The Boy Scouts of America on Monday ended its nationwide ban on openly gay adult leaders. But despite a compromise allowing conservative church-sponsored units to pick their own volunteer leaders, the Mormon church, the country’s largest sponsor of Scout units, said it might leave the organization.

To avoid the wholesale defection of conservative religious groups, the Boy Scouts said church-based local units would remain free to exclude gay adults from voluntary leadership roles like scoutmasters and Cub Scout den and pack leaders.

Mormons use the Boy Scouts as their main nonreligious activity for boys, and the Cub Scout and Boy Scout units they sponsor accounted for 17 percent of all youths in Scouting in 2013, the last year for which data have been published.

Under the Boy Scout policy adopted Monday, discrimination based on sexual orientation will also be barred in all Boy Scout offices and for all paid jobs — a step that could head off looming lawsuits in New York, Colorado and other states that prohibit such discrimination in employment.

. . . Scout officials say religious groups — which make up some 70 percent of chartered organizations — would still have the option to exclude gays even [with the new policy as] adopted.

“What they’re not taking into account is the new frontier that we’re on, where judges are being social change agents,” said John Stemberger, chairman of Trail Life USA, which bills itself as a Christian alternative to the Boy Scouts.

Trail Life issued its own eight-page legal memo, written by a former BSA lawyer who is now Trail Life’s general counsel.

“The church-chartered troop will likely be sued the moment it tries to revoke the membership of the homosexual member who wears his uniform to the Gay Pride Parade, revokes or denies membership to an adult who publicly gets married to someone of the same sex, or denies membership to the girl who believes she is actually a male,” the Trail Life memo reads.

“You’ve got a highly divided organization,” says Richard Ellis, a political science professor at Willamette University in Salem, Ore., and the author of “Judging the Boy Scouts of America.” “Now it’s not clear that even this solution, which is an attempt to get the [gay rights] issue out of the way, can do it, because nobody is happy with it.”

. . . Some 70 percent of Boy Scout troops are now run by faith-based groups. By the time the BSA considered changing its ban on gay Scout leaders in 2013, it polled its membership and got incredible pushback, Ellis says. Nearly all the councils in the Northeast wanted the anti-gay policy changed, while 80 percent of the Southern councils wanted it to stay the same. The organization worried about an exodus of members. In the end, it decided to go with lifting the ban on gay youths, but not gay adults.

A BSA decision to lift the ban on gay adults but still leave hiring decisions to the discretion of local religious-based organizations affiliated with troops might have seemed progressive if the Scouts had taken that stance 25 years ago, when many first urged it. But coming in 2015, it now seems to critics like too little, too late – a decision that will still allow for discrimination on religious grounds.

“Our position has been and remains clear – we continue to urge the Boy Scouts of America to embrace full LGBT inclusion, without exception,” says Liz Halloran, a spokeswoman for the Human Rights Campaign, which fights for gay rights, via an e-mail.

"The church has always welcomed all boys to its Scouting units regardless of sexual orientation," church spokesman Eric Hawkins said in a prepared statement. "However, the admission of openly gay leaders is inconsistent with the doctrines of the church and what have traditionally been the values of the Boy Scouts of America.”

Hawkins also confirmed the church is considering the possibility of creating an international program similar to Scouting and also made for young men ages 12 to 18.

"As a global organization with members in 170 countries, the church has long been evaluating the limitations that fully one-half of its youth face where Scouting is not available," he said. "Those worldwide needs combined with this vote by the BSA National Executive Board will be carefully reviewed by the leaders of the church in the weeks ahead."

The Catholic Church, another large charter organization with the Boy Scouts, did not offer a formal response to the vote Monday.

Now that the Boy Scouts of America will be embracing so-called "gay boys" as members, Christian churches across America will be dropping their sponsorship of local troops.  The downsized BSA will only be sponsored by secular civic organizations and liberal so-called "churches" who celebrate homosexual behavior between men and boys.

Although the new BSA policy only allows "gay boys," after the first lawsuit by a homosexual Eagle Scout turning age 18 who wants to be a troop leader, the BSA will be forced to go "fully gay."

[President of the SBC executive committee, Frank] Page said that the Southern Baptist Convention [SBC] -- the largest Protestant denomination in the United States -- would be holding its national meeting in two weeks, after which it would likely recommend that its 47,000 U.S. churches pull away from the Boy Scouts of America. From there, it is up to each individual church to decide what to do, said Page.

About 70 percent of all local Boy Scout troops are supported by religious groups, according to the Boy Scouts of America, and the Southern Baptist Convention currently sponsors "hundreds of troops, probably thousands," Page said.

