Florida School Rejects Gay Agenda ENDA Proposal

The one-town-at-a-time strategy of the Gay/Transgender Agenda hit a road block last week when the Brevard County School Board, after hearing from residents, voted unanimously against an ordinance change proposed by a Heritage High School (Palm Bay, Florida) sexual revolutionary teacher to grant special rights based on "sexual orientation" and "gender identity."

The cause is led primarily by LGBT high school teacher and advocate Daniel Wal-Desousa.

Dozens of parents, grandparents, and Brevard County School workers lined up to express their concern about changing the anti-discrimination policy.

After a more than five-hour meeting, the board ultimately decided to hold off on sending the anti-discrimination policy word changes to a public hearing, until they can all agree on the implications of it.

Nearly 100 people signed up to speak at the meeting, and most of those who spoke were in opposition to the LGBT policy.

Policy opponents said they feared the LGBT policy would mean that those who voice religious objections to gay marriage in local schools would be branded as bigots and disciplined for discrimination. Some opponents said they wanted to preach scripture in schools, and many said they were concerned about transgender individuals using public school bathrooms. They argued that the LGBT policy threatened morality.

The Liberty Counsel, a national litigation and advocacy organization that represents the interests of American evangelical Christians and cultural conservatives, sent a letter to the Brevard School Board prior to this hearing, stating its strong opposition to the LGBT policies and its willingness to legally challenge the policies if they are imposed. That public letter was cited multiple times during the course of the school board hearing.

In the conclusion of its letter, the Counsel added, "If the District enacts these misguided changes, and instead violates the First Amendment rights of other students and teachers, Liberty Counsel stands prepared to advocate on their behalf against the District."

The [Liberty Counsel] letter continued, "'Sexual orientation' or 'gender identity'...are not like others protected by law.  They are subjective, behavior-based categories, rather than federally-recognized immutable characteristics like race, color, sex, national origin, or constitutionally-protected fundamental rights, like religion."

The letter also notes that the "legal bullying" of the Obama administration's Office of Civil Rights' "baseless" statements "strong-arm[ing] school districts" for transgender bathrooms "cites no legal authority – case law or statutory – for the claim that Title IX now applies to students claiming to be the opposite sex."

"A student with gender confusion who truly believes he or she is the opposite sex should be treated with care, compassion, and kindness, but must not be officially affirmed in his or her confusion, no matter how sincerely-held," the lawyers' letter stated.

"Many parents ... stood up in opposition to this dangerous policy change. We win when we show up," Mat Staver, founder and chairman of Liberty Counsel, said in a press release.

Obama's Enforcer Follows Man into Ladies' Room

The federal government has strong-armed Deluxe Financial Services Corp. of Shoreview, Minnesota into an agreement to pay $115,000 and change its company policy to allow men into women's facilities.  As part of the legal action, the Obama administration Equal Employment Opportunity Commission (EEOC) will be following up to ensure the company succumbs fully to the Gay Agenda.

The male employee, after beginning to show up for work in female clothing, complained in part, that Deluxe supervisors and coworkers referred to him using male pronouns.

According to EEOC’s complaint, Britney Austin was assigned the male sex at birth and presented as male when hired by the company. Ms. Austin performed her duties satisfactorily in the company’s Phoenix offices throughout a lengthy tenure. However, after she informed her supervisor that she was transgender and began to present as a woman at work, Deluxe refused to let her use the women’s restroom.

Such alleged conduct violates Title VII of the Civil Rights Act of 1964, which prohibits sex discrimination, including that based on transgender status and gender stereotyping. This includes subjecting an employee to different terms and conditions or a hostile work environment because of sex.

A suit filed by EEOC, EEOC v. Deluxe Financial Services, Inc., sought both monetary and injunctive relief. Britney Austin intervened in the lawsuit and asserted additional claims.

Minnesota U.S. District Court Judge Ann Montgomery issued a consent decree on Jan. 20 ordering Deluxe Financial Services Inc. to pay Britney Austin the amount and change its equal employment opportunity policies to prevent unlawful sex discrimination and harassment.

