High Schoolers Dissected Baby Brains in New Mexico

A Congressional committee is recommending criminal charges against the University of New Mexico (UNM) for illegally handling aborted babies after learning that the medical school instructed high school students in dissection of fetal brains at a summer camp.

“Documentation obtained by the panel in the course of its investigation reflects that the transfer of fetal tissue from SWWO to UNM for research purposes is a direct violation of New Mexico’s Jonathan Spradling Revised Uniform Anatomical Gift Act.”

[Congresswoman Marsha] Blackburn charged the school broke state laws governing the use of aborted fetal tissue it received from Southwestern Women’s Options [SWWO], which provides late-term abortions. Published reports said the tissue was used for research and even dissected at what has been described as summer camps in 2012 and 2014.

Blackburn told [New Mexico Attorney General Hector] Balderas that university officials trained new abortion doctors, referred women to outside abortion clinics, sent UNM faculty and residents to an abortion clinic during transition between owners, extended “voluntary faculty” status to local abortionists, supplied residents and fellows to perform abortions for SWWO, and put pressure on employees and students for political support, all in violation of state law..

“Today, UNM Hospital performs surgical abortions for any reason through 25 weeks gestation,” said the report. “Since the time when opposition to participating in abortion procedures was the predominant view of UNM medical staff, the culture appears to have changed—along with the composition of UNM hospital and clinic personnel—to one aggressively in favor of the expansion of abortion.”

Earlier in June, the [House] panel sent evidence to the U.S. Department of Health and Human Services indicating that Planned Parenthood and the human tissue procurement company StemExpress may have violated patients’ privacy under HIPPA.

Supreme Court Legalizes Sex With Animals in Canada

In a 7-to-1 ruling this week, the Canadian Supreme Court acquitted "D.L.W.," a British Columbia man convicted of 13 counts of rape and incest, of bestiality because he didn't insert his penis into the family dog but rather only engaged in other sex acts with the animal, and failed in his attempts to insert the dog's penis into his stepdaughters.

"Although bestiality was often subsumed in terms such as sodomy or buggery, penetration was the essence - 'the defining act' - of the offence."

DLW's attorneys argued that bestiality linked to "buggery" - or sodomy - with animals beginning with an 1892 criminal code. Bestiality was first used in a 1955 code, but still was not defined to encompass every sex act with animals.

According to court record DLW smeared peanut butter on the genitals of his victims and had the family dog lick it off while he videotaped the act.

Court documents disclose that DLW attempted to have the dog perform intercourse on the stepdaughter, but that ultimately failed.

DLW is serving a 16 year prison sentence. He brought the bestitality conviction to the court on appeal.

Canada’s legal definition of bestiality is rather amorphous. Before 1859, Canada prosecuted depraved sex offenses under the English Buggery Act, a broad prohibition on sodomy. Thereafter, an anti-buggery law was incorporated into the Consolidated Statutes of Canada as a capital crime. The Criminal Law Amendment Act of 1969, championed by Pierre Trudeau, later prime minister and father to current Prime Minister Justin Trudeau, repealed the laws.

“Applying the principles that guide statutory interpretation leads to the conclusion in this case that the term bestiality has a well-established legal meaning and refers to sexual intercourse between a human and an animal. Penetration has always been understood to be an essential element of bestiality,” the [Supreme Court] opinion read.

Justice Thomas Cromwell, writing for the majority, pored over the history of the law — and its evolution from Church of England prohibitions in the 16th century to early laws enacted in colonial Canada — and ruled that lawmakers have always intended to single out only a certain subset of animal abusers.

The Criminal Code does not expressly say that a penetrative act is necessary to be considered an offence. But Cromwell said that's what generations of lawmakers intended and subsequent legislative changes have added little clarity.

The only justice in the minority, Rosalie Abella, rejected the majority's decision. "Acts with animals that have a sexual purpose are inherently exploitative whether or not penetration occurs, and the prevention of sexual exploitation is what the 1988 amendments were all about," she wrote in her dissenting opinion.

