Atheists Force 9/11 Sign Down, Kansas Locals Rebel

Since the local post office yielded to the Wisconsin-based Freedom From Religion Foundation (FFRF) last month by removing a "God Bless America" banner placed by postal workers 15 years ago, residents of Pittsburg, Kansas have displayed thousands of such signs throughout town.

The Pittsburg post office took the banner down Wednesday after hearing complaints about it from the Wisconsin-based Freedom From Religion Foundation. The organization said hanging the banner at the post office violated the principle of separation of church and state.

A spokeswoman for the U.S. Post Office [Twana Barber] said the postal service removed the banner because postal policy prohibits the placement of notices on postal property unless they’re official government notices.

The Pittsburg Morning Sun reports that a similar banner appeared at a couple of local businesses by Thursday, and a local sign company says requests for more signs have been pouring in.

Postal workers [about 60] paid for the 12-foot-long vinyl banner after the Sept. 11, 2001, terrorist attacks that took down the Twin Towers and killed 2,996 people in New York, the Pentagon and in Pennsylvania.

Ed Hinde watched as employees took out the eight screws holding the red, white and blue banner to the southeast corner of the post office at Seventh and Locust streets. They rolled up the banner because it was brittle after more than a decade outside.

“After the Sept. 11 attacks, a group of employees came to me and said, ‘Let’s do something’,” recalled Hinde, who served as postmaster from 1987 to 2003. “The employees paid for half of it, and I paid for half of it.”

About a dozen people, including retired letter carriers, members of the American Legion and other Pittsburg residents, watched in silence.

. . . Jake's Fireworks responded by printing 1,200 "God Bless America" yard signs and 300 similar banners. The company began handing out signs at 11 a.m. and by 11:45 a.m., the signs were gone.

Cars stretched over two blocks. Drivers were eventually met with rows of American flags and a digital sign saying "God Bless America" as they pulled into the company’s driveway at east industrial park, where Marietta and other employees directed traffic and greeted the drivers.

The company had a crew work overnight printing signs, [retail sales director Jason Marietta] said. Marietta knew the demand would be high after a Facebook post was shared 1,500 times. He just didn’t imagine it would be this big.

It took roughly 45 minutes for community members to clear out 1,500 signs, but employees continued to take down contact information to distribute additional signs and banners as they are printed.

Thursday morning, a very similar banner appeared on the fence next to local business Jayhawk Signs and Graphics, another at CDL Electric Company and social media marketing by Jake’s Fireworks promised more to come.

“We hung the banner in support of our troops and to commemorate the 9/11 attacks on America,” said Shea McLaughlin, with CDL Electric. “That banner has nothing to do with religious values or political correctness. It has everything to do with freedom of speech and the foundation that this country was built on.”

McLaughlin said that foundation is the God-given right to be free, along with free speech.

“Sometimes you have to stand up for what’s right,” McLaughlin continued. “In the day and age of political correctness someone has to be a leader and stand up for what they believe in.”

. . . Area residents also showed up at the post office with sandwich boards and flags, earning cheers of support from passers-by.

Wichita State Chapel Muslim Conversion = Uprising

The Wichita State University administration is backtracking as a result of public reaction to recent renovations of the Harvey D. Grace Memorial Chapel that removed the Christian cross, altar and pews in favor of a more mosque-like atmosphere complete with Muslim prayer rugs.  The university is also being pressured by naïve students and other liberals for more "inclusive" construction projects including additions of Islamic-compliant restrooms, showers, etc.

The [donor] family that made the chapel possible in 1964 specified that it remain open to all creeds and races. But dozens of Wichita residents learned about the renovation after Wichita State alumna Ann Cusick posted the changes to her Facebook page Friday and said taking out the pews marginalized Christians.

After that, university donors, alumni and others began posting comments and contacting university administrators.

Wichita State President John Bardo said Tuesday in a statement on the university's Facebook page that the school will consider changing the chapel's furnishings once again.

[WSU’s vice president for student affairs, Eric] Sexton vowed on Tuesday to spend “whatever time it takes” to talk to students, donors, alums and the Wichita community.

