Public Brings Amazing Grace Back to Alabama School

Elmore County School Superintendent, Dr. Andre Harrison, was quick to agree with a lone atheist that it's unconstitutional for the Holtville High School Marching Band in Deatsville, Alabama to play "Amazing Grace," but after his ban on the hymn caused a citizen revolt, Harrison was told by school counsel that it's OK to play Christian music at football games.
"I was reminded that, as a public school, we simply cannot endorse a religious message in our activities. I completely understand the frustration of some of our parents, but we have an obligation to follow the law, even when we don't want to."

Dr. Andre' Harrison said that the same person who complained to the district about the song also called the school's central office twice to say that the playing of "Amazing Grace" was unconstitutional.

"After word of my decision circulated, I heard from many concerned parents, and frankly I still had reservations about my initial decision. I asked counsel to do further research on this issue and present me with options that would keep the district in legal compliance, but permit performance of one of the most iconic songs in the history of our nation," Harrison said today.

In a statement to the Elmore & Autauga News, the Elmore County Board of Education said legal counsel recommended that the religious-themed song be pulled from the band's repertoire following the complaint.

"Our Constitution prohibits us from promoting religion in our educational programs and activities," the statement read, in part. "While we understand the feelings of the parents who are unhappy about the decision, we have an obligation to comply with the law."

Superintendent Dr. Andre' Harrison also issued this statement to the website: "When the question was raised about the band playing Amazing Grace, a song we all grew up singing, my first reaction was this is a message that should be celebrated. But, after consulting with legal counsel, I was reminded that, as a public school, we simply cannot endorse a religious message in our activities. I completely understand the frustration of some of our parents, but we have an obligation to follow the law, even when we don't want to."

School officials didn't say who issued the complaint, but it appeared to have come by telephone.

School, Cops Threaten Bible-sharing 7-year-old

Administrators at Desert Rose Elementary School in Palmdale, California banned first-grader Caleb Zavala from sharing Bible verses (notes given to him by his mother, Christina Zavala) to classmates during lunchtime, and then the Los Angeles Deputy Sheriff was dispatched to the family home to further forbid the boy from sharing his faith with anyone, anywhere on school property because "someone might be offended."

When one child shared one of these notes with the first-grade teacher, telling her, "this is the most beautiful story I've ever seen," the teacher intervened. After publicly rebuking the Zavala boy, she called Mr. and Mrs. Zavala and, invoking separation of church and state, told them that their son was not allowed to share bible verses on school grounds. The teacher was unimpressed with Mrs. Zavala's correct interpretation of the Establishment Clause and stated that if they wanted to share bible, it would have to be outside the school gates.

According, Mrs. Zavala and her son proceeded to hand out bible verses and stories to her son's friends at the school gate for a brief period after school let out. According to the Zavala's many children congregated to receive the stories.

On May 9, 2016, when Mr. Jaime Zavala came to pick up his son and distribute bible verses, he was approached by School Principal Pagliagro. Pagliagro told Mr. Zavala that it was "against school policy" to hand the bible notes out at the school gate and they would have to move onto the sidewalk, which was a "public place." Jaime and his son complied and soon returned home. It was at 4:30 pm on that day that the LA Deputy Sheriff knocked on their door, telling them the school had called to report that the child and his parents had been sharing papers at school and that this was not permitted.

Mrs. Zavala made it a practice of including a Bible verse and encouraging note in her son’s lunch bag. The boy would tell his friends about the note and read them aloud at the lunch table.

It wasn’t long before children asked for copies of the notes and Mrs. Zavala obliged – including a brief note to explain the daily Bible verse.

“This is a clear, gross violation of the rights of a child,” said Horatio Mihet, a Liberty Counsel attorney representing the first-grader who attends Desert Rose Elementary School in Palmdale. They are also representing his parents, Christina and Jaime Zavala.

“It was outrageous and should shock the conscious of every freedom-loving American,” Mihet told me. “Apparently all the real criminals have been dealt with in Palmdale – and now they’re going after kids who share Bible verses during lunch time.”

The Liberty Counsel, a nonprofit litigation organization which specializes in defending religious freedom, has since sent a letter to the Palmdale School District to inform the administration of the correct interpretation of the clause establishing separation of church and state, arguing that pupils have the right to exercise freedom of speech through printed materials.