The National Jewish Committee on Scouting, the Episcopal Church, the United Church of Christ, the Unitarian Universalist Association and the Metropolitan Community Church all urged full repeal of the longtime ban [on deviant sexual behavior in scouting].

One of the first religious organizations to denounce the Boy Scout's new policy on allowing gay members was the Assemblies of God, the world's largest Pentecostal group, saying in a statement, "We believe that the BSA policy change will lead to a mass exodus from the Boy Scout program, as Assemblies of God and many other churches can no longer support groups that are part of an organization allowing members who are openly homosexual."

Father Derek Lappe is the priest at Our Lady Star of the Sea in Bremerton [Washington].

"It was a very difficult decision, it's a very sad thing, with the long legacy we have of scouting in this parish," he said.

Ultimately, Lappe says the new scouting policy just doesn't align with the values and teachings of the Catholic Church.

"My concern is this definition of a young man, a 10 to 18 year old boy as "openly gay" or "openly homosexual"," he said.  "How is that supposed to be lived out within what we believe as Catholics and what we teach about Catholics."

Tim Hester, executive pastor of Southeast Christian, said the youth organization’s consideration of that issue started the discussion that eventually led to the church’s board of elders deciding against renewing the church’s charter with Troop 212, but it wasn’t the deciding issue.

Hester said Troop 212 leaders approached Southeast Christian — which in 2011 was listed as the fourth-largest congregation in the nation in a survey by Outreach magazine — when the gay vote issue first came up.

“Truly for us it’s a logical decision,” he said. “We cannot be distracted from the mission God has called us to.”

First Baptist Church of Helena Pastor Greg Walker told WBRC-TV that as a pastor and a Christian, he can’t allow a group “to openly support a sinful lifestyle under the umbrella of First Baptist Helena.”

The Rev. Mike Shaw, of the First Baptist Church of Pelham and former president of the Alabama Baptist Convention, says his church will no longer sponsor Troop 404 after the policy takes place next year.

“We’re not doing it out of hatred. The teachings of the scripture are very clear on this. We’re doing it because it violates the clear teaching of scripture,” Shaw told the Birmingham News.

. . . while the BSA’s proposed new policy would purport to leave in place its policy denying membership to adult leaders who are “open or avowed homosexuals,” it would in fact undermine the legal basis for maintaining that policy in states that prohibit discrimination on the basis of sexual orientation. In Boy Scouts of America v. Dale (2000), the Supreme Court ruled that the BSA has a constitutionally protected right under the First Amendment to its existing membership policy. That victory rested heavily on the BSA’s position that (as the Court summarized it) “homosexual conduct is inconsistent with the values it seeks to instill.” The resolution, however, is conspicuously silent on whether this remains the BSA’s position.

Further, because the proposed new policy would apparently allow youth members who are “open or avowed homosexuals” to occupy leadership roles in the troop, it is difficult to see on what basis the BSA could expect to justify barring adults who are “open or avowed homosexuals” from leadership roles. . . .

But is there a significant difference between a 17-year-and-11-month old youth leader and an 18-year-old (or older) adult leader—a difference so significant that the BSA could plausibly be thought to hold, and to be advancing, a position that “homosexual conduct is inconsistent with the values it seeks to instill” when it allows “open or avowed homosexuals” to be youth leaders but not adult leaders? The BSA’s failure to address this fundamental question is telling.

While 53% support gay marriage, 46% oppose it. A third would go further: They say gay or lesbian relations between consenting adults should be illegal.

The question of adoption by gay men and lesbians has shown the biggest gains in recent decades. By 61%-36%, those surveyed say gay men and lesbians should have a right to adopt children, more than double the support it had 18 years ago.

However, a majority of Americans, 52%-42%, say the Boy Scouts of America shouldn't allow openly gay adults to serve as troop leaders.

Americans are now inclined to say that being gay is something a person is born with [-- NOT!]. Surveys in the 1970s and 1980s showed the public overwhelmingly attributing homosexuality to upbringing or environment.

"Most Americans harbor no ill will toward people with same-sex attractions. But at the same time, they respect the right of parents to be the first to introduce the controversial topic of sexual orientation to their children," Sprigg said.

There were some partisan differences. Democrats were most favorable to the gay rights position with 60 percent saying gays should be allowed to serve as Boy Scout leaders and 75 percent saying gays and lesbians should be allowed to adopt. Republicans were the most opposed -- 26 percent would allow gay Boy Scout leaders and 46 percent support adoption rights for homosexuals. Independents were in the middle with a majority, 61 percent, supporting adoption rights, and a minority, 40 percent, supporting Boy Scout leadership.

