Obama's Monument to the 'Goodness' of Deviant Sex

Today, President Obama's senior advisor Valerie Jarrett dedicated America's first national monument to homosexuality, hedonism, and mental illness.  At the ceremony in Greenwhich Village, Jarrett praised the 1969 LGBT Stonewall riots as a battle for civil rights and emphasized this new monument as a symbol of the "true goodness" of the Gay/Transgender Agenda.

"This week I'm designating the Stonewall National Monument as the newest addition to America's national park system," Obama said in a video released by the White House on Friday.

Interior Secretary Sally Jewell visited the Stonewall Inn in 2014 to announce a new National Park Service initiative to identify important places and events associated with the LGBT civil rights struggle.

The National Park Service, which turns 100 this year, has expanded its efforts to include sites that tell the story of the LGBT community and other diverse U.S. communities, park service director Jonathan Jarvis told CNN in April.

The effort includes a Lesbian, Gay, Bisexual, Transgender and Queer (LGBTQ) Heritage Initiative, launched in 2014, to identify places and events associated with the story of LGBTQ Americans for inclusion in the park service.

Local and federal officials joined members of the LGBT community at a dedication ceremony officially designating the historic Stonewall Inn as a national monument to gay rights.

“I could not be more proud than today, where we are here to celebrate and recognize the first new unit of the National Parks system, the first national monument dedicated to the story of the lesbian, gay, bisexual, transgender community and their fight for equal rights,” Director of the National Park Service Jonathan Jarvis said.

Jarvis said Stonewall and Christopher Park have now been welcomed into the family of “America’s most important places,” that includes the Grand Canyon, Yosemite and the Statue of Liberty.

Speakers at the ceremony included Secretary of the Interior Sally Jewell, Sen. Kirsten Gillibrand and Mayor Bill de Blasio, among many others.

Toilets NOT in Restrooms: Next for Transgender

(Caution: News articles below are NOT satire.)

Cooper Union for the Advancement of Science and Art in New York City is the first college in the nation to designate all restrooms as "genderless" by replacing men/women signage with a simple designation of the type of toilet fixtures found inside (toilets, urinals, partitions, etc.).

What's next?  Because privacy has been deemed unnecessary, doors should simply be removed so that the type of fixtures and partitions may be viewed prior to entry, but even better, for safety (to counteract sexual predators), architects' new designs should place toilets and urinals in open spaces — along hallways, for example.

Bill Mea, acting president of the Cooper Union, informed his campus via email that soon all the college's bathrooms will be gender neutral. Anyone will be allowed to use any bathroom, and the signs designating bathrooms for either men or women will be replaced with signs that say either “Restroom With Urinals and Stalls,” “Restroom With Only Stalls” or “Restroom Single Occupancy.”

. . . many colleges and universities around the country have been slowly expanding support for transgender students by adding gender-neutral, single-stall bathrooms around campus or simply allowing people to use the bathroom that aligns with the gender identity. But Cooper Union appears to be the first college to completely eliminate gender distinctions in bathrooms.

The policy change arose out of a yearslong push by student activists for reform and an impromptu on-campus test of the policy. Several transgender students at Cooper Union began fighting for “degendered” campus bathrooms about two years ago and were joined along the way by up to 50 more students and others who helped in various ways. Last fall, some of them removed the signs from bathrooms in a building on campus and left in their place banners reading just “Bathroom :)” or “Degendered.”

An elite American college has removed men and women signs from its lavatories in a move aimed at allowing transgender students to use the public conveniences of their choice.

The decision – effectively enabling transgenders to decide which facility to use, regardless of their gender at birth – has been hailed as a victory by student campaigners.

. . . Cooper Union’s decision was not the product of a bruising legal battle or a drawn-out showdown before the media. And although it took nearly two years of urging by the student activists for the administration to act, the campus of 950 engineering and arts students doesn’t exactly feel battle-scarred.

“Cooper Union has always been on the forward edge of social justice issues,” [Acting President Bill] Mea said in a recent interview. “From the start, in 1859, we admitted women, African Americans. It has always been an institution that promoted equality amongst people.

“I never got any overt bigotry or nastiness,” he added. “Some would have preferred to keep things exactly as they were. But the majority of them were very supportive. People thought, ‘Why is this an issue at all?’ As in, why aren’t we already doing this?”

“When there’s a gendered space, there’s a sense of ownership to that space,” Mea said, explaining why the school chose to remove the men’s and women’s signs altogether. “When people see someone who they think doesn’t belong there, it can create stress for everyone. So we thought, let’s just take that away.” Almost all students and faculty are continuing to use the same bathrooms without issue, Mea added. “Visitors are figuring it out pretty quickly, too.”

I thank our students who raised the issue of gendered spaces and how they create health concerns and make some of us feel unsafe in an environment where health and safety are the top priorities in a student’s ability to learn. As is often the case, our students are at the forefront of raising both concerns and our consciousness on matters of importance. . . .

We, who are in positions of power, have the obligation to not only stand with those without power, but to stand in front of them, clearing a path for them to walk. I cannot change the outside world and how it treats transgender and gender non-conforming people, but I can change the Cooper Union environment to help everyone feel safe when they are inside our buildings. Please know that my decision comes from a personal sense of obligation to others, which is a reflection of my beliefs and, I believe, an extension of the beliefs held by our founder.