Montgomery also told the company to issue a letter of reference for future employers, change its national health benefits plan to delete any partial exclusion for health care based on transgender status and provide an annual report to the U.S. Equal Employment Opportunity Commission (EEOC), which filed the lawsuit on behalf of the complainant.

The company issued a letter of apology, which states, "We want to ensure you that we have made changes to our internal policies, including how we treat transgender employees' requests to change biographical information or use a restroom commensurate with their gender identity."

"The company has changed its policies to ensure that transgender employees may use a restroom commensurate with their gender identity, that the company will promptly correct that employee's sex designation and name in our internal records and systems, and that we will take hostile comments based on sex- stereotyping seriously, investigate them, and take prompt corrective and remedial action," the letter read.

In addition to requiring that Deluxe pay monetary damages to Ms. Austin, a three-year consent decree provides that Deluxe will issue a letter of apology to Ms. Austin and a letter of reference for future employers. The consent decree also provides that, as of January 1, 2016, Deluxe's national health benefits plan will not include any partial or categorical exclusion for otherwise medically necessary care based on transgender status.

"This settlement underscores EEOC's commitment to securing the rights of transgender individuals under Title VII in the federal courts," said EEOC General Counsel David Lopez. "This is our second such resolution and we hope that employers will take notice and begin to take proactive steps to prevent and eliminate discrimination against their transgender workers."

This is the third lawsuit filed by EEOC alleging discrimination on the basis of transgender status. In April, 2015, a Florida eye clinic paid $150,000 to settle an EEOC lawsuit seeking relief for an employee who had been transitioning from male to female. EEOC also filed suit seeking relief for an employee of a Detroit area funeral home fired for transitioning from male to female, which is still pending.

Acting [EEOC] District Director Elizabeth Cadle added, "EEOC considers protecting transgender, lesbian, gay, and bisexual employees to be a strategic enforcement priority. We will continue to assure that transgender employees receive the full benefit of federal anti-discrimination laws in all industries."

Austin wasn’t allowed to use the women’s restroom and co-workers used hurtful epithets and intentionally used the wrong gender pronouns to refer to her, the EEOC said in a June complaint. The company denies having created or subjected Austin to a hostile workplace, and said it’s “fully committed to fostering an inclusive, respectful workplace,” according to the order.

“In the interest of resolving this matter, to avoid further cost of litigation, and as a result of having engaged in comprehensive settlement negotiations, the parties have agreed that this action should be resolved by entry of this decree,” Judge Montgomery wrote in Wednesday’s order.

The EEOC is represented in-house by Laurie A Vasichek, Iris Halpern and Michael H. Imdiecke. Austin is represented by Jillian T. Weiss and Ezra Young.

Deluxe is represented by Angela Beranek Brandt and David M. Wilk of Larson King LLP.

The case is Equal Employment Opportunity Commission v. Deluxe Financial Services Inc., case number 0:15-cv-02646, in the U.S. District Court for the District of Minnesota.

1) Include gender identity in your non-discrimination and no-harassment policies. If you’re a federal contractor, you should have done this a long time ago. If you’re not, then you should seriously consider adding it now.

2) Make sure your policies provide that discrimination against or harassment of individuals because of their transgender (and related) status will not be tolerated, whether the behavior comes from “employees, customers, agents, contractors, sub-contractors, clients,” or anyone else.

3) Make sure that employees understand that deliberately referring to a transgendered person by his or her “biological” gender, or by his or her original name, is considered discrimination and harassment by the EEOC.

. . .

5) A transgendered employee should be allowed to use the restroom “commensurate with their gender identity” without any limitations. Again, the EEOC’s position is that the employer may not ask for the medical records of the transgendered employee, or otherwise probe into his or her medical details before doing so. (This means an employer cannot make the employee wait to change restrooms until after he or she has had gender-reassignment surgery.)

7) The employer should conduct annual training for rank-and-file employees that includes discrimination based on gender identity, sex stereotyping, and gender dysphoria, and should penalize any employee who fails to complete the training on an annual basis.