Last July, the Boy Scouts of America announced that, after a two-year review, it would continue its policy of not allowing gays to become members, volunteers or leaders.

The poll showed stronger support for two other rights -- inheritance and health insurance. Seventy-eight percent support inheritance rights and 77 percent support health insurance benefits for gay and lesbian domestic partners or spouses. Though Republicans were the least supportive of these rights, a majority, 68 percent and 61 percent, respectively, supported them.

A lesbian leading a Cub Scout pack in Ohio, breaking the rule against homosexual leaders, has recently been dismissed from the Boy Scouts of America. Jennifer Tyrell, a 32-year-old Bridgeport mother of four, withdrew her 7-year-old son from the Boy Scouts of America when she was recently dismissed after serving as leader of his Cub pack for several months.

Tyrell is working with Change.org, a liberal political group, on a campaign to raise awareness about the Boy Scouts' policy toward gays and lesbians. She said she gathered 140,000 signatures and said she hopes to push the organization to accept gay leaders and scouts.

The organization said it respects people's right to a different opinion.

"Scouting will continue to teach our members to treat everyone with courtesy and respect," the [BSA] statement said.

The organization said it believes Scouting is not the right place for youngsters to be exposed to issues of sexual orientation.

Because of the policy, Tyrrell said she only reluctantly allowed her 7-year-old son to join up in Bridgeport, where she lives with her partner and their four children. Told, she said, by the local cub master that it didn't matter that she is a lesbian, she was drafted to lead the pack in September.

Jennifer Tyrrell has collected more than 126,000 signatures for a petition on Change.org that urges the Boy Scouts of America to end their policy banning gay youth and den leaders.

“Hunger Games” star Josh Hutcherson along with TV stars Jesse Tyler Ferguson from ABC’s hit sitcom “Modern Family” and Max Adler from Fox’s “Glee” all signed the petition and lent their support at the Gay & Lesbian Alliance Against Defemation’s Media Awards Saturday night, an event spokesman confirmed.

“I feel as though I’m right in this, and I feel one day they’ll realize that,” Tyrrell told the Daily News Monday.

“Hopefully, with the amount of signatures we’ve collected in less than a week, we’ll send a huge statement to the Boy Scouts of America — that people are ready for a change.”

"We can't be kicked out of the building or evicted, and we don't have to pay any rent," scouts attorney William M. McSwain said after the unanimous verdict by a jury of six women and two men.

The scouts' lawyers expect U.S. District Judge Ronald Buckwalter to issue a permanent injunction that bars eviction because of the policy - set by the national organization - that homosexuals cannot be scouts or troop leaders.

That's not necessarily the end of the dispute, however.

The jury's answers to the 11 questions on the verdict sheet were "inconsistent," City Solicitor Shelley Smith said, "and when verdict sheets have inconsistent answers, the potential exists that the verdict is flawed. We will be exploring our options."

Mayor Nutter said in a statement, "While the good work of the Boy Scouts cannot be disputed, the city remains steadfast in its commitment to prevent its facilities from being used to disadvantage certain groups."

In 2007, the scouts were ordered to vacate the 80-year-old headquarters they had occupied rent-free, or pay $200,000 a year to lease the building from the Fairmount Park Commission.

The scouts can now ask the court to order the city to pay legal fees of about $860,000.

A jury took only five hours to decide against the city and the firm of Schnader, Harrison, Segal and Lewis, which donated hundreds of otherwise billable hours to assist the city solicitor.

. . . In 2003, the council agreed to a compromise that would have allowed the city to continue to charge only nominal rent for the headquarters that the Scouts built in 1928 [with organization funds,] on city property at 22nd and Winter streets.

But that agreement quickly unraveled. The Boy Scouts of America cited a U.S. Supreme Court ruling that private organizations can't be forced to accept homosexuals. It threatened to decertify the local council if it compromised on this point.

The city still maintains that the terms of its original agreement allow it to evict the Scouts without citing a reason. One of the attorneys for the Scouts said as much in his closing argument.

. . . the city is likely to file post-trial motions and may look for a "more global" approach to the eviction that is not specific to the Scouts.

A three-judge panel . . . said it would await action by the U.S. Supreme Court before Barnes-Wallace v. City of San Diego, 04-55732, can go forward.