Going forward, we will identify the restrooms in the Foundation Building and 41 Cooper Square and the common-area restrooms in the Residence Hall as follows:

    Restroom with Urinals and Stalls
    Restroom with Only Stalls
    Restroom Single Occupancy

We are creatures of habit and most of us will continue using those restrooms that we normally have used, but they will no longer be owned by a specific gender. I also ask that none of us practice gender policing, where we attempt to restrict someone from using the same restroom we are using or make them feel uncomfortable for doing so. If you feel uncomfortable sharing a restroom, then the single-occupancy restrooms will now be available to you. As with all changes, this will take a little time to implement, so please be patient as we work through the signage and lock (single-occupancy restrooms) changes.

Bisexual Man Convicted of Hate Murder by NY Jury

This week, Elliot Morales, 36, was found guilty by a Manhattan jury of murder as a hate crime for shooting Mark Carson, a 32-year-old homosexual, in New York City in 2013.
"Motivated by irrational rage, the defendant targeted and executed a defenseless young man based on his sexual orientation after taunting and insulting the victim and his companion."

Witnesses testified at Morales' trial that he shouted anti-gay slurs at Carson and his roommate in Greenwich Village before firing a fatal shot when the men confronted him.

Morales, who represented himself, admitted pulling the trigger but argued that the shooting couldn't have been a hate crime because he is bisexual.

New York's hate crime law doesn't say attackers need to be of a different ethnicity or sexuality than their victim.

Morales admitted shooting Carson but said he acted in self-defense and couldn't be guilty of a hate crime because he is bisexual. His star witness was a transgender woman who testified that she was his ex-lover.

In Morales' closing argument last week, he wept and told jurors that he was "not a bigot of any type" and that charging him with a hate crime was "ridiculous."

Police said Carson and his roommate were passing in front of a pizza parlor shortly after midnight on May 18, 2013, when Morales called out to them, using slurs and saying the men looked like "gay wrestlers." The two confronted Morales, following him around a corner, before he pulled a revolver and shot Carson in the face at close range, authorities said.

Assistant District Attorney Shannon Lucey said in her closing argument that Morales had issues with his own sexuality and was jealous that Carson and his roommate were openly gay.

The jury of four men and eight women [it would appear] deliberated for two days after two weeks of emotional testimony in State Supreme Court, during which Mr. Morales represented himself and took the witness stand to declare he was not prejudiced toward gay people. Murder as a hate crime carries a minimum sentence of 20 years to life, five years more than a second-degree murder conviction.

A few minutes later on Avenue of the Americas, Mr. Morales encountered Mr. Carson and Mr. Robinson, two gay men from Brooklyn who were out on the town on a warm Friday night. As he passed them, Mr. Morales called the men “gay wrestlers,” Mr. Robinson testified. Mr. Carson spun on his heel and confronted Mr. Morales.

Spewing antigay insults, Mr. Morales dared Mr. Carson and Mr. [Danny] Robinson to come around the corner onto Eighth Street to settle their differences, Mr. Robinson testified. They followed him, thinking it was a bluff.

There, just after midnight on May 18, 2013, in the shadow of a closed bookstore, Mr. Morales shot Mr. Carson while Mr. Robinson was on the telephone with the police, witnesses said.

Bruce Vento Elementary in St. Paul is joining other public schools in opting out of holiday celebrations as school officials strive to be more culturally sensitive and inclusive. The school has a predominantly Asian and black student body, and English is a second language for more than half of its pupils, who come from a range of faith backgrounds.

In a letter to parents last week, Principal Scott Masini said his rationale was to avoid "encroaching on the educational opportunities of others and threatening a culture of tolerance and respect for all." He acknowledged it would be an unpopular decision for some.

The letter drew both criticism and support as it started circulating on social media, with some people praising the policy for its sensitivity to diverse cultures and others decrying it as political correctness. The Star Tribune newspaper in Minneapolis ran an editorial calling the decision misguided and urged Masini to reconsider.

As word spread, the school district issued a statement saying its longstanding policy "discourages programs and festivities that celebrate observances unless they are required by law." That means government holidays celebrating the birthdays of President George Washington, President Abraham Lincoln and Martin Luther King Jr., along with Veterans Day, are still OK.

Mayor Bill de Blasio and City Schools Chancellor Carmen FariƱa announced the addition of the new holiday to the school calendar in June.

The city school system will become only the second major urban school district in the nation, after San Francisco, to close on [the Asian] Lunar New Year.

When de Blasio announced in early March last year that the Mulsim holy days Eid al-Adha and Eid al-Fitr would appear on this year's school calendar, Lunar New Year advocates began to push to have their holiday added.

The Department of Education was able to add the Lunar New Year holiday to the school calendar by consolidating two half-days previously designated for staff administrative work, of which neither could count toward the 180-day minimum, into one full day. This allowed room for the addition of the Lunar New Year without any loss in state aid-able days.

. . . the city's 12 congressional members sent a letter to de Blasio dated March 9, saying they were happy Eid al-Adha and Eid al-Fitr would become public school holidays, but were "puzzled and concerned" about why Lunar New Year was left out. Four days later, city and state elected officials held a rally outside City Hall. On April 1, legislation was introduced in Albany to amend New York's education law to recognize Lunar New Year as a public school holiday for any city with one-million people — namely New York City.

