Fed. Judge Says Atheists Right on New Clergy Tax

U.S. District Judge Barbara Crabb in Wisconsin ruled in favor of the Freedom From Religion Foundation saying that clergy cannot be exempt from paying income taxes on charitable money used to pay for their housing.  If the Obama administration does not appeal the ruling, the federal government will gain billions of dollars in tax revenue via a fleecing of church leaders.

The Madison-based Freedom From Religion Foundation filed the lawsuit against U.S. Treasury Secretary Jacob Lew and acting IRS commissioner Daniel Werfel. Treasury Department spokeswoman Victoria Esser and IRS spokesman Grant Williams referred questions Saturday to the Department of Justice, which is representing Lew and Werfel. A spokeswoman for the Justice Department did not immediately respond to an email seeking comment Saturday.

Under the law, passed by Congress in 1954, ministers don’t pay income taxes on compensation that is designated part of a housing allowance. The Freedom From Religion Foundation says that a clergy member to use the untaxed income to purchase a home, and then, in a practice known as “double dipping,” deduct interest paid on the mortgage and property taxes.

In her ruling, Crabb referenced a 2002 statement by then-U.S. Rep. Jim Ramstad of Minnesota that said the exemption would save clergy members $2.3 billion in taxes from 2002-2007. Crabb said the magnitude of the benefit only underscores what’s wrong with the law.

In her ruling, the judge wrote that the exemption "provides a benefit to religious persons and no one else, even though doing so is not necessary to alleviate a special burden on religious exercise," as quoted by the Wisconsin State Journal.

"We have seen many courts over the years attempt to banish God in various ways from the public square, but this case in particular reveals a level of supreme arrogance," [Family Research Council President Tony] Perkins said in a statement. "Once again, Judge Crabb has neglected to consult the Constitution that she was sworn to uphold."

Society has long provided this tax housing allowance to clergy because of the tremendous benefit that churches in turn give to society, Perkins explained. "Clergy help carry the burden of many social ills that would otherwise become the burden of taxpayers and the federal government."

Perkins pointed out that the same judge had struck down the National Day of Prayer as unconstitutional.

. . . Why exactly do ministers receive a tax exemption for their housing allowance?

Since at least the time when Joseph served in Pharaoh's Egypt, religious property has been exempt from certain forms of taxation (Genesis 47:26). The practice continued in the Roman Empire and through medieval Europe and was part of the common law, which America adopted from England. The common law granted tax exemptions to established churches and, through the equity law tradition, to all churches. From the 15th century to the 19th century, most pastors lived in the parsonage, a house provided by the church. Housing was thus a form of non-cash payment that was exempt from taxation since the parsonage was church property.

By the early 20th century, though, both clergy housing and taxation had changed considerably. So in 1921, Congress passed the Revenue Act, which exempted from the gross income of ministers the rental value of any "dwelling house and appurtenances thereof" provided by a church as part of clergy compensation. This parsonage exemption, however, applied only to ministers who lived on property owned by their church and disadvantaged ministers whose churches provided a housing allowance rather than a church-owned parsonage.

In 1954, Congress amended the tax code to allow ministers to exempt a portion of their income to the extent used by the minister for housing. According to the Senate Report at the time, the purpose of this addition was to eliminate the disparity in the tax code between ministers who lived in a church-owned parsonage and those who were given a stipend with which to secure housing.

Even as disease control authorities recognize a new strain of HIV that leads to AIDS in record brief time, there has yet to be issued a definitive statement that the most effective means of stopping the pandemic is abstinence from anal sex -- principally deviant male homosexual sex.

The A3/02 strain combines the two most common HIV strains in Guinea-Bissau and develops into AIDS within five years, up to two-and-a-half years faster than either of its parent strains, said Angelica Palm, one of the scientists behind the study published in the Journal of Infectious Diseases. This type of strain, a recombinant, appears when a person becomes infected by two different strains, allowing DNA to fuse and create a new one.

Researchers from [Sweden's] Lund University warn in the study that recombinant strains may spread more rapidly, in part from immigration to the United State or Europe, and that there are likely many more that still haven’t been identified.

