Minn. School Sued: OKs Boy Flashing in Girls Room

Several families have filed a federal lawsuit against numerous Obama administration officials and the Virginia (Minnesota) School District for permitting a sexually confused boy to confront half-naked girls in their locker rooms.  After the girls and their parents complained, the school suggested they use a private room, but the boy follows them there repeatedly and harasses them by raising his dress and otherwise exposing himself.

"No student should be forced to use private facilities at school, like locker rooms and restrooms, with students of the opposite sex. No government agency should hold hostage important education funding to advance an unlawful agenda."

Alliance Defending Freedom [ADF] is fighting a Virginia, Minnesota school district. The conservative group filed a lawsuit on the behalf of 11 families who want to stop the allowance of the opposite sex in their children’s locker rooms, Fox News reports. The lawsuit named Attorney General Loretta Lynch, Virginia School District #706, and Secretary of Education John King Jr. as defendants.

The lawsuit filed said that a transgender student, only identified as Student X, used the female locker rooms and restrooms and participated on girl athletic teams. The ADF said that Student X violated some girls by twerking in their presence, dancing to suggestive songs, and making jokes about a girl’s bra size.

According to the lawsuit, girls who were uncomfortable with Student X were told they could use another locker room. One student, called Plaintiff A, said that she was told she could change in an empty boy’s locker room but Student X followed her in there. Plaintiff A said there was nowhere to go for privacy.

The ADF lawsuit explains that the [federal] DOE and DOJ are unlawfully redefining the terms of Title IX, something that only Congress can alter, and are illegitimately forcing their political will on all public schools across the nation. As the lawsuit points out, no federal law requires schools to allow boys into girls’ locker rooms or girls into boys’ locker rooms, and other courts have rejected the agencies’ interpretation to the contrary. The lawsuit also explains that the DOE did not comply with key provisions of the Administrative Procedure Act when it adopted its rules.

The complaint explains some of the real concerns of students and parents, such as when a biologically male student who identifies as a female—and who is allowed to enter the girls’ locker room under the district’s policy—went on to dance in the locker room “in a sexually explicit manner—‘twerking,’ ‘grinding’ and dancing like he was on a ‘stripper pole’ to songs with explicit lyrics, including ‘Milkshake’ by Kelis. On another occasion, a female student saw the male student lift his dress to reveal his underwear while ‘grinding’ to the music.”

"What these girls are asking for is something that for all of American history has been the common-sense presumption, that you have facilities for girls, facilities for boys and any student that is uncomfortable with that — including the transgender student at the heart of this case, (who) they're not uncompassionate to — they would think the best thing would be for this student to have the option to use the ... restroom of (the student's) biological sex or to make one of the single-stall restrooms available for (the student) to use," said Matt Sharp, an attorney with the Arizona-based Alliance Defending Freedom, a religious legal advocacy nonprofit group.

The lawsuit seeks to have the district's policy and the federal guidance declared unlawful, and a permanent injunction issued against both. It also seeks "an award of nominal damages in the amount of one dollar, and compensatory damages" for each plaintiff, along with legal fees.

Virginia Superintendent Noel Schmidt declined to comment Thursday, and the school district's attorney, John Colosimo, couldn't be reached for comment.

America's schools are churning out sluts in droves.

Police in Duxbury, Massachusetts are investigating to determine how exposés of over fifty girls attending Duxbury High School in the Boston suburb were posted to the Internet photo site DropBox.  Authorities say that the girls, all identified by name in the postings, are simply innocent minors who eagerly took "embarrassing photos" of themselves or encouraged others to photograph them in "varying stages of undress."

Police were alerted to the Dopbox page on Wednesday by officials at Duxbury High School. Authorities worked with the Internet site to have the photos removed.

Duxbury Police Chief Matthew Clancy says some of the images were taken by friends or the subjects themselves. Others appeared to be fakes.

He says police were conducting interviews at the high school, but did not expect to charge any of the students there.

[DropBox, the] San Francisco-headquartered company could take weeks to turn over data that could help investigators trace who started the Dropbox page and who used it to post or share the photos, Duxbury police Chief Matthew M. Clancy said, adding that search warrants of those people are likely to follow.

“It’s a very sensitive, private and embarrassing matter,” the chief said. “In most cases, these are selfies that were sent to a boyfriend. That’s a crime in Massachusetts, but we’re not treating it as one in the case of these girls. We want them to learn from this.