Pres. Obama's Homosexual Christmas Proclamation

This year, President Obama issued statements during Christmas week to celebrate the "Christmas miracles" of same-sex "marriage" and a transformed U.S. military that proudly includes homosexuals and other people suffering sexual confusion, while he asks for God's blessing in his war against Biblical values that he wages along with his fellow sexual revolutionaries.

Gender Redefined by NY City Law; Biology Be Damned

Sexual revolutionaries are trumpeting the latest New York City reinterpretation of existing law to elevate the Gay Agenda by giving special privileges to "transgender and gender non-conforming persons."  The new language rejects human biology with its new definition of gender as one’s “actual or perceived sex and shall also include a person’s gender identity, self-image, appearance, behavior or expression, whether or not that gender identity, self-image, appearance, behavior or expression is different from that traditionally associated with the legal sex assigned to that person at birth.”

The new rules give special rights to perverts, as well as any and every variation of sexual deviant so that such “individuals be permitted to use single-sex facilities, such as bathrooms or locker rooms, and participate in single-sex programs, consistent with their gender, regardless of their sex assigned at birth, anatomy, medical history, appearance, or the sex indicated on their identification.”

New York City has warned landlords, employers and businesses they could be running afoul of the law by purposely calling a transgender woman "him" or "Mr." when she prefers a female title and pronoun, or by barring her from using a women's restroom.

New guidelines detail the legal protections of transgender and gender-nonconforming New Yorkers and what constitutes discrimination under the city's Human Rights Law, the New York City Commission on Human Rights said on Monday.

Failing to provide employee health benefits for gender-affirming care or failing to accommodate people undergoing gender transition, such as medical appointments, could violate the law as well, they said.

New York City provides stronger protections than most local laws in the United States and goes beyond federal law as well . . .

Some cities around the country have added transgender people to anti-discrimination protections, and New York Gov. Andrew Cuomo did likewise for his state this fall. Other communities have rebuffed them: Houston voters this fall defeated an ordinance that would have established nondiscrimination protections for gay and transgender people.

The rules also declare that transgender people can't be denied access to the restroom or locker room where their gender identity belongs, at their discretion. Unisex, single-occupancy bathrooms are suggested but not required.

Objections from fellow patrons or employees "are not a lawful reason to deny access," the guidelines say. . . .

"Today's guidance makes it abundantly clear what the city considers to be discrimination," which can lead to fines of up to $250,000, Commissioner Carmelyn P. Malalis said in a statement. . . .

The guidelines are the progressive de Blasio administration’s new interpretation of city gender-discrimination laws that date to 2002.

Lesbian Mayor's Gay Agenda Defeated by Voters

Citizens of Houston, Texas, the fourth-largest city in the U.S., turned out in record numbers to defeat Prop 1, the Houston Equal Rights Ordinance No. 2014-530 (HERO), by a margin of 62% to 38%.  The city's lesbian mayor Annise D. Parker, along with city bureaucrats, had pulled several legal tricks in attempts to negate the citizens' uprising against the Gay Agenda ordinance previously enacted by decree.

Opponents of the issue branded it "the bathroom ordinance," playing up the argument that it would allow sexual predators dressed as women to use women's restrooms. A television ad featured a little girl being cornered by a man in a restroom.

Supporters sold it as an anti-discrimination measure protecting a broad range of citizens from the elderly to veterans. The ordinance would have offered increased protections for gay and transgender people, as well as protections against discrimination based on sex, race, age, religion and other categories.

"The supporters of this proposition brought in movie stars and elites from Washington D.C. and Hollywood to try to force their twisted agenda on the good people of Texas," said Lt. Gov. Dan Patrick. "It didn't work and advocates of this ridiculous proposal are on notice tonight that the voters of Houston will not stand for this kind of liberal nonsense."

It was favored by the White House, Democratic presidential front-runner Hillary Clinton and tech giant Apple, but faced opposition from many religious leaders and Republicans.

Texas Gov. Greg Abbott, a Republican, tweeted earlier this week against the ordinance: "HOUSTON: Vote Texas values, not @HillaryClinton values. Vote NO on City of Houston Proposition 1. No men in women's bathrooms."