More Sex for Women Than Men; Lesbian Sex on Rise

A new study from the London School of Hygiene and Tropical Medicine, shows the ravages of the sexual revolution typical on both sides of the Atlantic: The average number of sexual partners for women has doubled, whereas for men the average is up by one-third, yet twice as many women as men dislike having sex. More women are getting sexually transmitted infections. Women are choosing homosexual behavior at four times the rate of just two decades ago, and in general, any and all behaviors beyond conventional sexual intercourse is increasing.

Women have caught up with men in the sexual revolution - and have even overtaken them in the case of same-sex relationships - but they are still the ones who pay the biggest price in terms of sexually transmitted infections and unplanned pregnancies, the national sex survey has found.

Four times as many women now report same-sex experiences with other women compared to 20 years ago. They are also starting to have sex earlier in the lives and are having more sexual partners over their lifetime than a generation ago, according to the National Survey of Sexual Attitudes and Lifestyles, published in The Lancet.

The four-fold increase in sexual activity between women - which does not necessarily include genital contact - is one of the most dramatic shifts in behaviour identified by the survey, which was carried out between 2010 and 2012 and involved detailed interviews with more than 15,000 adults aged between 16 and 74 about their sexual behaviour and attitudes.

On average, the number of sexual partners reported by women has doubled, from four to eight, whereas the number for men rose from nine to 12. The research also found an increasing sexual repertoire among both genders, with higher levels of anal and oral sex reported.

“It reflects a shift away from sex being seen purely in the context of reproduction toward a greater emphasis on pleasure and recreation,” said Kaye Wellings, head of social and environmental health research at the London School of Hygiene and Tropical Medicine, one of the leaders of the research. She said similar results about changes in women’s sex lives have been found in France.

Other scientists said the findings supported previous research that have found sexual orientation for women tends to be more fluid than for men.

These are the groups who are generally in the vanguard of social trends. In seeking diversity through sex with men and with women, for example, women may be exercising lifestyle choices. The study findings show that fewer women than men self-identify as gay, and more see themselves as bi-sexual.

The proportion of study participants who tell the researchers they don't enjoy sex is small, but it is twice as high among women as men. Women are more likely to get a sexually transmitted infection. And they are far more likely to have experienced sex against their will - one in ten women, compared with one in 70 men.

[It used to be that] the imperative was not to have sex, at least not until you were married, and unless your partner was of the opposite sex, and sex was likely to lead to babies.

Now, if the pages of the internet and lifestyle magazines are a guide, that imperative has reversed. The advice in many is how to have more and better sex, in different ways. This is all to the good.

She has been an abortion rights advocate for decades and owned clinics since 1996, but Derzis is facing some of the biggest political and legal pressure she has ever seen. She spars with pastors and politicians alike, and her latest fight is to keep open her Mississippi clinic, the last one remaining in the state.

In addition to the facility in Jackson, Derzis owns a clinic in Columbus, Ga., and one in Richmond, Va.

Derzis agreed to close [her Birmingham, Alabama] clinic in 2012 after the state Health Department found numerous health violations, including allowing unlicensed workers to administer medications. A physician then ran a clinic in the building, but a judge closed it in August because the facility wasn’t licensed for abortions.

Derzis talks openly about the abortion she had when she was 20, newly married and in college. She said didn’t want children, and knew immediately she wanted to end the pregnancy. Derzis said her mother told her she’d regret it, but she hasn’t. She said she was about 12 weeks along when she had the procedure, and the doctor was gruff and disrespectful.

“I thank God every day I had that abortion,” said Derzis, who later divorced and doesn’t have children. “It was not a great experience, but you know what? I had a safe abortion. And that’s what counts.”

. . . abortion opponents rallied on the front steps of the Mississippi Capitol. Operation Rescue America leader Flip Benham preached to a crowd of about 20 supporters, most of whom had come to Jackson from different corners of the country.

Monday's protest came three days after JWHO and Wake Up Mississippi, a pro-abortion-rights political organization, began hosting "This Clinic is a Refuge," a week-long event to rally support for the clinic. Supporters held a women's rights poetry slam at Soul Wired Cafe Friday night and rallied Saturday outside the clinic and in front of the Governor's mansion.