“We’re clearly identifying these girls as victims because that’s what they are,” said Clancy, who declined to say how many there are.

Both Duxbury Schools Superintendent Benedict Tantillo and high school Principal Blake A. Dalton did not return repeated calls yesterday. But Clancy said police will join school officials as needed to warn students about the dangers and the consequences of sharing nude photos of themselves or others.

[Chief Clancy] said police are investigating to determine who created and contributed to the site.

He or she could be looking at a decade-long prison sentence.

That's because even if the images originated as "sexts" and were shared willingly with a teenage boyfriend or girlfriend, they are still considered child pornography if the subject is under 18. That means that even before they made it on the website, the images were technically illegally shared if they were texted or emailed.

A conviction on a charge of distributing child pornography in Massachusetts carries a minimum sentence of 10 years in prison and a maximum of 20 years.

The book in question, titled “It’s Perfectly Normal,” touts itself as a children’s book for ages 10 and up, that talks all about changing bodies, sex and sexual health.

Inside of the book are illustrations about all of those things, including pages of naked teens and adults, some depicting sex acts and even masturbation.

Officials with the Rainier School District noted the title is on the state approved list of books allowed at the school, but in a letter sent home to parents Thursday, the school’s principal admits they were inappropriately passed out to 4th graders in the library recently.

Darren Vaughn, who has a fifth-grade son at the school, said he learned from his neighbors that librarian Alison Dale-Moore had told several kids to look at the books. Vaughn, 43, of Rainier said his son later told him that the librarian had told several of his friends to take the books.

Vaughn said the books — including “It’s Perfectly Normal” and “It’s Not a Stork” — are “very graphic and explicit” for 10-year-olds. He said the books contain images of masturbation, condom usage, sexual intercourse and self examination.

“For example, “It’s Perfectly Normal” has a young female person bending over with a full view of her backside examining herself with a mirror,” he said. “There’s a young boy on a bed who is masturbating. It gets worse from there.”

[Vaughn] said several board members were in the dark about the books, despite the complaints being reported to Superintendent Michael Carter at the end of March.

Toilets NOT in Restrooms: Next for Transgender

Cooper Union for the Advancement of Science and Art in New York City is the first college in the nation to designate all restrooms as "genderless" by replacing men/women signage with a simple designation of the type of toilet fixtures found inside (toilets, urinals, partitions, etc.).

What's next?  Because privacy has been deemed unnecessary, doors should simply be removed so that the type of fixtures and partitions may be viewed prior to entry, but even better, for safety (to counteract sexual predators), architects' new designs should place toilets and urinals in open spaces — along hallways, for example.

Bill Mea, acting president of the Cooper Union, informed his campus via email that soon all the college's bathrooms will be gender neutral. Anyone will be allowed to use any bathroom, and the signs designating bathrooms for either men or women will be replaced with signs that say either “Restroom With Urinals and Stalls,” “Restroom With Only Stalls” or “Restroom Single Occupancy.”

. . . many colleges and universities around the country have been slowly expanding support for transgender students by adding gender-neutral, single-stall bathrooms around campus or simply allowing people to use the bathroom that aligns with the gender identity. But Cooper Union appears to be the first college to completely eliminate gender distinctions in bathrooms.

The policy change arose out of a yearslong push by student activists for reform and an impromptu on-campus test of the policy. Several transgender students at Cooper Union began fighting for “degendered” campus bathrooms about two years ago and were joined along the way by up to 50 more students and others who helped in various ways. Last fall, some of them removed the signs from bathrooms in a building on campus and left in their place banners reading just “Bathroom :)” or “Degendered.”

. . . Cooper Union’s decision was not the product of a bruising legal battle or a drawn-out showdown before the media. And although it took nearly two years of urging by the student activists for the administration to act, the campus of 950 engineering and arts students doesn’t exactly feel battle-scarred.

“Cooper Union has always been on the forward edge of social justice issues,” [Acting President Bill] Mea said in a recent interview. “From the start, in 1859, we admitted women, African Americans. It has always been an institution that promoted equality amongst people.

“I never got any overt bigotry or nastiness,” he added. “Some would have preferred to keep things exactly as they were. But the majority of them were very supportive. People thought, ‘Why is this an issue at all?’ As in, why aren’t we already doing this?”