[Alumna Ann] Cusick posted about the chapel renovation as soon as she learned of it, on Friday, six months after it was settled. She included a photo from inside the chapel, showing the absence of pews. “The Muslims are ecstatic” about the renovation, she wrote in the post. “Sumpin’ NOT right here.”

By Monday, donors, alums and others were contacting WSU administrators, including Sexton, who serves a dual role as both student affairs vice president and executive athletic director.

. . . There was a more recent story in the campus paper reporting that hundreds of Muslim students had signed a petition asking WSU to install bidet shower heads in WSU restroom and showers. A hand-held bidet is used among Muslims as part of cleansing habits.

Right in the American Heartland, in the state of Kansas, a minority group of Muslim students have succeeded in taking over what used to be the Christian chapel of their university to the dismay of the school's majority Christian population.

But the Muslims now in control of the facility are dismissing the Christian outrage, calling it "Islamophobia," or prejudice against Muslims.

The Muslim students have also apparently taken over the university's student body and publication, the Wichita Eagle. Student body president Joseph Shepard told the Wichita Eagle that the Christian outrage is "coming from off-campus, not from the students here."

It should also be underscored that Christian students who used the chapel also favored taking out the pews to make the space more inviting to Bible study groups and interfaith events. The request came through the student government association.

Why not accommodate Muslims at Wichita State? They number about 1,000 out of the nearly 15,000 in the student body. As The Wichita Eagle also explained, most of the foreign Muslim students pay three times the tuition rate of in-state students.

Obviously, alumni of any university or college have an important role to play. They have a vested interest in the stability of their alma mater. But alumni who are good stewards understand that they shouldn’t meddle by imposing their prejudices.

. . . what happened at Wichita State wasn’t so much a renovation as it was a Christian cleansing. Anything remotely related to the décor of a Christian church was given the heave-ho.

The chapel’s stained glass windows are still intact – for now. But I would not be terribly surprised if they’re boarded up – for the sake of inclusivity.

This is what the Islamic transformation of a nation founded on Judeo-Christian values looks like, folks. The Christian faith is marginalized while the Islamic faith is given accommodation.

Kansas Gov. Protects Liberty, Homosexualists Attack

Days after the U.S. Supreme Court blessed the Gay Agenda, Kansas Gov. Brownback issued (executive order) EO-15-05 "Preservation and Protection of Religious Freedom" to shield (only some) Christians from persecution by the state government for refusing to be associated with same-sex "marriages."

Shortly after the executive order was signed, the ACLU released a statement calling the Governor's unnecessary.

The state and U.S. constitutions protect religious liberties, and Kansas enacted a law in 2013 saying that state and local agencies can't substantially limit someone's exercise of religion without a compelling reason.

But the order says state agencies can't alter contracts with individuals or religious groups, change their tax status or deny them licenses or tax breaks based on their refusal to perform same-sex marriages or provide services for such marriages.

The executive director of the leading gay rights group in Kansas is calling Republican Governor Sam Brownback's recent executive order on same-sex marriage an "unconstitutional power grab."

Tom Witt of Equality Kansas issued a lengthy statement Thursday criticizing the order Brownback issued to protect clergy, churches and religious groups from state sanctions for refusing to participate in same-sex weddings or provide goods, services or accommodations for them.

The order covers religious groups with state contracts to provide social services. Its definition of state government includes "political subdivisions."

Witt said that language applies the order to cities, counties, school districts and other local governments. Witt said Brownback declared himself their "supreme ruler" and is allowing them to refuse to recognize legal same-sex marriages.

Gay rights groups immediately condemned the executive order. In a statement, Sarah Warbelow, legal director for the Human Rights Campaign, said the order both feeds false rumors that clergy will ultimately be forced to officiate same-sex marriages, and invites hospitals and other religiously affiliated organizations to refuse to recognize gay couples’ marriages.