This is unacceptable," Trudeau said at the time, noting that the bill would expand existing "hate speech" prohibitions to include any public speech or communication that "promotes hatred" on the basis of "gender identity" or "gender expression," which is aimed at defending transgender people.

Hartstirn, 33, has been arrested for assaulting an 8-year-old girl who was alone in the public restroom of Jason's Deli in Chicago's South Loop.  News reports identify Hartstirn's gender as male, but a savvy defense attorney will likely advise the accused to say that Hartstirn self-identified as a woman at the time of entry into the restroom.

A man choked an 8-year-old girl until she passed out inside the bathroom of a South Loop store last weekend, according to Chicago Police.

She was with her mother at the business in the 1200 block of South Canal when the girl went to the bathroom alone about 1:15 p.m. on May 7, according to Chicago Police.

The woman then heard a scream from her daughter and went inside to find 33-year-old Reese M. Hartstirn carrying the unconscious girl into a stall, police said. He had choked her with his hands, police allege.

The girl went into the store’s bathroom. At some point, Reese M. Hartstirn, 33, came into the bathroom and started choking the girl with his hands, causing her to become unconscious, according to a release from the Chicago Police Department.

He then picked up the unconscious girl and carried her into a bathroom stall, closing the door so she couldn’t leave, according to the release.  Hartstirn pushed the girl’s mother when she came into the stall to rescue her daughter, police said.

Hartstirn, of the 500 block of North Racine Avenue, was charged with a felony count of aggravated kidnapping and a felony count of aggravated battery to a child under 13, according to the release.

Cook County Judge Adam Bourgeois ordered Hartstirn held without bail Monday, according to court records.  He is scheduled to appear in court May 16.

Police in Duxbury, Massachusetts are investigating to determine how exposés of over fifty girls attending Duxbury High School in the Boston suburb were posted to the Internet photo site DropBox.  Authorities say that the girls, all identified by name in the postings, are simply innocent minors who eagerly took "embarrassing photos" of themselves or encouraged others to photograph them in "varying stages of undress."

[DropBox, the] San Francisco-headquartered company could take weeks to turn over data that could help investigators trace who started the Dropbox page and who used it to post or share the photos, Duxbury police Chief Matthew M. Clancy said, adding that search warrants of those people are likely to follow.

“It’s a very sensitive, private and embarrassing matter,” the chief said. “In most cases, these are selfies that were sent to a boyfriend. That’s a crime in Massachusetts, but we’re not treating it as one in the case of these girls. We want them to learn from this.

“We’re clearly identifying these girls as victims because that’s what they are,” said Clancy, who declined to say how many there are.

Both Duxbury Schools Superintendent Benedict Tantillo and high school Principal Blake A. Dalton did not return repeated calls yesterday. But Clancy said police will join school officials as needed to warn students about the dangers and the consequences of sharing nude photos of themselves or others.

[Chief Clancy] said police are investigating to determine who created and contributed to the site.

He or she could be looking at a decade-long prison sentence.

That's because even if the images originated as "sexts" and were shared willingly with a teenage boyfriend or girlfriend, they are still considered child pornography if the subject is under 18. That means that even before they made it on the website, the images were technically illegally shared if they were texted or emailed.

A conviction on a charge of distributing child pornography in Massachusetts carries a minimum sentence of 10 years in prison and a maximum of 20 years.

Police in Simpsonville, South Carolina have charged Peggy Louise Atkins with third-degree criminal sexual conduct for abusing a toddler while employed as a nurse for a company hired by Medicare and paid by the state Department of Social Services.  The offender was observed by foster parents with the 2-year-old girl in an "inappropriate position" in order to sexually stimulate Atkins.

Police say Anderson encouraged boys to engage in sexual activity with him and each other during several parties at his home. Anderson texted apologies to some parents amid the investigation.

