75% of Abortion Clinics Closed: Jan. 2015 vs. 1991

In 1991 there were 2,176 surgical abortion clinics in America, yet today that number has declined to 551 -- the decline being most significant in the past few years.  In addition, there are currently 188 medication-only abortion facilities, down from 196 in 2012.  Although the total number of children killed annually by abortionists continues to decrease, the rate of killings per clinic has risen significantly.
“The only things that are preventing total collapse are court injunctions that are blocking several state abortion safety laws from being enforced. Once those laws clear the courts, we expect to see even more dangerous abortion facilities close.”
-- Troy Newman, president of Operation Rescue

-- From "US abortion clinics shutter to record low" by Sarah Ferris, The Hill 12/30/14

The number of abortion clinics across the country has shrunk by nearly one-quarter over the last five years, with 60 facilities shuttered in 2014 alone, according to new research . . . by the anti-abortion group Operation Rescue.

Clinic closures have spiked since the Republican wave of 2010, when the GOP took over the House and made gains in state legislatures around the country.

Since then, more than 200 new abortion rules have passed through state legislatures. The disappearance of the clinics comes as the rate of abortions nationwide continues its decades-long decline.

From "60 Abortion Clnics Closed In 2014; Number Of Total Clinics A Quarter Less Than It Was 5 Years Ago" by Stephanie Castillo, Medical Daily 12/30/14

The survey confirmed 60 surgical abortion clinics were closed for all or part of 2014; 14 were allowed to reopen due to court action. This brings the total number of abortion clinics in the United States — surgical and medication-only — to 739, nearly a quarter less than the number of clinics open five years ago. Though a significant amount, it’s still less than the 93 closings reported in 2013.

Texas, unsurprisingly, reported the greatest number of closures after the U.S Supreme Court ruled the state “could begin enforcing restrictions on abortion clinics that critics of the new rules say will force all but seven of the facilities in the state to shut down.”

According to the [pro-abortion] Guttmatcher Institute, one in three women will have an abortion in her lifetime. And these women aren’t just sexually active teens who only account for 18 percent of total women who opt for the procedure. Women in their 20s account for more than half of all abortions, and 61 percent of abortions are obtained by women with one or more children.

From "73 Abortion Facilities Shut Down in 2014, 75% of Abortion Clinics Closed Since 1991" by Cheryl Sullenger, Operation Rescue posted at LifeNews.com 12/29/14

Out of 60 surgical abortion clinic closures [in 2014], 47 were permanent. This represents a 23% decline in surgical abortion facilities over the past five years.

Thirteen surgical facilities were allowed to reopen after initially closing, primarily due to court action that enjoined abortion safety laws that had shut down the substandard facilities.

Thirteen facilities that provided only medication abortions account for the remaining closures in 2014. That more than doubles the number of medication abortion facilities that closed in 2013 when six were shuttered.

Closures far outpaced clinic openings. Fifteen facilities either added surgical abortions or opened for the first time. Thirteen clinics, primarily Planned Parenthood centers, added medication abortions to clinics that previously did not provide them. Eight clinics that formerly provided surgical abortions made the decision to halt those procedures, but continue to sell medication abortions.

From "Abortion industry on verge of 'implosion'" posted at World Net Daily 12/29/14

[Troy Newman said,] “As abortion facilities continue to close, abortion numbers continue to fall. While national abortion numbers remain incomplete, the average number of abortions decreases by about 3 percent annually. However, state statistics show that the drop in abortions that is more pronounced in areas where there are abortion clinic closures.

“For example, in Ohio, four abortion facilities closed in 2013, the most recent year for which abortion figures are available. During that year, the number of abortions dropped by nine percent – three times the average national drop in abortion numbers.”

“No matter how one views the numbers, they show that we are winning,” said Newman. “As the truth about abortion abuses and other dangers become public and are followed by new laws that increase protections for women and their babies, we can only expect the decline of the abortion cartel to continue until it collapses altogether.”

Miss. Abortionist: God Called Me to Kill Babies

Diane Derzis, 59, owner of Mississippi's only abortion clinic, with hundreds of patients per month, is hell-bent to continue her mission despite ever-more restrictive abortion laws enacted by state legislators with the support of the voters.
“If they think they’re going to make me feel badly about what I do … not gonna happen.  I feel like God wants me to do this job.”

-- From "Abortion clinic owner committed despite pressure" by Emily Wagster Pettus, Associated Press 11/23/13

She has been an abortion rights advocate for decades and owned clinics since 1996, but Derzis is facing some of the biggest political and legal pressure she has ever seen. She spars with pastors and politicians alike, and her latest fight is to keep open her Mississippi clinic, the last one remaining in the state.