"Therefore, it was improper to ban student religious discussion during lunchtime. The district cannot suppress and censor this discussion, or the one-page notes consisting of Bible stories and verses placed by C's mother in C's lunch for his own personal enjoyment and edification; which he voluntarily chose to share with his little friends during non-instructional time; which interested classmates were free to accept or refuse, at their own discretion," the letter stated.

"The additional copies requested by C from his mother, for his friends (who had specifically requested them from him), are likewise protected, and fall into no classification of material that might be lawfully prohibited by the school district," it added.

Lone Atheist Muzzles Penn. Students at Graduation

There will be no invocation or benediction at commencement ceremonies at Pottsgrove High School in Pottstown, Pennsylvania this year because last year a single, anonymous complaint frightened school officials into a panic.  As a result, constitutionally-protected, student-initiated Christian free speech has been officially banned.
"The decision was made after last year's graduation when a student went off script from the nondenominational prayer that has been done over the years and turned it into a very Christian prayer."

Justin Valentine was school board president during 2015 graduation and said a complaint from another board member was the reason prayer was pulled.

"What happened was there was one person, one complaint that we received, and that's what triggered this," he said. "We knew the driving force behind this not happening again."

Valentine declined to identify the individual.

Current board member Patricia Grimm was also on the board in August when the decision on prayer was made.

"To me, it's (prayer) student driven," she said. "This is a tradition we always have regardless of the law and this is what the students want. I know there was a lot of discussion about the student going off of his intended speech but there was only one complaint."

The change apparently is the result of one student’s decision to invoke Jesus Christ in his comments at last year’s graduation.

As a result, [Supt.] Feola consulted the district’s longtime Solicitor Marc Davis, who told her a 2000 ruling in California made the district’s practice illegal.

. . . although the decision was made in August, it did not become a public discussion until Thursday, part of discussion on Facebook — particularly among board members, and two former school board presidents.

“This is very disappointing to me too,” wrote board member Bill Parker. “While the district, due to case law, can not direct that there be a prayer as part of the ceremony, we can also not violate freedom of speech.”

Mike Neiffer, who served as school board president prior to Valentine and acknowledged that there are legal issues to be considered, posted “I think the issue is that the change doesn’t appear to have been discussed in public nor was the public allowed to comment on it. As for me, let the students decide. It’s their graduation.”

Atheists Nix Ohio Graduation Choir Tradition

Board members of the East Liverpool City School District demonstrated their ignorance of U.S. Supreme Court rulings, as well as their gullibility to atheist bullying when they decided to end the decades-long tradition of the school choir singing The Lord's Prayer at the East Liverpool High School commencement.
"When I was first on this board I expressed a concern about us singing. The comment made was that 'we know we are breaking the law, we will do it until we get caught.' Well, ladies and gentlemen we got caught."

When East Liverpool High School seniors graduate later this month, singing the Lord's Prayer will not be a part of the ceremony.

After a complaint by a parent, the district received a letter from The Freedom From Religion Foundation [FFRF, based in Wisconsin,] citing legal rulings on the separation of church and state.

. . . Larry Walton tells 21 News that the prayer has been part of commencement for the ten years he has been with the school.

However he says following the complaints, the school will no longer the prayer during the ceremony.

[Choir director Lisa] Ensinger said she sang the song at her own graduation and, when interviewed for her position, was asked what would happen if she was ever told students could not sing it.

"I said, 'That's the day I resign,' and now it's happened and my heart is broken," Ensinger told the board, adding that the Lord's Prayer has been sung for district graduations for 70 years and saying, "I hate to see that go. When we stop having traditions what do we have left?"

President Larry Walton said, "The Supreme Court says we can't do it," saying other districts have tried to fight it and, in at least one, the legal costs were more than $850,000.

Board member Richard Wolf questioned, "I don't know when we voted on this. Did we vote on this? If it's student initiated, it's like prayer at the flag pole. If those people want to institute a lawsuit, let them."

Since no public discussion or vote on the issue were held by the school board, the newspaper made a public records request for all emails between board members and [Superintendent Melissa] Watson to determine how the decision was made.

[The newspaper obtained] a flurry of emails between board members and Watson through May 1 in regard to the matter, with President Larry Walton the first to respond, saying, "Let us just not do it. We have 'gotten away' with it for 10 years. This is a battle we will lose. I don't believe we should waste our funds on such a legal encounter."