In announcing the order, Brownback said the order was necessary to defend the rights of religious Kansans in the wake of the Supreme Court decision. “Today’s executive order protects Kansas clergy and religious organizations from being forced to participate in activities that violate their sincerely and deeply held beliefs,” he said in a statement.

The order bars the state from acting against any individual clergy or religious leader who declines to participate in a same-sex ceremony, or any religious group that declines to provide services for or recognize a same-sex marriage if it conflicts with their faith or moral conviction. An example of a prohibited action would be to revoke the tax-exempt status of a religious organization.

Gov. Sam Brownback issued an executive order Tuesday prohibiting state government from taking action against clergy members or religious organizations that deny services to couples based on religious beliefs.

Among other things, the order is intended to protect religious organizations that provide adoption services for the state from having to place children with gay couples if that conflicts with their beliefs.

The order explicitly protects religious organizations that provide “social services or charitable services,” meaning that it extends beyond the wedding ceremony.

The order means “a homeless shelter that received a state contract or grant could refuse family housing to a gay couple with a child, or a foster care agency could refuse to place a child in their custody with the child’s family member just because the family member was in a same-sex relationship – and the state could not require them to treat all families equally,” said Micah Kubic, executive director of the Kansas chapter of the ACLU.

Attorneys said it was difficult to know the full impact of the governor’s order just yet.

Last week, the Republican governor said he is considering to propose new religious liberty legislation. This week, Brownback offered few specifics on what a potential bill should do, but said he wants issues of religious liberty “fleshed out” and called on lawmakers to hold hearings next year.

“You’ve got this fundamental value, this fundamental right that the Founding Fathers came in search of on religious liberty,” Brownback said. “And during the years when I was in the Congress, in the Senate, this was one of the things I fought for a lot for people overseas, was religious liberty, religious freedom.

“Because it’s one of the basic hallmarks of a society that allows you to develop societally. And now you’re looking at this very fundamental right being attacked in the United States. It was an odd circumstance for me to start fighting for it at home when I’ve been primarily fighting for it overseas.”

Brownback’s suggestion that lawmakers should take up the issue of religious liberty next year has drawn opposition from the Kansas Chamber of Commerce. The organization called further legislation “unnecessary.”

Abortionists Stymied by New Oklahoma & Kansas Laws

Whereas abortion advocates routinely challenge virtually every new state law limiting abortion, they appear starkly hesitant to sue to block first-of-a-kind second trimester pro-life laws enacted this month in Kansas and Oklahoma.  Apparently abortionists are reticent to defend, publicly in court, the gruesome D&E procedure wherein the unborn baby dies as he/she is literally torn limb-from-limb.

Oklahoma has become the second state to ban a common second-trimester abortion procedure that critics describe as dismembering a fetus.

Republican Gov. Mary Fallin signed the legislation Monday after it was overwhelmingly approved by the House and Senate.

The abortion measure prohibits doctors from using forceps, clamps, scissors or similar instruments on a live fetus to remove it from the womb in pieces. Such instruments are used in dilation and evacuation [D&E] procedures performed in the second trimester.

In the procedure, the cervix is dilated with medication and the fetus is removed with forceps, often in parts. With a new legal approach intended to highlight what for many are uncomfortable aspects of abortions, groups like National Right to Life hope to expand their efforts.

“The Unborn Child Protection From Dismemberment Abortion Act is the first of what we hope will be many state laws banning dismemberment abortions,” said Carol Tobias, president of National Right to Life. “This law has the power to transform the landscape of abortion policy in the United States.”

“The law raises very grave constitutional concerns,” said Janet Crepps, a lawyer with the Center for Reproductive Rights in New York.

It might also be possible, some experts said, for doctors to comply with the law by killing the fetus with an injection of the heart drug digoxin before starting a dilation and evacuation procedure. This is commonly done in very late abortions, after perhaps 18 weeks, but not earlier because, experts say, it seems unnecessary and adds uncertainties to the procedure.

The bill, which takes effect on November 1, passed the state legislature by lopsided majorities, clearing the state House of Representatives 84-2 in February, and the state Senate last week by a 37-4 margin.