“When there’s a gendered space, there’s a sense of ownership to that space,” Mea said, explaining why the school chose to remove the men’s and women’s signs altogether. “When people see someone who they think doesn’t belong there, it can create stress for everyone. So we thought, let’s just take that away.” Almost all students and faculty are continuing to use the same bathrooms without issue, Mea added. “Visitors are figuring it out pretty quickly, too.”

I thank our students who raised the issue of gendered spaces and how they create health concerns and make some of us feel unsafe in an environment where health and safety are the top priorities in a student’s ability to learn. As is often the case, our students are at the forefront of raising both concerns and our consciousness on matters of importance. . . .

We, who are in positions of power, have the obligation to not only stand with those without power, but to stand in front of them, clearing a path for them to walk. I cannot change the outside world and how it treats transgender and gender non-conforming people, but I can change the Cooper Union environment to help everyone feel safe when they are inside our buildings. Please know that my decision comes from a personal sense of obligation to others, which is a reflection of my beliefs and, I believe, an extension of the beliefs held by our founder.

Going forward, we will identify the restrooms in the Foundation Building and 41 Cooper Square and the common-area restrooms in the Residence Hall as follows:

    Restroom with Urinals and Stalls
    Restroom with Only Stalls
    Restroom Single Occupancy

We are creatures of habit and most of us will continue using those restrooms that we normally have used, but they will no longer be owned by a specific gender. I also ask that none of us practice gender policing, where we attempt to restrict someone from using the same restroom we are using or make them feel uncomfortable for doing so. If you feel uncomfortable sharing a restroom, then the single-occupancy restrooms will now be available to you. As with all changes, this will take a little time to implement, so please be patient as we work through the signage and lock (single-occupancy restrooms) changes.

NJ Parents Reject School's New Transgender Policy

Unlike the parents in several New Jersey school districts which recently enacted the Gay/Transgender Agenda open-bathroom policies, parents of the Pascack Valley Regional High School District are not standing still for a policy that allows students to hide an alternative "gender identity" from their own parents, and also requires the school to accept every child's sexual whim.

The Board of Education believes the responsibility for determining a student's gender identity rests with the student . . . Therefore, the Board will accept a student's assertion of his or her gender identity when there is consistent and uniform assertion of the gender identity, or any other evidence that the gender identity is sincerely held as a part of the student’s core identity. The Board of Education will not question or disregard the assertion of a student’s gender identity.
The Board also recognized a transgender student’s right to privacy, and therefore, if a student represents that his/her parent(s)/guardian(s) is unaware of the student’s gender identity, the school and district staff must obtain consent from the student prior to communicating with his/her parent(s)/guardian(s) regarding the student’s transgender status.

A crowd of more than 100 people debated the issue Tuesday night at Pascack Hills High School [in Montvale, NJ].

The policy would prohibit discrimination based on gender identity and sexual orientation, allow transgender students to participate in physical education classes and sports, as well as provide access to restrooms and locker rooms based on their gender identity.

Pascack Valley school officials plan to introduce the policy next week and vote on it the following week.

A new proposal by the Pascack Valley Board of Education would permit district students to use locker rooms and restrooms based on their gender identity and require staff to address students by the name and gender pronoun a student identifies with.

A student would be permitted to take physical education classes "consistent with their gender identity."

A student's records, including grade books and their permanent record, would be required to reflect the gender as well. Official student records would be changed if a parent documents a legal change of a student's name or gender.

Theresa Jordan, a Hillsdale resident and mother of a Pascack Valley High School student, said her objections over the issue of restroom use were centered on her religious beliefs, adding that she was “looking out for the rights of my daughter not to be exposed to something I don't want her to be exposed to.”

Pascack Valley temporarily tabled the proposal last month after parents at a Feb. 22 Board of Education meeting opposed it, with one woman questioning whether it opened the door to “sexual immorality.” . . .

The Pascack Valley proposal is similar to model school policies that have been circulating around the state. In North Jersey, North Arlington, Carlstadt, East Rutherford and Mahwah have adopted such policies. The North Arlington policy, approved earlier this year, uses the same language as the one in Pascack Valley. Last month, Toms River school officials put a similar proposal on hold after it met with opposition from parents and local religious leaders.