Former Queens state Assemblyman Jimmy Meng, a Democrat, was the first to propose such a bill in 2005, but it failed to gain a sponsor in the state Senate. Meng's daughter Grace, a former state assemblywoman who is now a Democrat congresswoman from Queens, also introduced legislation in early 2009 with support from state Sen. Daniel Squadron, a Democrat whose district includes Chinatown.

After several months went by without any news, more than 40 elected officials, advocacy groups, and community leaders sent an open letter to de Blasio in June, saying his administration did not keep a promise to meet before the end of May for discussions. Around the same time, the state Senate unanimously approved a bill making Lunar New Year a public school holiday.

Following mounting pressure, the mayor, who controls the city's school system with state approval, announced on June 22 through Twitter that Lunar New Year would be added to the 2015-2016 calendar. The message was published in English, Chinese, and Korean.

Across the metro area and the country, schools are juggling sensitivity with holiday fun as student bodies become increasingly diverse. Several schools have turned to seasonal celebrations to include all students, and some have scaled back in-class celebrations to save teaching time.

[St. Paul's] Vento school is echoing that rationale in its decision to stop celebrating major holidays, to avoid “encroaching on the educational opportunities of others and threatening a culture of tolerance and respect for all,” Masini said in the letter addressed to families. “My personal feeling is we need to find a way to honor and engage in holidays that are inclusive of our student population.”

Masini was cheered and jeered by people online. Some said fun was being sucked out of schools. He responded in a comment released by the school district Thursday. “I’m struggling with this and I don’t know what the right answer is,” he said. “But, what I do know is celebrating some holidays and not others is not inclusive of all of the students we serve.

Wayzata Public Schools no longer observes specific holidays, opting instead for seasonal celebrations, said spokeswoman Amy Parnell. Valentine’s Day is the only exception — certain schools still decide to recognize the holiday.

The policy reads, in part:  “Schools shall discourage programs and festivities arranged to celebrate holidays and other special days, and shall strive to eliminate them, except where such observances are required by law.”

Exceptions to the policy are Veterans Day and the birthdays of Martin Luther King, George Washington and Abraham Lincoln. When school is held on those days, state law says “at least one hour of the school program must be devoted to a patriotic observance of the day.”

[St. Paul Public Schools spokeswoman Toya] Stewart Downey said Superintendent Valeria Silva supports the district’s policy on holiday observances. But the district will gather input from schools in case the school board wants to change the policy.

Accused Bisexual Abuser Hired by Multiple Schools

Days after Jinwoo Seong, 36, was fired by the New York Department of Education from Martin Van Buren High School in Queens for oral sex with a male student and groping numerous students of both sexes, he began teaching math at Don Bosco Technical Academy (middle school) in the Paterson, New Jersey school district, having passed the necessary background check.
“Jinwoo Seong’s inappropriate conduct makes it clear that he has no place in New York City public schools.”

In October, New Jersey OK’d Seong’s application to recognize his New York certifications — a month before he was fired from NYCs as schools investigator Richard Condon wrote in a letter he had “no place” in the schools, the report said. He started at Don Bosco in a $62,000 position on Dec. 7, the report said.

The [New York] Post reported that the investigation found he’d exposed himself to a male student, touched a girl’s breast and butt, cracked “gay jokes” and had a girl measure a boy’s genitals. The New York Deptartment of Education assigned Seong to a “rubber room” where he reported and sat all day until his firing was official on Nov. 30, according to the Post.

Seong has denied the allegations. Capt. James Smith, executive director of security and internal investigations for Paterson schools, told the Post that Seong passed a criminal background check because he was never charged with a crime.

Seong’s lawyer, Vincent White, said in a letter to Paterson officials that his client “has never been charged with any crime by local law enforcement.” White’s letter, dated Feb. 1, also described the New York City School District’s eight-page report accusing Seong of the sexual activity as “extremely flawed.”

White told Paterson officials that the New York report “ignored the fact that students gave inconsistent, hearsay statements and some alleged victims even denied the truth of the allegations until they were further prodded to confirm them.” White said students at Martin Van Buren High School in Queens were retaliating against Seong for calling their parents about discipline problems.

District officials said they were unaware of the New York investigation targeting Seong until contacted about the situation late last week by a reporter from the New York Post. The Post published a story about Seong on Sunday. The story said Seong’s termination by the New York education department took effect Nov. 30.

The report says Seong denied the allegations. Seong’s lawyer wrote to Paterson school officials that he hoped his client “will not be further victimized due to these baseless allegations made by some troubled students.”

Seong, who was fired, managed to get a new job in Jersey simply by not revealing his troubled past. The case shows how a teacher accused of shocking misconduct can slip through bureaucratic cracks and back into the classroom.

Capt. James Smith, executive director of security and internal investigations for Paterson schools, on Friday immediately ordered Seong’s removal from the classroom pending further inquiry when informed by The Post about Condon’s report.

“If you’ve been disciplined for inappropriate conduct with a student, we’ll take action,” Smith said he told Seong.

The state is investigating Seong to determine if he should be stripped of his license.