D&E abortion accounts for approximately 96 percent of all second trimester abortions, according to the National Abortion Federation – an estimated 100,000 abortions a year.

“So, yes, a dismemberment ban would stop many babies from being aborted,” pro-life newshound Jill Stanek wrote. But she adds that the educational value may be more important yet, since it was during the time that bills banning partial birth abortion were “introduced throughout the states and federally during the 1990s that public opinion began to change on abortion.”

Dr. Anthony Levatino, a former abortionist, graphically described D&E abortions on the floor of the House of Representatives in 2012, from removing each part of the body at the joint to finally decapitating the child and extracting the skull and body fragments. “Many times a little face may come out and stare back at you,” he said.

Now Illegal to Rip Babies Limb From Limb in Kansas

Today, Kansas Gov. Sam Brownback may have reduced abortions in the state by 8% as he signed into law the Unborn Child Protection from Dismemberment Abortion Act that outlaws second trimester abortions using dilation and extraction methods (D&E) that remove the “unborn child one piece at a time.” It's the first such law in the nation.

That Brownback would sign the bill had not been in serious doubt. The Republican governor has signed about a dozen anti-abortion measures since assuming office in 2011. The Legislature also passed Senate Bill 95 with robust majorities: the House approved 98-26 and the Senate passed 31-9.

In a news release, the governor’s office acknowledged Brownback had signed the legislation, but did not offer further comment in the statement. The governor did offer a brief comment on social media.

“Proud to sign SB95 protecting life at its most vulnerable stage with bipartisan support from #ksleg,” Brownback posted to Twitter.

The bill redefines dilation and evacuation as “dismemberment abortion” and outlaws it except when necessary to save a woman’s life or prevent irreversible damage to her physical health. Doctors could not use forceps, clamps, scissors or similar instruments on a fetus to remove it from the womb in pieces.

Kansas already bans most abortions at or after the 22nd week of pregnancy. But other legislators said Wednesday they want to ban abortion as soon as a fetal heartbeat can be detected. One anti-abortion group, the Kansas Coalition for Life, is pushing a separate bill to ban suction abortions, which account for more than half of pregnancies terminated in Kansas.

Elsewhere, the Oklahoma House has approved a ban on the procedure and its Senate is expected to debate it next week. Similar bills have been introduced in Missouri and South Carolina.

Other methods for performing a second trimester abortion include inducing labor or using a technique where medicine is used to terminate the pregnancy.

In Missouri, [the dismemberment procedure] was used in 629 out of 5,624 abortions during 2012, state figures show.

D&E dismemberment abortions are as brutal as the partial-birth abortion method, which is now illegal in the United States and which was upheld in the Supreme Court. But would such an abortion ban be constitutional given the Roe v. Wade decision? National Right to Life points to the high court’s ruling in the partial-birth abortion case as grounds for banning dismemberment abortions too.

In his dissent to the U.S. Supreme Court’s 2000 Stenberg v. Carhart decision, Justice Kennedy observed that in D&E dismemberment abortions, “The fetus, in many cases, dies just as a human adult or child would: It bleeds to death as it is torn limb from limb. The fetus can be alive at the beginning of the dismemberment process and can survive for a time while its limbs are being torn off.” Justice Kennedy added in the Court’s 2007 opinion, Gonzales v. Carhart, which upheld the ban on partial-birth abortion, that D&E abortions are “laden with the power to devalue human life…”

Kansas GOP Gov. Rescinds 'Gay Rights' of Dem. Gov.

Republican Gov. Sam Brownback signed an executive order last week striking down the 2007 Gay Agenda action of the previous Kansas governor, Democrat Kathleen Sebelius (the ObamaCare queen).  Brownback's order removed the protected status for state workers who labeled themselves based on deviant sexual behavior (i.e.: sexual orientation or gender identity).  A second order affirmed protection of state employees against discrimination based on race, religion, gender, age or national origin.

Rep. John Rubin, a Shawnee Republican, a former federal judge, defended the governor’s decision from a legal standpoint, saying that if sexual orientation isn’t a protected class at the federal level, then the issue should be up to the Legislature to decide.