At the meeting, held at Pascack Valley High School, Hillsdale resident Bernadette Orso, a mother of a teenage son, called that part of the policy an "invasion of privacy" and not "proper or respectful."

Sherry Silk, a Montvale resident, agreed. In the instance of an anatomical boy identifying as a girl, she said it may "open a door" for "sexual immorality."

Carolee Adams, another Montvale resident, concurred, telling the board to postpone the vote and that the policy needs "further investigation and time."

While the board moved to table the policy after much public outcry, Board President Jeffrey Steinfeld told parents that the district's two principals, as well as the board attorney, told the board that they should have the policy in place, for one to avoid litigation. Board Member Arnold Scher was opposed to tabling the policy.

[Steinfeld] added that the policy committee reviewed the policy and a "tremendous amount of thought" went into it. Superintendent Erik Gundersen explained that the needs and rights of transgender students is a "significant factor for the policy."

"We have a strong policy in place," said Gundersen. "You have to allow [transgender students] the right to have access to a locker room. They have the legal right to have access. We don't have the legal right to say no."

Women's Voices Silenced: WA Transgender Restrooms

Last year, when the YMCA of Pierce and Kitsap Counties in Washington state decided to open women's locker rooms to men, citizen Autumn Bennett publicly announced that she would cancel her YMCA membership.  Then in 2016, this open-door-to-the-bathroom policy became state law, and as Bennett continued to speak against it, the political correctness police shut down her right to speak publicly, and the YMCA started firing female employees who opposed having men in the women's room.

A group called “Keep Locker Rooms Safe,” which advocates for sex-assigned locker rooms, is being censored by Facebook because of a post criticizing gender-blind bathrooms.

Autumn Bennett, a manager of the Keep Locker Rooms Safe Facebook page, told The Daily Wire her page has been repeatedly censored by Facebook after she and her four colleagues posted about a Washington state bill mandating unrestricted access to male and female locker rooms based on "self-identified" sex affiliation. Bennett’s account was blocked while her colleagues were censored and reported by leftist Facebook activists who were offended by her posts.

Facebook protocol reserves the right to remove posts which are considered "credible threats to public figures, as well as hate speech directed at them - just as we do for private individuals."

Autumn said her post, which simply emphasized that men of all types are now legally permitted into women’s locker rooms, was hotly contested by trans activists and LGBTQ allies using social media to fight back. . . .

Autumn Bennett, the administrator of the page advocating for safety and privacy in locker rooms through sex-assigned bathrooms, told The Daily Wire the threats she has been receiving since the incident have gotten increasingly more aggressive. Trans activists have formed their own fake “Keep Locker Rooms Safe” Facebook pages in opposition to her group, mocking the group’s cause and harassing administrators.

One activist even posted a call to action for activists to investigate Bennett’s personal information, such as where she works.

Bennett and her colleagues decided to publicize the insults and threats from opposing activists by creating an album on their page filled with screenshots of the language that was used against her group, including phrases such as “Go f*** yourself” and “I hope your teeth fall out.” . . .

Although Bennett and her colleagues reported the aggressive language used against her group, Facebook responded by shutting their page down for having publicized what was being said to them.

Several trans activists bragged for having been the reason for Facebook’s censorship of Bennett and her colleagues.

On Dec. 26, a state regulation went into effect that guarantees access to restrooms, locker rooms, and other such facilities according to a person’s gender identity [NOT actual biological sex]. It affects public and private buildings, including schools, restaurants, stores and most places of employment.

The state Human Rights Commission says its new regulation is not introducing a new right, but clarifying a 2006 state law prohibiting discrimination on the basis of sexual orientation or gender identity. Hit by funding cuts, the commission just got around to rule-making.

Yet among some legislators and members of the public, it has generated an uproar. Sharon Ortiz, Human Rights Commission executive director, said state officials are “getting bombarded with calls.”

At the YMCA of Pierce and Kitsap Counties, the controversy came to a head in September, when a thousand calls and emails led the organization to scale back its original decision — only to readopt it in December after yet more discussion and consultation with the state attorney general’s office.

A new policy was set in place in April that allowed members to use the facility of the gender they identified with. But after news of the policy spread months later, many members became upset.

A second policy was put in place with more complex rules. This time, however, members of the transgendered community became upset because the new policy tied the revision to fears of child abuse.