A statement from the San Antonio Police Department said one of the parties involved the suspect hosting a "bros night" Feb. 12 at his house, which was attended by seven boys, ages 15 to 17. A sign at the door at the party read, "The last one to get naked has to get the first dare," the department said.

“Another incident involved suspect challenging a 17-year-old to see who can be the most obscene. It involved the suspect and the 17-year-old sending pictures of their genitals to each other [a.k.a. sexting]. The incident was reported last week to (a) church, and the church banned suspect from returning,” police said.

Morales admitted shooting Carson but said he acted in self-defense and couldn't be guilty of a hate crime because he is bisexual. His star witness was a transgender woman who testified that she was his ex-lover.

In Morales' closing argument last week, he wept and told jurors that he was "not a bigot of any type" and that charging him with a hate crime was "ridiculous."

Police said Carson and his roommate were passing in front of a pizza parlor shortly after midnight on May 18, 2013, when Morales called out to them, using slurs and saying the men looked like "gay wrestlers." The two confronted Morales, following him around a corner, before he pulled a revolver and shot Carson in the face at close range, authorities said.

Assistant District Attorney Shannon Lucey said in her closing argument that Morales had issues with his own sexuality and was jealous that Carson and his roommate were openly gay.

The jury of four men and eight women [it would appear] deliberated for two days after two weeks of emotional testimony in State Supreme Court, during which Mr. Morales represented himself and took the witness stand to declare he was not prejudiced toward gay people. Murder as a hate crime carries a minimum sentence of 20 years to life, five years more than a second-degree murder conviction.

A few minutes later on Avenue of the Americas, Mr. Morales encountered Mr. Carson and Mr. Robinson, two gay men from Brooklyn who were out on the town on a warm Friday night. As he passed them, Mr. Morales called the men “gay wrestlers,” Mr. Robinson testified. Mr. Carson spun on his heel and confronted Mr. Morales.

Spewing antigay insults, Mr. Morales dared Mr. Carson and Mr. [Danny] Robinson to come around the corner onto Eighth Street to settle their differences, Mr. Robinson testified. They followed him, thinking it was a bluff.

There, just after midnight on May 18, 2013, in the shadow of a closed bookstore, Mr. Morales shot Mr. Carson while Mr. Robinson was on the telephone with the police, witnesses said.

Abortions Outlawed at 20 Weeks in South Dakota

South Dakota Gov. Dennis Daugaard signed a bill this week criminalizing abortions at 20 weeks gestation.  The law includes an exception for the life of the mother in certain cases of emergency, but requires every effort be made to deliver the baby alive.  No exception is provided for cases of rape or incest.

The measure allows abortions later than 19 weeks if there is a medical emergency, but a claim or diagnosis that a woman intends to kill or harm herself aren't part of the exemption. The law says that when such an abortion is necessary because of an emergency, the doctor must "deliver the child in the manner which ... provides the best opportunity for the unborn child to survive," but only if that is consistent with preserving the woman's life and preventing an "irreversible" impairment of a major bodily function.

Performing an abortion that violates the new threshold is a Class 1 misdemeanor, which carries a penalty of up to a year in jail and a $2,000 fine. A woman who gets such an abortion would not be subject to that consequence.

Similar laws are in effect in 12 other states. Courts have blocked laws in Arizona, Idaho and Georgia.

Supporters say the measure aims to prevent excruciating pain fetuses experience during abortion procedures. While some doctors contend that fetuses can feel pain at 20 weeks, the American Congress of Obstetricians and Gynecologists says evidence suggests that's not possible until the third trimester begins at 27 weeks.

Opponents including representatives from the American Civil Liberties Union and reproductive rights groups have said the measure is unconstitutional as it bans abortions before the point of viability. They also said the measure could create health problems for some pregnant women.

Thirteen states have approved similar bans, according to the reproductive health think-tank Guttmacher Institute, which depart from the 22-24 week standard of a fetus' viability outside the womb established by the Supreme Court's landmark 1973 decision in Roe v. Wade. At least two of those bans in Arizona and Idaho were enjoined due to court orders, voiding the policies.