“Until sexual orientation is either added in Kansas as a protected class under our law or added federally, which it isn’t now … I think that’s the Legislature’s prerogative,” Rubin said. “Whether they should be a protected class is a separate question. … But it isn’t a protected class until we say it is.”

Brownback's removal of sexual orientation and gender identity protections was greeted with instant outcry by LGBT advocacy groups and comes at a time gays and lesbians around the country have been fighting for nondiscrimination laws and the right to marry. A federal judge struck down Kansas' ban on same-sex marriage in November, and the state has appealed the ruling.

The legal director of the American Civil Liberties Union of Kansas called Brownback's move "a sad day for Kansas" and said it was unusual to see a state take away legal protections from gay and lesbian residents rather than add them.

Fewer than half the nation's states have statewide nondiscrimination laws protecting sexual orientation or gender identity, according to the American Civil Liberties Union, though many large companies have created their own policies and some cities have protections that go beyond state laws.

Sebelius' 2007 executive order did not change discrimination policies for private employers. It applied only to state workers.

Court OKs Defunding Planned Parenthood in Kansas

A law enacted in Kansas in 2011, effectively forbidding any taxpayer funding of organizations that provide abortions, was immediately halted by a federal district judge, but yesterday, the U.S. Court of Appeals Tenth Circuit lifted that injunction.  The legal battle over the law will continue, but in the meantime, the annual flow of more than $330,000 of state tax dollars to Planned Parenthood has ended.

At issue in Tuesday’s ruling is money distributed to states under Title X, a federally financed family planning program. A Kansas law requires the state to first allocate the Title X money to public health departments and hospitals, which leaves no funds for specialty family planning clinics like Planned Parenthood.

The Kansas law limits the entities that can receive funding the state allocates out of federal government subsidies it receives for family planning services to low-income residents.

U.S. District Court J. Thomas Marten blocked enforcement of the state law in 2011, ruling that it unconstitutionally was intended to punish Planned Parenthood for advocating for abortion rights and would likely be overturned. He ordered Kansas to continue funding Planned Parenthood until the case was resolved. He also found the state law violates the U.S. Constitution's supremacy clause, saying states cannot impose additional requirements for entities to qualify for federal programs.

A divided panel of the 10th U.S. Circuit Court of Appeals in Denver overturned Marten's rulings, saying Kansas can halt the funding. Tuesday's decision is not a final ruling on the merits of the case itself, and the appeals court sent the case back to the lower court for further proceedings. Given the split 2-1 ruling and the issues at stake in the litigation, it is also likely that the panel's decision could be appealed to the full court for a rehearing.

Kansas had argued Marten's ruling "emasculates the state of Kansas' autonomy and sovereignty rights" in the Constitution's 11th Amendment. The state contends the law restricting the distribution of federal family planning funds does not target Planned Parenthood because the statute itself does not name the group or even mention abortion.

GOP Coalition For 'Gay Marriage' in Appeals Court

Twenty prominent Republicans, including former U.S. senators Alan Simpson of Wyoming and Nancy Kassebaum of Kansas, are filing a document with the 10th Circuit U.S. Court of Appeals saying that citizens of Utah and Oklahoma had no constitutional basis to define marriage as one man and one woman.  These RINOs go further by arguing that government-sanctioned deviant sexual behavior is good for American society.

The Republican group cited constitutional guarantees of equal protection under the law, proper limits to government's role in citizens' personal lives, and individual freedom, among other reasons.

. . . 17 states plus the District of Columbia recognize same-sex marriage, including eight states where it became legal in 2013.

Utah and Oklahoma would be added to that list if federal court rulings overturning gay marriage bans on constitutional grounds are upheld by the U.S. Appeals Court in Denver. Hearings are slated for April.

Rulings there could render same-sex marriage legal in states within the court's circuit - namely Colorado, Kansas, New Mexico, Oklahoma, Utah and Wyoming, although an opposing decision by the U.S. Supreme Court could bar them.

