Court Nixes Police Favoring Muslims vs. Christians

On June 15, 2012, Christian evangelists were ordered by police to leave the Arab International Festival in Dearborn, Michigan because some Muslims there perpetrated acts of violence against the Christians.  Last week, the 6th Circuit Appeals Court ruled in favor of Bible Believers against defendant Wayne County, Michigan.

“We find that defendants violated the Bible Believers’ First Amendment rights because there can be no legitimate dispute based on this record that the [police] effectuated a heckler’s veto by cutting off the Bible Believers’ protected speech in response to a hostile crowd’s reaction. . . . The video record evinces next to no attempt made by the officers to protect the Bible Believers or prevent the lawless actions of the [Muslim] audience.”

The case stems from a 2012 incident in which members of a group called Bible Believers were pelted with rocks while carrying a pig’s head and telling Dearborn Muslims at the street festival that they would “burn in hell.” Wayne County sheriff’s deputies told the evangelists to leave or be ticketed.

“From a constitutional standpoint, this should be an easy case to resolve,” said Judge Eric Clay, writing for the majority. “However, it is also easy to understand Dearborn’s desire to host a joyous festival celebrating the city’s Arab heritage in an atmosphere that is free of hate and negative influences.

“But the answer to disagreeable speech is not violent retaliation by offended listeners or ratification of the heckler’s veto through threat of arrest by the police,” Clay wrote.

Some [Muslim] members of the crowd responded by throwing plastic bottles, eggs and milk crates at the Bible Believers.

The 6th U.S. Circuit Court of Appeals in Cincinnati, Ohio, made its ruling based on the First Amendment, saying the evangelist group Bible Believers should have been protected even though its speech was loathsome and intolerant. The opinion also mentioned the obligation of police when confronted with constitutionally protected speech that threatens to incite violence.

“Bearing in mind the interspersed surges of ethnic, racial, and religious conflict that from time to time mar our national history, the constitutional lessons to be learned from the circumstances of this case are both timeless and markedly seasonable,” Judge Eric Clay wrote.

The opinion by the court on Wednesday overturned a lower-court judgment and sent the case back to a federal court in Detroit, where a judge will decide the damages.

An en banc federal appeals court [review by 15 judges] has ruled that Christian evangelists who were “preaching hate and denigration to a crowd of Muslims” may collect damages because police told them to leave.

Police conferred with the Wayne County corporation counsel and told the Bible Believers they would be cited for disorderly conduct if they did not leave. More than a dozen officers escorted the group members from the festival.

The Constitution, however, does not allow “an angry mob of riotous adolescents to dictate what religious beliefs and opinions could and could not be expressed,” the court said. . . .

The court said Wayne County “effectuated a constitutionally impermissible heckler’s veto,” violating the Christians’ rights to free speech, free exercise of religion and equal protection.

The case against Wayne County, Sheriff Benny Napoleon and members of the department [deputies Dennis Richardson and Mike Jaafar], originally was handled in Detroit by U.S. District Judge Patrick Duggan, who recently retired.

The full court agreed one year ago to reconsider the case after setting aside a 2-1 decision by a three-judge panel in August 2014.

In that opinion, the panel said sheriff’s deputies didn’t violate the evangelists’ free speech rights

Such rehearings are rare.

“We are reviewing the court’s opinion,” sheriff’s office spokeswoman Paula Bridges said in a statement Wednesday. “No decision has been made as to what next steps, if any, will be taken therefore we will refrain from comment at this time.”

The lawsuit was originally filed in Detroit federal court by Ruben Chavez, Arthur Fisher, and Joshua DeLosSantos, a group known as the Bible Believers.

U.S. District Judge Patrick Duggan threw out the case, and an earlier appeals ruling upheld that decision, but the Wednesday opinion overturns the first two, ordering the case back to the lower court for calculation of damages.

"The only references to violence or lawlessness on the part of the Bible Believers were messages such as, 'Islam is a Religion of Blood and Murder,' 'Turn or Burn,' and 'Your prophet is a pedophile.' These messages, however offensive, do not advocate for, encourage, condone, or even embrace imminent violence or lawlessness," the majority found in an opinion written but U.S. 6th Circuit Judge Eric L. Clay.

