they have had sexual contact with other females, new data showed Thursday.

Among women, 5.5 percent said they are bisexual, compared to two percent of men.

Compared to the same survey taken from 2006-2010, researchers found "significantly higher percentages of women in the 2011–2013" reporting that they had had same-sex sexual contact.

The CDC’s sexuality report, as well as their questionnaire, were highly praised by experts nation-wide, and even by the [HRC] Human Rights Campaign [a gay-rights, LGBTQ advocate], as one of the most accurate studies of its sort ever performed.

Experts were impressed by the accuracy and high specificity of the questions presented by the CDC, which differentiated between parameters like sexual behavior, sexual attraction, and sexual orientation, and even allowed responders to answer with a relative attraction level towards both genders in particular.

Subjects were chosen to be aged between 18 and 44, all throughout the entire nation. The researchers had a sample of 9,000 participants, which they then presented with the questionnaire.

The percentage of bisexual men only increased by .8% from the previous study performed a few years ago, but the percentage of bisexual women increased by a whopping 40%.

The finding that women were more likely than men to say they were bisexual is consistent with what previous studies have found, said Casey E. Copen, demographer at the CDC National Center for Health Statistics and lead author of the study, which was published on Thursday.

Women were also more likely than men to report having same-sex sexual contact. Compared with 17.4% of women, only 6.2% of men said they had ever had this activity.

As awareness about bisexuality has grown over the years, it could be getting easier for people to label themselves as bisexual, said Debby Herbenick, associate professor at Indiana University and author of the book "Sex Made Easy," who was not involved in the study.

For decades, experts studying human sexuality have asked people if they're gay, straight, or bisexual.

Two more possible answers have been added in recent years, allowing people to say they're attracted "mostly to the opposite sex" or "mostly to the same sex."

. . . 7.5 percent of women who claimed to be attracted only to men had had "sexual contact" with another woman. Among men who said they were straight, 2.8 percent had had sexual contact with another man.

Illinois Lesbian Jail Officer Shoots Lover, Dies

Erika Aguirre, 28, of Berwyn, Illinois broke into a home and shot Deisy Jaimes, her lesbian lover, several times, critically wounding her as well as her father, Enrique Jaimes, as his wife and other two teenage children all escaped after shots fired by Aguirre missed hitting anyone else.  The incident concluded when Aguirre committed suicide with a single shot to her head.

Bridgeview (Illinois) Police Chief Walter Klimek identified the dead woman as 28-year-old Erika Aguirre. The Cook County Sheriff's Office says Aguirre was an employee for four years, working at the jail's intake division. Klimek says Aguirre and a 27-year-old woman had been in a relationship for four years but had recently broken up.

Klimek says Aguirre broke into the home southwest of Chicago about 11:30 p.m. Sunday and shot the 52-year-old man twice. The former girlfriend was then shot numerous times. Klimek says both are in critical condition at Advocate Christ Medical Center in Oak Lawn.

From "Cook County correctional officer shot two, then killed herself in Bridgeview" by Ashlee Rezin and Simone Alicea, Chicago Sun-Times 11/16/15

Neighbors called police at 11:32 p.m. when they saw a woman, dressed in black and carrying a gun, walking around the house, according to Bridgeview Police Chief Walter Klimek.

Officers responded to the home, looked through a window and saw a person lying in a pool of blood in the kitchen, Klimek said. The 5th District SWAT unit, comprised of members from police departments from the 5th District Circuit Court area, was then called to the scene.

The unit entered the home and found the woman dead in the kitchen, Klimek said.

[Erika Aguirre] broke a basement window while the couple and their three children were inside, police said.

The 17-year-old heard glass break and went to investigate. She "confronted the shooter in the basement, at which point she was able to escape," Klimek said, but not before she was shot at "a couple of times" but not struck.

The 17-year-old was able to alert her mother and brother, and they were able to escape from the house.

A semi-automatic gun was recovered along with three magazines, each of which holds up to 15 rounds, Klimek said. He said about 15 rounds were fired inside the home.