. . . [Board member Patricia Persohn wrote,] "I am hearing parents threatening to withdraw their students. I was elected to represent the views of the community, and they are screaming. At the time that I voted to replace the song, I thought we were being threatened with lawsuit. I do believe it is just a matter of time before we are engaged in a fight. We need to set this issue aside right now and move on. I will vote to let the song remain in the program."

In her initial emailed response, board member Sarah Porter said, "I'm OK with a lawsuit. I'm a Catholic girl, lol, I'm not opposed to the Lord's Prayer. In this day and age, I think the majority of the public will back us if a lawsuit is brought forth."

"As a person of faith it means a great deal to me as you know, but as an educator I see this as an opening to a very broad door that can cause great detriment to our music education program," said Ensinger.

As a music educator she says she knows what is allowed and what it not. She says the rules are, if a piece of music has an educational value, it's permitted. So, she questions if the Lord's Prayer is not permitted, what other pieces would not be permitted?

"Mozart... his Requiem Mass, would no longer be allowed. Handel's Messiah would no longer be allowed. All of the music of the Medieval period would never be allowed," said Ensinger.

Evangelist Wins Lawsuit vs. San Fran. Police, ESPN

Gino Emmerich and a Christian law firm will be paid $10,000 because Emmerich was forced by San Francisco police and sports TV outlet ESPN to cease holding a “John 3:16” sign outside of the Giants ballpark in July 2014.  Emmerich was singled out for holding a Christian sign among a plethora of signs and expressions of free speech by others in a crowd.

A traveling minister who carried his “John 3:16” sign to Willie Mays Plaza at AT&T Park before a Giants game, and said he was told to leave or face arrest, has settled his lawsuit for $10,000.

Gino Emmerich sued the city of San Francisco, but the settlement funds — $2,500 to Emmerich and $7,500 to his lawyer — will come from ESPN, which was filming the pregame activities and hired city police to keep order, City Attorney Dennis Herrera’s office said Tuesday. As part of the settlement, the city agreed to review the status of the plaza and the extent of the public’s right to carry signs or express opinions there.

. . . an ESPN producer walked up with four uniformed police officers and told [Emmerich] he would be arrested if he displayed his sign.

After the producer left, Emmerich said he nevertheless held the sign up in front of an ESPN camera. One of the officers then grabbed him from behind and moved him out of camera range, where police issued another arrest warning and let him go. All the while, Emmerich said, fans were in the plaza, some displaying other types of signs, though none with religious messages.

A settlement has been reached in a First Amendment lawsuit filed by The Rutherford Institute against police officers who allegedly intimidated and threatened to arrest a man who was lawfully and peacefully exercising his First Amendment rights in the Willie Mays Plaza prior to a Giants v. Dodgers game by holding up a “John 3:16” religious sign in the public plaza in front of the San Francisco Giants ballpark. The lawsuit, filed in the U.S. District Court for the Northern District of California on behalf of Gino Emmerich, alleged that police officers violated Emmerich’s right to free speech and assembly when they forcefully removed him from Willie Mays Plaza, surrounded him and threatened him with arrest if he did not cease displaying his “John 3:16” sign. Under the settlement agreement, the City and County of San Francisco have agreed to conduct an investigation about the status of Willie Mays Plaza in connection with the rights of citizens to exercise their First Amendment rights there.

On Sunday, July 27, 2014, prior to the start of a Giants v. Dodgers baseball game, Gino Emmerich arrived at Willie Mays Plaza carrying a “John 3:16” sign, a religious reference to a central tenet of Christianity. Other people were in the plaza, some displaying signs and otherwise communicating messages. Also in the plaza was a makeshift broadcast booth put together for a live broadcast and discussion of the Giants v. Dodgers game for ESPN SportsCenter. . . . Emmerich stationed himself in view of the camera, behind the commentators, and held up his John 3:16 sign. While Emmerich was holding up his sign, a police officer grabbed him from behind by his shirt and neck and moved him out of the view of the camera. Once Emmerich was clear of the cameras, he was surrounded by four police officers and warned, “If you go over there and hold that sign again, we will arrest you and the sergeant will come over here and decide where we are going to take you.” Emmerich then left the plaza as to avoid the possibility of arrest and turned to The Rutherford Institute for help.