The ordinance was originally passed by Houston City Council in 2014, but the Texas Supreme Court earlier this year forced it onto the ballot [following a citizen petition drive].

City Council passed the law 11-6 in May last year, but conservative foes launched an effort to force a repeal referendum that spanned more than one year of legal challenges. In July, the Texas Supreme Court ordered the city to either repeal the law or place in the ballot. By a 12-5 vote, City Council opted for the latter, officially unleashing two dueling campaigns.

Businesses that serve the public, private employers, housing and city contracting are all subject to the law and face up to $5,000 in fines for violations. Religious institutions, however, are exempt. The ordinance was in effect for only three months between extensive legal challenges.

[The vote] came after an 18-month battle pitting gay rights advocates against those who believed they were defending religious liberty.

[Annise] Parker, the first lesbian mayor of a major U.S. city, had championed the ordinance, making it a personal battle about what she called “my rights.”

Conservative leaders who campaigned and spoke out against the ordinance included a coalition of pastors, Republican Gov. Greg Abbott, Lt. Gov. Dan Patrick, former Houston Astro Lance Berkman and Houston Texans football owner Bob McNair.

Jonathan Saenz, president of Texas Values Action, a conservative group that opposed the ordinance, called the vote “a significant victory for common sense, safety, and religious freedom, not just in Houston, but for all of Texas.... This vote will impact the nation and shows, once again, that the people still support common-sense Texas values."

With the Houston vote garnering national attention, the loss for HERO supporters comes after a tumultuous year and half since the ordinance was first passed by the Houston City Council in May 2014.

Almost immediately, conservative activists and pastors began collecting signatures to petition a referendum or repeal of the ordinance. City officials later ruled that they hadn’t collected enough signatures, prompting a lawsuit from the opponents.

The ordinance had been in effect for about three months when it was put on hold as the legal challenge made its way through the courts. In April, a state district judge ruled in favor of the city, saying opponents of the ordinance had not gathered enough valid signatures.

The case went to the Texas Supreme Court, which in July told the city council it had to consider a valid referendum petition and repeal the ordinance or put it up for public vote.

In Houston, the ordinance’s proponents — including Mayor Annise D. Parker, local and national gay rights and civil rights groups and the actress Sally Field — accused opponents of using fearmongering against gay people, and far-fetched talk of bathroom attacks, to generate support for a repeal. The ordinance, they noted, says nothing specifically about whether men can use women’s restrooms.

The proponents’ defeat at the polls was a kind of personal blow to Ms. Parker, a Democrat. Houston became the largest city in the United States to elect an openly gay mayor when she won office in December 2009. Now in her third and final term, Ms. Parker had pushed hard for the ordinance and helped it gain endorsements from President Obama and corporate giants like Apple.

Opponents of the measure — including Mr. Patrick, pastors of conservative megachurches and the former Houston Astros baseball star Lance Berkman — said the ordinance had nothing to do with discrimination and was about the mayor’s gay agenda being forced on the city. They denied that they had any bias against gay people, and said the ordinance was so vague that it would make anyone who tried to keep any man from entering a women’s bathroom the subject of a city investigation and fine.

"While much of the debate focused on biological males using a woman's bathroom, many voters told us they understood this involved a lot more than bathrooms," Family Research Council President Tony Perkins said after the votes were counted.

"The mayor's efforts to disenfranchise voters and subpoena pastors' sermons and private communications demonstrated this law was ultimately about silencing and even stripping away the livelihood of those who refused to yield their beliefs to this new morality."

"Houstonians' religious freedom, freedom of speech, and the right to petition their government have won the day, but much more work remains to be done to safeguard these freedoms across the nation. No person should be punished by the government because of their beliefs," Perkins said.

The ordinance would have applied to businesses that serve the public, such as restaurants and hotels, private employers, housing, city employment and city contracting. It would have allowed residents to file a complaint if they felt they had been discriminated against based on the various protected categories. Religious institutions would have been exempt. Violators would have faced fines up to $5,000.

