Supreme Court Legalizes Sex With Animals in Canada

In a 7-to-1 ruling this week, the Canadian Supreme Court acquitted "D.L.W.," a British Columbia man convicted of 13 counts of rape and incest, of bestiality because he didn't insert his penis into the family dog but rather only engaged in other sex acts with the animal, and failed in his attempts to insert the dog's penis into his stepdaughters.

"Although bestiality was often subsumed in terms such as sodomy or buggery, penetration was the essence - 'the defining act' - of the offence."

DLW's attorneys argued that bestiality linked to "buggery" - or sodomy - with animals beginning with an 1892 criminal code. Bestiality was first used in a 1955 code, but still was not defined to encompass every sex act with animals.

According to court record DLW smeared peanut butter on the genitals of his victims and had the family dog lick it off while he videotaped the act.

Court documents disclose that DLW attempted to have the dog perform intercourse on the stepdaughter, but that ultimately failed.

DLW is serving a 16 year prison sentence. He brought the bestitality conviction to the court on appeal.

Canada’s legal definition of bestiality is rather amorphous. Before 1859, Canada prosecuted depraved sex offenses under the English Buggery Act, a broad prohibition on sodomy. Thereafter, an anti-buggery law was incorporated into the Consolidated Statutes of Canada as a capital crime. The Criminal Law Amendment Act of 1969, championed by Pierre Trudeau, later prime minister and father to current Prime Minister Justin Trudeau, repealed the laws.

“Applying the principles that guide statutory interpretation leads to the conclusion in this case that the term bestiality has a well-established legal meaning and refers to sexual intercourse between a human and an animal. Penetration has always been understood to be an essential element of bestiality,” the [Supreme Court] opinion read.

Justice Thomas Cromwell, writing for the majority, pored over the history of the law — and its evolution from Church of England prohibitions in the 16th century to early laws enacted in colonial Canada — and ruled that lawmakers have always intended to single out only a certain subset of animal abusers.

The Criminal Code does not expressly say that a penetrative act is necessary to be considered an offence. But Cromwell said that's what generations of lawmakers intended and subsequent legislative changes have added little clarity.

The only justice in the minority, Rosalie Abella, rejected the majority's decision. "Acts with animals that have a sexual purpose are inherently exploitative whether or not penetration occurs, and the prevention of sexual exploitation is what the 1988 amendments were all about," she wrote in her dissenting opinion.

The Canadian legislature process recently made international news after the Liberal Party, led by Prime Minister Justin Trudeau, introduced a new bill seeking to establish two year prison terms for people found guilty of transgender discrimination.

"There remains much to be done, though. Far too many people still face harassment, discrimination, and violence for being who they are. This is unacceptable," Trudeau said at the time, noting that the bill would expand existing "hate speech" prohibitions to include any public speech or communication that "promotes hatred" on the basis of "gender identity" or "gender expression," which is aimed at defending transgender people.

Both babies and pets are considered vulnerable and require nurturing, something role-players with troubled pasts may find soothing.

Puppy play is just one form of a larger phenomenon known as “pet play,” which is commonly associated with sexual acts like bondage, dominance and submission, and sadomasochism. However, pet play and BDSM are not mutually exclusive. . . .

While some parents were outraged over the play, other parents and students defended the drama teacher at a school board meeting last week.

Cave Creek Unified School District Superintendent Dr. Debbi Burdick released a statement that reads, in part: "The District does not in any way condone the use of the controversial play in its curriculum. The teacher did not obtain the permission of any parent or of the administration prior to introducing its mature concepts into the classroom and the item has been removed from use."

Last Tuesday, several dozen people attended the governing-board meeting, using the public-comment time to address the board members about the incident.

Many students, including several from the advanced-acting class, defended Cupo’s choice of the play.

Some of their parents expressed anger that the other parents had questioned their children.

On Nov. 15, the Senate Armed Services Committee unanimously approved S. 1867, the National Defense Authorization Act, which includes a provision to repeal Article 125 of the Uniform Code of Military Justice (UCMJ).

Article 125 of the UCMJ makes it illegal to engage in both sodomy with humans and sex with animals.

It states: "(a) Any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration, however slight, is sufficient to complete the offense. (b) Any person found guilty of sodomy shall be punished as a court-martial may direct.”

“It’s all about using the military to advance this administration’s radical social agenda,” [Family Research Council President Tony] Perkins told CNSNews.com. “Not only did they overturn Don’t Ask Don’t Tell, but they had another problem, and that is, under military law sodomy is illegal, just as adultery is illegal, so they had to remove that prohibition against sodomy.”

Bestiality Causes Cancer of Penis: Study

In a study of 492 men from rural Brazil, 35 percent reported having had sex with an animal at some point in their lives. The report found those men were twice as likely to develop cancer of the penis.