“Much of what used to be great about America—especially as it pertains to our love of freedom and our commitment to First Amendment activities—has been overshadowed by a greater desire for security and an inclination towards political correctness,” said John W. Whitehead, president of The Rutherford Institute and author of Battlefield America: The War on the American People. “That this incident, with its police intimidation tactics, overt discrimination and censorship, took place in a public plaza dedicated to Willie Mays, a legendary baseball player who lived through an era of police tactics, discrimination and censorship, is a powerful indictment of all that is wrong with America today.”

Opposing Sexual Deviancy Verboten in Calif. School

A handful of students at Shadow Hills High School in Indio, California recently began wearing tiny stickers showing their opposition to the Gay Agenda advocacy that is widespread in the school.  Naturally, the sexual revolutionaries complained, so the the Desert Sands Unified School District has banned the stickers.

Both anti-gay stickers and pro-gay rights symbols previously had been allowed as a matter of free speech at Shadow Hills High School in Indio, a city outside Palm Springs. But Superintendent Gary Rutherford wrote in a letter to Shadow Hills staff on Monday that new “information” had prompted an additional review. He didn’t note what that information was.

“Recently some information has been brought forward that requires additional investigation and follow-up to determine a proper course of action,” Rutherford wrote. “Pending further investigation, we are going to ask students who are displaying the symbol showing a rainbow pattern with a circle and a line, at least for now, to remove symbols while at school.”

Site and district administration had previously said they could not ask the 12 students to remove the anti-gay symbols in the interest of protecting freedom of speech rights.

Officials would not comment on what additional information prompted the [reversal and] investigation. A call to Shadow Hills Principal Marcus Wood was not immediately returned.

The symbols began appearing on campus several weeks ago when a handful of students started wearing the anti-gay badges on their school ID cards. One of the symbols was placed on the window of the Gay Straight Alliance coordinator's classroom, and a student changed his Google Classroom profile picture to an image of the symbol, said AP U.S. History teacher Amy Oberman.

Teachers and students at Shadow Hills were upset with the district's rationale last week, saying that LGBTQ students on campus felt targeted by the students.

Students who placed anti-gay stickers on their identification badges at a Southern California high school have the right to wear the symbols, just as others can sport insignia supporting gay rights, administrators said.

Both symbols are allowed as a matter of free speech, as long as they do not cause a disruption at Shadow Hills High School in Indio, a city outside Palm Springs, administrators said in a statement emailed to staff last week.

“We all have a right to freedom of speech, but students also have a right to be educated without fear. This has always been our policy, and we will continue to enforce it,” according to their Wednesday statement.

“Sometimes people can be uncomfortable because of an opinion, but that doesn’t mean it’s bullying,” said Laura Fisher, assistant superintendent of personnel services.

Florida Police Let Abortionists Prohibit Prayer

After a challenge from pro-life lawyers, police in Hollywood, Florida now claim they never told Christians that the government would support attempts by the local abortion clinic to force eviction of praying pro-lifers from the public sidewalk at the clinic.

Representatives from Hollywood, Florida's 40 Days for Life chapter say that five times over the past three years, the group has, successfully and without incident, held prayer vigils outside A Woman's Center of Hollywood, an abortion provider located on Hollywood Boulevard. During such vigils, group members pray and try to educate women about alternatives to abortion.

But on February 10, three group members claim, a Hollywood Police officer ordered them off a sidewalk, violating their constitutional rights of free speech and assembly. While they are now demanding an apology from the police department, the department claims the protesters had actually been trespassing on private property.

. . . The group provided documentation that shows it applied for a permit to assemble outside the center from February 10 to March 20.

The group says three or four people were praying outside the center for 12 hours a day, each day.

Thomas More Society attorneys have sent a letter to the City of Hollywood, Florida, and the Hollywood Police Department challenging a police officer’s recent order forbidding pro-lifers from standing on a public sidewalk in front of a clinic that performs abortions, apparently at the clinic’s request. On the first day of the Spring 40 Days for Life prayer vigil outside A Woman’s Center of Hollywood abortion facility, Officer Del Castillo of the Hollywood Police Department told pro-life volunteers that they could not stand on the public sidewalk in front of the abortion clinic. Thomas More Society contends that this demand is a blatant violation of the pro-lifers’ First Amendment rights.