In spring 2012, lawmakers threatened JWHO and its owner, Diane Derzis, with closure when they passed a bill requiring doctors performing abortions to have admitting privileges, which the physicians have tried and failed to get multiple times in the past.

Federal Judge Daniel P. Jordan initially blocked the law, then reversed course and allowed it with one stipulation—the clinic would be permitted to continue operations while its physicians continued to try to secure admitting privileges.

Homosexual Predator, Honored by Obama, Arrested

Teenager Caleb Michael Laieski, an advisor to the mayor of Phoenix in his advocacy of "gay rights," has been indicted for 13 counts of felony sex crimes with a 14-year-old boy.  Laieski, who was honored at a White House "gay pride" event for his anti-bullying advocacy, was himself the victim of a 43-year-old openly homosexual Phoenix police detective who was arrested in August 2012 for sex crimes against boys.
"As you know, Phoenix is ranked as one of the very best cities in the country in terms of LGBT friendliness. I think it's great for business, and we're very proud of that."

"It would be inappropriate for our office to comment on what is an ongoing and very serious criminal matter," the statement [from the Mayor's office] read. "The victims in this case deserve justice, and we have full confidence that the legal system will handle it in an appropriate manner."

Laieski gained national attention in 2011 when he appeared in a documentary about bullying and discussed issues involving gay youth with both President Barack Obama and Vice President Joe Biden.

Laieski has pleaded not guilty. His attorney, Cary Lackey, said Laieski and the other boy were in fact the underage victims of a Phoenix police officer.

Former officer Chris J. Wilson was indicted last year on 10 counts of sexual conduct with a minor stemming from allegations he performed sex acts on a 14-year-old and a 17-year-old and participated in a sexual act with the two together at the older boy’s apartment, according to court documents.

In court filings, Laieski says the charges against him arise from a “consensual relationship he had with a 14-year-old when he himself was 16-years-old, or at most, 17-years-old.”

Under state law, a minor who engages in intercourse or oral sex with another minor 14 or younger can be found guilty of a sex crime. Children under age 15 cannot legally consent to sexual activity, even if their partner is also a minor.

Wilson was politically connected, and as explained in a December 2012 New Times story by Monica Alonzo, Wilson's supervisor, Phoenix police Sergeant Mark Schweikert, alleged that Phoenix Councilman Tom Simplot and Assistant Police Chief Tracy Montgomery -- who are both openly gay -- were "influencing" how he supervised Wilson.

The 14-year-old boy, who's also emerged as a prominent young activist against anti-gay bullying, had told his parents about his alleged relationships with Laieski and Wilson, and his parents relayed that information to police.

Caleb Laieski, now 18, was 17 at the time of the alleged abuse. His alleged victim, a close friend he met on TrevorSpace (a social media site for children and young adults aged 13-24 who have an interest in homosexuality), was only 14 at the time. The younger boy said the sex was consensual, but that he felt “pressured” to participate. However, Arizona law says no one younger than 15 is capable of giving consent.

Laieski rose to national prominence after he and a 35-year-old friend, Casey Cameron, sent e-mails to 5,000 Arizona schools in 2011 demanding special protections for gay students and threatening legal action if they failed to bring their policies in line with his demands. The teen then dropped out of high school, got his GED, and traveled to Washington, D.C., to lobby for the Student Non-Discrimination Act.

In 2012, Laieski was given a position in Mayor Stanton’s office as a “youth and diversity liaison,” advising the mayor on matters of policy having to do with youth, particularly gay youth. He was an “advocate on loan,” meaning his salary was funded by an outside group, called “One in Ten.”

According to police records, part of his job was to represent the mayor’s office at local homosexual protests, which is how he got to know Wilson, who was usually assigned as the officer in charge of policing such events.

On Bayard Rustin’s website, his lover and the executor of his estate, Walter Naegle, wrote about the gay activist’s life, including his 10-year homosexual relationship with the author and his national chairmanship of the Social Democrats USA, formerly the Socialist Party of America.

According to an Aug. 29 interview with Naegle on thegrio.com, the two men met in Times Square in 1977 when Naegle was 27 and Rustin was 65. According to Naegle, Rustin legally adopted him as a son, because they could not be married.