In addition to the facility in Jackson, Derzis owns a clinic in Columbus, Ga., and one in Richmond, Va.

Derzis agreed to close [her Birmingham, Alabama] clinic in 2012 after the state Health Department found numerous health violations, including allowing unlicensed workers to administer medications. A physician then ran a clinic in the building, but a judge closed it in August because the facility wasn’t licensed for abortions.

Derzis talks openly about the abortion she had when she was 20, newly married and in college. She said didn’t want children, and knew immediately she wanted to end the pregnancy. Derzis said her mother told her she’d regret it, but she hasn’t. She said she was about 12 weeks along when she had the procedure, and the doctor was gruff and disrespectful.

“I thank God every day I had that abortion,” said Derzis, who later divorced and doesn’t have children. “It was not a great experience, but you know what? I had a safe abortion. And that’s what counts.”

From "Controversy Roils Around Abortion Clinic" by Tyler Cleveland, Jackson Free Press 11/4/13

. . . abortion opponents rallied on the front steps of the Mississippi Capitol. Operation Rescue America leader Flip Benham preached to a crowd of about 20 supporters, most of whom had come to Jackson from different corners of the country.

Monday's protest came three days after JWHO and Wake Up Mississippi, a pro-abortion-rights political organization, began hosting "This Clinic is a Refuge," a week-long event to rally support for the clinic. Supporters held a women's rights poetry slam at Soul Wired Cafe Friday night and rallied Saturday outside the clinic and in front of the Governor's mansion.

In spring 2012, lawmakers threatened JWHO and its owner, Diane Derzis, with closure when they passed a bill requiring doctors performing abortions to have admitting privileges, which the physicians have tried and failed to get multiple times in the past.

Federal Judge Daniel P. Jordan initially blocked the law, then reversed course and allowed it with one stipulation—the clinic would be permitted to continue operations while its physicians continued to try to secure admitting privileges.

Albuquerque Abortionist-Hotel Combo Fly In Victims

Voters in Albuquerque, New Mexico will decide on Tuesday whether their city will continue to be America's late-term abortion capital, or if abortion after 20 weeks gestation will be banned. A new undercover video has exposed the combined effort of the Southwestern Women’s Options abortion clinic with the Plaza Inn to provided discounted “room-service (even third-trimester) abortions” for out-of-town mothers-to-be.

. . . New Mexico's largest city is believed to be the first municipality in the country to place such an initiative on a ballot.

The "Pain Capable Unborn Child Protection Ordinance," which needs a majority to pass, would have statewide impact because the only late-term abortion providers in the largely rural state are in Albuquerque.

Women living out of state also fly to Albuquerque for this type of care, said Micaela Cadena, policy director at Young Women United. The New Mexico-based group is part of the Respect ABQ Women campaign, which is fighting the local measure.

To get the measure on the ballot, Operation Rescue and other antiabortion groups gathered 27,000 signatures — more than twice the number the city requires. If successful, the ordinance could be implemented days after city officials certify the election.

Opponents of the measure, including state Atty. Gen. Gary King, have said they're prepared to sue if the measure passes.

Albuquerque could become the first city in the country to pass a ban on abortions past 20 weeks of pregnancy after a vote next Tuesday.

Voters appear to support the measure, according to a September poll by the Albuquerque Journal that showed support at 54 percent and opposition at 39 percent. But there’s been a lot of advertising and activity on both sides since September, so the outcome isn’t certain.

. . . New Mexico Legislature, controlled by Democrats, is unlikely to take up the provision. So attention turned to Albuquerque.

The new undercover [video] recording features an investigator attempting to schedule a 25-week (six-plus-month) abortion appointment with Southwestern Women’s Options, that late-term abortion clinic. After specifying that the late-term abortion comprises a “week-long procedure,” the staffer directs the investigator to the Plaza Inn – “a hotel that we work in conjunction with” – which offers room rate discounts and free transportation to and from all appointments. The video shows definitively that the Plaza Inn is cooperating with Southwestern Women’s Options [SWO] abortionists to enhance revenues for both businesses.

In the undercover recording, the Plaza Inn staffer admits that under such circumstances, “you guys [SWO patients] actually transport yourselves[.] … I think you wind up going to the hospital[.]”

Black Chicago Girl Killed, No Media Outrage

The media blitz of Trayvon Martin's death, versus the virtual media blackout of the deaths of Tonya Reaves and her unborn child during an abortion . . .

One year after Tonya's death, Dr. Alveda King, niece of Dr. Martin Luther King, Jr., is joining Chicago area pastors and the Life Education And Resource Network (LEARN) to demand that the Illinois General Assembly respond to the genocide.  The 3-day event began yesterday with a press conference -- absent the media.
“Jesse Jackson and Al Sharpton were willing to move heaven and earth to get justice for Trayvon Martin, but they write off Tonya Reeves like she never existed.  Someone needs to ask these two why they think Trayvon’s life counts more than Tonya’s.”