"Although it might be inferred that the Bible Believers' speech was intended to anger their target audience, the record is devoid of any indication that they intended imminent lawlessness to ensue. Quite to the contrary, the Bible Believers contacted Wayne County prior to their visit, requesting that the WCSO keep the public at bay so that the Bible Believers could 'engage in their peaceful expression.'"

The Jersey City Board of Education had originally proposed to close schools next Thursday so that Muslim students could observe the [Eid al-Adha] holiday, and the City Council unanimously supported it a week ago. The academic year would have extended one day to June 23, 2016 as a result.

But during the nearly four hours of debate at the board meeting Thursday, some of the Jewish faith said they felt they were being discriminated against because they weren't getting their own school days off for holidays like Rosh Hashanah and Yom Kippur.

In the original resolution announcing the vote, the board said it was "committed to honoring the great diversity of our district, including our religious diversity," and that it will "continue to engage our communities to explore ways to support its diverse communities and celebrate our many cultures and faiths."

On Friday, Jersey City Schools Superintendent Marcia Lyles said board members were concerned that it would be too disruptive to declare a new school holiday without more advance notice.

On Saturday, Jessica Abdelnabbi Berrocal, a Muslim parent in Jersey City who started the petition for the holiday in June, said she thinks the vote rather meant that "they aren't ready for the change."

Lyles's Chief of Staff Maryann Dickar, who also attended the meeting, said it is inaccurate to characterize the debate on the holiday as "a conflict between Jews and Muslims." She said she recalled only one statement that referenced the Jewish holiday, among "hundreds" of other comments.

New York City public schools were scheduled to close Thursday for their first time recognizing the Muslim holiday Eid al-Adha. The district, which serves about 1.1 million students, was due to become the largest school system in the United States to shut down for the observance. Local Muslims welcomed the move as a symbol of the community's acceptance and shift toward inclusion, Agence France Presse reported.

New York City has an estimated 600,000 to 1 million Muslim residents, and between 10 and 12 percent of its public school students identify as Muslim. That means that holy days tended to devastate attendance -- for example, the last time Eid al-Adha was on a school day, more than one-third of PS/IS 30 in Brooklyn was absent, according to a news release.

About two years after first agreeing to give students the day off, Mayor Bill de Blasio announced the calendar change in March. He officially canceled classes on Eid al-Fitr, which occurred in July and marked the end of the fasting month Ramadan, and Eid al-Adha. Eid al-Adha, also called the Feast of Sacrifice, runs from Wednesday night to Thursday night. Schools in New York City were already closed Wednesday for the Jewish observance of Yom Kippur.

“It is a huge victory to actually see the day come,” says Linda Sarsour, a member of the Coalition for Muslim School Holidays and a New York activist with three children.

“As an imam as well as a parent I am very happy,” agreed Imam Shamsi Ali, director of the Jamaica Muslim Center in Queens.

“I’m sure this kind of policy from the government side will push Muslims further to feel a sense of belonging,” he said.

New York follows at least seven other school districts that close for Eid in New Jersey, Massachusetts and Vermont, but activists are still campaigning in other parts of the country.

Ibrahim Hooper, spokesperson for the Council on American-Islamic Relations (CAIR), the country’s largest Muslim civil liberties organization, agreed that the holiday comes at the right time.

The number of religion-related lobbying groups in Washington has grown five-fold in the past 40 years, with their spending reaching almost $400 million annually, the Pew Research Center’s Forum on Religion & Public Life latest study showed. It identified 212 groups, up from 158 a decade ago and 40 in 1970.

This certainly doesn't make the liberal media happy.

. . . the economic downturn seems to have taken a toll on the expenditure of many religion-related advocacy groups, the study shows. Of the 104 groups for which expenditure data were available for 2008 and 2009, 56 of them said their spending was lower in 2009 than in the previous year, with an average decline in spending of about $500,000. The 104 groups altogether saw a net drop in spending of about $14 million during the two-year period.

The study found 15 percent of the groups that answered a questionnaire on their activities said meeting with officials was their most frequently used method of advocacy. This came in second after the most popular strategy — educating constituents on issues — which 41 percent of the groups cited as their most-used method.