Gender Redefined by NY City Law; Biology Be Damned

Sexual revolutionaries are trumpeting the latest New York City reinterpretation of existing law to elevate the Gay Agenda by giving special privileges to "transgender and gender non-conforming persons."  The new language rejects human biology with its new definition of gender as one’s “actual or perceived sex and shall also include a person’s gender identity, self-image, appearance, behavior or expression, whether or not that gender identity, self-image, appearance, behavior or expression is different from that traditionally associated with the legal sex assigned to that person at birth.”

The new rules give special rights to perverts, as well as any and every variation of sexual deviant so that such “individuals be permitted to use single-sex facilities, such as bathrooms or locker rooms, and participate in single-sex programs, consistent with their gender, regardless of their sex assigned at birth, anatomy, medical history, appearance, or the sex indicated on their identification.”

New York City has warned landlords, employers and businesses they could be running afoul of the law by purposely calling a transgender woman "him" or "Mr." when she prefers a female title and pronoun, or by barring her from using a women's restroom.

New guidelines detail the legal protections of transgender and gender-nonconforming New Yorkers and what constitutes discrimination under the city's Human Rights Law, the New York City Commission on Human Rights said on Monday.

Failing to provide employee health benefits for gender-affirming care or failing to accommodate people undergoing gender transition, such as medical appointments, could violate the law as well, they said.

New York City provides stronger protections than most local laws in the United States and goes beyond federal law as well . . .

Some cities around the country have added transgender people to anti-discrimination protections, and New York Gov. Andrew Cuomo did likewise for his state this fall. Other communities have rebuffed them: Houston voters this fall defeated an ordinance that would have established nondiscrimination protections for gay and transgender people.

The rules also declare that transgender people can't be denied access to the restroom or locker room where their gender identity belongs, at their discretion. Unisex, single-occupancy bathrooms are suggested but not required.

Objections from fellow patrons or employees "are not a lawful reason to deny access," the guidelines say. . . .

"Today's guidance makes it abundantly clear what the city considers to be discrimination," which can lead to fines of up to $250,000, Commissioner Carmelyn P. Malalis said in a statement. . . .

Fewer Abortions, but Most are Blacks & Hispanics

In a new report, President Obama's Centers for Disease Control and Prevention compiled statistics showing that the number of unborn babies killed in the U.S. continues to decline each year.  The report also shows that well over half of all abortions where race was recorded were on black or Hispanic women, but in New York City, these minorities accounted for over three-quarters of the dead babies.

The number of abortions performed in the United States hit an historic low in 2012, continuing a 25-year-long gradual decline, according to a new report from the Centers for Disease Control.

About 699,000 abortions were reported to the CDC in 2012 - a 4 percent drop from the year before, or about 31,000 fewer abortions, the CDC said.

"From 2003 to 2012, the total number, rate and ratio of reported abortions decreased 17 percent, 18 percent and 14 percent, respectively, and reached their lowest level in 2012 for the entire period of analysis," the CDC said in its report.

In 2012, the abortion rate fell 5 percent to 13 abortions per 1,000 women of child-bearing age. That is about half what it was in 1974, the year after the landmark Supreme Court decision that established a nationwide right to abortion.

The CDC data is not a complete national picture. It's based on reports from health departments in 47 states, Washington and New York City. California, Maryland and New Hampshire don't report abortion numbers.

Earlier this year, The Associated Press surveyed health departments in 45 states, gathering more recent data, mostly from 2013 and 2014. The AP found that abortions continued to fall in those years. Declines were seen in states that have passed anti-abortion laws as well as in more liberal states.

Among these abortions categorized by race and ethnicity – see Table 12 in the surveillance report – the CDC says there were 148,971 black babies killed by abortion in 2012 (36.7% of the 405,795) and 75,868 Hispanic babies (18.7%).

For whites, there were 152,673 abortions, or 37.6% of the total. In another category labeled “other” there were 28,283 abortions, or 7% of the total. The “other” category includes Asians and Native Americans, as well as ethnicity reported as “unknown.”

The Census Bureau says that blacks make up 13.2% of the U.S. population and Hispanics comprise 17.4% of the population. Combined, blacks and Hispanics make up 30.6% of the population, yet 55.4% of the abortion reported by race were of black and Hispanic babies.

In total, there were 70,997 abortions in New York City in 2012. Among those abortions, 31,328 were black babies (44.1%); 22,917 were Hispanic babies (32.3%).

Also, there were 9,704 white babies aborted (13.7%), and 7,048 “Other” babies aborted (9.9%) in New York City in 2012 – the "Other" children were Asian, Native American, or of “unknown” ethnicity.

Blacks make up 25.5% of the population in New York City, according to the Census Bureau, and Hispanics comprise 28.6% of the population. Yet Hispanics and blacks equal 76.4% of the abortions in New York City.

Kids' Sexting Arrests — Overreaction, Say Parents

Two 14-year-old boys in Smithtown School District (Long Island, NY) have been arrested because one had sex with an underage girl while the other filmed it and then transmitted it to other kids.  The charges against the two boys include a felony for disseminating indecent material to minors as well as a misdemeanor for child abuse.  Dozens of students at Kings Park High School have now been suspended for participating in the transmission of this sexually explicit material.