"Sally Ride, who died on Monday, can help put a face to a national problem. She was the first American woman and the youngest American ever to travel in space-the kind of accomplishment that automatically gets you the label of "inspiration for generations of young Americans" and an obit in the Times," said a blog in the New York Times when Ride died last year. "What's less well known is that Ms. Ride was gay. Family and friends were aware of her 27-year relationship with Tam O'Shaughnessy, but the wider public was not."

“As an advocate of birth control, I wish to take advantage of the present opportunity to point out that the unbalance between the birth rate of the ‘unfit’ and the ‘fit,’ admittedly the greatest present menace to civilization, can never be rectified by the inauguration of a cradle competition between these two classes,” Sanger wrote in an article entitled "The Eugenic Value of Birth Control Propaganda," which appeared in the October 1921 edition of Birth Control Review.

As one of the architects of the abortion holocaust, Steinem summed up her philosophy in a 2005 New York Observer interview.  The 71-year-old was asked what her advice to young women in the 21st century would be.  She replied, "To do whatever they f---ing well please."

No one should underestimate Steinem's part in the murder of 55 million babies and counting.  Her mainstream good looks, media savvy, and Smith College degree landed her on talk shows, lecture circuits and magazines in the 1960s -- something the dowdy, militant-looking Shulasmith Firestone, leader of the Redstockings, could only dream about.  Steinem looked all-American, making her message more palatable to the masses.

Like Barack Obama, Gloria Steinem rejects the notion that all life is sacred.  She set out to kill the maternal conscience by persuading women that killing their babies was nothing, and he legislated the attack on mothers and children to the fullest extent possible.  She laid the groundwork; Obama brought it home.

When the atheist advocacy organization Military Religious Freedom Foundation and myriad homosexualists learned that Dr. Michael Rosebush, a Christian who believes that homosexual behavior is sinful and that faith in Jesus Christ redeems us from sin, has been employed at the Air Force Academy since 2009, they joined in a chorus calling for his termination.

Mike Rosebush, who now works as a research analyst for the academy's Center of Character and Leadership Development, was hired by the academy in 2009, before the military's "don't ask, don't tell" law was repealed.

The same year, he published "Sanctification Coaching: Sexual Purity and Peace for Christian Men with Same-Sex Attractions." The book advocates using Christian teachings and prayer to overcome "wicked desires" like homosexual urges, and charts Rosebush's own "struggles" to turn away from a gay lifestyle.

Before that, Rosebush was an active leader and speaker at numerous "conversion therapy" organizations, which maintain that same-sex urges can be overcome through discipline and prayer.

Rosebush has actually spent a good share of his career at the academy. After graduating from there in 1975, he taught a core psychology course on campus from 1982 to 1985, the academy says via email. In 1989, he completed a doctorate in counseling psychology from the University of North Carolina, which included a dissertation titled, "Behavioral observation scale for a subordinate appraisal of supervisory performance at the U.S. Air Force Academy."

He then returned to the academy from 1988 to 1992, teaching courses on leadership and marriage and family. He was named an "outstanding instructor" during that time, the academy reports.

In 1990, he became a Licensed Professional Counselor in Colorado; he would often practice over the phone. In 1995, he retired from the military and joined Focus on the Family, the Colorado Springs-based Christian organization notorious for LGBT intolerance.

During 10 years there, he was a vice president and directed a college program in the Focus on the Family Institute, according to biographies issued by the National Association for Research and Therapy of Homosexuals (NARTH) and the website strengthinweakness.org.

During that period, Rosebush worked in the academy’s directorate of education and taught a course on marriage and family and a behavioral science core leadership course, and he won an outstanding instructor award, the academy said.

He also was named the Cadet Wing “civilian of the year” by the commandant of cadets in 2011.

The link between casual sex and mental health was found to be the same for both men and women according to the study published in the Journal of Sex Research.

Dr Claire Kamp Dush, professor of human sciences at Ohio State University, said: "That was unexpected because there is still this sexual double standard in society that says it is OK for men to have casual sexual relationships, but it is not OK for women.

Researchers found that each additional casual sexual relationship increased the odds of suicidal thoughts by 18 percent.

They were surveyed about their romantic relationship experiences as well as depressive symptoms and thoughts of suicide. Casual sexual relationships were reported by 29 percent of the teens interviewed. "Casual sex" was defined in the study as having sex with a partner that one was not "dating."