The plaintiffs, who identify themselves as being agnostic or gay, want to evict the Desert Pacific Council of the Boy Scouts of America from Camp Balboa in San Diego’s Balboa Park and the Youth Aquatic Center on Fiesta Island, also in San Diego, for which the scouts pay nominal rent to the city.

The case involves a series of projects by the Boy Scouts of America in San Diego. The private organization has provided millions of dollars in improvements to public facilities in exchange for their use but faces being banned because homosexuals and lesbians who never even were exposed to the work claimed their feelings were hurt.

The organization has asked the U.S. Supreme Court to overturn the decision from the 9th U.S. Circuit Court of Appeals, and now two major public interest law firms have joined them in their request.

"Radical homosexuals are attempting to use every means possible to destroy the Scouts despite a recent U.S. Supreme Court decision that recognized their First Amendment right to have a morally-based policy excluding homosexual involvement," said Richard Thompson, president of the Thomas More Law Center, which worked with the the Alliance Defense Fund on the friend-of-the-court brief.

At issue in the case are leases from the city of San Diego allowing the San Diego Boy Scouts to build and operate campgrounds and an aquatic center on city property for their use and the public's.

Thomas More Law Center and Alliance Defense Fund lawyers . . . argue the court's "permission ideological standing rule" now creates a new threat to faith-based organizations that choose to cooperate with the government in establishing public benefit programs by subjecting them to lawsuits from people who never even "observed" anything.

A cross erected in the remote Arizona desert by U.S. veterans in memory of their lost World War I buddies has become the focal point for an effort by the American Civil Liberties Union to eradicate references to Christianity from America's heritage.

. . . the attack on the cross in the desert . . . now needs a favorable ruling from the U.S. Supreme Court or faces demolition.

The Mojave Desert Memorial Cross has stood for more than 75 years in honor of America's lost soldiers. It was erected in 1934 by World War I veterans who saw the image of a doughboy in the shadows on the stone hillside and wanted a place to remember their lost trench-mates from the big war.

But the ACLU, representing a man from Oregon who has alleged he might drive on the desert road in Arizona and might be offended by the cross, has won lower court rulings that the cross must cease to exist.

The cross was covered in a bag when the court's ruling was released, and later encased in a plywood box so that no one could inadvertently see the representation of Christianity, officials said.

Attorneys with the Liberty Legal Institute, which calls the case a "microcosm" of the trend of hostility towards veterans' memorials in the U.S, say the impact will reach many more memorials than just the one in Arizona.

Judge Upholds Christian School Religious Liberty

A private religious high school can expel students it believes are lesbians because the school isn't covered by California civil rights laws, a state appeals court has ruled.

Relying on a 1998 state Supreme Court ruling that allowed the Boy Scouts to exclude gays and atheists, the Fourth District Court of Appeal in San Bernardino said California Lutheran High School is a social organization entitled to follow its own principles, not a business subject to state anti-discrimination laws.

"The whole purpose of sending one's child to a religious school is to ensure that he or she learns even secular subjects within a religious framework," Justice Betty Richli said in the 3-0 ruling, issued Monday.

As with the Boy Scouts, she said, the primary function of the school is to instill its values in young people, who are told of its policies when they enroll.

Kirk Hanson, a lawyer for the two girls, said he was disappointed and would talk to them about a possible appeal to the state Supreme Court.

PHILADELPHIA (AP) - A Boy Scouts chapter engaged in a long fight over gay rights has sued the city of Philadelphia to try to avoid paying $200,000 a year in rent to stay in the city-owned space that has been its headquarters for 80 years.

The Cradle of Liberty Council currently pays $1 annually for the space, but the city has given it until Saturday to open their membership to gays or start being charged fair-market rent.

The federal suit filed Friday accuses the city of censorship for targeting the Scouts but maintaining free or nominal leases with other groups that limit membership, such as Baptist and Roman Catholic church groups and The Colonial Dames of America.

The U.S. Supreme Court ruled in 2000 that the Boy Scouts, as a private group, have a First Amendment right to bar gays. But the policy has had consequences, with municipalities, charities and donors withholding support.

The Cradle of Liberty Council oversees about 300 troops in Philadelphia and suburban Delaware and Montgomery counties. It serves about 70,000 children, including 50,000 in the city, the suit said.

The Scouts say the higher rent would force them to cut programs, and represents the cost of sending about 800 needy children to summer camp.

The city owns the Beaux Arts headquarters constructed by the Scouts in 1928 and the land beneath it. The Scouts have spent about $60,000 a year to maintain the building, and another $1.5 million for renovations in 1994, the suit said.