Aguirre then confronted 52-year-old Enrique Jaimes, and shot him twice. She then went to an upstairs bedroom, and shot 22-year-old Deisy Jaimes in the head, shoulders, and legs, police said. Both victims were taken to Advocate Christ Medical Center in Oak Lawn in critical condition.

Neighbor Jeff Polston said he called 911 after a girl who got out of the house unharmed knocked on his door for help. She told him about the intruder, describing her as a cold-blooded killer.

“She just said it was methodical; very slow, and not nervous,” Polston said.

Investigators determined Aguirre and Deisy James had been in a recent relationship, until they broke up.

But the community is facing backlash, too, from feminists like Germaine Greer's not-"real women" commentary to Houston voters, who struck down a 2014 LGBT anti-discrimination law . . . And now a small number of gay people want to end common cause with them, too, putting up a Change.org petition demanding that several important LGBT (lesbian, gay, bisexual, and transgender) rights organizations remove the T from their missions.

Why undo such a long-standing coalition? "We feel their ideology is not only completely different from that promoted by the LGB community (LGB is about sexual orientation, trans is about gender identity)," reads the anonymous petition, "but is ultimately regressive and actually hostile to the goals of women and gay men."

The 65-year-old former Olympian stopped to address one protester, who over the loudspeaker could be heard saying, "You are an insult to trans people, you are an insult to women."

Caitlyn spoke to a group of 1,000 people at the 7th annual Speaker Series luncheon for the Chicago House, which provides social services for those impacted by HIV/AIDS and other LGBT issues.

We have made great progress over the past decade decoupling gender identity from genitalia. On the one hand, it's easy, because gender identity is a brain function and genitalia are just genitals. On the other hand, trying to teach a society that has been raised for generations (millennia, actually) to believe that sex is nothing more than genitals, is extremely difficult. Because we have been successful, we have put ourselves in the unenviable but unavoidable position of dealing with bathroom panic attacks that stem from fears of male genitals.

Not that long ago trans women were assumed to have undergone genital reconstruction. No more penis, therefore, no threat that the male weapon would be used for predation, a fear that underlies transphobia. Not that there weren't many trans women who could not afford bottom surgery, or for whom it was medically contraindicated, or who just didn't care, but the cisgender [normal] population viewed trans women as postoperative trans women. As the decoupling began, initially targeted to include trans men rather than non-operative trans women, it became obvious to more non-trans persons, as an unintended consequence, that some trans women still had their penises, and that propelled the bathroom panic forward.

Politically speaking and being hard-nosed and practical, I will say that trans persons have no right to demand that language be changed to include them while alienating the vast majority in the process. . . .

To me, the LGB movement, with its celebration of all types of gay men and women, such as bears, leather daddies, drag queens, diesel dykes, lipstick lesbians, etc., has always been about expanding and re-defining concepts of gender; the trans movement, on the other hand, appears to be about re-asserting and codifying traditional concepts of gender.

Over the past few years, as we’ve seen such rapid, astonishing progress towards LGBT equality . . . Lately I’ve been struggling to understand why gay men feel so entitled to tell others how to behave, when so many people are of the opinion that we are societal deviants, no matter how well-behaved we are. Why are so many of us adopting the very same kind of oppressive language that has been wielded against us by antigay extremists?

It’s surprising how many gay men consider themselves arbiters of social norms and mores, as same-sex marriage has only held majority support in this country for a few years now. And that majority is still very slim . . . It is a particularly galling feat of hypocrisy for gay men, who have been on the outskirts of acceptable society for such a long time, to turn around and assert their role as gatekeepers so soon after achieving “respectability.”

There’s an audible “I got mine” mentality in [the “Drop the T” movement] that repulses me. Yes, I’ve seen exclusionary language from trans activists as well, and comments that seem homophobic or misogynistic, but it’s all symptomatic of the same problem.

Why should your opinion of what is the “correct” way to express gender, gender identity, sexuality, or religion become a mandate for others? . . .