Meanwhile, the sexting epidemic is prompting more education "experts" to advise that sexting doesn't harm kids, but rather what's needed is education in "safe sexting."

Suffolk County police said an encounter that occurred off school grounds between a male and female, who knew each other, was recorded on a cellphone by a male acquaintance in late October. Police said the recording was distributed electronically.

Further dissemination of the video may result in criminal charges, police said.

Smithtown School District confirms it is investigating the incident and working with Suffolk County police on the investigation into the allegations that its students were also involved in the sexting.

Andrew Fenton's son is one of dozens of students in the Kings Park Central School District on Long Island who are now suspended for this week for allegedly texting or even viewing a video of another student in a sexually explicit video.

Fenton told Eyewitness News that kids were pulled into the principal's office at Kings Park High last Friday, and 20 parents had a meeting with the principal on Monday morning. Two students have officially been arrested.

"It's impossible to believe that your son could get into trouble because somebody forwarded a video to his phone that he has no control over receiving it," says Fenton.

Thomas Phelan said his 15-year-old son was unfairly dragged into a sexting scandal involving several students at Kings Park High School and William T. Rogers Middle School simply for receiving a text message.

“My son was an unwilling participant because he didn’t give anyone permission or authority to send this over to him,” he said.

“A kid to receive that on their phone, I don’t know how they punish those specific kids because you can’t stop what you receive on your phone.” parent Wayne Davignon told WCBS 880’s Mike Xirinachs.

The school district posted a letter to parents on its website that said: “Possession and/or disseminating of indecent material is illegal. This can be a serious violation of the KCPSD Code of Conduct and a crime, which can result in suspension and/or arrest.”

At least one of the suspended students attempted to attend class at Kings Park High School on Tuesday morning, but school officials called his father and told him the boy would need to be removed, Newsday reported. The father reluctantly consented and, shortly after 9 a.m., two police officers escorted the boy off the premises.

Distributing obscene images of minors is a felony in New York, and a spokesperson for the Suffolk County Police Department told FoxNews.com that students found to have passed along the sexting images could be arrested.

Any students who attempted to defy the suspension were subject to arrest if the district requested it, a spokesperson for the Suffolk Police Department said. Police maintained a presence at the school on Tuesday morning.

Yes, WE do have a serious problem. However, from my perspective it is that our young people are carrying mini computers in their back pockets that are both unfiltered and largely unsupervised. This is a shared problem, and more than just an issue of one student, one decision, or one suspension.

This is not simply a Kings Park issue, but rather a more global issue. The good news is that this is an issue that we can address together as a community.

Many of our children are using mobile devices and social media in perfectly safe, normal, and educational ways. However, some of our children are engaging in problematic behavior.

The thing that deeply upsets me is that very few, if any, of our students district-wide reported any recent problematic behaviors to an adult. This I find troubling. There is a law on the books called the 911 Good Samaritan Law, where a person cannot be arrested for calling 911 if they are with someone in immediate need of attention. My goal over the next few months is to work with our principals and parents to get the word out that we need our young people to be good citizens and report problematic behavior to an adult. In most cases, no school discipline would result for the reporter/upstander.  On the contrary, the young person would certainly be rewarded for helping to make Kings Park a safer place to live and go to school.

. . . For the past century, we’ve been worrying that new forms of media are fostering sexual immorality in the young. And we’ve called upon our schools to stem the evil tide. . . .

The schools are an easy target, but the wrong one. Public ambivalence about youth sexuality limits what the schools can do, nor do we have strong evidence that schools can affect teenagers’ behavior, in any event. And it’s hardly certain that youth sexting is the dangerous scourge that most adults imagine. . . . nobody has ever shown that the sexting induces kids to engage in riskier behavior. . . .

Many teenagers regard sexting as a normal part of courtship . . . [they] know that it can be perfectly innocuous . . . when a romantic couple shares intimate photos and deletes them right afterward.

. . . So how should we address the issue of sexting? What if we tried to meet the kids where they are? The most promising sex education initiatives right now are text-messaging services, which allow teenagers to submit questions anonymously and receive informed answers. In North Carolina and Texas, these services are operated by public health departments; others are run by organizations like Planned Parenthood. . . .

6-day-old Baby NOT a Person, Says NY Appeals Court

A pregnant Jennifer Jorgensen crashed her car in 2008 while on drugs and/or alcohol causing her near-full-term baby to be delivered by emergency C-section.  Jorgensen was initially sentenced to 3 to 9 years in prison for second-degree manslaughter because her baby girl died six days afterward. However, the highest court in the state of New York overturned that conviction, because the case hinged on the question of intent of the state law "to hold pregnant women criminally responsible for engaging in reckless conduct against themselves and their unborn fetuses, such that they should be subject to criminal liability for prenatal conduct that results in postnatal death? Under the current statutory scheme, the answer to this question is no."

Prosecutors argued that Jennifer Jorgensen was speeding, intoxicated, and unbelted when she crossed into traffic in 2008 and hit another vehicle head-on, killing Mary and Robert Kelly. Jorgensen, of Long Island, was eight months’ pregnant at the time.

She was acquitted of manslaughter in the deaths of the Kellys but convicted of recklessly causing her daughter’s death.