Some called the bill unnecessary. The only clinic that performs abortion in South Dakota is Planned Parenthood in Sioux Falls, which will not perform abortions after the 14th week of gestation.

The bill's author, state Sen. Jeff Monroe, R-Pierre, called that "baloney."

"I don't believe they are cutting it off at 14 weeks," he told Courthouse News.

The bill requires medical professionals to fill out a form answering 23 questions about any abortion performed in the state. Information sought includes the reason for the abortion, the mother's age and race, the gestational age of the fetus, and how the procedure was paid for.

The bill is modeled after the Pain-Capable Unborn Child Protection Act, which has become law in 12 states: Alabama, Arkansas, Georgia, Idaho, Kansas, Louisiana, Nebraska, North Dakota, Oklahoma, Texas, West Virginia and Wisconsin.

Though abortion advocates deny the science of fetal pain, researchers have established that unborn babies can feel pain at 20 weeks or earlier. Dr. Steven Zielinski, an internal medicine physician from Oregon, is one of the leading researchers into it. He first published reports in the 1980s to validate research showing evidence for unborn pain.

He has testified before U.S. Congress that an unborn child could feel pain at “eight-and-a-half weeks and possibly earlier” and that a baby before birth “under the right circumstances, is capable of crying.”

Child-Self Porn Legalized in New Mexico: Sexting

This week, Gov. Susana Martinez of New Mexico signed legislation allowing children of ages 14 to 18 to legally produce child pornography (of themselves) and as well as distribute such pornography through electronic transmission and "sexting" because the majority of legislators believe children should have this right.

“I believe this bill is an important step forward in protecting our children from exploitation. New Mexico has passed a law which means teenagers can legally send each explicit “sexts” with each other without falling foul of the state’s child sex abuse images laws.

Democratic State Senator George Muñoz told the Guardian: “Kids will be kids, and they’re going to make mistakes.

“You can’t punish them for the rest of their lifetime with a charge of child pornography … if they’re consensually sending photos back and forth.”

The law specifies that sexting between minors is only legal if they “knowingly and voluntarily” exchanged images and there is no evidence of coercion.

Before the law was passed teenagers could face long jail terms as in child abuse cases prosecutors can file a charge against for each image they send.

In announcing she had signed the bill, [Gov.] Martinez pointed out she could not line-item veto the provision — only bills dealing with spending can be partly vetoed — and either had to sign the bill in its entirety or veto it.

She also called on lawmakers to revisit the sexting issue in the 2017 legislative session.

After being revised several times on its way through the Legislature, this year’s bill ended up increasing the potential prison time to 10 years — 11 years, in some cases — for child pornography possession, and ramping up penalties for manufacturing and distribution, as well.

The legislation, House Bill 65, is intended to fix a situation created by a 2014 New Mexico Supreme Court ruling that effectively said 18 months was the maximum sentence for possession, no matter how many images the offender possessed.

The law increases the sentence for possession of child pornography to 10 years from 18 months; increases the sentence for distributing child pornography to 11 years from three years; and increases the sentence for manufacturing child pornography to 12 years from nine years. It passed the Senate on a 40-0 vote and the House 64-0.

Under the new law, teenagers between 14 and 17 who send explicit images of themselves to one another will not be prosecuted for possession of child pornography. Senators added the exception in an amendment to the House bill, expressing concerns that teens engaging in consensual behavior could face criminal charges.

Debate on the exemption for teenagers sparked some of the highest drama of the 30-day legislative session that ended last week, with staffers for Attorney General Hector Balderas’ office walking out of a Senate committee hearing in protest. Later, on the Senate floor, Sen. Lisa Torraco, R-Albuquerque, moved to oust members of Balderas’ staff from the full Senate debate on the bill, saying, “The attorney general has not been helpful in this process.” Senators agreed, and Balderas’ staff members were barred from the floor.