The YMCA leadership says the purpose of the new policy changes is to be more inclusive in the community, but there has been backlash, with some fearful this will open the door to a lot more than those who are transgender.

This week, Autumn Bennett plans to cancel her family's YMCA membership due to the policy change.

“This for me has nothing to do with discrimination against any other sort of groups, it has everything to do with the safety of children,” said Bennett. “Any pedophile, potential pedophile, rapist can pose and say 'Hey, I identify as this particular sex, and I can go in there and take pictures or assault someone.'”

Women's Breasts vs. Men's: Could Police Discern?

After a New Hampshire judge essentially legalized topless female nudity, state lawmakers considered a bill banning bare female breasts/nipples in public, but critics explained that such a law would require police officers to determine if the offender is a man or a woman and because of the myriad new transgender rights, any apparent female offender could simply claim to "identify as a man" and thus negate the infraction.

The House Criminal Justice and Public Safety Committee had voted last week, 18-0, to kill the bill, with several members saying passing the bill would guarantee the law would be challenged in federal court because it violated equal protection rights under the Constitution.

Some on the committee said the place to enact restrictions is at the local level, not statewide, and others noted that if a women had commited a second offense under the proposal she would have had to register as a sex offender and could have spent up to seven years in jail.

New Hampshire, like most states, does not have laws prohibiting women from going topless if men are allowed the same privilege.

The House voted against making it a misdemeanor for women to show their breasts with "reckless disregard" for whether it would offend someone. The bill was partly a response to a "Free the Nipple" movement that led to two women being cited for going topless at a Gilford beach. A judge dismissed that case in February.

Bill supporters had cautioned that allowing women to go topless at beaches could lead to them also going topless at libraries and Little League games. They said they were trying to shield families and children.

[However, the House committee reported that] the bill also would place police officers "in the uncomfortable position of having to determine the gender of a potential offender."

At Monday's public hearing, backers of the legislation cautioned that allowing women to go topless at beaches will create a slippery slope where women are going topless at public libraries and Little League baseball games. [Rep. Brian] Gallagher and Rep. Peter Spanos, a co-sponsor of the bill, said New Hampshire could lose tourism dollars if women are wandering public places with their breasts uncovered. Both said they brought the legislation in response to concern from constituents over the incident in Gilford.

But opponents charge such a ban violates the constitution by creating different standards for men and women. Kari Stephens, a Hampton resident who said she goes topless at the beach, argued lawmakers shouldn't be taking away a right that women in New Hampshire already have.

The New Hampshire chapter of the American Civil Liberties Union also opposes the bill.

Child-Self Porn Legalized in New Mexico: Sexting

This week, Gov. Susana Martinez of New Mexico signed legislation allowing children of ages 14 to 18 to legally produce child pornography (of themselves) and as well as distribute such pornography through electronic transmission and "sexting" because the majority of legislators believe children should have this right.

“I believe this bill is an important step forward in protecting our children from exploitation. As a former prosecutor who specialized in child abuse and sexual abuse cases, I know how important it is that we protect our kids from these abhorrent criminals.  I don’t support the so-called ‘sexting’ amendment, as I believe the reasoning behind it is misinformed and it was not carefully considered.”

New Mexico has passed a law which means teenagers can legally send each explicit “sexts” with each other without falling foul of the state’s child sex abuse images laws.

Democratic State Senator George Muñoz told the Guardian: “Kids will be kids, and they’re going to make mistakes.

“You can’t punish them for the rest of their lifetime with a charge of child pornography … if they’re consensually sending photos back and forth.”

The law specifies that sexting between minors is only legal if they “knowingly and voluntarily” exchanged images and there is no evidence of coercion.

Before the law was passed teenagers could face long jail terms as in child abuse cases prosecutors can file a charge against for each image they send.

In announcing she had signed the bill, [Gov.] Martinez pointed out she could not line-item veto the provision — only bills dealing with spending can be partly vetoed — and either had to sign the bill in its entirety or veto it.

She also called on lawmakers to revisit the sexting issue in the 2017 legislative session.

After being revised several times on its way through the Legislature, this year’s bill ended up increasing the potential prison time to 10 years — 11 years, in some cases — for child pornography possession, and ramping up penalties for manufacturing and distribution, as well.

