Justice Scalia: Abortion, Homosexuality Easy Cases

While some U.S. Supreme Court justices engage in much soul-searching on controversial cases, one justice says the decision on the two most hotly contested current issues is "easy as pie."

Scalia was recently discoursing before an American Enterprise Institute audience on being a self-described “textualist” who believes the U.S. Constitution should be interpreted exactly as written and intended by the Founders more than 200 years ago.

Scalia has consistently dissented from Supreme Court rulings that have limited application of the death penalty in cases of underage or mentally defective defendants.  He has consistently voted to overrule the U.S. Supreme Court’s 1973 Roe vs. Wade decision that legalized abortion.

The Supreme Court, by a 6-3 vote in 2003, overturned Texas’ anti-sodomy law and recognized privacy in the bedroom.  Scalia filed a fiery dissent, arguing that the ruling furthered “the homosexual agenda.”

The Supremes will take up same-sex marriage later this term, according to Scalia’s colleague Justice Ruth Bader Ginsburg.

He contrasted his style of interpretation with that of a colleague who tries to be true to the values of the Constitution as he applies them to a changing world. This imaginary justice goes home for dinner and tells his wife what a wonderful day he had, Scalia said.

This imaginary justice, Scalia continued, announces that it turns out “’the Constitution means exactly what I think it ought to mean.’ No kidding.”

As he has said many times before, the justice said the people should turn to their elected lawmakers, not judges, to advocate for abortion rights or an end to the death penalty. Or they should try to change the Constitution, although Scalia said the Constitution makes changing it too hard by requiring 38 states to ratify an amendment for it to take effect.

. . . Justice Scalia turned to mocking so-called Living Constitutionalists, who think the document has a dynamic meaning and that contemporary views should be taken into account when interpreting it. . . .

Like his imaginary justice, Justice Scalia sometimes fails to set aside his personal beliefs. Consider his dissent in Lawrence v. Texas, which struck down the state sodomy laws he finds so obviously acceptable under the Constitution. He said Americans have every right to enforce “the moral opprobrium that has traditionally attached to homosexual conduct” in order to protect “themselves and their families from a lifestyle that they believe to be immoral and destructive.”

In that dissent, he argued that sodomy laws don’t violate the equal protection clause.

Canada's anti-polygamy law offends fundamental freedoms protected by the Charter of Rights and Freedoms, argues the B.C. Civil Liberties Association.

"This law is a Victorian statute," BCCLA lawyer Monique Pongracic-Speier said in a written statement. "It is time for it to be relegated to the scrap heap of history. It invites the state to inspect the bedrooms — and kitchens and living rooms — of consenting adults who find fulfilment in plural relationships. It erodes the dignity of people involved in those relationships and denies them the privacy that is available to couples and monogamous families."

"The BCCLA argues that individuals should be free to make the life choices they wish so long as those choices do not harm other people and they engage in them with free, informed and full consent," Pongracic-Speier said in a press release. "By intruding into adults' decisions about the form of conjugal relationship that best meets their personal needs and aspirations, the law overextends the reach of the criminal law into individuals' private lives, intruding into their most private relationships."

Final arguments in the case will begin later this month in B.C. Supreme Court, which has heard months of testimony both for and against upholding the federal law, including conflicting expert testimony about whether the practice of multiple marriage is inherently harmful to women and children.

Written arguments have already been filed by several interveners in the case, as well as the federal and provincial governments.

Both levels of government are defending the law, arguing polygamy is inherently harmful and must be kept illegal. They've alleged multiple marriage inevitably leads to sexual and physical abuse, child brides, teen pregnancies and the trafficking of young girls to be married.

Forced Abortions NOT Outlawed in Canada

Abortionists' interests were satisfied as lawmakers, including Prime Minister Harper, opposed a bill to forbid forced abortion, including by coercion; the vote was 178 to 97.

In the aftermath of the vote in the Canadian House of Commons on a bill the prevent forced and pressured abortions, Prime Minister Stephen Harper is coming under fire for opposing the measure.

Harper has said all along he doesn’t want to open Canada’s abortion debate but the legislation, modeled after successful bills in the United States that don’t affect the status of legalized abortion, was defeated by MPs.

Paul Wells of Macleans noted Harper took the unusual step of voting on the measure.

Conservative MP Rod Bruinooge (Winnipeg South) sponsored the bill, C-510, and it had the support of many Conservatives, including members of Harper’s own Cabinet: Stockwell Day, Jason Kenney and Gail Shea, among others. But Harper voted with other cabinet members James Moore and Lawrence Cannon in opposing the measure.

Roxanne’s Law was named for Roxanne Fernando, a young Winnipeg woman who was killed after refusing demands from her boyfriend to have an abortion. The woman’s brutally beaten body was discovered in a snow filled ditch outside of Winnipeg in February 2007.

“I just think it’s legally unnecessary,” Heritage Minister James Moore said. “Those protections already exist in the criminal code. That was the justice minister’s assessment and I agree with him.”

Abortion Rights Coalition of Canada President Joyce Arthur says she is pleased by the vote.

"One of the biggest problems with the bill, of course, is that it was focusing on abortion only, when we know that women are also coerced into child birth," Arthur continued.

Gay Agenda Counters Freedom of Press

The refusal by [New Hampshire's] largest newspaper to run a wedding announcement from a gay couple has drawn the ire of one of New Hampshire’s Democratic congressmen, among others.

The New Hampshire Union Leader of Manchester says it has a constitutional right to choose what to print. Publisher Joe McQuaid says the paper isn’t "anti-gay," but believes that marriage is between a man and a woman. He said the paper is opposed to a recent state law legalizing gay marriage.