Kamp Dush also believes that casual sexual relationships may hurt the ability of young adults to develop committed relationships at an important time in their development. She also believes that researchers need to look closely at other measures of mental health.

Obama Strips God from Lincoln's Gettysburg Address

President Obama was the only one to omit the words "under God" among the 61 politicians, former presidents and celebrities who recited the Gettysburg Address for a new Ken Burns PBS documentary (click for a 57-second audio montage). After a media brouhaha, the White House is now blaming, the very-liberal, Burns for giving President Obama Abraham Lincoln's first draft to read, which omits the words -- the other 60 were apparently given the correct version.

Included in the other sixty, who read "under God," were:  Liberal TV pundits Rachel Maddow (MSNBC Host), Wolf Blitzer (CNN Journalist), Arianna Huffington (Entrepreneur), David Gregory (NBC Journalist), Gwen Ifill (PBS Journalist), Nina Totenberg (NPR Journalist), Bob Schieffer (CBS Journalist); and liberal politicians Bill Clinton (Former President), Jimmy Carter (Former President), Mario Cuomo (Former Governor of New York), Gabby Giffords (Former Congresswoman), Tim Kaine (Senator), Chuck Schumer (Senator), Debbie Wasserman Schultz (Congresswoman), Nancy Pelosi (House Minority Leader); as well as liberal comedians Stephen Colbert, Jimmy Kimmel, Conan O'Brien, and Whoopi Goldberg.

Civil War historians say religion was central to President Lincoln's original address. Dr. Allen Guelzo of Gettysburg College told Albert Mohler that, for President Lincoln, “Gettysburg is almost a religious experience. It’s almost like a revival meeting where citizens come together and experience being born again in the new religion of American democracy.”

The practice of eliding references to God from America's Founding documents has become a habit for President Obama, who has dropped the word “Creator” or other references to God from the Declaration of Independence on numerous occasions. He is believed to be the first president to issue a Thanksgiving address without mentioning God. He has often skipped writing an Easter proclamation altogether.

Christian Businesses Must Employ Atheists: Judge

A judge has ruled that Tyler Stille, a small grocery store owner in Tabor, Iowa, harassed former employee Sherri Chafin by criticizing her for lying about her cohabitation in order to get government assistance benefits and by recommending specific Bible readings. Although Chafin accepted the job knowing it is a Christian-based business, she now admits that she's never believed in the Bible or churches in general, and is currently employed at Romantix (a sex shop).

On the other hand, it's just fine when President Obama's DOJ Forces Employees to Celebrate Sexual Deviancy (the religion of the Gay Agenda)

However, a recent U.S. Supreme Court ruling against President Obama's EEOC gives some hope for Christian businesses.

Sherri Chafin said she quit in January 2012 after Stille preached to her about the wisdom of King Solomon and questioned her lifestyle. She filed for unemployment pay.

"He told me that I should read one psalm, or one chapter, per day, something like that," Chafin testified at an unemployment hearing.

"He asked me if I was receiving food stamps, or any welfare, or anything like that. He told me that if I was, it was unjust because I worked and I lived with my roommate — who is my boyfriend and we're not married," Chafin testified. "He was very intimidating."

Stille said his employees all knew before they were hired that faith is an integral part of his business.

The case centered on a question that often divides civil libertarians and people of faith: Do business owners have the right to advocate for their religious beliefs in discussions with employees?

The Civil Rights Act of 1964 provides that workers cannot be forced to participate in religious activity as a condition of employment at a typical, non-faith-based business. The courts have held that business owners are free to share with workers their own religious beliefs, but also said that unwanted proselytizing is a form of religious harassment.

Stille said he complimented Chafin on her work ethic, calling her a "workhorse," and said his final meeting with her was prompted by Chafin making an inappropriate remark to a customer. He said he began the meeting by asking his wife for a Bible because it was his intent to read Chafin some proverbs.

Stille said that although he had previously questioned Chafin about her faith and her reliance on food stamps, there was little or no discussion along those lines the day she quit.

Store owner Tyler Stille says it’s clear his faith is an important part of his business. A Christian fish symbol is part of the store’s sign, the store plays Christian music “all the time” and he tells interviewees about his faith.