The legislation, House Bill 65, is intended to fix a situation created by a 2014 New Mexico Supreme Court ruling that effectively said 18 months was the maximum sentence for possession, no matter how many images the offender possessed.

The law increases the sentence for possession of child pornography to 10 years from 18 months; increases the sentence for distributing child pornography to 11 years from three years; and increases the sentence for manufacturing child pornography to 12 years from nine years. It passed the Senate on a 40-0 vote and the House 64-0.

Under the new law, teenagers between 14 and 17 who send explicit images of themselves to one another will not be prosecuted for possession of child pornography. Senators added the exception in an amendment to the House bill, expressing concerns that teens engaging in consensual behavior could face criminal charges.

Debate on the exemption for teenagers sparked some of the highest drama of the 30-day legislative session that ended last week, with staffers for Attorney General Hector Balderas’ office walking out of a Senate committee hearing in protest. Later, on the Senate floor, Sen. Lisa Torraco, R-Albuquerque, moved to oust members of Balderas’ staff from the full Senate debate on the bill, saying, “The attorney general has not been helpful in this process.” Senators agreed, and Balderas’ staff members were barred from the floor.

Approval of the [sexting] amendment, supported by state senators from both parties, caused a staffer from Attorney General Hector Balderas’ office who was acting as an expert witness to storm out of the room during a senate committee hearing earlier this month. Balderas’ office pushed hard for the legislation initially but opposed the amendment, arguing that it would allow adults to pay or pressure minors to make child pornography.

Supporters of the amendment, however, argued that not exempting teen sexting would lead to arrests and jail time for teenagers who, in the words of Sen. Cisco McSorley, D-Albuquerque, are simply “being young and dumb.”

Sen. Sue Wilson Beffort, R-Sandia Park, even said during committee that she would filibuster the bill if the sexting amendment wasn’t added.

“These kids are active at this age,” Wilson Beffort said at the time. “If you are a parent of a boy who goes to jail, it’s really serious.”

Following a 2014 New Mexico Supreme Court decision that ended the long-standing precedent of allowing prosecutors to charge child pornographers with multiple counts based on the number of images or videos they possessed, those who possessed child pornography were only sentenced to 18 months in prison.

The legislation was sponsored by Representatives Sarah Maestas Barnes (R-Albuquerque) and Randal Crowder (R-Clovis).

The Governor will continue to support legislation that also closes the per-image child pornography loophole in state law, which was why this bill was introduced in the first place.

The bill has already sparked plenty of controversy. But defense lawyers insist that majority of adolescents are not aware of the severity and legal consequences of sexting, a common trait in the Smartphone age. . . .

According to the journal Pediatrics, teens who sext are more likely to be sexually active in less than a year. They are also likely to have multiple partners, pay little attention to birth control, and do drugs and alcohol. The study concluded by saying sexting was the new “normal” of teenage sexual behavior.

Most states have not updated their child abuse image laws. But supporters of the New Mexico bill hope other legislatures take a cue and do the same. [Democratic State Senator George] Muñoz, who pushed for sexting reform and an amendment for stiffer penalties against child pornography, said “Our laws have to change with technology.”

The state attorney general, Hector Baldera slammed the sexting proposal and deemed it as dangerous. “I cannot support an amendment that weakens protection against teenagers from predatory activity and creates a dangerous new child exploitation loophole,” he said in a statement.

Transgender Restrooms for S. Dakota Schools Passes

Yesterday, the South Dakota legislature passed a bill to comply with President Obama's edict that sexually confused students be accommodated in public schools; those students will use assigned private restrooms, locker rooms, showers, etc.  However, sexual revolutionaries are not satisfied because this means that the privacy of ALL students will be respected, such that use of facilities labeled boys/men and girls/women will be (traditionally) restricted based on "physical condition of being male or female as determined by a person's chromosomes and anatomy as identified at birth," rather than by whim (a.k.a. "gender identity").

The bill has provoked outrage from gay and transgender rights activists, who say it discriminates against transgender children. They say that it could put schools at risk of lawsuits; in 2014, the Education Department issued guidance finding that Title IX, the federal law that requires equal treatment of the sexes in schools, requires that students be permitted to use facilities that match their gender identity.