The brief was the latest sign of widening cracks in Republican opposition to same-sex marriage, even deep in the country’s conservative heartland.

Sean Gallagher, a lawyer and Republican Party activist in Denver who helped prepare the brief, said many Republicans were rethinking their positions. “The themes of liberty and freedom resonate especially well in the West,” said Mr. Gallagher, who was chief counsel in Colorado for Mitt Romney’s presidential campaign in 2012.

In December, a federal court in Utah overturned the state’s amendment restricting marriage to a man and a woman. In January, a federal court in Oklahoma struck down that state’s ban on gay marriage.

In Nevada, the state prevailed in court in 2012 in its defense of marriage restrictions. The gay and lesbian plaintiffs appealed to the Court of Appeals for the Ninth Circuit, in San Francisco, and last month Nevada’s Republican governor, Brian Sandoval, agreed to withdraw from the case, saying that defense of a same-sex marriage ban was not legally tenable.

Arizona's divisive SB1026 -- which supporters claim protected religious freedom, and critics say served as cover for businesses to discriminate against gays and lesbians -- didn't come from nowhere. . . . But from where, or from whom, did the impetus come?

It took time to hash out among both state lawmakers and interest groups. In this case, advocates from the Arizona Center for Policy and Alliance Defending Freedom -- whose website says it "coordinates legal efforts (for) Christian legal and policy organizations" all across the United States and in 31 countries -- were among those who played a part in crafting the legislation.

But from where, or from whom, did the impetus come? And who paid for the Arizona push and similar ones in a host of other states?

. . . state Rep. Sam Teasley (R-Marietta) and state Sen. Joshua McKoon (R-Columbus) [say] their religious liberty bills filed this session . . . have been ripped by critics for targeting gay people, a charge the lawmakers deny.

The Georgia Municipal Association and the Association of County Commissioners of Georgia have also opposed the bills. McKoon said cities and counties have been able to enact rules and policies hostile to religious liberty.

Major companies such as Delta Air Lines have wrongly denounced the bills, Teasley said he believes, because they haven’t bothered to take the time to understand them.

Mike Griffin, lobbyist for the Georgia Baptist Convention, said a conversation is underway among conservative groups about conducting an economic boycott of companies such as Delta and Home Depot for opposing the bills.

Senate President Susan Wagle [R] took the unusual step Thursday night of issuing a statement saying the bill — which has drawn an avalanche of national criticism — didn’t have the support of a majority of Republicans in her chamber.

The Kansas House passed the bill Wednesday, spurring a national outcry that it was tantamount to state-sanctioned discrimination. The critics gained traction on social media, where a Facebook page set up opposing the measure received nearly 40,000 “likes” by late Thursday.

After House Bill 2453 passed the House, Senate Vice President Jeff King (R-Independence) announced that the Senate would not be considering the bill, saying briefly that the bill was "kaput." King went on to assure concerned Kansas residents that religious exemptions regarding same-sex marriage will be addressed next month during Senate hearings.

Those supporting the bill argued in response that although the legislation was vilified as being discriminatory and ultimately killed, it is still necessary for legislators in the state to pursue protection of religious liberty as the possibility of same-sex marriage legalization looms in the future.

When the bill first passed the House Committee, Gov. Sam Brownback said he was a "strong proponent and supporter for religious liberty."

It started innocently enough, according to House Speaker Brian Bosma, R-Indianapolis.

Indiana Wesleyan University, a Christian college with a Merrillville location that hires employees on the basis of religion — as permitted by federal law — wanted to continue receiving state workforce training grants.

So state Rep. Eric Turner, R-Cicero, suggested adding a provision to Senate Bill 367 that would permit religious entities to receive state contracts even if they discriminate in hiring based on religion. The proposal was approved 6-5 Monday by the House Ways and Means Committee.

Faced with the prospect of Indiana being lumped with Arizona on the religious discrimination issue, Bosma sent Senate Bill 367 back to the Ways and Means Committee on Tuesday. The panel deleted the provision allowing state contractors to discriminate in hiring based on religion.