[Julie Elder,] administrative law judge (ALJ) sided with Chafin, saying that Stille’s conduct was “inapproriate, unacceptable and unprofessional,” at best. The ALJ also said Stille had created an intolerable work environment.

Atheists' Lawsuits Force Jesus Out of Ohio Schools

Shortly after a federal judge ruled against the Jackson City (Ohio) School District for displaying a portrait of Jesus Christ (ruling in favor of the American Civil Liberties Union of Ohio and the Wisconsin-based Freedom from Religion Foundation), the East Muskingum, Ohio school board voted unanimously to remove a portrait of Jesus in response to an ultimatum by the ACLU. The atheists' action was in response to a student complaint that the school didn't endorse the Gay Agenda.

The board decided to leave the empty frame hanging in place, along with its 1971 dedication plaque in memorial of former teacher Margaret Barnett.  It is not known if the school asked any Christian organizations to provide pro bono legal defense.

The consent decree approved by U.S. District Judge Algernon Marbley mandates the permanent removal of the portrait from [Jackson City] school grounds. A financial settlement that's part of the agreement also requires the school to pay the plaintiffs a combination of damages and legal fees totaling $95,000.

Of that total, $15,000 will be divided equally between the five [parents/students], and $80,000 will be paid to the attorneys.

About a month before the lawsuit was filed in the federal court in Columbus, Ohio, Rebecca Markert, a staff attorney with the Freedom from Religion Foundation wrote a letter of complaint to the district on behalf of parents with students in the school.

James Hardiman of the Ohio ACLU then filed the suit, claiming the display of the portrait violated the Establishment Clause of the First Amendment, the 14th Amendment, and also the Constitution of the State of Ohio.

A meeting was held Thursday evening in regards to a picture of Jesus hanging at John Glenn High School [in East Muskingum].

The picture in question depicts a shepherd herding his flock. The painting was donated more than 40 years ago as a memorial for Margaret Barnett, a beloved teacher. After receiving a complaint from a student, the picture was called into question by the American Civil Liberties Union.

"You have one ..It's just like one apple ruins the whole bushel type of thing. One person didn't get their point of view across, which you're in kind of an immature status just because you are in high school and you're going to have the high school drama, " said 2006 John Glenn Graduate, Steven Ball.

About 400 people turned out for the board meeting, including local pastors and church groups, residents and former students and officials

There were 18 speakers who took the podium favoring keeping the painting of “The Good Shepherd” . . .

Rix Mills Presbyterian Pastor Jim Gibson previously had offered to place the picture in the church, which Margaret Bennett attended.

Local resident Tom Hayes said he recalls when the picture used to hang in the main hallway of the school, rather than out of the public’s view in the school office.

. . . the board's position read in part: "It is not a responsible and wise use of the funds dedicated to the current and future students of the East Muskingum Schools to expend those funds on litigation that is not likely to succeed."

The ACLU became aware of the painting at issue after a student who became upset about the removal of a T-shirt from a display. The T-shirt, modified in an art class, carried a slogan that read, "Gay is OK."

The T-shirt reportedly was removed after a parent had complained and the administration deemed the display of the shirt disruptive of the learning environment at the school. However, students apparently were allowed to wear the shirt to school subsequent to its removal from the display.

Nevertheless, the situation escalated and the focus shifted from the shirt to the painting. The objecting student said she would file a lawsuit if it were not removed because its presence violated her religious freedom.

Allison Whaley, an 18-year-old senior at John Glenn High School in New Concord, about 70 miles east of Columbus, said she was frustrated by what she sees as her community’s lack of tolerance.

“I’m trying to break down barriers and instill a tolerance for other lifestyles, for other cultures and religions,” she said.

East Muskingum school district Superintendent Jill Johnson said art students were assigned to research several social topics and create T-shirt designs that exemplified their feelings about the topic. The designs were displayed in a case near the high school’s front entrance.

Two of the designs — “Gay is Okay” and another that said “Right to Life” — “became hot topics throughout the rest of the school,” Johnson said. “There were comments made and side conversations overheard. The decision was made to remove the T-shirts as disruptive to the educational process.” Two students were sent to the office for arguing about them.