Codify More 'Gay Rights:' Hillary, Biden Promise

Democrats Hillary Clinton and Joe Biden competed Saturday for endorsements in speeches before the Human Rights Campaign (HRC), America's largest homosexual activist group, whose co-founder was arrested for anal sex with a boy.  If elected president, Hillary promised to change the Civil Rights Act of 1964 via a Federal Equality Act to provide even more "gay rights."  Biden said that the military must eliminate restrictions that limit full inclusion of mentally ill sexual deviants.

The vice president spoke to 3,500 LGBT activists and leaders in a cavernous subterranean ballroom at the Washington Convention Center for the annual Human Rights Campaign dinner, a speaking gig Democratic presidential front-runner Hillary Clinton turned down in order to appear on “Saturday Night Live,” The New York Times reported.

Biden is close to deciding on a 2016 presidential bid against Clinton, and the LGBT community is an important constituency for any Democrat eyeing the White House. He contrasted with the former secretary of state at one point on Saturday, telling gay rights activists that equality would come easily now — even though just hours before Clinton had warned the same group that further change would be difficult.

Though Clinton gave up the keynote spot to the vice president, she addressed the group’s breakfast meeting early Saturday instead, giving the first speech of her 2016 campaign exclusively focused on LGBT rights. She thanked the Human Rights Campaign for helping “change a lot of minds, including mine” on marriage equality.

On policy, Clinton and Biden lined up almost perfectly. They both called for a new focus on transgender rights and working to expand LGBT rights abroad. They identified the same three specific domestic policy goals: A federal equality act that would extend civil rights protections to LGBT Americans, allowing trans people serve in the military, and upgrading to “honorable discharge” the status of service members who were kicked out of the military under Don’t Ask Don’t Tell.

Biden, who is considering running for president, declared transgender rights to be "the civil rights issue of our time" as he delivered the keynote speech, just hours after Hillary Rodham Clinton — his top rival if he enters the race — gave a rousing address elevating LGBT rights as a main pillar of 2016 bid. Biden said gays and lesbians shouldn't fear "those shrill voices" trying to undo gay marriage and other advances because Americans "have moved so far beyond them and their appeals to prejudice and fear and homophobia."

Clinton also pledged to press a new generation of laws to protect the gay and lesbian community, including penalties on child welfare agencies that discriminate against them, nondiscrimination protections in the military for transgender individuals and laws to help prevent violence against transgender people, many of whom are female minorities.

Obama's Gay Agenda Trumps Congress—Employment/ENDA

This week, President Obama's Equal Employment Opportunity Commission (EEOC) discovered groundbreaking new "gay rights" under Title VII of the Civil Rights Act of 1964 by reinterpreting "sex discrimination" provisions to enact a de facto Employment Non-Discrimination Act (ENDA) that Congress, including Democrats, has refused to pass for decades.  Thus, as quickly as activist courts can carry out this Obama precedent, virtually every sexual deviancy will be guaranteed in the workplace, including a cross-dressing man who suddenly shows up in a dress, could not be fired, not even from a Christian school.

In a decision dated Thursday, the EEOC said that employers who discriminate against LGBT workers are violating Title VII of the 1964 Civil Rights Act, which prohibits employment discrimination “based on race, color, religion, sex and national origin.”

In the past, courts have ruled that Title VII does not cover discrimination based on sexual orientation because it’s not explicitly mentioned in the law, but the EEOC’s ruling disputes that reasoning. . . .

The Equal Employment Opportunity Commission also argued this week that since courts have consistently ruled that the racial protections of Title VII apply to relationships, the sex protections should apply to relationships as well. Under Title VII, employers can’t discriminate against employees based on the races of their spouses or friends (so, for example, you couldn’t be fired for being in an interracial marriage). The EEOC’s Thursday ruling ensures that the same standard applies to sex as well, which means you can’t be fired based on whom you choose to date or marry.

The Equal Employment Opportunity Commission was created to enforce and implement the 1964 Civil Rights Act. This new interpretation radically expands the scope of those protections.

In its opinion, following a 3-2 vote, the EEOC said " 'sexual orientation' as a concept cannot be defined or understood without reference to sex," The Washington Post reported.