Yes, the pendulum sometimes swings too far in the other direction; liberals can be bigots too. . . . I believe we can be sensitive and understanding of the experience of others without pushing political correctness so far that it becomes tyrannical and obscene. There is an obvious middle road we can take here.

. . . we need to be careful not to turn our passion and vehemence against one another; together we will all rise up, but divided we will all fall right back down to where we started.

Lesbian Mayor's Gay Agenda Defeated by Voters

Citizens of Houston, Texas, the fourth-largest city in the U.S., turned out in record numbers to defeat Prop 1, the Houston Equal Rights Ordinance No. 2014-530 (HERO), by a margin of 62% to 38%.  The city's lesbian mayor Annise D. Parker, along with city bureaucrats, had pulled several legal tricks in attempts to negate the citizens' uprising against the Gay Agenda ordinance previously enacted by decree.

Opponents of the issue branded it "the bathroom ordinance," playing up the argument that it would allow sexual predators dressed as women to use women's restrooms. A television ad featured a little girl being cornered by a man in a restroom.

Supporters sold it as an anti-discrimination measure protecting a broad range of citizens from the elderly to veterans. The ordinance would have offered increased protections for gay and transgender people, as well as protections against discrimination based on sex, race, age, religion and other categories.

"The supporters of this proposition brought in movie stars and elites from Washington D.C. and Hollywood to try to force their twisted agenda on the good people of Texas," said Lt. Gov. Dan Patrick. "It didn't work and advocates of this ridiculous proposal are on notice tonight that the voters of Houston will not stand for this kind of liberal nonsense."

It was favored by the White House, Democratic presidential front-runner Hillary Clinton and tech giant Apple, but faced opposition from many religious leaders and Republicans.

Texas Gov. Greg Abbott, a Republican, tweeted earlier this week against the ordinance: "HOUSTON: Vote Texas values, not @HillaryClinton values. Vote NO on City of Houston Proposition 1. No men in women's bathrooms."

The ordinance was originally passed by Houston City Council in 2014, but the Texas Supreme Court earlier this year forced it onto the ballot [following a citizen petition drive].

City Council passed the law 11-6 in May last year, but conservative foes launched an effort to force a repeal referendum that spanned more than one year of legal challenges. In July, the Texas Supreme Court ordered the city to either repeal the law or place in the ballot. By a 12-5 vote, City Council opted for the latter, officially unleashing two dueling campaigns.

Businesses that serve the public, private employers, housing and city contracting are all subject to the law and face up to $5,000 in fines for violations. Religious institutions, however, are exempt. The ordinance was in effect for only three months between extensive legal challenges.

Conservative leaders who campaigned and spoke out against the ordinance included a coalition of pastors, Republican Gov. Greg Abbott, Lt. Gov. Dan Patrick, former Houston Astro Lance Berkman and Houston Texans football owner Bob McNair.

Jonathan Saenz, president of Texas Values Action, a conservative group that opposed the ordinance, called the vote “a significant victory for common sense, safety, and religious freedom, not just in Houston, but for all of Texas.... This vote will impact the nation and shows, once again, that the people still support common-sense Texas values."

With the Houston vote garnering national attention, the loss for HERO supporters comes after a tumultuous year and half since the ordinance was first passed by the Houston City Council in May 2014.

Almost immediately, conservative activists and pastors began collecting signatures to petition a referendum or repeal of the ordinance. City officials later ruled that they hadn’t collected enough signatures, prompting a lawsuit from the opponents.

The ordinance had been in effect for about three months when it was put on hold as the legal challenge made its way through the courts. In April, a state district judge ruled in favor of the city, saying opponents of the ordinance had not gathered enough valid signatures.

The case went to the Texas Supreme Court, which in July told the city council it had to consider a valid referendum petition and repeal the ordinance or put it up for public vote.

In Houston, the ordinance’s proponents — including Mayor Annise D. Parker, local and national gay rights and civil rights groups and the actress Sally Field — accused opponents of using fearmongering against gay people, and far-fetched talk of bathroom attacks, to generate support for a repeal. The ordinance, they noted, says nothing specifically about whether men can use women’s restrooms.