But the Court of Appeals, in a 5-1 ruling, said the state Legislature didn’t intend to hold a pregnant woman responsible for such harmful conduct to herself or her fetus unless it’s intentional.

Any imposition of criminal liability for actions of pregnant women where a child later dies from injuries suffered while in the womb needs to be clearly defined by lawmakers, Judge Eugene Pigott Jr. wrote. “It should also not be left to the whim of the prosecutor.”

“Conceivably, one could find it ‘reckless’ for a pregnant woman to disregard her obstetrician’s specific orders concerning bed rest; take prescription and/or illicit drugs; shovel a walkway; engage in a contact sport; carry groceries; or disregard dietary restrictions,” Pigott wrote. “Such conduct, if it resulted in premature birth and subsequent death of the child, could result in criminal liability for the mother.”

At present, that’s not in New York’s criminal law, Pigott wrote.

In a dissent, Judge Eugene Fahy wrote that he could not join in a ruling that analyzes New York statutes to determine that the 6-day-old child was not a person because she was unborn when her mother crashed. “The pertinent parts of the Penal Law speak to victims as they are, not as they were at the time the acts giving rise to the crime were committed.”

In June 2009, Jorgensen was indicted for aggravated vehicular homicide, driving under the influence of drugs and alcohol and — charges related to the death of the infant — manslaughter in the second degree and endangering the welfare of a child.

Her first trial ended with a hung jury. In a 2010 retrial, Jorgensen was convicted on only one charge: second-degree manslaughter for causing the death of her daughter. A 3- to 9-year sentence was stayed pending her appeal. An appellate court subsequently upheld her conviction.

The court said that Suffolk County prosecutors "concede that, had defendant not consented to the cesarean section with the result that the child be born alive, she would not have been prosecuted for manslaughter in the second degree." Ruling against Jorgensen, then, "would create a perverse incentive for a pregnant woman to refuse a cesarean section out of fear that if her baby is born alive she would face criminal charges for her alleged reckless conduct, jeopardizing the health of the woman and the unborn fetus."

State legislators have put down laws to criminalize self-abortions, but has left the question "ambiguous" as to whether it's a crime to be reckless while pregnant.

"We conclude that the legislature did not intend to impose greater punishment on pregnant women for their alleged reckless conduct toward a fetus than for their intentional conduct," [Judge] Pigott wrote.

And since the baby did not die while in the womb, Jorgenson "could not have been prosecuted under the manslaughter statute because the fetus would not have fallen under the definition of a 'person'" under the law, the said.

Judge Eugene M. Fahey Fahey dissented, stating: "I conclude that the baby was a person in the eyes of the penal law, that the mother can be held accountable ... for the baby's death, and that the appellate division's order should be affirmed."

School officials in Jersey City, New Jersey called for security after an unruly mob of Muslim parents attempted a take-over of the School Board meeting last week.  The local religious minority demanded that the school officially declare an Islamic holiday on September 24th.

The Jersey City Board of Education had originally proposed to close schools next Thursday so that Muslim students could observe the [Eid al-Adha] holiday, and the City Council unanimously supported it a week ago. The academic year would have extended one day to June 23, 2016 as a result.

But during the nearly four hours of debate at the board meeting Thursday, some of the Jewish faith said they felt they were being discriminated against because they weren't getting their own school days off for holidays like Rosh Hashanah and Yom Kippur.

In the original resolution announcing the vote, the board said it was "committed to honoring the great diversity of our district, including our religious diversity," and that it will "continue to engage our communities to explore ways to support its diverse communities and celebrate our many cultures and faiths."

Lyles's Chief of Staff Maryann Dickar, who also attended the meeting, said it is inaccurate to characterize the debate on the holiday as "a conflict between Jews and Muslims." She said she recalled only one statement that referenced the Jewish holiday, among "hundreds" of other comments.

New York City public schools were scheduled to close Thursday for their first time recognizing the Muslim holiday Eid al-Adha. The district, which serves about 1.1 million students, was due to become the largest school system in the United States to shut down for the observance. Local Muslims welcomed the move as a symbol of the community's acceptance and shift toward inclusion, Agence France Presse reported.

New York City has an estimated 600,000 to 1 million Muslim residents, and between 10 and 12 percent of its public school students identify as Muslim. That means that holy days tended to devastate attendance -- for example, the last time Eid al-Adha was on a school day, more than one-third of PS/IS 30 in Brooklyn was absent, according to a news release.

About two years after first agreeing to give students the day off, Mayor Bill de Blasio announced the calendar change in March. He officially canceled classes on Eid al-Fitr, which occurred in July and marked the end of the fasting month Ramadan, and Eid al-Adha. Eid al-Adha, also called the Feast of Sacrifice, runs from Wednesday night to Thursday night. Schools in New York City were already closed Wednesday for the Jewish observance of Yom Kippur.

“It is a huge victory to actually see the day come,” says Linda Sarsour, a member of the Coalition for Muslim School Holidays and a New York activist with three children.

“As an imam as well as a parent I am very happy,” agreed Imam Shamsi Ali, director of the Jamaica Muslim Center in Queens.

“I’m sure this kind of policy from the government side will push Muslims further to feel a sense of belonging,” he said.

New York follows at least seven other school districts that close for Eid in New Jersey, Massachusetts and Vermont, but activists are still campaigning in other parts of the country.