This is the third year that volunteers participating in the 40 Days for Life Hollywood prayer vigils have had a peaceful presence on the public property – including both the sidewalk and swale (grassy area between the street and sidewalk) – outside A Woman’s Center. However, last week, on the first day of this years’ campaign, Officer Del Castillo of the Hollywood Police Department told the pro-lifers that they could not stand on the public sidewalk because the clinic had said they did not want the pro-lifers there.  He stated that the abortion clinic has the right to determine who may and may not stand on the sidewalk in front of its building.  He implied that if this order was not obeyed, pro-lifers could be ticketed.

"We should not be banned from the public sidewalk just because we're pro-life," said John Hickey, a 40 Days for Life Hollywood volunteer. "We're exercising our First Amendment rights by holding a peaceful prayer vigil to help women and unborn children. Hopefully, Officer Del Castillo's supervisors will reverse his incorrect order so that our free speech will be respected for the rest of the 40 Days vigil."

Women's Health Link filed the lawsuit in September 2014, alleging Citilink violated its constitutional rights, specifically the First and 14th amendments, by refusing to display an advertisement/public service announcement for its free referral service for women seeking "life-affirming health care related services."

The case began in 2013 when Women’s Health Link asked to place advertising cards in the interior of the city public transportation company Citilink’s buses, LifeNews previously reported. Citilink denied the request twice, saying that Women’s Health Link is associated with Allen County Right to Life, a pro-life organization, and that the Women’s Health Link website discusses “controversial issues.”

Citilink reportedly has permitted many non-profit and government organizations to place public service announcements with various messages in the interior of their buses, including the state of Indiana, Parkview Health and the United Way.

According to court documents, the 11-by-17-inch ad would cost $524 for three months and says "You are not alone" and "Free resources for women seeking health care" on either side of the smiling face of a young woman, with the organization's website and telephone number on a banner below.

Citilink officials rejected the proposed ad on two occasions, saying their attorneys believed that the organization's website dealt with "controversial issues," according to court documents.

The woman who submitted the advertisement on behalf of Women's Health Link [Beck Rogness] was on the organization's board of directors and also was communications manager for Allen County Right to Life, according to court documents.

Women's Health Link and Allen County Right to Life share email addresses and a physical address.

So the request was resubmitted under the agency’s provision for “public service announcements by government entities, academic institutions, or nonprofit organizations.”

NASA Bans Jesus, Threatening Employees' Freedom

Lawyers at the National Aeronautics and Space Administration (NASA) told agency Christian employees to terminate use of the name 'Jesus' when announcing their scheduled lunch break gatherings, as they've been doing since the turn of the century.  Lawyers representing the employees are threatening a lawsuit for discrimination and violations of First Amendment rights of citizens.

The Liberty Institute, which is representing the Christian employees, threatened Monday to sue NASA over what it claims is religious discrimination. At issue is whether a praise and worship club should be allowed to use the name “Jesus” in NASA’s employee newsletter.

NASA told the Christian employees last year the meeting announcement they posted in the newsletter violated the government’s responsibility to remain neutral on religious matters, according to the Institute. The agency did not tell the Christian employees to stop meeting during lunchtime, but did order the club to refrain from using the name “Jesus” in their emails.

“It is illegal for the government to censor the name of Jesus from emails authored by employees,” Jeremy Dys, senior counsel for Liberty Institute, said in a statement. “Preventing a religious club’s announcement just because it contains the name ‘Jesus’ is blatant religious discrimination. We call on NASA to end their censorship and apologize.”

The praise and worship club has been meeting at NASA’s Johnson Space Center in Houston since 2001. They discuss their faith and sing worship songs during their lunch break.

These employees had formed a private group within the agency called the JSC Praise and Worship Club, an entity separate from the agency. As part of the group, employees meet together during lunch to pray, and no one is prevented from taking part in the group’s activities.

In an announcement email, one of the employees had used the word “Jesus.” A few days after the email went out, NASA lawyers clamped down and said the use of the word was absolutely unacceptable and would not accept the group’s offer to issue any kind of disclaimer to downplay its use.

The Liberty Institute wants NASA to issue a response by March 10 reconsidering its original position. If not, the Liberty Institute is ready to sue the agency.

Generic religious references and secular speech, like announcements for soccer camps, Latin Dance classes—or even Praise and Worship Club announcements without the name “Jesus”—are still permitted in JSC Today.

How in the world do these words [in the First Amendment of the U.S. Constitution] — “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof ...” justify NASA ordering a praise and worship club to stop using “Jesus” in a NASA-related newsletter?

