Indiana Outlaws Killing Disabled, Abortionists Sue

Yesterday, Gov. Mike Pence signed House Enrolled Act 1337, which makes it illegal to perform abortions on babies based on fetal genetic abnormalities or the fetus's race, sex or ancestry, and mandates that otherwise aborted babies must be buried or cremated.  Planned Parenthood has announced it will seek a court injunction to continue its butchery status quo.

Republican Gov. Mike Pence signed the measure just hours ahead of his deadline to take action on the proposal approved by the Republican-dominated Legislature two weeks ago, the governor's office said. It is due to take effect in July, but Planned Parenthood of Indiana and Kentucky said it will ask a court to block the measure before that can happen.

Pence called the bill "a comprehensive pro-life measure that affirms the value of all human life."

Pence was a prominent abortion rights opponent while serving in Congress before being elected governor in 2012 and received perfect scores from Indiana Right to Life for his record of opposing abortion.

Pence is also facing a tough re-election campaign in a rematch against Democrat John Gregg and will be counting on a strong turnout from his evangelical base in November. Gregg said Thursday he would have vetoed the measure.

The law, which passed both chambers of the Republican-controlled General Assembly with large majorities, builds on Indiana’s already restrictive abortion rules, and was cheered by anti-abortion groups that had encouraged Gov. Mike Pence to sign it.

In addition to holding doctors liable if a woman has an abortion solely because of objections to the fetus’s race, sex or a disability, like Down syndrome, the law restricts fetal tissue donation and requires doctors performing abortions to have admitting privileges at a hospital or to have an agreement with a doctor who does.

The measure drew a sharp rebuke from the Planned Parenthood Action Fund and other abortion rights groups, and the law returned Indiana to the center of a national debate about social issues.

The law could also put some doctors who perform abortions in jeopardy if it is learned that a woman told them that she chose to end her pregnancy because of gender, disabilities or other reasons limited by the law.

It's a divisive issue that's once again placed the state at the center of a national debate. And a legal challenge to the law, which takes effect in July, is already in the works. Less than half an hour after Pence signed the measure, Planned Parenthood of Indiana and Kentucky said it plans to request a preliminary injunction to block the new restrictions . . . [by] working with the American Civil Liberties Union of Indiana in its plans to file a legal challenge.

“By enacting this legislation, we take an important step in protecting the unborn, while still providing an exception for the life of the mother. I sign this legislation with a prayer that God would continue to bless these precious children, mothers and families,” Pence said in a statement.

The controversial and potentially unconstitutional measure further restricts abortion in Indiana — already one of the most restrictive states in the nation. . . .

Social conservative groups, including Indiana Right to Life and the American Family Association of Indiana, had advocated for the new restrictions. Micah Clark, the leader of the family association, has said the measure “protects these special needs children from an intentional abortion based upon their genetics” in an email to supporters.

Republicans ushered the bill through the state legislature over the last three months despite opposition from some conservative lawmakers, including Representative Cindy Kirchhofer, who felt the measure was too restrictive.

North Dakota is the only U.S. state that prohibits abortions based on fetal anomalies. Seven states ban those based on gender, and Arizona prohibits those based on race, according to the Guttmacher Institute, an organization that tracks abortion laws.

Indiana state Sen. Liz Brown, who worked with [Sen. Travis] Holdman on the measure, said previously that many families face pressure to abort from doctors or other health care professionals when their babies are diagnosed with an illness or disability in the womb. “What we hear from doctors is — it would really be better off if you were not born,” Brown said. “If you are born, we will love you, and we think you have equal rights and should be a member of society. In fact, we have the Americans with Disabilities Act and have to make accommodations. But we don’t want to make the accommodation before you’re born, and in fact, it would really be easier if you were not born.”

. . . it's unclear how the law would play out in real life. The proposed ban on abortions would apply only when the sole reason for seeking the procedure is because the fetus may have a disability or is of a certain gender, race, color, national origin or ancestry.

Beth Cate, a public policy professor at Indiana University, questioned whether doctors would be left to infer a woman’s reasons for seeking an abortion based on her medical questions.

How do you know the reason a woman is seeking an abortion unless she explicitly states it — or does the doctor try to read her mind?

Can YOUR Child Pass the Test -- to be Born?

With each new money-generating medical procedure to determine the "health" of an unborn child, more babies are selectively killed in the womb, and due to testing errors, many of the aborted children were certainly perfectly healthy.  However, even if every test were 100% accurate, how high will the bar be raised?  How many babies will "make the grade" and allowed to be born?

The importance of Pre-natal testing for chromosomal aberrations in the body has been emphasized in a study conducted by the New England Journal of Medicine. The latest DNA test, which has been developed by researchers to screen Down syndrome and other related diseases are dramatically accurate. The new test is based on DNA sequencing and it will be used to identify Down syndrome and other related diseases.

This genetic test is being marketed by Illumina Inc. of San Diego, California which also had footed the bill for the research. A crack team of researchers have perfected this genetic test which gave far less false results among the 1,941 women and the results were compared with the conventional standard serum screening methods. The tests were conducted as early as 10 week of pregnancy.