A group of ministers is calling for tougher oversight of facilities in Illinois that provide abortions.

On Thursday, they also remembered Tonya Reaves. Reaves died nearly a year ago after undergoing an abortion at a Planned Parenthood clinic in Chicago.

The ministers want lawmakers in Springfield to pass legislation to ensure the safety of all women. They say that includes making sure women are better informed of the risks of an abortion.

From "Mother of woman who died after abortion, suing Planned Parenthood" by Chicago Sun-Times Media Wire, posted at WFLD-TV32 5/20/13

Tonya Reaves died at Northwestern July 20 [2012] after she began to hemorrhage at a Planned Parenthood clinic located at 18 S. Michigan Ave., according to the Cook County Medical Examiner's office. Reaves, of the 1500 block of North Kildare Avenue, was pronounced dead at 11:20 p.m.

An autopsy found she died of a hemorrhage following a cervical dilation and evacuation performed during an intrauterine pregnancy, according to the medical examiner's office. Her death was ruled an accident.

Dorsey Johns, Reaves' mother, claims staff at the Planned Parenthood clinic "carelessly performed" the elective abortion and failed to properly monitor and assess her daughter's condition after the procedure, according to the suit filed in Cook County Circuit Court.

From "Planned Parenthood Killed Tonya Reaves in an Abortion One Year Ago, No Justice Yet" by Cheryl Sullenger, Operation Rescue, posted at LifeNews.com 7/18/13

Planned Parenthood staff allowed Reaves to languish at the clinic after having botched her abortion while she hemorrhaged for 5½ long hours before seeking emergency care. Records show that Planned Parenthood did not call 911 for an ambulance, which was the quickest way to get help for her.

While the nation rages over the supposed “injustice” of the acquittal of George Zimmerman, a Hispanic man, in the shooting death of Trayvon Martin, a Black teen, there has been no mention in the national press about Tonya’s brutal death at the hands of Planned Parenthood, even though Tonya was also an African-American whose life was ended by a blonde white abortionist named Mandy Gittler.

In fact, while Pres. Barack Obama was quick to jump in to the Trayvon Martin fray, noting that if he had a son, he’d look like Trayvon, Obama disrespected Tonya and her grieving family with comments in support of Planned Parenthood made during a campaign speech in Portland just days after her death.

We have to wonder how Mr. Obama would have felt if that had been Malia or Sasha bleeding to death on that abortion table. . . .

From "#Justice4Tonya: Hold Planned Parenthood Accountable for Killing Black Woman in Abortion" by Ryan Bomberger, LifeNews.com 7/18/13

We are a culture that jumps on bandwagons. Trayvon’s tragic death brought out the racialists, the Civil Wrongs activists and other liberals in droves. A black woman is killed by Planned Parenthood, and the President praises the abortion chain, while the “I AM TRAYVON MARTIN” crowd is silent.

Sadly, [Tonya's] death proves that, for many so called “civil rights” leaders, sometimes violence toward women is simply…ok. The real war on women has killed again.  The simple truth is that protecting abortion is more important to Planned Parenthood than protecting women.

No mainstream news outlet has asked the question, “What is a late-term abortionist like Mandy Gittler doing in a Planned Parenthood clinic that claims to only do medication abortions?” Planned Parenthood of Illinois has never indicated that surgical abortions were ever done at their 18 South Michigan Ave (Loop Center) location. . . .

From "Grieved Over Strife Surrounding Zimmerman Verdict" by Dr. Alveda King 7/15/13

“I believe that the verdict in the Zimmerman/Trayvon Martin Case further exposes a grievous and deep vein of disharmony and racial tension in our nation that can only be healed when people realize that every human being should be treated with dignity and respect,” says Dr. Alveda King, Director of African American Outreach for Priests for Life.

“Now in the wake of Trayvon’s senseless death and Mr. Zimmerman’s acquittal many people are angry at the tragic loss of life and what some perceive to be a shun on the Black race. For the record, Acts 17:26 teaches that there is one blood and one human race, not multiple races, so racism is based on a lie!

“Let’s face it. If both people in this tragedy were of common ethnicity, there would be no media feeding frenzy. The gun control debate is a smokescreen in that people do use guns to kill other people as Zimmerman did in this case. But guns don’t kill people. People kill people. Yes, sometimes they use guns, but they sometimes use bombs or knives too. We definitely need love control and heart control and nonviolence control.

“There are murders going on every day that the media overlooks. Remember Tonya Reaves. Millions of Black babies and many of their mothers are being slaughtered in abortion mills. Where is the justice for that?”