The proponents’ defeat at the polls was a kind of personal blow to Ms. Parker, a Democrat. Houston became the largest city in the United States to elect an openly gay mayor when she won office in December 2009. Now in her third and final term, Ms. Parker had pushed hard for the ordinance and helped it gain endorsements from President Obama and corporate giants like Apple.

Opponents of the measure — including Mr. Patrick, pastors of conservative megachurches and the former Houston Astros baseball star Lance Berkman — said the ordinance had nothing to do with discrimination and was about the mayor’s gay agenda being forced on the city. They denied that they had any bias against gay people, and said the ordinance was so vague that it would make anyone who tried to keep any man from entering a women’s bathroom the subject of a city investigation and fine.

"While much of the debate focused on biological males using a woman's bathroom, many voters told us they understood this involved a lot more than bathrooms," Family Research Council President Tony Perkins said after the votes were counted.

"The mayor's efforts to disenfranchise voters and subpoena pastors' sermons and private communications demonstrated this law was ultimately about silencing and even stripping away the livelihood of those who refused to yield their beliefs to this new morality."

"Houstonians' religious freedom, freedom of speech, and the right to petition their government have won the day, but much more work remains to be done to safeguard these freedoms across the nation. No person should be punished by the government because of their beliefs," Perkins said.

The ordinance would have applied to businesses that serve the public, such as restaurants and hotels, private employers, housing, city employment and city contracting. It would have allowed residents to file a complaint if they felt they had been discriminated against based on the various protected categories. Religious institutions would have been exempt. Violators would have faced fines up to $5,000.

Illinois Lesbian Arrested: Sexually Abused Girls

Acclaimed gymnastics coach, Patricia Hermann, operating at facilities in the Chicago suburbs of Hanover Park, Hoffman Estates, Mount Prospect and Roselle, was arrested at her home in Schaumburg by police on felony charges of sexually molesting two minor girls at a hotel in Georgia while they were at a competition event trip months ago.

Patricia Hermann, 48, has been charged with sexual battery of a minor and aggravated sexual battery of a minor, according to Cobb County (Ga.) Police Sgt. Dana Pierce. The alleged abuse of two disabled girls happened on a trip to Georgia between late April and early May, authorities said.

Hermann is being held without bond at the Cook County Jail, according to Cook County sheriff’s spokeswoman Sophia Ansari. Her extradition status was not immediately known Tuesday morning.

Hermann is founder and CEO of Elite Stars, an athletic program for individuals with special needs based in northwest suburban Schaumburg, according to her biography on the Elite Stars website.

Cobb County Sheriff's Sgt. Dana Pierce said the offenses occurred between April 30 and May 3, when Hermann and members of the Elite Stars gymnastics team were staying at a Kennesaw, Georgia, hotel while taking part in a competition.

"When they returned home, the two female athletes separately told their parents that the head coach of Elite Stars, Patricia Hermann, physically and sexually abused them in a hotel room during the trip," Pierce said Monday.

A warrant issued Oct. 22 states that during interviews at the DuPage County [Illinois] Child Advocacy Center, the girls -- ages 13 and 10 -- described Hermann making physical contact with intimate parts of their bodies. Each claim was corroborated by another minor who was staying in the same room, according to the warrant.

Hermann was booked into the Cook County [Illinois] Jail on Monday after being arrested by Schaumburg police, said Sophia Ansari, a spokeswoman for the Cook County Sheriff's Office. She was being held without bond pending extradition to Georgia, Ansari said.

The alleged sexual abuse happened between late April and early May at a hotel in Kennesaw, which is outside Atlanta, Pierce said. Participants in the Elite Stars program had been in Georgia for a gymnastics competition, the sergeant said.

After they returned home, two girls in their early teens with cognitive disabilities told their parents separately that Hermann had abused them, Pierce said. Law enforcement agencies in Illinois helped with the investigation, Pierce said.