Approval of the [sexting] amendment, supported by state senators from both parties, caused a staffer from Attorney General Hector Balderas’ office who was acting as an expert witness to storm out of the room during a senate committee hearing earlier this month. Balderas’ office pushed hard for the legislation initially but opposed the amendment, arguing that it would allow adults to pay or pressure minors to make child pornography.

Supporters of the amendment, however, argued that not exempting teen sexting would lead to arrests and jail time for teenagers who, in the words of Sen. Cisco McSorley, D-Albuquerque, are simply “being young and dumb.”

Sen. Sue Wilson Beffort, R-Sandia Park, even said during committee that she would filibuster the bill if the sexting amendment wasn’t added.

“These kids are active at this age,” Wilson Beffort said at the time. “If you are a parent of a boy who goes to jail, it’s really serious.”

Following a 2014 New Mexico Supreme Court decision that ended the long-standing precedent of allowing prosecutors to charge child pornographers with multiple counts based on the number of images or videos they possessed, those who possessed child pornography were only sentenced to 18 months in prison.

The legislation was sponsored by Representatives Sarah Maestas Barnes (R-Albuquerque) and Randal Crowder (R-Clovis).

The Governor will continue to support legislation that also closes the per-image child pornography loophole in state law, which was why this bill was introduced in the first place.

The bill has already sparked plenty of controversy. But defense lawyers insist that majority of adolescents are not aware of the severity and legal consequences of sexting, a common trait in the Smartphone age. . . .

According to the journal Pediatrics, teens who sext are more likely to be sexually active in less than a year. They are also likely to have multiple partners, pay little attention to birth control, and do drugs and alcohol. The study concluded by saying sexting was the new “normal” of teenage sexual behavior.

Most states have not updated their child abuse image laws. But supporters of the New Mexico bill hope other legislatures take a cue and do the same. [Democratic State Senator George] Muñoz, who pushed for sexting reform and an amendment for stiffer penalties against child pornography, said “Our laws have to change with technology.”

The state attorney general, Hector Baldera slammed the sexting proposal and deemed it as dangerous. “I cannot support an amendment that weakens protection against teenagers from predatory activity and creates a dangerous new child exploitation loophole,” he said in a statement.

Maroney is accused of engaging in sex acts with the victim eight times and touching the minor sexually on at least two occasions.

Maroney also is accused in one incident of trying to strangle the victim. In another, the indictment says, Maroney cut the victim's tongue with a knife.

George County sheriff's Sgt. J.D. Savage said an investigation began in August after the victim came forward with the allegations.

Maroney is free on a total bond of $100,000.

If convicted of all the charges, Maroney could go to prison for life.

The event saw law enforcers from several different agencies joined together through prayer for the Metro.

Each leader that headed to the podium led the crowd in a different prayer. Participants included Jackson Mayor Tony Yarber, councilman DeKeither Stamps and many others [including Jackson Public Schools Superintendent Dr. Cedrick Gray].

The Jackson Fire Department chief said the number of fire deaths had dropped 90% since last year.

The prayer meeting started one year ago. Chief Vance says the goal is to eventually do them every three months.

The St. Charles Parish Sheriff’s Office investigation began after a family member of the student provided information about the alleged crime. Detectives interviewed the student, who said that she did have a sexual relationship with a DHS teacher named Kimberly Naquin, according to the Sheriff’s Office.

According to the student, the relationship began in September 2014 and lasted until August 2015.

The student advised most of the inappropriate contact occurred at the teacher’s prior residence, which was located in Kenner; however an undetermined amount of incidents occurred within St. Charles Parish at a Destrehan High School classroom and a Destrehan residence, according to investigators.

Naquin is being held without bond at the Nelson Coleman Corrections facility in Killona. Her Facebook page says her mother, Karen Naquin, is a teacher in the St. Charles Parish public school system.

