The Liberty Institute says Chaplain Wes Modder (MAH’-der), an ordained Assemblies of God minister, has received decorations and was called “the best of the best” by the commander [Capt. Jon R. Fahs] now seeking to administer discipline. Modder is based at South Carolina’s U.S. Navy Joint Base Charleston Goose Creek.
Liberty Institute attorney Mike Berry says the range of punishment Modder faces could be career ending. Modder is eligible for a 20-year retirement in September.
According to Berry, the Navy has requested that Modder be barred from promotion, fired from his job as chaplain, and brought before a military Board of Inquiry, where he could be forced out of the Navy.

. . . in December, Equal Opportunity representatives paid Modder a visit, delivering a five-page complaint, which detailed concerns about Modder’s views on marriage, pre-marital sex and masturbation, among other things. Modder was immediately removed from duties, with no defense allowed.
Berry has decided to take up the case and represent the chaplain. Both believe the charges are bogus, and in fact, Berry stated that the officer who accused Modder may be held criminally liable for making false statements and abusing his position.
The whole debacle reminded Modder of an incident which occurred when he first arrived at the Naval Nuclear Power Training Command in South Carolina and was preparing to deliver a speech at a graduation ceremony.
According to Modder, the captain quickly pulled him aside, “looked at [him] and said, ‘Hey chaplain – do not pray in Jesus’ name.’”

“On multiple occasions he discriminated against students who were of different faiths and backgrounds,” the Chaplain’s commanding Officer Capt. Jon R. Fahs wrote in a memorandum obtained by Fox News.
“They want chaplains to be glorified summer camp counselors and not speak truth and love into people’s lives,” Berry told me. “There are some anti-religious elements in our military. Anytime somebody wants to live their faith out – there are people who say that is offensive.”
Modder said the young officer [spy] had only been working with him for about a month and would constantly pepper him with questions pertaining to homosexuality. He had no idea that the officer was in fact gay – and married to another man.
“His five page letter of complaint was unconscionable,” Modder said. “He said I had a behavioral pattern of being anti-discriminatory of same sex orientation.”
“I believe some of what the lieutenant [spy] has alleged could constitute a military crime – false statements – taking what the chaplain said and twisting or misconstruing it – in an attempt to get the chaplain punished,” [Berry] said. “He abused the position he was placed in as a chaplain’s assistant.”
He believes the officer may have gained access to private counseling file[s].

In its response letter, Liberty Institute attorneys assert that censoring Chaplain Modder's religious expression is unconstitutional religious discrimination. They note that federal law and military regulations forbid the Navy from punishing a chaplain because they act according to their faith. Liberty Institute also requests that the Navy allow Chaplain Modder to return to serving his sailors according to his faith.