"It's not a productive discussion right now given what's happening in some other states," Bosma said.

The ease of this win came as a surprise of some gay-rights supporters, accustomed to waging years-long guerrilla warfare in states across the country. . . . Marci A. Hamilton, a professor of law at Cordoza Law School who advises lawmakers on Church-State issues, says social conservatives fundamentally misread the public's appetite for such laws. "I don't expect these laws to make it and I don't expect there to be much more on this issue,” Hamilton says. "The window for getting laws to discriminate against gays and lesbians has essentially closed.”

The challenge to the contraception mandate in Sebelius vs. Hobby Lobby, scheduled to be heard by the Supreme Court next month, shares the same rationale as the Arizona law: That for-profit companies and employees should be exempt from laws that conflict with their religious beliefs. "It's really important to connect what's going on in Arizona with the Hobby Lobby case," says Sally Steenland, director of the Faith and Progressive Policy Initiative at the Center for American Progress, a left-leaning think tank. "It's giving religious liberty to for-profit corporations, which has never been done and has no precedent, and allowing them to pick and choose which laws they want to obey."

The argument has been made that since corporations don’t go to heaven or hell, family businesses should not be able to freely exercise religion. This argument is flawed in many ways. It also ignores our own legal history, which is replete with examples where corporate charters have indeed been legal vehicles for the practice of religion.

During the colonial period, those in dissent from the established Anglican Church were able to use existing civil and secular legal entities to create a space to practice their religion in accord with the dictates of their consciences.

In Massachusetts, the colonial Legislature in 1692 approved a law mandating that each town use general taxation to provide for an “able, learned orthodox minister” of the Congregational church. In 1728, the Legislature granted an exemption from taxes to support local Congregational ministers to Baptists and Quakers, but they had to get a special certificate denoting their status from their town clerks.

Christian Girl Muzzled, Sues Kansas City School

A seventh-grade student at Robert Clark Middle School in Bonner Springs, Kansas, a suburb of the Kansas City area, has sued her school in federal court for restricting her free speech rights by forbidding her to give fellow students a flier with Bible verses this past September.
Banned: The distribution of “religious materials…on school grounds or in any attendance facility before, during, or after the school day or a school activity.”

Their policies expressly say no religious materials can be distrusted at school. Well that's a flat ban on religious materials," said Tedesco.

The Alliance Defending Freedom [ADF], a conservative Christian group based in Scottsdale, Arizona, that advocates for religious rights, contends a counselor at Robert E. Clark Middle School in Bonner Springs violated the student's rights to free speech and equal protection by refusing to allow the student to post fliers promoting the Sept. 25 "See You at the Pole" event, a national event in which teens pray around their school flagpoles.

The group contends in the lawsuit filed Nov. 26 in federal court in Kansas City, Kansas, that the counselor told the student the fliers, which contained Bible verses, could not be posted or distributed at school because of their religious content. The ADF, which filed the lawsuit on behalf of the student identified only as "K.R.," also said the district has a policy banning distribution of religious materials on school grounds but allows other types of materials to be posted and distributed.

The district has a policy prohibiting distribution of religious materials on school grounds because "different entities request to distribute information to students constantly. If all entities who requested were allowed it would be disruptive to the school environment," [school superintendent Dan] Brungardt said in an email.

The school has allowed the posting of a variety of materials, including a hand-made poster of a tombstone with the words “RIP” and a poster of rap artist Lil’ Wayne with the words “Good Kush and Alcohol.”

A school counselor confronted the student at a school dance in front of her friends and informed her that the fliers were “illegal” because of the Bible verses and could not be posted or distributed at school.

The Alliance Defending Freedom lawsuit, K.R. v. Unified School District No. 204, filed in the U.S. District Court for the District of Kansas, explains, “Students do not shed their constitutional rights at the schoolhouse gate. Non-disruptive, private student expression is protected by the First Amendment.” Moreover, “the government may not discriminate against speech based on its viewpoint, regardless of the forum.”