On Monday night, ABC7 spoke to the mother of one of the two alleged victims. The victim's mother was too upset to speak on camera. Her daughter, she says, went on a gymnastics trip to Georgia and came back extremely upset.

It's surprising news in her quiet Schaumburg neighborhood, where residents say several special needs families live.

"Yes, it's a surprise to everyone in the neighborhood, I think it's hard to believe," said Scott McIlvain, a neighbor.

Hermann was booked by Cook County authorities. She will likely be extradited to Georgia.

Lesbians Sue Christian School for Biblical Beliefs

A lesbian "married couple" plan to file a civil rights lawsuit against a Christian school in San Diego, California for not enrolling their 5-year-old daughter based on the following from the school's handbook:
“Mt. Erie Christian Academy [MECA] is a religious, Bible-believing institution providing education in a distinct Christian environment, and it believes that its biblical role is to work in conjunction with the home to mold students to be Christ like. On those occasions in which the atmosphere or conduct within a particular home is counter to or in opposition to the biblical lifestyle that the school teaches, the school reserves the right, within its sole discretion, to refuse admission of an applicant or to discontinue enrollment of a student. This includes, but is not necessarily limited to, living in, condoning or supporting sexual immorality; practicing homosexual lifestyle or alternative gender identity; promoting such practices; or otherwise having the inability to support the moral principles of the school (Leviticus 20:13a; Romans 1:21-27; Matthew 19:4-6; I Corinthians 6:9-20).”

Sheena, a stay-at-home mom who asked 10News.com not to use her last name, said the parents were summoned to the school the Friday before Labor Day. Her wife, Lashaune, is in the navy and is now away on deployment.

While school administrators have not commented about the case to the media, ABC 10 cited a woman identified as "Kailyn" who described herself as the director of Mt. Erie, who told them that although the school has a non-discrimination policy in place, that the "Bible says homosexuality is a sin," and that "we don't condone any sinful lifestyles."

"The least Christian thing I could think of is turning away a child," Rev. MacArthur Flournoy of the Religion and Faith Program at the Human Rights Campaign said in a statement on HRC's website. "The message this school is sending to this child is that God is not there for her nor for her parents. There's absolutely nothing Godly in their actions."

Added Johanna Eager, Director of HRC Foundation’s Welcoming Schools program: “There is no doubt substantial harm is done to schools, children, teachers and families when a school tells a student that something is wrong with them or their family.”

San Diego attorney Eugene Iredale said . . . both California and federal cases have upheld the right of private institutions to bar membership based on religious beliefs.  That is exactly the opposite of discrimination laws that pertain to publicly-funded programs and businesses that cater to the general public.

Iredale said he believes that in the next five to 10 years, the U.S. Supreme Court will have to decide a case like the one involving Mt. Erie because of changing public policy regarding homosexuality.

Sheena said she's ready to fight for it.

Team 10 reached out to the National Center for Lesbian Rights.

"This type of policy is out of touch with reality," said Cathy Sakimura, deputy director and family law director for the NCLR.

Sakimura said barring Sheena's daughter from school could create a culture of fear among children at the school, allowing children to think it’s not OK to be LGBT or divorced. She hopes the Mt. In the months since the Supreme Court decided same-sex marriage should be legal throughout the United States, faith-based high schools have entered a new frontier. While some Christian schools are fighting to teach biblical views on sexuality, others have changed to fit in.

Solicitor General Donald Verrilli made comments before the Supreme Court foreshadowing legal problems for faith-based schools. When asked by Justice Samuel Alito if a faith-based school could lose its tax-exempt status over its views on same-sex marriage, Verrilli replied, "It's certainly going to be an issue. I don't deny that."

Joe Carter, editor for The Gospel Coalition, wrote last spring that the Supreme Court's decision on same-sex marriage could force some schools to either adjust views on sexuality or give-up non-profit status, making them for-profit schools. That could mean faith-based schools won't be in existence much longer.

Iredale: "If you have a religion that believed in human sacrifice or amputation of the arm or the hand for theft, would we permit that in the interest of permitting the free practice of one's religion? I don't think so, and one could argue that psychologically... this is as devastating to the little 5-year-old girl as some of those other vicious practices."