The final ruling, which stems from a complaint filed in 2012 by a man who claimed he was denied a job because he is gay, constitutes the EEOC’s official interpretations of Title VII of the Civil Rights Act of 1964, the primary statute governing employment discrimination claims against both public and private employers that will guide future EEOC enforcement of federal nondiscrimination laws.

Freedom for All Americans, the organization pushing for such protections at the state and federal level, said the EEOC’s decision highlights the need for a comprehensive federal law.

“Comprehensive nondiscrimination protections for LGBT people are strongly supported by Americans from all walks of life. We’ll continue working to ensure our laws at the municipal, state and federal level recognize that LGBT Americans deserve to live free from the fear of discrimination."

The defenses employers can use to fire workers because of their sexual orientation are slowly crumbling.  Another blow to sexual orientation bias came this week . . .

The [EEOC] commission delivered the decision in the case of a supervisory air traffic control specialist employed by the Federal Aviation Administration in Miami who claimed he was passed over for a permanent position as a front line manager because he is gay. The air traffic control specialist said his supervisor, who was involved in the manager selection process, had made derogatory comments about the complainant’s male partner.

In allowing the complainant’s case to move forward, the five-member EEOC ruled 3-2 that while sexual orientation is not explicitly listed in the Title VII as a prohibited basis for employment decisions, the question is whether an employer relies on sex-based considerations or takes gender into account when hiring, firing, or promoting.

. . . The commission issued a ruling similar to this week’s in 2012 when it determined that gender identity bias is prohibited by Title VII’s ban on sex discrimination. . . .

The commission did not widely publicize the ruling, dated Wednesday, but it quickly drew attention among advocacy groups and legal experts. “Discrimination on the basis of sexual orientation is premised on sex-based preferences, assumptions, expectations, stereotypes or norms,” the document stated. “‘Sexual orientation’ as a concept cannot be defined or understood without reference to sex.”

Though the ruling does not formally bind federal courts, the courts frequently defer to federal agencies when they interpret laws that come under their jurisdiction.

“In an area of law where we’re seeing rapid change, courts may well be interested in what the lead anti-discrimination agency has to say,” said Helen Norton, a professor at the University of Colorado Law School. “Courts wrestling with this question don’t have to feel that they’re first. There’s a government agency with expertise in anti-discrimination law that has taken this position.”

Several legal experts said the power of the ruling was that it simplified the legal standard for plaintiffs alleging discrimination.

The ruling partly accomplishes what gay rights groups have sought for years to achieve in Congress, where the federal Employment Nondiscrimination Act has languished for more than two decades. In November 2013, the Senate approved the law with 64 votes, including 10 Republicans.

James Esseks, director of the American Civil Liberties Union’s LGBT project, called the EEOC ruling “a monumental step forward” that would provide protection to millions of Americans.

But Esseks added that courts couldn’t be expected to interpret the ruling consistently and that a comprehensive federal law was still needed.

The Supreme Court may not think bans on gay marriage are sex discrimination, but the Equal Employment Opportunity Commission thinks anti-gay discrimination in the workplace is. The EEOC, in a 3-2 vote, has concluded that Title VII of the 1964 Civil Rights Act forbids sexual orientation discrimination on the job because it’s a form “sex” discrimination, which is explicitly forbidden. The opinion is 17 pages long, although the portion dealing with anti-gay employment discrimination is only pp. 5-14. The opinion follows by three years a decision from the EEOC that discrimination based on gender identity is also sex discrimination. That ruling on transgender employment rights has been broadly accepted by the federal courts.

The EEOC’s view on sexual orientation, however, runs counter to the rulings of several circuit courts. These courts have reasoned that “sexual orientation” is not among the list of prohibited bases for employment action, that Congress did not intend to eliminate anti-gay discrimination when it enacted Title VII, and that Congress has repeatedly refused to add “sexual orientation” to employment protections.

The EEOC calls these earlier circuit court decisions “dated” . . .