The study shows that a majority of the groups, 64 percent, work on both domestic and foreign issues, while 20 percent engage in domestic issues only. The domestic topic most commonly addressed by the groups include the relationship between church and state, civil rights and liberties for religious and other minorities, life issues (such as abortion and capital punishment) and family and marriage.

Some longtime Hill advocates highlighted the report’s finding that the vast majority of religious advocates stick to softer education-type outreach and don’t get into explicit politics, such as donating money to candidates. Others said the report showed how tiny the field is, compared with the tens of thousands of mostly corporate lobbyists that have ballooned in number in Washington.

Compared with their numbers in the U.S. population, Muslims and Jews make up a bigger chunk of advocates. There are 17 Muslim advocacy groups and 25 Jewish advocacy groups, while the faith groups represent less than 1 percent and 1.7 percent of the American public, respectively, according to Pew.

Of the 212 groups studied, about half (51%) address domestic church-state issues, such as debates over public displays of religion, hate-crime laws and school vouchers. A similar portion (48%) works on civil rights and liberties, such as gay rights, women’s rights, workers’ rights and the rights of religious and ethnic minorities.

About four in-ten groups in the study (42%) work on bioethics and life issues, which include abortion, capital punishment, stem cell research and end-of-life issues. Roughly as many (39%) address family and marriage issues, including the definition of marriage, domestic violence and fatherhood initiatives. About one-in-six groups (17%) work on other domestic issues, a catch-all category that includes corporate accountability/responsibility, limited government/private enterprise, elections/campaign finance, capitalism, volunteerism and veterans’ issues.

Diane Bechtol of Aldersgate says this is something Christians are called to do: Be neighborly and develop relationships - even those who don't share your beliefs.

But Dr. Alex McFarland, a Christian theologian and radio talk show host, charged these churches “have crossed the line from respect and tolerance, to ... affirmation and endorsement.

"We as the church are called to show love, we're called to help. But to let a building simultaneously be used for the activities of a mosque and also the activities of Jesus Christ, it's just incompatible. And I think it's one more example of political correctness and hyper-tolerance gone awry."

Mohamed Elsanousi adamantly disagrees, saying it’s good for the country to know churches like these are extending a hand to Muslims.

Elsanousi says there are many churches and even synagogues in America where Muslims share space with Christians. “We feel good about it,” he says.

Mosque construction is at an all-time high. As of September, there were 1,897 mosques in the United States, a 57 percent increase since 2000.

Mr Choudary said the March rally was organised by the Islamic Thinkers society, an extremist group based in New York.

A terrible drama is unfolding in Afghanistan: There are reports that Said Musa, whose situation I described at Christmas, will soon be executed for the ‘crime’ of choosing to become a Christian.

Musa was one of about 25 Christians arrested on May 31, 2010, after a May 27 Noorin TV program showed video of a worship service held by indigenous Afghan Christians; he was arrested as he attempted to seek asylum at the German embassy. He converted to Christianity eight years ago, is the father of six young children, had a leg amputated after he stepped on a landmine while serving in the Afghan Army, and now has a prosthetic leg. His oldest child is eight and one is disabled (she cannot speak). He worked for the Red Cross/Red Crescent as an adviser to other amputees.

He was forced to appear before a judge without any legal counsel and without knowledge of the charges against him. “Nobody [wanted to be my] defender before the court. When I said ‘I am a Christian man,’ he [a potential lawyer] immediately spat on me and abused me and mocked me. . . . I am alone between 400 [people with] terrible values in the jail, like a sheep.” He has been beaten, mocked, and subjected to sleep deprivation and sexual abuse while in prison. No Afghan lawyer will defend him and authorities denied him access to a foreign lawyer.

Newspapers in the U.K. and elsewhere in Europe have reported the story, but with, the exception of the Wall Street Journal and, of course, NRO, American outlets have not found it worthy of attention.