Ibrahim Hooper, spokesperson for the Council on American-Islamic Relations (CAIR), the country’s largest Muslim civil liberties organization, agreed that the holiday comes at the right time.

Lesbian Teens MORE Likely to Get Pregnant, but HOW?

Once again disproving the fairy tale of the "gay gene," multiple studies show that teenage girls who claim the label "lesbian" are more likely to become pregnant (by a male, obviously), and self-identified "gay boys" are more likely to impregnate (a girl, obviously).  While liberals blame everyone else in society for these "unintended pregnancies," the Rainbow Health Initiative, a homosexual advocacy group, says the root causes include mental illness, sexual molestation as a child, and substance abuse.

For the new study, reported in the American Journal of Public Health, the researchers used data from nearly 10,000 ethnically and racially diverse New York City high school students from 2005, 2007 and 2009. They included only students who reported having sex with a member of the opposite sex.

About 85 percent of female students identified as heterosexual and about 90 percent only had male sexual partners. Of the male students, 96 percent identified as heterosexual and 97 percent only had female sexual partners.

About 14 percent of females became pregnant, and about 11 percent of males got someone pregnant.

Overall, about 13 percent of heterosexual females and about 14 percent of females who only had male sexual partners had been pregnant, compared to about 23 percent of lesbian or bisexual females and about 20 percent of girls who had male and female sexual partners.

About 10 percent of heterosexual males and those who only had female sexual partners experienced a pregnancy, compared to about 29 percent of gay or bisexual males and about 38 percent of males with female and male sexual partners.

Formerly known as the Minnesota Organization on Pregnancy, Parenting and Prevention, Teenwise analyzed data from Minnesota Department of Health data and the Minnesota Student Survey. The analysis found that twice as many adolescent lesbian females (50.9 percent) and gay males (48.7 percent) had had sex compared to straight females (23.5 percent) and straight males (25.9 percent). Bisexual males and females had the highest reported levels of sexual activity at 49.5 percent and 54.4 percent.

Bisexual females were five times more likely to have been pregnant than straight females at 8.2 percent vs. 1.5 percent. Lesbian and questioning females were also more likely to report having been pregnant at 6.6 percent and 2.8 percent respectively.

Gay males and males questioning their sexuality had the highest percent of reporting that they had gotten someone pregnant (9.9 percent vs. 2.4 percent for straight males). Bisexual males also had high rates of reporting having gotten someone pregnant at 8.9 percent.

. . . a much-ballyhooed study of teen sexual activity nationwide published in July . . . found that today’s youths are having less sex than previous generations. Less than half of teens older than 14 reported they’ve had intercourse, and the majority who were sexually active used some form of protection, according to the research by the Centers for Disease Control and Prevention.

That LGBTQ youths are more likely to have had sex and to have experienced pregnancy than other teens didn’t surprise [executive director Judith] Kahn, with Teenwise Minnesota, but the extent of risk-taking behavior compared with straight teens came as a shock.

Sexual violence came up repeatedly in interviews of pregnant LGBTQ youths by researchers for Rainbow Health Initiative. Childhood sexual abuse was experienced by at least 5 of the 18 teens interviewed. In some cases, the sexual abuse led to their pregnancies.

To better address the problem, the federal government just issued an $18 million grant to Planned Parenthood in nine states — including Minnesota — to support programs aimed at reducing teen pregnancies and sexually transmitted diseases in the LGBTQ population.

The pregnancy rate for teenagers who identify as lesbian or as bisexual is two to seven times greater than their heterosexual counterparts, according to a 2007 British Columbian study  “Not Yet Equal: The Health of Lesbian, Gay, & Bisexual Youth in BC.”  While the average teen birth rate is currently at an all-time low due in part to improved sexual education, this sexual education may be biased toward heterosexuals.  The fact that sexual harassment and substance abuse has been found to be more common in lesbian and gay youth may also contribute to this disparity.

Joe Carter, an editor for The Gospel Coalition, writes that a reason could be that LGBQ teens claimed to have sex much more often than straight teens, as 50.9 percent of lesbian females and 48.7 percent of gay males said they had sex at least once compared with 23.5 percent of straight females and 25.9 percent of straight males.

"Over the past few years evangelical churches have made great strides in learning how to minister to those with same-sex attraction," Carter goes on to say. "But there is much more we could do for teens who identify as gay, lesbian, and bisexual. The fact that LGB teens are engaging in sexual activity with both sexes at a higher rate than their straight peers may be a symptom of loneliness, an unmet need for intimacy and connection, or unresolved emotional problems.

"Some people may be shocked by the high pregnancy rates among the lesbian and gay teens," Evan Lenow, assistant professor of ethics at Southwestern Baptist Theological Seminary, told Baptist Press in written comments. "However, this confirms what studies have shown for years. Individuals who identify as lesbian and gay are much more likely to experiment with sex and have many more sexual partners than their heterosexual counterparts. Some of these teens who identify as lesbian and gay may be simply experimenting with all types of sexual partnerships and thinking less about the ramifications of such experimentation."

Bob Stith, founder of Family and Gender Issues Ministries in Southlake, Texas, told BP data on teen sexual activity indicates "the sexual confusion of many of these young people." He suggested the distinction between homosexual and heterosexual teens often is not "quite so clear" as researchers imply.