Those who think the First Amendment and/or the “separation of church and state” (a phrase not in the U.S. Constitution, if that matters) supports the removal of each and every religious reference from the public domain (although it seems Christianity is usually the targeted religion) are either ignorant of the U.S. Constitution or have an agenda.

It is pure and simple. The First Amendment is meant to keep the federal government from mandating a religion — the kind of persecution and oppression that led many to risk their lives for freedom.

Instead, many are of the mistaken belief that the First Amendment is meant to remove all public displays of religion. And NASA has provided yet another example.

Kentucky School Censors Christmas from Charlie Brown

A religious liberty attorney representing a Kentucky Christian family has complained to the Johnson County School District about its decision to delete all Biblical references from the play "A Charlie Brown Christmas" at W.R. Castle Elementary School in Wittensville.  The district's attorney and state officials recommended the censorship after a lone complaint.
“And there were in the same country shepherds abiding in the field, keeping watch over their flocks by night, and lo the angel of the Lord came upon them and the glory of the Lord shone round about them, and they were sore afraid, and the angel said unto them, Fear not, for behold, I bring you tidings of great joy, which shall be to all people. For unto you is born this day in the city of David, a savior, tis Christ the Lord. And this shall be a sign unto you. You shall find the babe wrapped in swaddling clothes lying in a manger. And suddenly, there was with the angel a multitude of the heavenly host, praising God and saying, ‘Glory to God in the highest, and on Earth peace, good will toward men.’ . . . Principal Jeff Cochran said all Biblical references were removed from the play after receiving a message Friday from Superintendent Thomas Salyer.

Salyer says he made his decision based upon the advice of his attorney and state officials.

CNN reported last month that Linus’ recitation of the Bible passages was also at issue in the development of the 1965 animated television special “A Charlie Brown Christmas.”

Peanuts creator Charles Schulz wanted to include the speech, CNN reported, but the producers were hesitant. After much back and forth, the passage was left in, the network said.

Matt Sharp, an attorney with the Arizona-based Alliance Defending Freedom, said it was contacted by and is now representing Joey Collins, whose daughter is a cast member in the play that is scheduled for Thursday at W.R. Castle Elementary School.

“There is no violation of the so-called ‘separation of church and state’ by allowing children to learn about theater and the origins of Christmas through participating in a stage version of this beloved program that contains the same religious elements as the television version,” the letter Sharp sent to the district on Tuesday said. “. . . Given that courts have consistently held that schools may organize and sponsor Christmas programs and performances that include religious songs and study the historical origins of Christmas, there is no basis for the district’s decision to censor the religious aspects of ‘A Charlie Brown Christmas.’”

Meanwhile, Sharp said that his recommendations to school district officials are “constitutional.”

“We would even be willing to help the school district if the school district was sued” for putting the religious content back in the play, he said.

"The Supreme Court has consistently held that schools can teach about religion, and can use the Bible as a resource in curricular programs," ADF Legal Counsel Matt Sharp said. "So, when the issue has come up with Christmas programs, {The U.S. Supreme Court has} held that you can sing 'Silent Night' as part of a Christmas program, or include biblical references."

"They're losing all of these great works of classic western culture, of the musical impact and of being able to understand how the bible has influenced Shakespeare and 'Moby Dick' and all of these other things," Sharp said.

“Schools should not have to think twice about whether they can allow students to perform a classic Christmas production simply because it contains biblical references,” said Sharp in a press release. “‘A Charlie Brown Christmas’ has become an iconic Christmas story and tradition. Are school officials going to start demanding that other classic productions, such as Shakespearean plays, be censored just because they contain religious references?”

Christmas Parties Banned at Univ. of Tennessee

In an effort to increase "diversity and inclusion," UT Knoxville Chancellor Jimmy Cheek's Office of Diversity issued a directive that Christmas must be EXcluded from any "holiday parties" on campus.
"I could not believe that, especially in light of what's gone on the last couple of years with the debacle over sex week, then foolishness over the gender neutral pronouns that they put out a few months ago, and now we have the same group telling us that. Managers and supervisors shouldn't display any endorsement of religion."

An online memo this week from the University's Office of Diversity advised employees to make sure their holiday celebrations aren't Christmas parties "in disguise".

