Change Sex Overnight in New York With New Law

Beginning forty-three years ago in New York, if you wanted to change from being a man to a woman, or vice versa, you had to have sexual mutilation surgery, but with the new law supported by New York's new mayor, you can simply change the gender on your birth certificate for a small fee and some paperwork.
"It doesn't make sense that you can change your gender and name on every single form of identification, but not on your birth certificate. People need congruency."

[Transgender New Yorkers] and their advocates, at a hearing of the City Council's Health Committee, spoke in favor of the bill that would eliminate the [proof-of-surgery] requirement and, instead, authorize a health professional to provide an affidavit saying the record change is a more accurate reflection of the person's gender.

Eliminating the surgery requirement would put New York City, which issues its own birth certificates, in line with the state. California, Oregon, Rhode Island, Vermont, and Washington, D.C., also have removed surgery requirements.

Speakers at the hearing said that requiring proof of surgery is a burden on transgender people since not all decide to have surgery and not all can afford the expensive procedure. They said the requirement leaves many with a birth certificate that doesn't match their lives and sets them up for discrimination in instances when a birth certificate is required as proof of identification, such as some government programs.

. . . thousands of transgender people across America have been forced into embarrassing encounters with bureaucrats, officials, landlords and others because of discrepancies with their documentation, according to transgender-rights advocacy groups.

In a 2008 survey of more than 7,000 transgender people, only 20 percent of trans women said they had had surgery to remove their penis and testes, and only 2 percent of trans men said they had had male genitals surgically created.

Some say they cannot afford the complex surgery. Many others . . . do not need or want it, finding hormone therapy sufficient. Besides the usual risks of major surgery, it leaves the person infertile, and some find the results less than satisfactory.

In 2010, the federal government began allowing transgender people to amend their passports regardless of anatomy. Last year, the American Psychiatric Association said it no longer considered being transgender a disorder.

Testifying before the City Council's health committee on Monday, Gretchen Van Wye, an assistant city health commissioner, said the agency is “developing a robust outreach and implementation strategy,” for a law it expects to pass without significant opposition.

Councilman Corey Johnson's bill, co-sponsored by several other council members, would require supporting documentation that the request for a birth certificate change more accurately reflect the applicant's sex. That could come from either a physician, a doctoral level psychologist, a licensed clinical social worker, licensed master social worker, physician's assistant, nurse practitioner, marriage family therapist, mental health counselor or a midwife.

No one who spoke during Monday's Council hearing opposed the measure, a marked change from 2006 when the Board of Health proposed a similar measure. Back then, the proposal was withdrawn after concerns were raised by vital records experts. Doctors worried how to determine which patients could be roomed together and law enforcement officials were concerned about where to house prisoners.

Transgender individuals are already able to change their gender on documents such as a drivers license. But that can create problems when the gender on the birth certificate does not match other identification.

Everything from getting a passport to applying for a job and medical benefits is placed in jeopardy when gender designations on transgender people's documents do not match, advocates for the legislation said.

"Not having the gender marker restricts me from pursuing a decent career," said Tiffany Mathieu, a transgender woman.

"I get scrutinized and deliberately placed into situations that are uncomfortable and confounding when I apply for jobs."

Mathieu said she has been denied Medicaid and other forms of assistance because the "gender marker on my birth certificate didn't match my ID."

Michael Silverman, executive director of the Transgender Legal Defense and Education Fund, said many of the clients his group represents are in deep poverty, with 84 percent reporting an annual income of less than $20,000 and two-thirds receiving Medicaid or other forms of public assistance.

On December 11, 2009, the Minister of Justice, Attorney General of Québec and minister responsible for the fight against homophobia, Kathleen Weil, released the first-ever Québec policy against homophobia. “The policy released this morning shows, once again, that Québec society is a leader in the field of sexual minority rights,” stated the Minister.

The main objective of the policy – overview of the policy – is to improve the situation of sexual minorities in Québec and allow them to attain social equality.