"In the haste to break down biblical standards, our culture is experiencing a spiritual truth," Stith, the Southern Baptist Convention's former national strategist for gender issues, said in written comments. "Once you deny biblical truth, regardless of how 'spiritual' this process may sound, you will have greater difficulty determining where to draw the boundaries. And while some of those who redefine the boundaries may not" approve of the behavior of sexual active teenagers, "they have opened the door for each man doing what is right in his own eyes."

Court Orders Lesbian Teachers back in NY School

After years of legal battling, the Manhattan Supreme Court closed the book on the November 2009 lesbian classroom romp of Alini Brito and Cindy Mauro that initially led to their firings, then suspensions, and now reinstatement with back pay and financial penalty to the taxpayers.  School employees had discovered the two naked women on the floor engaged in oral sex — an act first claimed by the pair to be Mauro checking Brito for low blood sugar (Mauro's head was between Brito's legs).

In papers filed in Manhattan Supreme Court, Cindy Mauro, 39, says the city Department of Education — which already tried unsuccessfully to boot her because of her after-hours schoolroom tryst with another romance language teacher — has slapped her with an unfair two-year suspension.

Alini Brito, her complaint points out, got slapped with just a one-year suspension for the "same exact incident and misconduct."

In court papers, a lawyer for Cindy Mauro, . . . who was spotted by school employees topless in a classroom with teacher said other teachers had received significantly less severe penalties for crimes and inappropriate misconduct involving students and even other teachers.

They were initially fired and sued to get their jobs back. A state appeals court said that firing was too harsh a penalty, because they were "consenting adults" and no children witnessed the after-hours hookup.

. . . Mauro, 39, will return to school in September, and will receive three years of back pay, according to new court papers.

But that’s not enough for the randy French teacher. In a Manhattan lawsuit, Mauro is demanding a simple written reprimand, a measly $2,500 fine, and full back pay.

The DOE hearing officer who imposed the two-year suspension, Michael Lazan, reasoned that Brito was “terrified and begged” her assistant principal “not to tell” anyone when she was caught topless with Mauro “between [her] legs,” according to court papers.

Mauro’s reaction, however, “was at best blase,” Lazan wrote in his ruling. Mauro claimed the sexual encounter was “only a kiss” and “made light of the whole situation, as if nothing had happened.”

A custodian heard noises, peered inside and, he said, saw a woman on the floor, topless. He alerted security. A school safety agent then barged into the room, the judge wrote, and “saw a brunette woman (Brito is dark haired) completely naked, lying on the floor” and “a blond woman (Mauro is light haired) also naked on top of the brunette.”

They instantly became the most famous teachers in New York City, winning their school the tabloid nickname of “Horndog High.” But though it all might have sounded like the stuff of overheated high school fantasy, it had some very grown-up consequences: They were fired.

Their case has gone through a series of twists, the latest this week, when an appeals court ruled, more than four years after the episode, that Ms. Brito and Ms. Mauro must be put back on the city’s payroll.

During the initial arbitration process, Ms. Brito and Ms. Mauro argued that there had been no impropriety whatsoever. Ms. Brito — who had required medical attention in the past — said she was suffering from reactive hypoglycemia, and Ms. Mauro was attending to her by laying her down, getting her sugar packets and elevating her feet, they said. Other than a sweater, which had been repurposed as a pillow for Ms. Brito, they said they were both fully dressed. They lost.

Judge Robert Torres upheld an arbitrator’s decision to fire Cindy Mauro, a former French instructor at Brooklyn’s James Madison High School, as “rational and with plausible basis.” Mauro had allegedly been spotted by a janitor half naked in a classroom lounging between the legs of a topless Brito; both women denied anything steamy was happening, with Brito insisting that Mauro was simply checking her blood sugar. City lawyers argued that there was no medical equipment found with the women, and the two had climbed six flights of stairs to get to the room, passing multiple classrooms and more than one bathroom on the way.

The Manhattan appellate judges said foreign-language teachers Alini Brito, 34, and Cindy Mauro, 38, were treated too harshly when they were dismissed for engaging in a topless classroom tryst inside Brooklyn’s James Madison HS in 2009.

The ruling stunned fellow teachers, who feared the judges have given a green light to all sorts of kinky classroom sleaze.

“[It] sets a poor example for other teachers. They may think they can do it, too,” fumed one James Madison teacher, who asked not to be named.

The ruling also shocked students at the school, which became known as “Horndog High” after news spread of Brito and Mauro’s canoodling. “A student could have walked in on them,” said 10th-grader Tiffany Kagan.

The teachers challenged the [initial] arbitration, Brito in Manhattan and Mauro in the Bronx, yielding separate results. The Bronx County Supreme Court upheld Mauro’s firing, causing Mauro to further appeal to a higher appellate court. The presiding justice in Brito’s appeal to Manhattan’s Supreme Court concluded with the presiding justice discounting the hearing officer’s observations and vacating Mauro’s firing. The DOE subsequently challenged the finding.

Brito’s and the DOE’s separate challenges were heard by the same panel of Appellate Division, 1st Department justices as they involved the same set of facts despite competing demands for relief.

In the cases against Mauro and Brito, the justices found each firing to be improper and excessive.