Premiering today at the Sundance Film Festival as part of the U.S. documentary competition, “After Tiller” is an intimate and heartfelt look at the four doctors performing third-trimester abortions in the United States, doing so even after the 2009 assassination of such a physician, Dr. George Tiller. . . .

“What’s interesting is that the four doctors really are proud of what they do,” said [film director Martha] Shane during a phone interview from Park City on Thursday morning. “They don’t feel they are working in the shadows. They’re brave enough to let the world know they do third-trimester abortions, they are public about it. Operation Rescue says the abortion patient suffered massive internal bleeding into her abdominal cavity. She slipped into a Code Blue condition approximately six times before finally succumbing to her injuries at around 9:30 a.m. The case has been placed with the Medical Examiner for further investigation.

“At Planned Parenthood, medical abortion is extremely safe,” reproductive health researcher James Trussell of Princeton University in New Jersey, who worked on the study, told Reuters. “The most common adverse outcome is just continuing pregnancy,” he added. “It doesn’t work 100 percent of the time.”

The data showed that 385 women had a serious side effect of the 233,805 total abortions during the study period. This includes 238 who sought treatment at the ER, 135 who were admitted to the hospital, 114 who had a blood transfusion and 57 who required intravenous antibiotics. All of the women in the study survived.

A study from 2010 showed that less than one percent of women having a surgical abortion prior to their sixteenth week of pregnancy needed intravenous fluid. And only one in 300 had a major complication as a result of surgery [thus totaling thousands annually across America].

Eight women each year had an ectopic pregnancy - when the embryo implants outside the uterus - that was diagnosed after the attempted [medication-induced] abortion. One died from related complications.

. . . Dr. Debra Stulberg, who studies disparities in reproductive health at the University of Chicago and wasn't involved in the new study . . . told Reuters Health medical abortions are still less common than surgical ones in the U.S., but that they're becoming relatively more frequent and "women should be reassured" based on these and other data.

One limitation, the study team noted, is that not all women checked back after the abortion or had follow up medical records available - so it's possible more complications could have occurred that weren't recorded.

Medical abortions done at Planned Parenthood run for about $300 to $800, according to its website.

So Operation Rescue founder Terry Randall, who is making a non-serious "run" for president, has bought "campaign" ads during the Super Bowl on local NBC affiliate stations that have primary elections within the following 45 days of the big game.

Terry has already run political ads featuring graphic images of babies killed by abortion during the first and second trimester. The ads were part of a three day ad run in New Hampshire on WBIN. The ads consisted of four 30 second spots that ran in rotation that attacked Obama’s support of child killing by abortion.

While Terry realizes he stands little chance of getting the Democratic nomination, he said he is running in order to give pro-life Catholics and evangelicals in the Democratic Party a choice during the primary season.

The difference between the candidates could not be more stark. Obama has 100 percent rating from militant pro-abortion group NARAL. While a state Senator in Illinois, Obama vetoed a bill that would require babies that survived an abortion be given medical treatment.

Two Abortionists Arrested, Charged with Murder

Two out-of-state doctors who traveled to Maryland to perform late-term abortions have been arrested and charged with multiple counts of murder under the state's viable fetus law, authorities said.

While late-term abortions are not illegal in Maryland, those who kill viable babies killed in the commission of crimes can be charged with murder in that state.

UPDATE 3/6/12: Government drops murder charges, as defense attorneys argue that prosecution would essentially outlaw abortion

-- From "Authorities: Abortion Doctors Charged With Murder" by Ben Nuckols, Associated Press 12/30/11

Dr. Steven Brigham, of Voorhees, N.J., was taken into custody Wednesday night and is being held in the Camden County jail, according to police in Elkton, Md. Authorities also arrested Dr. Nicola Riley in Salt Lake City and she is in jail in Utah. Each is awaiting an extradition hearing.

A search of [Brigham's Elkton] clinic . . . revealed a freezer with 35 late-term fetuses inside, including one believed to have been aborted at 36 weeks, authorities said.

Brigham, 55, is charged with five counts of first-degree murder, five counts of second-degree murder and one count of conspiracy. Riley, 46, faces one count each of first- and second-degree murder and one conspiracy count.

In the Elkton case, which police said forms the basis for most of the criminal charges filed this week, an 18-year-old woman from New Jersey suffered a ruptured uterus and other internal injuries during a procedure at the American Woman's Services clinic on East High Street in Elkton.

The physicians board found that the woman, who was 21 weeks pregnant, had initially been treated in Voorhees, N.J., where her cervix was dilated. The woman was then told to travel, in her own car, to Elkton so doctors could complete the procedure.