Senator Bo Watson said, "I don't think it's the job of the legislature to micro-manage the university, but this the second incident for this particular department within in the past year of what many of us will perceive to be poor judgment. . . . I think it's another example of the University trying to look so brilliant, that to the everyday citizen, they look stupid."

Chancellor Cheek has issued a statement defending the memo.

It said, "As a diverse campus, we do promote ways to be inclusive of all cultures and religions. I am disappointed that our efforts to be inclusive have been totally misconstrued."

All nine of the state's Republicans in Congress spoke out forcefully against the guidelines . . .

Lt. Gov. Ron Ramsey said UT Chancellor Jimmy Cheek should resign if he had anything to do with the guidelines, which are posted on the website of UT's Office for Diversity and Inclusion. Ramsey also hinted that the university could be stripped of its state funding.

U.S. Rep. Scott DesJarlais, a South Pittsburg, Tenn., Republican, slammed the holiday party suggestions as "nonsense" and said he would encourage the Tennessee General Assembly to investigate and, where necessary, "ensure that tax dollars are not being expended on this kind of frivolity."

On campus, students and faculty started online petitions in support of Cheek amid growing calls for his resignation.
"Students come to college to have an educational experience and engage in learning other peoples (sic) points of view both conservative and liberal," reads the petition, which is on the website change.org. "Although some in the Legislature may not realize that UT is a place for all students, Chancellor Cheek and Vice chancellor Hall have made this a priority. Over his time here he has worked to make this campus a place where students who are the majority and the minority can call home."

The university’s guidance warns students and faculty to “ensure your holiday party is not a Christmas party in disguise,” and to “not play games with religious and cultural themes” such as “Secret Santa.”  It warned that parties should have “no emphasis on religion or culture.”

“The Office of Diversity is not welcoming to all and hostile to none as they claim,” said [State] Senator Gresham.  “They are very hostile to students and other Tennesseans with Christian and conservative values.   By placing a virtual religious test regarding holiday events at this campus, every student who is a Christian is penalized.”

Senators Gresham and Bell criticized the Office of Diversity and Inclusion in August for a post on the university’s website asking students and faculty to toss out “he” and “she” when addressing students for gender-neutral pronouns like ”ze” and “zir”.  They also expressed disapproval over the university’s “Sex Week” which includes such events as drag shows, lectures given by a porn actress, an aphrodisiac cooking class and condom scavenger hunts.  Senators Gresham and Bell objected to student activity fees being used to help fund such events.

In a meeting this fall, the Senate Higher Education Committee found that UTK "far outspends" other universities in the state on their diversity programs, which goes far beyond the regulations required by state and federal law.

"Political correctness has been a scourge on American academia for too long," wrote [Lt. Gov.] Ramsey, R-Blountville. "If liberal arts universities in New York and Massachusetts wish to continue the practice that is up to them, but it has no place at institutions of higher learning in Tennessee."

"If the University of Tennessee cannot keep its house in order the General Assembly must shift funding to the University of Memphis, ETSU or other institutions of higher learning that don't embarrass us nationally on a regular basis," Ramsey said.

In a statement released Friday afternoon, Joe DiPietro — the UT system president who oversees campuses in Knoxville, Memphis, Martin and Chattanooga — said he respected the concerns of Ramsey and other Tennessee and federal lawmakers. He also praised [UT Knoxville Chancellor] Cheek, whom he credited with a series of “remarkable, transformative successes" at the Knoxville campus.

"We are in no way trying to dismiss this very important Christian holiday," Cheek said. "As a diverse campus, we do promote ways to be inclusive of all cultures and religions. I am disappointed that our efforts to be inclusive have been totally misconstrued."

The directive — entitled “Best Practices for Inclusive Holiday Celebrations in the Workplace” — instructed students and staff on how to effectively avoid the travesty of hosting a not very inclusive “holiday” party.

The reason for these intrusive measures is to make sure everyone “celebrate[s] your religious and cultural holidays in ways that are respectful and inclusive of our students.”

Christmas — the holiday the vast majority of Americans celebrate in December — is curiously treated by the memo as a minor festivity that’s only observed by a minority of students.

The desperate attempt to achieve “inclusion” at any and all level came at the expense of the vast majority’s wishes, which is typical for the aims of political correctness. The possibility that even one person of a designated protected class would be offended by a Christmas display is enough of a reason to purge all events of associations to the December holiday.

Christmas Tree Flyer Censored by NH School Supt.