The lawsuit also notes that the student’s posting of the material did not “interfere with the orderly conduct of educational activity within the school.”

The lawsuit states other students were permitted to post flyers containing other material. The lawsuit cited one student flyer of a tombstone that read “RIP” and “Here Lies K-STATE … I AM GLAD YOU ARE GONE FOREVER BECAUSE YOU TRY TO BE GOOD AS KU BUT YOUR ARE NOT.” Another example included flyers promoting rap artist Lil’ Wayne with the words “Good Kush and Alcohol.”

The lawsuit also alleges that the Clark Middle School newspaper “The Panther Press” sent home an issue in November with a ‘glowing’ review of “Call of Duty: Ghosts,” an M-rated video game that is “replete with graphic violence, profanity, drug use and nudity.”

Public Prayer OKd by Liberal, Kansas School Board

Initially, the school board had approved an 11-word motion to allow Liberal High School (LHS) students to pray over the public address system before athletic events, but after prominent atheist lawyers threatened, the board then created a legal document to allow students to speak their "pre-game message" of "opinions and philosophies" over the P.A.

School prayer was not on the agenda for Monday's meeting in Liberal, but board member Nick Hatcher brought it up at the last minute, saying he really missed prayer at football games.

. . . after the board's vote, students will again be allowed to initiate prayers over the intercom prior to games.

Superintendent of Schools Paul Larkin warned board members before the vote that they hadn’t considered possible problems.

"We can have student-led prayer, but if we turn away certain groups -- if you have someone who wants to serve up a prayer or a thought that isn’t the mainstream thinking -- you’re going to have a problem,” Larkin said. He suggested they get advice from the school board attorney.

Several years ago, LHS discontinued prayer at events like football games. Administration voiced concern that, by making the P.A. system available for prayers led by students or community members, the district could be perceived as sanctioning or even promoting traditional Christian prayer in violation of federal law. Student-led prayers then moved to the football field itself, prior to the game. However, no microphone or speaker system allowed spectators to hear such prayers. Monday night's vote will permit students to utilize the P.A. system for prayer before football games and all other special activities in the district.

. . . Board member Matt Friederich supported the motion, noting that “we make it a priority to open every board meeting with prayer.”

“We sit up here like hypocrites, and we pray,” said [board member Tammy] Sutherland-Abbott, “but we won’t let our kids do it.”

Sutherland-Abbott said she understood the federal law that prohibits school officials from leading prayer, but that she was tired of allowing the opinions of a few in America dictate what “the rest of us” could do. She made a motion to add the item “Student-Led Prayer” to the evening’s agenda.

From "District replaces prayer with broader definition to meet legal standard" by Rachel Coleman, Leader & Times (Liberal, KS) 10/3/13

In its second special meeting within a week, the Liberal USD 480 school board voted Wednesday to rescind the previously-adopted “Motion to allow student-led prayer at all USD 480 activities,” then replaced it with a narrower and more detailed policy.

Board member Nick Hatcher, who introduced the idea of student-led prayer at the board’s last regular meeting Sept. 23, presented a motion to rescind his sincere but hasty [previously-passed] 11-word motion.

. . . Hatcher followed with a new motion [which passed], crafted to pass muster with legal requirements [referencing a new "Pre-Game Message Procedure" -- excerpts below]:

* On the day of the game, the principal or assistant principal shall randomly select a student’s name from the list of names of students who have signed up to deliver the pre-game message.

* A time shall be set aside (no more than two minutes in length) prior to commencement of the game in which the selected student shall be entitled to deliver on the public address system a message entirely of the student’s choosing, the content of which shall be prepared by the student and not otherwise reviewed by the USD 480 Board of Education or its employees or agents. The subject of the student pre-game message must be related to the purpose of the event, and to the purpose of marking the opening of the game, honoring the occasion, the participants and those in attendance, bringing the audience to order and focusing the audience on the game; provided however, the message shall not contain racist material; threaten or bully any individual or group; incite violence or breach of the peace; contain any vulgarity, obscenity or profanity; or otherwise disturb or disrupt the educational process.