After the woman suffered a ruptured uterus, state officials said Riley put the patient in Brigham's rented Chevrolet Malibu and drove her Union Hospital in Elkton. The board said she sat in slumped in a wheelchair, nearly unconscious, outside the emergency room, while Riley argued with hospital staff, demanding their identities before treating the woman.

The woman was flown that day to Johns Hopkins Hospital in Baltimore for more treatment. State officials said Riley then returned to his clinic in Elkton to perform another abortion. The injured woman survived.

Although Maryland has suspended Riley’s medical license, she continues to have an active license to practice medicine in Utah.

But she can no longer perform abortions in Utah, under a February agreement with state licensing officials. And in August, she was ordered to pay a $10,000 fine for misleading officials about her criminal background when she applied for a Utah medical license in 2004.

Brigham, who has never been licensed in Maryland, allegedly initiated abortions in New Jersey and Riley completed the procedures in Maryland.

The murder charges do not have an immediate impact on Riley’s medical license in Utah.

Brigham was the owner of State College Medical Services, a clinic that opened in September 1997. The clinic was shut down in August 2002 after years of court battles with its landlord.

Brigham surrendered his Pennsylvania medical license in 2002 after an investigation into abortions he performed in the state.

Brigham operated a secret late-term abortion clinic in Elkton, Maryland, even though he had no license to practice in that state. He hired Riley to do late-term abortions there and at his abortion clinic in Baltimore. Brigham would start the late-term abortions at his office in New Jersey, then caravan the laboring women to Elkton where the abortions would be completed. The clandestine abortion scheme was discovered after a woman suffered a life-threatening botched abortion in August, 2010. When police raided the Elkton abortion clinic, they discovered the remains of 35 aborted babies, one of which was 33 weeks gestation.

Responding to the news that abortionists Steven Brigham and Nicola Riley are being held in custody for the murders of viable babies, Father Frank Pavone, National Director of Priests for Life, stated:

“These two individuals are now where they belong and should be in jail for the rest of their lives. This case, as it progresses, is key for the American people to pay attention to, because it exposes the abortion industry for what it is. Abortionists have no respect for human life, much less for human laws. Even those who believe abortion should be legal can join with us to stop the out of control practices of people like Brigham and Riley. And the time is now.”

New Mexico Ignores Deadly Botched Abortions

Pro-life groups have released emergency 911 calls initiated by abortion clinic workers, exposing the reality of botched abortions, which resulted in at least one death of the mother in New Mexico, where health officials have resisted a full investigation.

-- From "Abortion death reported at New Mexico clinic as state officials resist launching investigation" by Kathleen Gilbert, LifeSiteNews.com 8/23/11

The pro-life groups Operation Rescue and Project Defending Life both filed complaints with the New Mexico Medical Board concerning thirteen 911 calls from the University of New Mexico Center for Reproductive Health (UNMCRH) and Southwestern Women’s Options (SWO), a late-term abortion mill operated by Texas abortionist Curtis Boyd.

Several of the calls describe profuse bleeding and other abortion complications. One recording caught the gasping of a woman struggling for breath, whom a clinic worker described as “grayish” and unresponsive, following complications from an abortion.

“The Medical Board has all it needs to investigate the thirteen abortion-related injuries in our complaints. [They're] trying to tank this investigation by making demands that are above and beyond what are actually needed to investigate why women are being injured and possibly killed at two Albuquerque abortion clinics at the rate of one every ten weeks,” [said Cheryl Sullenger of Operation Rescue (OR).]

From "Woman Possibly Dies From Botched Abortion, Medical Board Stalling" by Steven Ertelt, LifeNews.com 8/22/11

A confidential informant has now come forward with more information about one of the patients who was the subject of the emergency calls. The information told OR and Tara Shaver of local pro-life group Project Defending Life that a woman died from abortion-related injuries at the UNM Center for Reproductive Health last month. The informant spoke several times with Shaver about the botched abortion and described how an emergency vehicle picked up the body of the woman who underwent the abortion procedure and transported the body to an undisclosed location.

Clinic workers who were visibly upset and shaken at the time of the incident were told not to discuss the situation with anyone, according to OR president Troy Newman and details the informant gave to Shaver made it appear the information was credible. Both groups have attempted to verify the information, but have had trouble getting details about the woman and her death from the abortion because of HIPAA privacy laws, but Newman says his group reported the abortion death to police.

“We have seen several abortionists, such as Rapin Osathanondh and Kermit Gosnell, criminally charged and sent to jail after abortion deaths,” he said. “Because of the fact that a death is involved, and because there appeared to be an attempt to cover up the death by ordering workers not to talk, it became our duty to report this to the police.”