Homosexual city solicitor breaks 1929 "in perpetuity" agreement and said to pursue Scouts with "vengeance"

The Philadelphia council of the Boy Scouts of America will lose the lease on its historic premises for its refusal to bow to pressure from the homosexual lobby to accept homosexual members and leaders. The city has told the Scouts they will be evicted if they cannot come up with US $200,000 a year "market value" rent for the land on which their building sits. Until now, the Scouts had paid a nominal $1 per year lease fee although the youth organisation had originally owned the premises in 1929.

The famous Beaux Arts style building was built and paid for by the Scouts, and turned over to the city with the understanding that the Scouts would be allowed to remain in it rent-free "in perpetuity."

City solicitor Romulo L. Diaz Jr. gave Philadelphia's "Cradle of Liberty Council" of the Scouts until Monday this week to renounce their policy. The Cradle of Liberty Council is the largest Scouts council in Pennsylvania and is the third largest in the entire Boy Scouts of America. The "City of Brotherly Love" has told the Scouts they have until June 1 to vacate their historic building.

..."This is an organization that has done more good for more children in this crime-ravaged city than most of the other so-called charitable groups in the City of Brotherly Love...At a time when this city is awash in blood, and we need as many safe havens for our children as possible, Philadelphia decides to go after an organization that is politically uncomfortable."

An editorial appearing in the online edition of Investor's Business Daily asked, "Isn't it hypocritical, though, to be intolerant in the name of tolerance, to say that it's wrong to disapprove of the lifestyles of others but OK to condemn the religious and moral beliefs of others?"

"How is it that an organization that has done immeasurable good for tens of millions of boys becomes one of America's most notorious and dangerous hate groups?"

Philadelphia Punishes Boy Scouts for 'Discriminating' Against Homosexuals

The action by city officials means that 30 new Cub Scout packs won't be organized, and that 800 needy kids will not be going to the Council's summer camp...

A pro-family activist devoted to countering the homosexual agenda says the United States has clearly reached the depths of depravity when a major U.S. city can decide to financially punish the Boy Scouts of America because they refuse to allow homosexuals into their group.

The Cradle of Liberty Council of the Boy Scouts of America, which serves about 64,000 scouts in Philadelphia and its suburbs, has been paying $1 a year rent for its downtown office. But recently the city decided that the Scouts must pay the fair market rent of $200,000 a year to remain in that city-owned location because the group "discriminates" against homosexuals.

Please take the time to contact the mayor to express your disgust at the treatment of this fine organization for young men.

...on May 31, the real-life (Philadelphia) City Council, without debate, and under pressure from an organization that promotes the rights of “sexual minorities,” stabbed the Scouts in the back. They voted 16 to 1 to break a 79-year-old agreement allowing the Cradle of Liberty Council of the Boy Scouts to occupy a building in a city park. The Scouts built the building in 1928, and turned it over to the city in exchange for a rent-free lease “in perpetuity.” Apparently, “perpetuity” in Philadelphia now means, “until gay groups boot you out.” The Scouts can stay only if they will open their ranks to open homosexuals.

Sexual immorality is now the moral high ground in Philadelphia, and the Boy Scouts are the bad guys. Does anyone with clout in Philadelphia see why this is monstrously wrong? Let’s be generous and assume that lots of people still don’t know about this. The story was ignored by all the networks except Fox News Channel, and the local press didn’t even put it on the front page.

It’s bad enough that the City Council wants to force the Scouts to allow homosexuals to be role models for young boys. There’s also the issue of child molestation.

Just ask the Roman Catholic Archdiocese of Philadelphia. They’ve faced lawsuits from 218 men and 33 women who claim to have been molested by priests. The church has paid out more than $1.4 million in settlements.

Councilman Darrell L. Clarke, the Democrat who introduced the motion, is urging the Scouts to “compromise. Honestly, no one wants to see them out of there.”

Okay, let’s be honest, Mr. Clarke. Everyone knows the Scouts cannot compromise. The lawsuits would bankrupt the organization. You’re telling them to slit their own throats or get out of town.
The Boy Scouts of America themselves have had to deal with hundreds of incidents of molestation. They cannot afford to surrender.

Given the clearly illustrated danger of mixing homosexual men with boys, it is criminal to use government power to force a youth group to put boys at risk just to please a special interest group. Actually, it’s criminal for any reason.

Because the mainstream media will not report it, many people don't know that the Boy Scouts once had a problem with gay scout leaders molesting boys...

It's also important to know that if the Dems are able to pass ENDA (Employment Non-Discrimination Act) they have vowed to use it to FORCE the Boys Scouts to accept homosexual scout leaders.