Responding to a question at a "town hall" meeting with students at St. Xavier College in Mumbai, India, President Obama satisfied Islamists and pundits in India, but his own explanation of jihad and the greatness of Islam plays differently with American victims of terrorist attacks:

"The phrase Jihad has a lot of meaning within Islam. Islam is one of the world's great religions and more than a billion people who practise Islam, an overwhelming majority, view their obligations to their religion as the one that reaffirms peace, justice and fairness," the President responded.

"Jihad can in no way assume the form of violence against the innocent and those who are perpetrating such violent acts have done great disservice to Islam," said Kamal Farooqi, a prominent member of the All India Muslim Personal Law Board. "To that extent President Obama is correct," he said.

He carefully avoided saying that he was opposed to jihad — which has several meanings, including both holy war and a personal quest for self-improvement — and instead said: “I think all of us recognize that this great religion in the hands of a few extremists has been distorted to justify violence towards innocent people that is never justified. And so, I think, one of the challenges that we face is, how do we isolate those who have these distorted notions of religious war.”

While Mr. Obama was dancing around questions — figuratively speaking — on Sunday, he also participated in some literal dancing, showing off some moves that, to the delight of photographers traveling with him, are likely to provide iconic images of his trip. Mr. Obama’s short performance came after student dancers doing a show for him implored him to join in.

Rev. Graham Loves Muslim People, Hates Islam

Rev. Franklin Graham, the son of Rev. Billy Graham, called Islam “wicked” and “evil” . . .

“They want to build as many mosques and cultural centers as they possibly can so they can convert as many Americans as they can to Islam.”

"It does not," Bahloul said. "Listen, we have some people, Christians, Muslims, Jewish and other, who misuse the holy books. It's understandable. I do not deny this," he said. "But it's something the extreme majority of the Muslims, they have a proper understanding about this religion."

When pastor Steve Stone [of the 550-person Heartsong Church in Cordova] initially heard of the mosque and Islamic center being erected on the sprawling land adjacent his church, his stomach tightened.

Then he raised a 6-foot sign reading, "Welcome to the Neighborhood."

On a 31-acre stretch at Humphrey Road and Houston Levee, Memphis Islamic Center leaders plan to build a massive gathering place during the next several years. It will include a mosque, youth center, day care center, indoor gym, sports fields, medical clinic and retirement home.

. . . Until Memphis Islamic Center is complete, members pray at nearby Heartsong Church . . . as members of the Christian congregation take the opportunity to sit in on Ramadan prayers and meet people at the nightly gatherings, much of that mystery and fear has dissipated.

The Memphis project hasn't been entirely free of criticism. Bloggers and religious publications have speculated that the Memphis group is receiving funding from Saudi Arabia, which the local Islamic board says is completely false.

When it is finished, the new facility will be a center for the whole community, and a place for interfaith cooperation . . .

Flush Koran Go to Jail - 'Hate' Crimes Arrest in NY

A 23-year-old man was arrested Friday on hate-crime charges after he threw a Quran in a toilet at Pace University on two separate occasions, police said.

Stanislav Shmulevich of Brooklyn was arrested on charges of criminal mischief and aggravated harassment, both hate crimes, police said. It was unclear if he was a student at the school. A message left at the Shmulevich home was not immediately returned.

The Islamic holy book was found in a toilet at Pace's lower Manhattan campus by a teacher on Oct. 13. A student discovered another book in a toilet on Nov. 21, police said.

Muslim activists had called on Pace University to crack down on hate crimes after the incidents. As a result, the university said it would offer sensitivity training to its students.

The school was accused by Muslim students of not taking the incident seriously enough at first. Pace classified the first desecration of the holy book as an act of vandalism, but university officials later reversed themselves and referred the incident to the New York Police Department's hate crimes unit.

The incidents came amid a spate of vandalism cases with religious or racial overtones at the school. In an earlier incident on Sept. 21, the school reported another copy of the Quran was found in a library toilet, and in October someone scrawled racial slurs on a student's car at the Westchester County satellite campus and on a bathroom wall at the campus in lower Manhattan. Police did not connect Shmulevich to those incidents.

While we cannot approve of this man's actions, an arrest seems pretty extreme does it not?

After all, 'artists' are given awards and TAX DOLLARS for submerging crucifixes in urine...