From "More 911 Calls Show Women Victimized by Botched Abortions" by Steven Ertelt, LifeNews.com 8/15/11

. . . Operation Rescue has obtained eight new 911 recordings that reveal a further pattern of botched abortions at the two Albuquerque abortion clinics. Together with five 911 calls released last month, the 13 calls show that life-threatening abortion complications requiring emergency assistance occur at the rate of one every 10 weeks, the group says.

“As disturbing as the critical nature of these life-threatening emergencies are, perhaps more disturbing are the callous attitudes of some of the abortion workers and their willingness to cover up for the abortionists,” said Operation Rescue Senior Policy Advisor Cheryl Sullenger. “The clinic workers are careful about how much information they revealed to the emergency dispatchers, and in many cases, even attempt to shift the blame for the complications onto the woman. Their general actions and attitudes toward the woman they just injured are despicable.”

[The tapes] show women ranging in ages from 18 to 34 who were between 8 weeks and approximately 24 weeks pregnant. Complications included:
• Uterine rupture with heavy bleeding.
• A panic-stricken 18-yer old patient with chest pains, numbness, and a severe headache after a late-term abortion.
• Cervical laceration with hemorrhaging.
• Uncontrolled bleeding after first and second trimester abortions.
• Multiple seizures.
• Abortion on a woman with an undiagnosed ectopic (tubal) pregnancy.

White House Targets Pro-lifers with Lawsuits

The Obama administration's Justice Department has sued at least a half dozen pro-life demonstrators, accusing them of trying to block access to abortion clinics.

-- From "Feds suing more abortion activists" by Roxana Hegeman, Associated Press 5/4/11

The Justice Department under President Barack Obama has taken a harder line against anti-abortion activists accused of trying to block access to clinics, suing at least a half-dozen of them under a federal law that lay mostly dormant during the Bush administration.

Since Obama's inauguration, federal lawsuits have been filed against a woman who blocked a car from entering a clinic in West Palm Beach, Fla.; a Texas man who threw his body across the door of a patient waiting area in San Antonio; and a Pennsylvania man who posted on the Internet the names and addresses of abortion providers and extolled his readers to kill them.

Government records obtained by The Associated Press show that in slightly over two years, the Obama Justice Department has filed six lawsuits under the Freedom of Access to Clinic Entrances Act, mostly to seek injunctions and fines. That compares with just one such lawsuit during the entire eight years of George W. Bush.

President Bill Clinton signed the law in 1994 after a turbulent period that included massive sit-ins at clinics, clinic bombings and other anti-abortion activities that culminated with Tiller being wounded in a 1993 shooting. The Clinton Justice Department subsequently filed 17 civil lawsuits under the law during his remaining term.

From "Obama's DOJ ups ante on pro-life groups" by Charlie Butts, OneNewsNow 5/5/11

The lawsuits, filed by the administration under the Freedom of Access to Clinic Entrances Act, charge the demonstrators with civil acts, not criminal acts. Hans von Spakovsky, senior legal fellow at The Heritage Foundation, says pro-lifers certainly have constitutional rights of free speech -- and criminal cases are more difficult to prove in court.

In one case, a Kansas woman wrote a letter to a physician who planned to open a Wichita abortion facility. She was taken to court as a result, but a federal judge ruled in the woman's favor based on her constitutional rights. No laws were broken.

However, von Spakovsky is reminded of the outrage over members of the New Black Panthers intimidating voters outside a polling place in the November 2008 election and U.S. Attorney General Eric Holder refusing to pursue prosecution.

Yet, he says, the federal government took a Kansas woman to court for writing a letter to the physician -- a letter containing no threat of violence whatsoever.

From "DOJ Targets Pro-Life Activists" by Raven Clabough, New American 5/5/11

According to the U.S. Department of Justice, when members of the New Black Panther Party stood outside voting booths on Election Day ’08 wearing military-type uniforms, bearing clubs and hurling racial epithets at voters, they were not engaged in voter intimidation. But now the same DOJ has determined that pro-life activists standing outside abortion clinics are trying to block access to the clinics. In fact, the Justice Department has sued half a dozen pro-life activists under a federal law that was relatively unused during the Bush administration.

. . . Operation Rescue President Troy Newman contends, “You don’t just go around filing injunctions against people that you believe are proponents of violence. Domestic violence cases have proven that little injunctions don’t stop people from committing acts of violence.… They are pretty weak cases all around the country.”

Newman asserts that if it has proof of criminal misconduct, the government should file criminal charges under broadly written criminal statutes, instead of pursuing lawsuits against mostly peaceful pro-life activists under an act that specifically targets them.

Dead Fetus Found, Police Say it's 'No Crime'

A dog-walking pedestrian passing an abortion clinic was stunned when the dog found a fetus in the parking lot. When notified, the police said that it's no crime to discard abortion remains, even though the abortionist is otherwise under investigation.