Her arrest comes three months after Destrehan High teachers Shelly Dufresne and Rachel Respess were accused of having sex with a 16-year-old male student. Dufresne pleaded guilty to a felony obscenity charge in St. Charles for having sex with the student at a home in Montz, where she lives. She received a three-year deferred prison sentence, three years of probation and a $1,000 fine.

For allegedly having sex with the same student at Respess' apartment in Kenner, Dufresene has pleaded not guilty in Jefferson Parish to two counts of carnal knowledge. Respess, originally accused of engagaing in group sex there with Dufresene and the student, was charged by prosecutors with failing to report a felony. She, too,has pleaded not guilty.

Louisiana already had a bad reputation for inappropriate relationships between school staff and students: In 2014, it ranked third in the United States, counting both convictions and arrests. That included Shelley Dufresne and Rachel Respess, who taught English at Destrehan High until their arrests that fall on charges of having group sex with a 16-year-old boy.

Louisiana law generally forbids sex between an adult and a person younger than 17. It strictly prohibits sexual contact between a teacher and a student through the age of 20, and it's very clear how seriously school systems should treat abuse.

But the laws and policies do not necessarily include consequences for the higher-ups. Destrehan High Principal Stephen Weber, for example, kept his job after the 2014 abuse came to light. And the state Education Department did not contact, sanction, reprimand or intervene at the school, spokesman Barry Landry said. He would not release Weber's annual evaluation results, saying they were not public information; the 2014-15 results aren't complete yet anyway.

Illinois Lesbian Jail Officer Shoots Lover, Dies

Erika Aguirre, 28, of Berwyn, Illinois broke into a home and shot Deisy Jaimes, her lesbian lover, several times, critically wounding her as well as her father, Enrique Jaimes, as his wife and other two teenage children all escaped after shots fired by Aguirre missed hitting anyone else.  The incident concluded when Aguirre committed suicide with a single shot to her head.

Bridgeview (Illinois) Police Chief Walter Klimek identified the dead woman as 28-year-old Erika Aguirre. The Cook County Sheriff's Office says Aguirre was an employee for four years, working at the jail's intake division. Klimek says Aguirre and a 27-year-old woman had been in a relationship for four years but had recently broken up.

Klimek says Aguirre broke into the home southwest of Chicago about 11:30 p.m. Sunday and shot the 52-year-old man twice. The former girlfriend was then shot numerous times. Klimek says both are in critical condition at Advocate Christ Medical Center in Oak Lawn.

Neighbors called police at 11:32 p.m. when they saw a woman, dressed in black and carrying a gun, walking around the house, according to Bridgeview Police Chief Walter Klimek.

Officers responded to the home, looked through a window and saw a person lying in a pool of blood in the kitchen, Klimek said. The 5th District SWAT unit, comprised of members from police departments from the 5th District Circuit Court area, was then called to the scene.

The unit entered the home and found the woman dead in the kitchen, Klimek said.

[Erika Aguirre] broke a basement window while the couple and their three children were inside, police said.

The 17-year-old heard glass break and went to investigate. She "confronted the shooter in the basement, at which point she was able to escape," Klimek said, but not before she was shot at "a couple of times" but not struck.

The 17-year-old was able to alert her mother and brother, and they were able to escape from the house.

A semi-automatic gun was recovered along with three magazines, each of which holds up to 15 rounds, Klimek said. He said about 15 rounds were fired inside the home.

Aguirre then confronted 52-year-old Enrique Jaimes, and shot him twice. She then went to an upstairs bedroom, and shot 22-year-old Deisy Jaimes in the head, shoulders, and legs, police said. Both victims were taken to Advocate Christ Medical Center in Oak Lawn in critical condition.

Neighbor Jeff Polston said he called 911 after a girl who got out of the house unharmed knocked on his door for help. She told him about the intruder, describing her as a cold-blooded killer.

“She just said it was methodical; very slow, and not nervous,” Polston said.

Investigators determined Aguirre and Deisy James had been in a recent relationship, until they broke up.