The paper was authored by a team of urologists from centers around Brazil and studied men from age 18 to 80. Men who had had sex with animals also reported a higher incidence of sexually transmitted diseases. Of the 118 penile cancer patients, 45 percent reported having had sex with animals, compared to 32 percent of healthy men. Fifty-nine percent of men who had sex with animals did so for one to five years, while 21 percent continued the behavior, also known as zoophilia, for more than five years.

Men reported having sex as frequently as daily with such animals as mares, cows, pigs and and chickens. Penile cancer accounts for up to 10 percent of cancers in men in Asia, Africa and South America, although it is rare in the U.S.

Michigan is one of 30 states that have enacted laws that prohibit sexual contact between humans and animals.

"We think that the intense and long-term SWA [sex with animals] practice could produce micro-traumas in the human penile tissue," Stenio de Cassio Zequi, a urologist in Sao Paolo, told LiveScience. "The genital mucous membranes of animals could have different characteristics from human genitalia, and the animals' secretions are probably different from human fluids. Perhaps animal tissues are less soft than ours, and non-human secretions would be toxic for us."

But that's not the only possible explanation. The study also fingered smoking, having sex with prostitutes, precancerous conditions of the penis, being nonwhite, and phimosis (a condition in which the foreskin cannot be fully retracted) as risk factors for penile cancer.

Sex with animals could be as ancient as sex itself. "Since time immemorial, this habit has been described in folk music, theater, jokes and oral traditions," Zequi told LiveScience. "In some antique civilizations there were temples or rituals designated for SWA practices." Yet SWA is underrepresented in scientific literature, and the new study is the first to link the practice to male genital cancers.

Tobias Köhler, a urologist at Southern Illinois University School of Medicine who was not involved in the research, said the study was rigorous. "It adds to our knowledge of cancer prevention and gives us epidemiological data we never really had before on sex with animals.”

He postulated that the lifestyle of men who have sex with animals could also be a factor. "The study reported that these men also have more sex with prostitutes," Köhler said.

Federal Health Official Arrested for Bestiality

44-year-old Kimberly Quinlan Lindsey, Deputy Director in the Office of Surveillance, Epidemiology and Laboratory Services of the Centers for Disease Control and Prevention, and previously the Deputy Branch Chief in the CDC Division of HIV/AIDS Prevention, was arrested under charges for bestiality with two animals and sex acts involving a 6-year-old boy.

Kimberly Lindsey, 44, and her boyfriend, 42-year-old Thomas Westerman, turned themselves into police Sunday night, DeKalb County police said in a statement. Both were charged with two counts of child molestation. Lindsey was also charged with one count of bestiality, police said.

Westerman was released on Monday on a $15,000 bond, but Lindsey remained in jail on Tuesday on a $20,000 bond, police said. They will have a court hearing on December 1.

CDC spokesman Tom Skinner declined to comment on the case other than to confirm that Lindsey and Westerman work at the CDC.

Prior to her current role, Lindsey was the senior health scientist in the Office of Public Health Preparedness and Response. That office oversees the allocation process for $1.5 billion in terrorism preparedness.

In her 12 years at the CDC, Lindsey has received 12 awards for outstanding performance on projects and programs, according to her bio on Emory University's Biological and Biomedical Sciences website. Lindsey earned her doctorate in immunology and molecular pathogenesis from the university in 1998, a year before she began work at the CDC.

"The bestiality charge is a result of evidence recovered during the investigation," DeKalb County police Lt. Pamela Kunz told The Huffington Post.

Investigators allegedly found photographs of Lindsey performing lewd acts on two pets. The offenses did not involve the child, police said. Kunz declined to elaborate. "The investigation is still active and we are not releasing further details [on that charge]," she said.

The alleged sex acts involving the child took place between January 2010 and August 2011. The child would allegedly spank [the naked] Lindsey and use an electric sex toy on her.

What makes the allegations especially outstanding is that the accused doctor is a woman well-known in her field and highly regarded.

Since joining the CDC in 1999, Lindsey has received a dozen awards for outstanding performance.

Sheriff Arpaio said an undercover investigation by his office began after detectives became aware that persons in the Phoenix area were using Craigslist to engage in illegal acts with animals. Detectives set up meetings through computer communications where the suspects believed they were meeting animal owners at a hotel.

Although bestiality may not be illegal in other states, the sheriff was instrumental in making the offense a crime in Arizona in 2006.

Sheriff Joe Arpaio of the southern Arizona county is no stranger to controversy. He has been at the center of federal investigations into his alleged abuse of power and use of racial-profiling to earn himself the self-described title of America’s toughest sheriff.

But Wednesday Arpaio turned the investigation onto the San Francisco-based Craigslist and gave a harsh warning to CEO Jim Buckmaster.