The latest research can open up a lucrative $6 billion market to biotechnology companies which are already selling these tests. Such tests usually carry a price tag of $700 to $2500.

[The new test] would let couples decide sooner whether to have an abortion or to prepare for a major medical problem. It also might cut down on the 200,000 invasive tests like amniocentesis done each year in the United States to diagnose or rule out problems in a fetus.

Current screening methods are imprecise. Ultrasounds and various blood tests can hint at a problem but don't directly test for one.

The next step is diagnostic testing — amniocentesis, like a needle biopsy to collect fetal cells, or chorionic villus sampling, which takes a snip of the placenta.

All pregnant women—not just those with high-risk pregnancies—should be offered a new, DNA-based screening test for Down syndrome, say researchers.

A pregnant woman’s blood contains bits of DNA from her fetus along with her own. By sequencing this mix of DNA, scientists can determine whether or not her fetus has an abnormal number of chromosomes, such as the extra copy of chromosome 21 that causes Down syndrome. Doctors are already using this finding to screen women who are at high-risk for having pregnancies with this kind of complication (say because they are over the age of 35, see “Medical Society Approval for Non-Invasive Prenatal Testing”). . . .

But so far, these tests are not used to screen the broader population of pregnant women. . . .

For now, if women want the DNA-based tests, they will have to pay for it themselves as insurers don’t yet cover it for low-risk pregnancies. The test have list prices range from $1,200 to $2,700 says Richard Rava, chief scientific officer of Verinata, the Illumina division responsible for the prenatal test.

Each year in the U.S. there are 6.6 million pregnancies and 4 million births, according the Centers for Disease Control & Prevention. The list prices of the tests, which are sold by four different companies, range from $700 to $2500. Assuming that pricing settles in the middle of that range and that there are 5 million women who choose to have the test, that would be a $8 billion market.

Such a market expansion could be important to all of the companies that make the tests . . .

Arizona's Gov. Brewer has signed legislation, that passed by a large majority, to outlaw abortion at, or after, 20 weeks gestation at which time the baby feels pain, but critics say this reduces the opportunity to detect fetal abnormalities and the chance to kill the "defective" child.

The 20-week abortion ban does not apply in medical emergencies and it would affect a tiny percentage of abortions performed in Arizona.

Critics argued that the 20-week deadline would likely prevent timely diagnosis of anomalies in the fetus.

In 2010, Nebraska was the first to ban abortions after 20 weeks based on the theory of fetal pain. Last year, Alabama, Idaho, Indiana, Kansas and Oklahoma passed similar laws. This year, in addition to Arizona, Michigan and Georgia are considering bans.

The bill would make numerous changes to abortion laws, including banning abortions after 20 weeks except in a "medical emergency," allowing doctors to prescribe medication abortion pills only through the seventh week of pregnancy and requiring clinics to perform an ultrasound 24 hours before an abortion instead of the current requirement of an hour before.

It also would set up several new requirements: Clinics must post signs saying it is against the law to coerce a woman into having an abortion, physicians must provide additional information about health risks, and the state must create a website with abortion health risks, contact information for adoption agencies and photos or drawings of developing fetuses.

House Bill 2036 bans "abortions at or after 20 weeks of gestation, except in cases of a medical emergency, based on the documented risks to women's health and the strong medical evidence that unborn children feel pain during an abortion at that gestational age."

It requires that physicians performing surgical abortions have privileges in a hospital within 30 miles from the place where the abortion is done.

The bill requires that a clinic "clearly post signs that are visible to all who enter the abortion clinic, that are clearly readable and that state it is unlawful for any person to force a woman to have an abortion and a woman who is being forced to have an abortion has the right to contact any local or state law enforcement or social service agency to receive protection from any actual or threatened physical, emotional or psychological abuse."

The bill states that a doctor who performs an abortion on a minor without certification that the pregnancy places the minor's health at risk or "that the pregnancy resulted from sexual conduct with a minor by the minor's parent, stepparent, uncle, grandparent, sibling, adoptive parent, legal guardian or foster parent or by a person who lives in the same household with the minor and the minor's mother" is guilty of a class 1 misdemeanor.

Yoest said the abortion industry commonly hides the sometimes deadly consequences of late-term abortions. She said the findings of fact included with the bill lay out some of the risks of late-term abortions, including higher medical risks and higher short-term and long-term physical and psychological complications.

$3M Awarded for Down's Baby Parents Wanted to Abort

In a so-called "wrongful birth" lawsuit, a Portland, Oregon jury awarded the parents $2.9 million to compensate for the financial burden of their Down syndrome daughter to be paid by the hospital for its faulty prenatal test that didn't detect the abnormality. Although they now say they love this child, the parents claim they certainly would have killed her in the womb if they'd been properly informed during pregnancy.

Ariel and Deborah Levy say they would have aborted their now four-year-old daughter [Kalanit] had they known about the condition back in 2007.

Initially overjoyed at the birth, they say they were left in a state of shock when hospital staff told them their daughter looked like she had Down syndrome.

A doctor then asked Deborah Levy if she'd had a prenatal test, to which Levy responded in the affirmative - the results of the test had revealed they would have a normal, healthy child.