Police officials determined that no crime had been committed, but pro-life activists were appalled after the trash bag with dime-sized limbs was apparently found outside the Hill Top Women's Reproductive Clinic, 300 E. Schuster.

"The medical examiner and the Crimes Against Persons (unit) made the determination it was not a crime," said Detective Mike Baranyay, a police spokes man. The fetus was 9 to 12 weeks old, police said.

Detectives and the medical examiner staff went to the scene but have not confirmed whether the fetus came from the clinic or elsewhere. "We do not know the origin of the fetus," Baranyay said.

Baranyay said the proper disposal of human tissue was a health department matter, not a police matter.

The facility is one of the abortion businesses operated by abortion practitioner Franz Theard, who is currently under investigation by the state medical board for numerous violations after an Operation Rescue investigation employing undercover phone calls showed him willing to violate Texas’ abortion laws.

The remains of the aborted baby, including discernible arms and hands, feet and legs, were discovered on Friday by the abortion clinic’s neighbor after his dog began to root in the trash near the Hilltop abortion center’s dumpster. He bagged the remains and later gave them to sidewalk Counselor Gaby Federico, of the pro-life group Live Action.

“We will be contacting the Texas Medical Board to inform them of this obvious case of illegal dumping of human remains,” said [Operation Rescue president Troy] Newman. “They can add this incident to their ongoing investigation.”

Pro-lifer Challenges Obama in Dem. Primary 2012

Randall Terry, the controversial pro-life activist, will challenge pro-abortion President Barack Obama in the Democratic primary with the sole mission of bringing up the issue of abortion.

UPDATE 3/7/12: Randall Terry succeeds with Super Bowl ads, and wins Democrat delegate in primary election against President Obama

-- From "Abortion foe plans Obama challenge" by Dan Hirschhorn, Politico 1/18/11

An outspoken anti-abortion activist says he wants to unseat President Barack Obama next year — and he wants to do it via the nearly impossible path of a Democratic primary challenge.

Randall Terry, who founded the group Operation Rescue and has been arrested numerous times for his aggressive approach to opposing abortion rights, plans to announce a primary challenge against Obama on Thursday outside the Holocaust Memorial Museum in Washington.

Besting a sitting Democratic president from far off his right flank is exceedingly unlikely. In an interview with POLITICO, Terry was blunt about being an underdog and said his main goals are to bloody up Obama politically and draw more attention to the abortion fight.

From "Activist Vows Graphic Anti-Abortion Ads During Super Bowl" by Devin Dwyer, ABC News 1/18/11

Veteran anti-abortion activist Randall Terry says he's mounting a Democratic primary challenge to President Obama in 2012, in part to be able to run graphic TV ads showing aborted fetuses during next year's Super Bowl.

"I want to pummel Obama. I despise this presidency. He is the arch child killer of the Western Hemisphere, so I'm going to go head-to-head with him," Terry said in a phone interview.

"My ultimate goal is to make child killing illegal again. And for child killing to be made illegal, there has to be a crisis of conscience; we have to show the victims like we show the Holocaust victims and say never again."

While TV networks occasionally reject ads based on controversial or graphic content, the Federal Communications Act requires broadcasters to provide legally qualified political candidates fair access to ad time and forbids them from censoring ads "in any way, or for any reason." Terry said he's confident he can raise the $2.5 million for a Super Bowl spot and that CBS would broadcast it.

From "Pro-Life Activist to Challenge Pro-Abortion Obama in Democratic Primary" by Steven Ertelt, LifeNews.com 1/18/11

Terry understands he has absolutely no shot of winning the Democratic nomination over the president, but he says his goal is to expose Obama’s pro-abortion record and energizing pro-life voters to oppose him in the general election, where Obama will face one of numerous potential pro-life Republican candidates.

He said the goal of his campaign is to “create a crisis of conscience for Americans regarding” abortion and to “pound on President Obama’s agenda” starting with abortion.

“America has never truly debated child killing, because America has never truly seen child killing. We will use FEC and FCC laws for federal candidates to bring America face to face with this massacre of the innocents,” he said.

But Wesley J. Smith, a respected bioethics attorney, called the move by Terry a [publicity] stunt and said it would ultimately help Obama.

Pastor Mark Holick of Spirit One Christian Center says he was arrested for handing out "packets that included the Gospel of John and the Book of Romans in English and Arabic, a DVD with testimonies of former Islamists who have come to the Lord."

Holick says Wichita police arrived and asked him and about a dozen other people to move farther away from the [Islamic Society of Wichita] building. Holick says he was then arrested for "loitering and failing to disperse."

In an email, Holick says his group was peaceful and he was exercising his First Amendment rights on the sidewalk.