In regards to Thursday's decision, a similar ruling was handed down in 2012, when the EEOC determined that transgender workers were protected from discrimination.

Jennifer Meinig, executive director of the American Civil Liberties Union of West Virginia, called the ruling groundbreaking but said protections are also needed on the state level. According to Buzzfeed, the commission ruled that gender identity-based discrimination is barred by the sex discrimination ban.

“This is a significant development because protections for gay and transgender people are almost nonexistent in federal law and in 28 states, including West Virginia,” Meinig said.

Lesbians Attack Ohio Christian Videographer

When Courtney Schmackers, proprietor of Next Door Stories in Bexley, Ohio (a suburb of Columbus) was asked by Jenn Moffitt, 33, and Jerra Knicely, 34, to video their "wedding" ceremony, Schmackers declined the work citing her Christian beliefs.  Not surprisingly, the lesbian couple took to the Internet to trash Schmackers' business and then asked the Bexley Chamber of Commerce to enjoin the battle.  The Chamber promptly agreed to devise a new sexual-orientation policy that would deny religious liberty to area businesses.

Ohio currently does not allow same-sex marriage, and its anti-discrimination law does not include sexual orientation. However, a number of municipalities and cities, including Columbus, have ordinances that prohibit sexual-orientation discrimination. Bexley is not among them.

In Bexley, [homosexualists'] criticism also has been directed at the Bexley Area Chamber of Commerce, where President Colleen Krupp said the organization is “like the vast majority of chamber organizations nationwide” in not having a non-discrimination policy that applies to membership.

However, she said, the chamber board “believes that discrimination in any form is wrong and should not be tolerated” and is working to implement an anti-discrimination policy that would include sexual orientation.

In a statement, Bexley Mayor Ben Kessler said: 'Bexley, Ohio is a community that embraces diversity and welcomes businesses, families and individuals of ALL sexual orientation, race, religion, age, nationality, ethnicity, disabilities, socio-economic levels, etc. As an employer and a provider of services to our residents, we extend that same openness and inclusivity.'

Moffitt and Kincely reached out to the Bexley Area Chamber of Commerce through its Facebook page about five weeks ago to file a complaint against the business. They also shared their story on Facebook to raise awareness and get the attention of local officials.

The Bexley Area Chamber of Commerce addressed the incident on its Facebook page. Even though it does not have a nondiscrimination policy that applies to membership, the organization said it does not tolerate discrimination "in any form."

After reviewing the situation, the organization sent a letter to its members saying its board is in the process of rewriting its policy to forbid applicants and current members "from discriminating on the basis of race, color, religion, creed, gender, gender expression, age, ancestry, disability, marital status, sexual orientation or military status."

"The Chamber Board believes that discrimination in any form is wrong and should not be tolerated," the board said in the letter, which it shared on its Facebook page. "As we revise this policy, we plan to seek input from our membership as well. We hope to have these new policies in place very soon."

Although the [lesbian] couple filed the complaint, Ohio is one of 13 states that does not allow same-sex marriages, and Bexley is also a municipality that does not prohibit discrimination based on sexual orientation. Additionally, the Bexley Chamber of Commerce does not prohibit its members from discriminating based on sexual orientation.

The Bexley Chamber of Commerce issued a statement through Facebook on Monday condemning Schmackers' refusal of service. The post continued by stating that board members have decided that the chamber's policy must be changed so that this type of "discrimination" does not happen again.

"At our Feb. 11 board meeting, we discussed in detail how the Bexley Area Chamber of Commerce could ensure this does not happen again. The Chamber Board believes that discrimination in any form is wrong and should not be tolerated. At this meeting, the board agreed that our membership policy must be revised to reflect this. We began the process of re-writing [sic] our policies and guidelines."

Sexual Deviancy Special Class? Not in Charlotte NC

After contentious lengthy debate with massive citizen attendance and participation, the Charlotte, North Carolina City Council, by a 6-5 vote, rejected a proposed new ordinance for protections of homosexuals, transgenders, etc. (to make them a special class above other citizens).  In 2012, former City Manager Curt Walton unilaterally created special privileges for LGBT employees, but that policy does NOT apply to the general public.