But the bill’s proponents have argued that the legislation actually matches up better with the original language of Title IX, which requires separate facilities for the sexes. They say it respects privacy while also meeting the needs of transgender students by requiring that schools allow them to use private facilities, such as a teacher’s or nurse’s bathroom.

The bill, which passed the state Senate 20 to 15, is just one example of how the debate over gay and transgender rights has shifted since same-sex couples won the right to marry, state by state at first and then nationally when the Supreme Court ruled that marriage was a constitutional right for gay couples.

Dozens of school districts have grappled with this issue, but South Dakota would be the first to make it a matter of state law. About a dozen states are considering similar legislation, according to the Human Rights Campaign.

Supporters say South Dakota's plan is a response to changes in the Obama administration's interpretation of the federal Title IX anti-discrimination law related to education. Federal officials have said that barring students from restrooms that match their gender identity is prohibited under [their new, progressive interpretation of] Title IX.

The South Dakota Senate approved the bill Tuesday on a 20-15 vote, moving it to Republican Gov. Dennis Daugaard's desk for his approval. Daugaard has said the measure seems like a good idea and plans to research the issue and listen to recorded testimony before making up his mind on whether to make the bill law.

The vote sparked outrage from Democrats and LGBT families and advocates Tuesday afternoon who said the measure is discriminatory, while conservatives marked its passage as a success in maintaining the privacy of South Dakota students.

Rep. Fred Deutsch, R-Florence, the bill's author, has said the measure is designed to ensure the privacy of transgender and non-transgender students in the most private areas in schools. He said the federal government has overstepped its authority in drafting Title IX regulations that require school districts to accommodate transgender students and they should receive "reasonable accommodations."

The state's House of Representatives approved the measure on a 58-10 vote last month.

The bill provides that with written parental permission, affected students may request a "reasonable accommodation ... that does not impose an undue hardship on a school district," such as use of a single-occupancy restroom.

The Transgender Law Center lambasted the bill's passage as "distressing and disturbing" and said it believes the legislation violates federal law.

"Every single child, including transgender youth, should have the opportunity to succeed and be treated fairly by our schools and elected officials," the center's executive director Kris Hayashi told The Huffington Post in a statement. If the governor signs the measure, Hayashi said, it will "endanger students and open up South Dakota schools to legal chaos, liability, and the loss of millions in federal funds."

Democrats, arguing against the bill in the Senate on Tuesday, also raised concerns that the measure may trigger the federal government to pull money from public schools, BuzzFeed News noted. Controversy also may prompt a tourism boycott, the Democrats warned.

Sen. David Omdahl, R-Sioux Falls, said the bill protects transgender individuals by providing separate facilities. He said it would preserve “the innocence of young people.”

[Sen. Bernie Hunhoff, D-Yankton] said he doesn’t know why South Dakota was chosen to be a test state, and he resents it.

[Sen. Brock Greenfield, R-Clark] said the state attorney general will defend the state law but won’t defend individual school districts. He said two [religious liberty rights] groups have volunteered to defend school districts.

Sen. Scott Parsley, D-Madison, asked Greenfield if the groups would pay for any legal settlement.

“I don’t want to get off on some rabbit trails,” Greenfield replied. He added that the groups would be responsible for legal costs.

Gov. Dennis Daugaard put out a statement late in the day saying that the bill did “not address any pressing issue” facing the state, and that it would have put schools in the “difficult position of following state law while knowing it openly invites federal litigation.”

The measure was pushed by conservative legislators who said it was an effort to protect the privacy of all students. But it appeared to conflict with the Obama administration’s interpretation of federal civil rights law and seemed likely to be headed for a court challenge.

“If and when these rare situations arise, I believe local school officials are best positioned to address them,” Mr. Daugaard wrote in a letter to lawmakers announcing his decision. “Instead of encouraging local solutions, this bill broadly regulates in a manner that invites conflict and litigation, diverting energy and resources from the education of the children of this state.” State Representative Fred Deutsch, the Republican who introduced the South Dakota bill, said he would not seek an override. Mr. Deutsch has said he believed that the federal Education Department had overstepped in its interpretation of Title IX, which bans sex discrimination in federally funded education programs, and that students’ biological sex should determine which restroom they use. Mr. Deutsch said he had spoken with Mr. Daugaard shortly before the veto statement was released.