The policy, released last month by Quebec's Minister of Justice and Attorney General Kathleen Weil, assigns the government the task of eliminating all forms of "homophobia" and "heterosexism" – including the belief that homosexuality is immoral – from society as a whole.

The text and specifics of the policy are steeped in vague bureaucratic language about "coordination" and "synergy," but the goal is spelled out clearly: to enlist the government to normalize homosexuality in society and to quell common criticisms levied against "sexual minorities," a term the policy uses to inclusively describe "lesbians, gays, bisexuals, transsexuals and transgenders."

"An inclusive society such as ours must take the necessary steps to combat homophobic attitudes and behavior patterns and move towards full acceptance of sexual diversity," states the Premier of Quebec Jean Charest in a letter that serves as the policy's introduction. "The policy sets out the government's goal of removing all the obstacles to full recognition of the social equality of the sexual minorities, at all levels of society."

The policy further defines the heterosexism that must be stomped out as "affirmation of heterosexuality as a social norm or the highest form of sexual orientation."

Furthermore, the policy laments, "It is still possible to hear people say that homosexuality is an illness, morally wrong or a form of deviant behavior, and that people choose their sexual orientation. These beliefs, often instilled in the past, tend to marginalize sexual minority groups and prevent full recognition of their social equality."

Such "prejudice," the policy affirms, must be combated.

And while the word "church" is never explicitly mentioned in the policy, it does declare it important to publicize the most "insidious" forms of homophobia with a plan to "target the various locations in which homophobic attitudes and behavior patterns, as well as heterosexist stereotypes, are found."

The policy also warns, "It will be necessary to deal with the heterosexist values on which some institutional practices are founded."

The new head of the Italian bishops conference has made political waves by asking on what basis may incest and pedophilia be denied if Italy legalizes same-sex unions and other alternatives to the family.

Archbishop Angelo Bagnasco of Genoa, who was appointed last month to lead the Italian Bishops Conference, is spearheading efforts of the Catholic Church in Italy against legislation giving unmarried unions – including same-sex ones – legal status and benefits.

“Why say 'no' to forms of legally recognised co-habitation which create alternatives to the family? Why say 'no' to incest?” the Archbishop said at a meeting of Church workers, according to the Italian journal, La Repubblica.

“Why say 'no' to the pedophile party in Holland?” Bagnasco stated, referring to the Dutch Brotherly Love, Freedom and Diversity party, which lobbies to reduce the age of consent from 16 to 12 and legalize child pornography.

Supporters of the “DICO” bill, which would grant legal recognition of opposite and same-sex civil unions and benefits, immediately objected that the Archbishop had equated the legislation with pedophilia and incest.

Environment minister Alfonso Pecoraro Scanio, a vociferous advocate of the homosexual agenda, said Archbishop Bagnasco had created a “grave, foolish comparison which offends millions of people”.

However, an editorial in Avvenire, the official newspaper of the Italian Bishops Conference, dismissed the controversy as a “storm in a teacup”, saying that Archbishop Bagnasco had merely illustrated the fact that family policy must be founded on principles other than whichever way public opinion gravitates.

Moral Decline, The Media, and Natural Law

The Culture and Media Institute has just released its National Cultural Values survey. 2,000 Americans aged 18 and older were asked a series of questions on moral issues.

Here are some key findings:

  • 74 percent, including majorities of every major demographic group, say they believe moral values in America are weaker than they were 20 years ago.
  • 48 percent say moral values are much weaker than they were 20 years ago.
  • 68 percent, including majorities of virtually every demographic group, say the media—entertainment and news alike—is having a detrimental effect on moral values in America.
  • 64 percent agree the news and entertainment media exercise powerful influence over American moral values. In fact, the substantial majority (74 percent) who believe moral values are weaker than twenty years ago consider the media to be the second greatest influence on moral values after parents and families.

Additional findings indicate that while most people give strong lip service to classical virtues, many don't actually walk the walk. Moreover, the authors of the study believe that there is a culture war in America, seem to agree that the media is largely at fault, and note that "Reversing America's moral decline will require a renewed acceptance of Orthodox values, which implies increased acceptance of God's authority."