Arpaio said his office . . . found that this case was not isolated. That other people looking to engage in bestiality used Craigslist and a secret language even existed amongst these people.

Craigslist is of course no stranger to controversy. The site came under fire for its adult services section, which it was forced to censor after pressure from numerous states to discontinue the service.

Obama Administration Advances Gay Agenda at U.N.

Homosexualists worldwide celebrated after the United Nations General Assembly voted in favor of an amendment submitted by the U.S., and advocated by Hillary Clinton, to include sexual orientation in a resolution condemning unjustified slayings.

The 192-nation U.N. General Assembly voted to restore a reference to killings due to sexual orientation that had been deleted from a resolution condemning unjustified slayings. The shift came after the United States submitted an amendment to restore the reference, which the General Assembly’s human rights committee removed last month from a resolution on extrajudicial, summary and arbitrary executions that is adopted every two years.

The U.S. amendment that restored the reference to sexual orientation was adopted with 93 votes in favor, 55 against and 27 abstentions. The amended resolution was then approved with 122 yes votes, one against and 62 abstentions. (Saudi Arabia cast the sole vote against the resolution, and the United States was among those who abstained.)

Not everyone was happy. Zimbabwe’s U.N. Ambassador Chitsaka Chipaziwa told the General Assembly that there was no need to refer explicitly to sexual orientation: “We will not have it foisted on us. We cannot accept this, especially if it entails accepting such practices as bestiality, pedophilia and those other practices many societies would find abhorrent in their value systems.” A European diplomat later told Reuters that Chipaziwa’s statement was “disgraceful.”

President Obama said the vote "marks an important moment in the struggle for civil and human rights."

U.S. Secretary of State Hillary Rodham Clinton said the U.S. reintroduced the language to send an unequivocal message that "No one should be killed for who they are."

"Sadly, many people around the world continue to be targeted and killed because of their sexual orientation," she said. "These heinous crimes must be condemned and investigated wherever they occur."

A culture war has broken out at the United Nations over whether gays should be singled out for the same protections as other minorities whose lives are threatened.

Benin, a largely Christian country of 8 million with a sizable Muslim population, argued that "sexual orientation had no legal foundation in any international human rights instruments." Morocco, an Arab country in north Africa that is almost exclusively Muslim, asserted that such selectivity "accommodated particular interests and groups over others" and urged all U.N. member states "to devote special attention to the protection of the family as the natural and fundamental unit of society."

More than two-thirds of U.N. members, many of them Muslim nations, are refusing to sign a separate United Nations statement condemning human rights violations based on sexual orientation and gender identity, especially with regard to the application of the death penalty and extrajudicial, summary or arbitrary executions.

Under the Bush administration in 2008, even the United States refused to join all other Western nations in signing that declaration, arguing that the broad framing of the language in the statement might conflict with U.S. laws.

With support from the European Union, the Nordic countries and Canada, the US launched a massive campaign to re-insert “sexual orientation” into a UN resolution before final approval in the General Assembly. Reportedly, the US was working “at the highest levels” to push countries to support its amendment.

One delegation blasted the US-led attempt to reintroduce “sexual orientation” into the text as “international legal adventurism.”

President Obama applauded supporters of the US amendment. In a statement, Obama said, “While today’s adoption of an inclusive resolution is important, so too are the conversations that have now begun in capitals around the world about inclusion, equality, and discrimination.”

The high-level political pressure exerted in this resolution caps an aggressive year-long campaign by the Obama administration to push “sexual orientation” issues at the UN and domestically.

Canada's ban on polygamy is about to be tested as never before in a British Columbia trial, lawyers and advocates on both sides say.

The "constitutional reference" proceeding opens in the province's Supreme Court Monday and is expected to last through January at least, The Vancouver Sun reported.

If Chief Justice Robert Bauman rules for legalization, Canada would become the first country in the developed world to allow multiple marriage and a likely magnet for U.S. fundamentalist Mormons, along with Muslims, Wiccans and secular polyamorists.

The decision, whichever way it goes, is likely go on the provincial Court of Appeal and eventually the Supreme Court of Canada. And Parliament could still have the last word.

The governments of B.C. and Canada, who want to uphold the law, are expected to argue that while some women in multiple marriages may be happy, there are social harms associated with the practice.

Polygamous wives are said to suffer increased family stress, depression, jealousy, lower self-esteem and feelings of disempowerment. Children have lower levels of socioeconomic status and reduced academic achievement, say the anti-polygamy forces.

Ron Skolrood, a constitutional lawyer in Vancouver, said it was "very difficult" to predict the outcome given the volume of evidence and argument expected to unfold during the trial.

But he said the case really boils down to a few consistent themes.

"Does the law address real social evils today? Or is it, as the challengers would say, an antiquated law that really has no relevance today?"