Under federal law, it’s illegal to discriminate against students because they’re male or female, and the American Civil Liberties Union says that also applies to transgender children, so the director of Virginia’s office, Claire Gastenaga, is dismayed by several bills drafted by state lawmakers.

But Delegate Mark Cole defends his decision to try and restrict access to restrooms based on anatomy.  He would require school boards and state agencies to adopt a policy fining violators $50, and he says his constituents view this as a legitimate problem.

Critics say self-image is a complicated matter -- that children cannot be defined solely by anatomy, and Gastenaga says enforcement would necessitate physical inspections.

[Cole] says the bill would also protect school districts from lawsuits, but Gastenaga believes courts will side with transgender people in the years to come – ruling that it’s discriminatory to bar them from the bathroom where they believe they belong.

House Bill 663, proposed by Delegate Mark Cole of the state's House of Representatives, defines anatomical sex as "the physical condition of being male or female, which is determined by a person's anatomy." It would require all restrooms on property owned or leased by the state "solely be used by individuals whose anatomical sex matches such gender designation."

The proposal would also allow schools to create a single-stall unisex bathroom or shower for students who request it.

The bill does not specify how "anatomical sex" will be confirmed by the law-enforcement officer, but civil rights advocates say there's really only one way to be sure.

The bill [House Bill 781] died in the Republican-controlled committee on a bipartisan [8-13] vote.

“This is a little bit complicated, and I’m not comfortable sending a signal to the courts that we’re making a decision in anticipation of what they may or may not decide,” said Del. Thomas A. “Tag” Greason, R-Loudoun.

All Ladies' Rooms Open to Men: Washington State

The state government of Washington just became the first in the nation to make it illegal to stop any man from entering and using restrooms, locker rooms, showers, etc. labeled for women/females/girls.  The Washington State Human Rights Commission acted unilaterally in order to grant "equality" to those who are confused about their sexuality, but now the "door is open" to a variety of sexual predators as well.

If a man says he is a woman and walks into the women’s restroom, it is now illegal for a business owner to intervene. That is the result of a new rule created by the Washington State Human Rights Commission that went into effect Dec. 26.

The issue has been heating up in Washington for a while now. School boards throughout Washington State have been wrestling with the matter.

However, this is the first statewide mandate that forces businesses to cooperate with a customer’s confusion about his or her gender.

From "Women's locker rooms and other facilities now open to men" by Robert Monteleone, Staff Writer, Columbia Basin Herald (Moses Lake, WA) 12/31/15

The rule, WSR 15-11-104, states, "all covered entities, except school districts...shall allow individuals the use of restrooms, locker rooms, dressing rooms...that are consistent with that individual's gender identity." The rule was not enacted by the state Legislature, but has the same force as a law.

The rule prohibits owners/management from requiring "use inconsistent with gender identity" and, "if another person expresses concern or discomfort about a person who uses a facility that is consistent with the person’s gender identity, the person expressing discomfort should be directed to a separate or gender neutral facility, if available."

In other words, if a female in the women's room felt uncomfortable by the presence of a male with gender dysphoria, she would be the one, by rule, asked to use a different restroom.

When asked "What defines a woman?," Laura Lindstrand, policy analyst for the Washington State Human Rights Commission, said the person simply "has to identify as a woman."

Lindstrand said she was unable to answer whether or not there should be a legal, not biological, definition of 'woman.'

State legislators are already working to draft bills in reaction to the Washington State Human Rights Commission’s newly enacted rules, saying the panel overstepped its authority by leaving the Legislature out of such a major change in policy and understanding.

The commission took action after an eight-month dispute over transgender access at the YMCA of Pierce and Kitsap counties, which at first allowed and then prohibited opposite-sex use of bathrooms, showers and locker rooms.

Emily Chiang, legal director of the American Civil Liberties Union of Washington, described the action as a clarification of the 2006 Washington Law Against Discrimination, not a wholesale change.

“What they’ve done is basically clarify existing Washington state law, which already prohibits discrimination on the basis of sexual orientation or gender identity,” Ms. Chiang said in an email. “So, it wouldn’t really make sense for the Legislature to be involved, the HRC action is designed to give additional guidance to people looking to understand the state law.”

[Republican state Rep. Graham Hunt] said the commission’s rule poses a threat to public safety by making it virtually impossible to stop sexual predators from taking advantage of the law to gain access to women’s restrooms and other facilities.