So, this news organization reaches out to an attorney who likens Christian practices to human sacrifice and amputation. Wow. Oh, and their other source? It's the deputy director and family law director for the National Center for Lesbian Rights, who said, "This type of policy is out of touch with reality."

Virgin Births: IVF Eliminating Fatherhood

Fertility clinics are now furthering the notion of the “synthetic family” by making fathers obsolete in procreation even among non-lesbian women who prefer to give birth prior to sexual intercourse with "Mr. Right."

About 25 young women in the UK who are hetereosexual and in their twenties have opted for IVF in the past five years because they feel ready to be a parent, doctors told the Mail on Sunday.

Whilst some religious groups have said a child should be brought up in a traditional family, one doctor said these single mothers are often more emotionally and financially stable than others who have been left to bring up a child after a relationship breakdown.

The news follows up a survey in 2013 which showed that one in every 200 women in the US reported to have become pregnant without having had sexual intercourse.

Out of these women, 31% said they had signed a chastity pledge whereby they vow, usually for religious reasons, not to have sex. About 28% of those girls' parents said they rarely talked to them about sex or contraception - compared to only 5% of other women who became pregnant and had had intercourse.

Fertility treatments have opened up the ways by which women and men can become parents and four British IVF firms have said they had assisted a heterosexual virgin to have a baby: Care Fertility, The London Women’s Clinic, Create Fertility, and the Assisted Reproduction and Gynaecology Centre.

The decision to provide fertility treatment in such cases was criticised by some religious groups, who claimed it undermined the importance of bringing up children in stable marriages, as well as from Josephine Quintavalle, from the group Comment on Reproductive Ethics, who said to the Mail:

"The message from nature is for a male and female to have a child, and I am saddened that we are willing to distort this.

"The diminished role of the father is not desirable for the child. Once you start down this route, where do you stop?"

Fertiilty doctors said single women who had never had sexual intercourse were seeking donor-assisted treatment – at a cost of around £5,000 – because they wanted to have a child now and save sex for a “special relationship”.

Maha Ragunath, medical director of its clinic in Nottingham, said: “The number of single women I see has doubled over the last decade and single women now account for at least ten per cent of my patients.

“A lot of them are very young, in their 20s, sometimes studying or doing very ordinary jobs and often living with their parents, rather than career women who have been driven and focused too much on their work”

“They are extremely happy to go ahead on their own and don’t care about the implications that might bring for the child or how they would go into a new relationship.”

Supporters of the traditional family system, however, have blasted the "distorted" move, stating that it was turning young children into "teddy bears" that are to be "picked off the shelf."

Some religious groups have also claimed that the move undermines the value of having children brought up in a stable marriage, while one leading psychotherapist has warned that a mother who has never been in a relationship could potential harm the development of the child.

Imam Suhaib Hasan, head of the Islamic Sharia Council in the UK, accused doctors engaged in providing IVF treatment to patients of acting like God.

Hasan said that when the man is removed from the aspect of a family, the woman becomes merely a breeding machine. He added that it effectively denies the right of the child to have a father.

Professor Robert Winston said "test-tube babies could suffer terrible health problems because the clinics were using IVF techniques which had not been properly tested."

He added, that the risk could include birth defects, genetic damage which may not emerge until adulthood and an increased chance of cancer. The medical profession was ignoring the evidence of problems that could take place.

Aside from that, he stressed the long-term attack of IVF, and follows a growing body of evidence that test tube babies are less healthy than the naturally conceived children.

Conversely, another study had been generated by Lord Winston at over three million normal conceptions and 40,000 IVF babies that found that IVF babies were two and half times more likely to have a low birth weight and prematurity compared to those babies with normal reproduction. Since it is not 100% guaranteed, it can lead to unsuccessful birth cycle.

Winston even stated, that small babies are more likely to grow up to develop vascular disease, diabetes, hypertension and osteoporosis.