There will also be academics testifying to their research on polygamous communities both in B.C. and around the world. And there will legal experts parsing Section 293 as well as relevant sections of the Charter of Rights and Freedoms.

Even if the polygamy section limits any of those freedoms, the judge could decide that the breach of those rights is justifiable if the practice is harmful. Or as the B.C. attorney-general’s lawyer describes it, "The main task facing this court will be assessing and weighing evidence respecting harm: the harm of polygamy versus the harm of prohibition."

According to the organization “Professionals for Ethics,” third grade students in Cordoba, located in the southern Spanish region of Andalusia, are using course material stating that “nature has given us sex so we can use it with another girl, with a boy or with an animal.” Parents groups say the material indoctrinates children and camouflages an agenda that is pro-homosexual and critical of moral norms and values.

Those words appeared in a pamphlet distributed to high school students in the region of Catalonia, according to Spanish news site Forum Libertas (Liberty Forum).

"Enjoying sex is a natural and recommendable thing," the pamphlet also states. "Learn the best ways to enjoy it with security and tranquility."

The pamphlet also endorses homosexual relationships, Forum Libertas reports. No mention is made of abstinence, nor the consequences of sexual intercourse.

Iowa Rep. Exposes Congressional Socialist Gay Agenda

Same sex marriage is part of a socialist agenda to undermine "the foundations of individual rights and liberties," Rep. Steve King (R-Iowa) said Wednesday.

The conservative Iowan condemned his own state's Supreme Court for legalizing gay and lesbian weddings, and expressed concern that the U.S. Congress might repeal the Defense of Marriage Act (DOMA), which gives states the ability to refuse to recognize same sex marriages or civil unions in other states.

King told a conservative news radio program:

"If there's a push for a socialist society where the foundations of individual rights and liberties are undermined and everybody is thrown together living collectively off one pot of resources earned by everyone, this is one of the goals they have to go to, same sex marriage, because it has to plow through marriage in order to get to their goal. They want public affirmation, they want access to public funds and resources."

King also said that former Sen. Rick Santorum (R-Pa.) was right to say that legal same sex marriages would open the door to legal polygamy or bestiality.

Cody Beck . . . an 18-year-old from Arizona who graduated from high school this past year . . . believes he and other members of this minority sexual orientation, who often call themselves "zoos," can follow the same path as the gay rights movement. Most researchers believe 2 to 8 percent of the population harbors forbidden desires toward animals, and Beck hopes this minority group can begin appealing to the open-minded for acceptance.

But if those like Beck are to make the same gains as gays, it's apparent they will have to do so without the help of gay rights groups, which so far want nothing to do with a zoophile movement. What's more, they will have to wage battle with well-funded and politically connected animal-protection activists.

As cave drawings will attest, there's a carnal desire in some humans to lie with beasts. And though many civilizations have tried, none has been able to eradicate it, much to the frustration of organizations such as the Humane Society.

Cody Beck, the Arizona zoophile who came out to his friends, was 12 then and had only just come to realize he was a zoophile. In the years since, he's been thrilled by how activists' efforts have broadened minds about what qualifies as moral, socially acceptable sex. He recognizes the exciting implications it might have for zoophiles like him. But he's crushed by the gay rights movement's rejection of zoophilia as a similarly legitimate orientation.

Beck believes these are expressions of fear that are natural in the early moments of revolution. "That's the story throughout history," he says. "People don't want to stand up for anything, because they don't want to get hurt." He draws some of his own strength from the recent movie Milk, in which Sean Penn plays the nation's first openly gay elected official, San Francisco City Supervisor Harvey Milk. "If we all stand up at once, we'll share the load. What's the point of living if we have to hide who we are?"

. . . zoophiles might yet prove the new frontier in the battle for sexual civil rights.

Florida Considers Law Against Bestiality

“There’s a tremendous correlation between sexually deviant behavior and crimes against children and crimes against animals,” said [Senator Nan] Rich, a Sunrise Democrat. “This is long overdue. These are heinous crimes. And people belong in jail.”

The act of bestiality is a step closer to becoming illegal in Florida now that a Senate committee voted to slap a third-degree felony charge on anyone who has sex with animals.

Florida is one of only 16 states that still permit bestiality – a fact that animal-rights activist and Sunrise Sen. Nan Rich learned to her horror when a Panhandle man three years ago was suspected of accidentally asphyxiating a family goat with which he was copulating.

But the Mossy Head man suspected of assaulting Meg the Goat was never charged, because law enforcement officials could never link him to the crime scene. The suspect was arrested in a separate goat-abducting months later, said Walton County Assistant State Attorney Walter Parker.

After the unanimous committee vote, Sen. Rich predicted the bill would pass easily this year. She said bestiality used to be illegal in Florida, but the statute was ruled unconstitutional because it was considered too broad.