Within days of her birth, however, a blood test confirmed the little girl had Down syndrome.

The Levys filed suit against Legacy Health, claiming that Deborah Levy would have aborted her pregnancy had she known her daughter had the chromosomal abnormality. The lawsuit blames Legacy's Center for Maternal-Fetal Medicine in North Portland and a Legacy lab for allegedly botching the test. The Levys -- who dearly love their daughter, now 4 -- want Legacy to pay for the extra life-time costs of caring for her. That is estimated at about $3 million.

Experts say such "wrongful birth" cases are extraordinarily rare nationwide, for one, because prenatal tests such as the CVS are as much as 99.7 percent accurate and when they fail, few parents are willing to endure the scrutiny of a legal challenge. But wrongful birth lawsuits may be becoming more common as technology advances, more women in their late 30s or 40s give birth and millions of expectant mothers come to rely on genetic screenings.

Several studies show that more than 89 percent of women who learn they will give birth to a child with Down syndrome choose to terminate their pregnancies.

According to Green, the Levy’s attorney argued

“that Dr. Thomas Jenkins removed maternal tissue — not fetal tissue –from Deborah Levy’s womb. The suit faults Jenkins and lab workers for not recognizing that the tissue was from the mother. The suit also faults Legacy for reassuring her that her baby didn’t have an extra 21st chromosome even though two ultrasounds allegedly raised red flags by showing traits of Down syndrome.”

The attorney for the hospital said the reason only normal cells were found by the CVS test is because

“Kalanit has mosiac Down syndrome — meaning a significant number of her cells don’t contain an extra 21st chromosome. Keating pointed to an analysis of Kalanit’s cells — taken after birth — that showed nearly 31 percent are normal.”

Abortionist Loses License for Killing Healthy Fetus

Mother pays to abort one unborn twin, thought to be Down syndrome, but Florida ob-gyn kills other twin; weeks later, mother aborts second twin as well

After an exceedingly rare and shocking medical error, state officials have taken away the medical license of a Sarasota ob-gyn who aborted the wrong fetus in a woman carrying twins, mistaking a seemingly healthy girl for a boy with congenital defects.

Dr. Matthew J. Kachinas performed abortions but never before had attempted this procedure, known as selective termination, in which a chemical injection terminates one fetus in a multiple pregnancy.

But in January 2006, he agreed to treat a woman identified in state records as K.M. She was roughly 16 weeks' pregnant with twins conceived through in vitro fertilization, a procedure used to help couples who have difficulty reproducing.

Doctors had counseled her that selective termination was an option after learning the male fetus had multiple problems, including a possible heart defect and Down syndrome. The female twin appeared normal.

A week and a half later, K.M. returned to the doctors at Florida Perinatal Associates monitoring her high-risk pregnancy. An ultrasound revealed that the fetus still alive was the one with congenital issues and Down syndrome. She returned to Kachinas several days later to terminate the second twin.

Palin's Special Child Threatens Abortionists

. . . her decision to carry to term her Down syndrome child established a special relationship with anti-abortion activists, and now . . . the leading figure of the anti-abortion movement.

And those people, says Greg Mueller, a veteran anti-abortion political operative and former spokesman for Pat Buchanan, are getting a powerful message. “She’s going out there as a pro-life woman to say that there’s great joy in special-needs kids — and that we shouldn’t be aborting them.”

Though the anti-abortion movement remains strong and deeply rooted on the right, the recent conservative resurgence has been driven by anti-government sentiment — not by the abortion battle. Palin’s own ability to infuriate and delight often has more to do with her notions of patriotism and her views of the White House than with her place in the abortion wars. But Trig is part of what makes Palin so singular among conservative leaders.

Palin’s increased focus on abortion rights, an aide said, was driven by the passionate response to Trig during the final days of John McCain's presidential campaign.

[Abortionists'] antipathy to her is based on the belief that she should have had an abortion rather than bearing her son.

Pro-eugenics Libertarians: Palin's Duty to Kill Down Syndrome Baby

"Because a person afflicted with Down syndrome is only capable of being marginally productive (if at all) and requires constant care and supervision . . . [the parents] are essentially stranding the cost of their child's life upon others."

A writer for a libertarian group has written perhaps the most scathing attack on pro-life vice presidential candidate Sarah Palin since the Alaska governor was announced weeks ago as John McCain's running mate. Nicholas Provenzo condemns Palin for the birth of her baby Trig, who has Down syndrome.

Provenzo, who writes for the Center for the Advancement of Capitalism, not only bashes her for allowing Trig to be born, but says she should have made the so-called morally justifiable decision to kill him in an abortion.

"Given that Palin's decision is being celebrated in some quarters, it is crucial to reaffirm the morality of aborting a fetus diagnosed with Down syndrome (or by extension, any unborn fetus)—a freedom that anti-abortion advocates seek to deny," [Provenzo writes.]

While as many as 80-90 percent of unborn children diagnosed with Down syndrome become victims of abortion, Palin didn't let her child become a statistic. Palin, who has deeply-felt pro-life views, gave birth to her fifth child in April and the baby was diagnosed with the condition.