On Friday at the Islamic Society of Wichita, the pastor of Spirit One Christian Center, Mark Holick, and others held up white signs with red lettering that said "Islam is a lie. Jesus is the truth" and passed out copies of the Gospel of John and book of Romans in English and Arabic.

Wichita police stood ready to respond.

Officers had arrested Holick just two weeks before at the same place, taking him to jail on a charge of loitering that he believes violated his First Amendment rights. Holick said it was his right to religious freedom to preach outside the mosque. He said his faith called him to testify.

A pastor in Wichita, Kansas, heads to court today to defend himself against charges involving his efforts to witness for Christ outside a mosque.

The Kansas pastor, who was ultimately charged with loitering and failure to disburse, is no stranger to controversy. In 2009 he won a $10,000 judgment after the City of Wichita admitted it had violated his civil rights when he was arrested for witnessing on a public city sidewalk during a homosexual event at a nearby park.

"It's really good for Christians to see what has really happened to our court system," he shares, "because if you haven't gone through it before, you really have no idea what it has become. But I think it's going to be good at trial, regardless of the verdict."

Pastor Holick and fourteen other Christians, including two additional senior ministers, did not step foot inside the mosque – - but merely attempted to engage Muslims in dialogue on a public sidewalk as they left the building.

The police allege that the pastor and his followers were blocking a driveway.

Mr. Holick denies this charge by saying: “Of course we never did do that. There would be no reason for us to block vehicles — and they probably have no idea how much I like all of my organs and bones perfectly in the position they’re in right now.”

Previously, Mr. Holick captured headlines by positing this message on the marquee of the Spirit One Christian Center: “America, we have a Muslim president. This is a sin against the Lord.”

Last year, the fiery pastor was taken into custody by the Wichita police for communicating his religious views to gays and lesbians at a homosexual festival that was held in a public park

In Court: Planned Parenthood Taxpayer Funds Fraud

The nation's largest abortion provider will defend itself before the 9th U.S. Circuit Court of Appeals for fraudulent overbilling alleged by its own top management.

-- From "Suit Threatens Planned Parenthood Funds" by Shannon Bream, FOXNews.com 9/9/10

Two former Planned Parenthood employees-turned-whistleblowers have made stunning allegations regarding the abortion provider's accounting practices. In a case now pending in federal court P. Victor Gonzalez alleges that he saw millions in fraudulent overbilling to state and federal governments when he worked as Chief Financial Officer for Planned Parenthood of Los Angeles.

Gonzalez alleges that after he reported the problems internally he was fired. While Gonzalez was still working for PPLA the state of California launched audits of various Planned Parenthood affiliates, and uncovered more than $5.2 million in overbilling at a single affiliate based in San Diego. Gonzalez claims that Planned Parenthood lobbyists intervened to stop other audits that were still pending statewide.

In his court filings, Gonzalez has outlined several transactions he alleges show illegal activity. For example, in one year Gonzalez says PPLA paid $225,695.65 for Ortho Tri-Cyclen birth control pills, yet billed the government $918,084 - for a profit of $692,388.35.

Planned Parenthood tried to have the Gonzalez whistleblower case dismissed on a technicality, but the Ninth Circuit Court of Appeals recently denied that motion. Walter Weber, who represents Gonzalez, says it could take years to actually get the case to trial. Weber asserts that the issues outlined by Gonzalez are so wide-spread that they are akin to "ACORN-like corruption" - and that federal agencies, like the U.S. Department of Health and Human Services, should consider de-funding Planned Parenthood of any government money.

From "Planned Parenthood Abortion Biz Found Improperly Billing Medicaid in New Jersey" by Steven Ertelt, LifeNews.com Editor 8/16/10

The U.S. Inspector General for the Department of Health and Human Services has uncovered a consistent problem with New Jersey-based family planning clinics run by the Planned Parenthood abortion business. They were found to be improperly billing Medicaid for services that did not qualify as family planning.

An initial audit revealed New Jersey improperly received federal reimbursement at the enhanced 90% rate for 160,955 prescriptions drug claims that were billed as family planning, but did not qualify as family planning services. A letter from the Inspector General to New Jersey officials recommended that New Jersey repay $2,219,746 to the federal government.

A second audit by the U. S. Inspector General for the HHS Department found Planned Parenthood family planning centers improperly received the enhanced 90% rate for outpatient services which did not qualify as family planning services.

A third audit found New Jersey received federal Medicaid reimbursement for 111 of the 161 claims for inpatient services which were improperly billed as family planning at the enhanced 90 percent rate. The Office of Inspector General recommended New Jersey reimburse $162,548 to the federal government and determine the amount of federal Medicaid funds improperly reimbursed at the 90% rate for inpatient hospital services following the audit period and refund that amount as well.