In an often-heated meeting that stretched until nearly midnight and included more than 100 speakers, Charlotte City Council narrowly rejected an amended ordinance that would have provided protections for lesbian, gay, bisexual and transgender individuals in public spaces.

A deeply divided crowd filled the meeting chambers as well as an overflow room as speaker after speaker took a turn at the microphone, each making an impassioned plea for the council to vote a particular way. And that's after hundreds had rallied for hours before the meeting started Monday evening and thousands had sent emails to the council members.

The original proposal would have updated the city's existing nondiscrimination ordinance for commercial and transportation-for-hire enterprises and public accommodations, adding five new protected characteristics — marital status, familial status, sexual orientation, gender identity and gender expression. In addition, transgender individuals would be allowed to choose which restroom, locker room or shower to use in public places.

Before the final vote, council members had removed the section of the ordinance that would have allowed transgender people to use the bathroom of the gender they identify with. That issue drew the most vigorous opposition from dozens of speakers.

But even with the bathroom portion removed, council remained divided. Several council members had said they were opposed to removing that part, which would also have applied to locker rooms and showers, because it weakened the ordinance.

Mayfield and Autry, also a Democrat, voted against removing the bathroom section, and both voted against the final bill because they couldn’t support a half measure.

The final vote against the bill brought together both supporters and opponents of the original measure. [Kenny] Smith, a Republican, said he believed the bill was motivated not by a desire to end discrimination but by a political agenda to “impose the progressive left’s new morality on our citizens.”

Council members Michael Barnes, Kenny Smith, LaWana Mayfield, Ed Driggs, John Autry and Greg Phipps voted against it. Voting in favor of the ordinance were David Howard, Claire Fallon, Vi Lyles, Patsy Kinsey and Al Austin, all Democrats.

On Sunday, [Nancy Kraft, pastor at Holy Trinity Lutheran Church] told congregants she just doesn't understand how anyone could oppose the measure. "It feels mean and hateful to me," and added, "what makes me crazier is seeing such injustice being perpetrated by people who claim to follow Jesus."

Last week, Reverend Mark Harris at First Baptist Church in Charlotte said the city council is "trying to make protected classes out of purely abnormal behavior."

Both Reverend Harris and Pastor Kraft have done more than just preach to their faithful. They are both activists on this issue. Both have joined dozens of other clergy members in signing letters to the city council either for or against the expansion of the non-discrimination ordinance.

. . . Tami Fitzgerald, executive director of the North Carolina Values Coalition, a group opposed to the measure [said,] "It leads to religious discrimination by the city because it automatically discriminates and excludes businesses that have religious beliefs."

From "Policy gives city of Charlotte transgender employees bathroom choice" by Steve Harrison, Charlotte Observer 3/4/15

City of Charlotte policies [in place since 2012] prohibit discrimination against transgender employees, which allows them to use the bathroom of their choice on the job. The same goes for job applicants.

But those protections don’t always extend to nonemployees using public Government Center bathrooms, highlighting the complexities of the issue.

Lisa Metzger, 38, a wife and mother of 11 who lives in Matthews, said she alerted a police officer Monday night that transgender women were using the women’s restroom during the City Council meeting.

She even videotaped some of them, which Metzger says she showed police to prompt officers to stop the activity.

From "For Gay Rights Advocates, No Time To Rest After Charlotte Decision" by Paul Garber, WFDD-FM88.5 (Winston-Salem, NC) 3/4/15

It’s been a roller-coaster year across the state for gay rights advocates and opponents. In January, Greensboro became the first city in the state to pass a housing non-discrimination measure that includes protections for gays and transgendered people.

Chris Sgro is executive director of the gay and transgender advocacy group Equality NC, and a resident of Greensboro. He says even though the Charlotte measure failed to pass, he believes other cities across the state will continue to push for anti-discrimination policies.

“I still think the fact that we had that conversation with a majority of the Charlotte City Council and got them to a place where they want to provide these protections is going to provide pressure for other parts of the state – municipalities across the state – to consider protections for gay and trans folks.”