A few days after Veterans' Day, Superintendent Robert Malay of School Administrative Unit 29 (Keene, New Hampshire) put Air Force veteran John Fletcher on notice that if he wanted to distribute invitation flyers in district schools for any civic events, the word "Christmas" is strictly forbidden.  The Lions Club and American Legion had previously sponsored the annual Christmas tree lighting in Marlborough, NH for over 15 years without incident.
"I was very upset, I really was.  If it's not a school sponsored activity, I don't understand why 'Christmas' had to come out of 'Christmas Tree'."

"He wanted me to change it to say "holiday tree lighting" instead," Fletcher told FOX25. "It's not a holiday tree, it's a Christmas tree. If you want a holiday tree, then do it for Valentine's Day, or Columbus Day, or whatever you want."

Fletcher and his wife - who play Santa Claus and Mrs. Claus at the tree lighting - used WhiteOut to remove the word "Christmas" from the flyer but refused to change the actual wording.

"In this case, this political correctness has just gone too far. it's just getting out of hand," Fletcher said.

[Fletcher] was so upset he wrote a letter to the Sentinel Source – the newspaper of record in that neck of the woods.

“As commander of the American Legion it offends me,” he wrote. “I respect all rights; always have. But do not take away our rights because you may offend someone else.”

I called Superintendent Malay to find out why the word “Christmas” needed to be deleted, but he did not return my message.

Folks, I chatted with at the local school are pretty upset at how Mr. Fletcher was treated. They say the superintendent really ruffled some feathers.

Maine Sues Pastor: Preaching Too Loud on Abortion

Maine Attorney General Janet Mills filed a civil rights lawsuit against Lisbon Pastor Brian Ingalls for peacefully preaching a pro-life message outside a Planned Parenthood facility in Portland. Abortionists appealed to the pro-abortion Democrat AG saying that pregnant mothers inside their facility could hear the pastor's concerns about “murdering babies, aborted babies’ blood and Jesus.”

"All patients have the right to receive medical services free of 'the cacophony of political protests,' in the words of the United States Supreme Court," Mills, a Democrat, said in a statement. "While protesters have every right to say anything they want in a public area in the vicinity of a medical facility, they are not permitted to disrupt another citizen's healthcare services."

Maine law protects the right of any person to receive "safe and effective" medical services without disruptions caused by loud noises.

According to the complaint, police warned Ingalls to keep his voice down so that he would not be heard inside, but he continued yelling anyway.

The lawsuit would prevent Ingalls, a regular protester at the clinic, from coming within 50 feet (15 m) of the facility.

Attorney General Janet Mills filed the complaint against Brian Ingalls, 26, under the state's civil rights act. Mills said he violated the rights of patients at the Portland facility on Oct. 23 when the sound of his voice directed to the second floor disrupted counseling sessions between staff and patients.

Ingalls, of Lisbon, declined to comment when reached by email. His attorney, Erin Kuenzig, said it's a "baseless lawsuit" filed to circumvent a U.S. Supreme Court ruling about protester buffer zones. . . . The U.S. Supreme Court ruled in 2014 that similar buffer zones in Massachusetts violated free speech rights.

"They're trying to claim that it's some kind of safety concern that he was preaching the Bible on a public sidewalk," Kuenzig said. "Just completely meritless."

The suit filed in Cumberland County Superior Court alleges that Ingalls frequently is a protester at the Portland Planned Parenthood location and on Oct. 23 “was yelling up toward the second floor of the building at 443 Congress St. about murdering babies, aborted babies’ blood and Jesus.”

Erin Kuenzig is with the Thomas More Law Center, which is representing Ingalls in this suit. She said that Mills’ suit is an attempt to rehash a prior legal battle the law center fought against Portland when the city tried and ultimately failed to implement a 39-foot buffer zone for protests around Planned Parenthood’s Congress Street location.

“The complaint that was filed was completely meritless and just an attempt to circumvent the court ruling issued in October,” Kuenzig said by phone Tuesday. “This is essentially another buffer zone. … It’s clear that Planned Parenthood doesn’t like what Mr. Ingalls is saying, and he’s simply a Christian who is preaching from the Bible.”

Kuenzig said one flaw in the complaint is that there is no guideline about how loud someone can protest.

“There’s no way to judge that,” she said. “This is just another way to try to silence pro-life advocates outside the abortion clinic.”