Democratic U.S. Senate candidate Paul Hodes called on the paper to change its policy and respect the state law. He challenged Republican opponent Kelly Ayotte to denounce its decision. An Ayotte spokesman said government officials have no business telling a free press what to do.

“The Union Leader’s disgraceful policy of exclusion harkens to a different time in this country when people were denied opportunity because of their race, religion and ethnic origin,” Hodes said in the letter.

[McQuaid said,] “This newspaper has never published wedding or engagement announcements from homosexual couples. It would be hypocritical of us to do so, given our belief that marriage is and needs to remain a social and civil structure between men and women and our opposition to the recent state law legalizing gay marriage.”

Pastor Warns America of Socialism, Calls for Prayer

America currently stands in a very dangerous position, said renowned pastor and author Dr. Charles Stanley. Today more than ever, the country is turning away from God and moving closer toward socialism, he warned. And the consequences will be grave.

Over time, the prayer meetings swelled from a handful to over 10,000. It got so there were too many to fit in the church where the prayers started. Very soon the Berlin Wall came down.

But under a socialist society, in which the government controls all means of production and distribution, there is no motivation for diligence and creativity is stifled, he said.

He added, "Naturally, when the government takes control, do you think that freedom of speech is always going to be there?"

"The tide is bringing in a control that will indeed attempt to silence the truth and will attempt to squash the religious devotion and worship of the people of God."

"It is an attempt to destroy the Christian spirit in America," he said.

"There is a war going on against Jesus," he declared. "It's part of the strategy. The primary reason for this war against Him is He is interfering with the plan to make this a socialist nation. Mark it down. It is the truth."

"Do you want this nation to keep going where it's going or do you want us to get back on track?" he posed.

Prayer, he said, is the one thing he knows that works.

Memorial Day 2010 "For You"

Today, most Americans remember "the sacrifices of those who fell in military service to the country."

Vice President Joe Biden will take the place of President Obama for the traditional wreath-laying ceremony at Arlington, the most prestigious military cemetery in the country, where many of the soldiers killed in Iraq and Afghanistan are buried.

Obama is in Chicago, Illinois, spending the night with his family at their home for the first time in more than a year. He will mark the holiday with remarks at the Abraham Lincoln National Cemetery, about an hour outside Chicago.

Back in Washington, the Vietnam Veterans Memorial will officially recognize six names added to the black granite wall in May.

The addition brings the number of men and women who were killed or remain missing in action to 58,267.

Texas Bureaucrats Say Homeschool Scrutiny Needed

The Texas Education Agency is suspicious that the 22,620 high school students whom local school administrators categorized in 2008 as homeschool transfers are actually dropouts.

While home-schooling's popularity has increased, the rate of growth concentrated in Texas' high school population is off the chart: It's nearly tripled in the last decade, including a 24 percent jump in a single year.

Texas' lax documentation and hands-off practices [of homeschooling] make it impossible to know how many of these students are actually being taught at home. It also opens the door to abuse of the designation, which could help school districts avoid the sanctions that come with high dropout rates, experts said.

In some states, parents are required to file sworn affidavits when they withdraw their children. Many states also require families to submit curriculum, attendance records or test scores when they opt to home-school.

In Texas, the Texas Education Agency requires a “signed statement from a parent/guardian or qualified student” or “documentation of an oral statement by the parent/guardian or qualified student made within 10 days of the time the student quits attending school in the district, signed and dated by an authorized representative of the district” noting that they intend to attend home-school.

Liberal 'Christians' Lobby Against Great Commission

Under the guise of noble embrace of religion, the Chicago Council on Global Affairs is lobbying President Obama to terminate traditional American foreign policy of freedom of religion.

American foreign policy is handicapped by a narrow, ill-informed and "uncompromising Western secularism" that feeds religious extremism, threatens traditional cultures and fails to encourage religious groups that promote peace and human rights, according to a two-year study by the Chicago Council on Global Affairs.

The council's 32-member task force, which included former government officials and scholars representing all major faiths, delivered its report to the White House on Tuesday. The report warns of a serious "capabilities gap" and recommends that President Obama make religion "an integral part of our foreign policy."

The Chicago Council's task force was led by R. Scott Appleby of the University of Notre Dame and Richard Cizik of the New Evangelical Partnership for the Common Good. "Religion," the task force says, "is pivotal to the fate" of such nations as Afghanistan, Pakistan, India, Iraq, Iran, Nigeria and Yemen, all vital to U.S. national and global security.

"Despite a world abuzz with religious fervor," the task force says, "the U.S. government has been slow to respond effectively to situations where religion plays a global role." Those include the growing influence of Pentecostalism in Latin America, evangelical Christianity in Africa and religious minorities in the Far East.

. . . Obama appointed a special envoy to the Organization of the Islamic Conference and created a new Muslim outreach position in the State Department. In the past year, he said, embassies in Muslim-majority countries have held hundreds of meetings with a broad range of people not involved in government.

. . . Cizik said some parts of the world -- the Middle East, China, Russia and India, for example -- are particularly sensitive to the U.S. government's emphasis on religious freedom and see it as a form of imperialism.

One of the truisms I learned in college was that nations have interests. So do religions. Sometimes those interests are mutually exclusive. In most cases, religious interests focus on a "kingdom not of this world," to invoke a biblical analogy. But one -- Islam -- has an interest here on earth and large numbers of adherents to that faith believe not only that they have the only truth -- a characteristic found in most religions -- but that they have been ordered by Allah to impose it by force on everyone else. This imposition also includes the taking of land that can spread the Islamic kingdom on earth. This is not bigotry. This is fact as stated in the sermons of their imams and the media in many Islamic countries.

Any diplomatic "outreach" must understand this truth. It must also include at least some common principles in order for that outreach to produce objectives in the best interests of the nations involved, most especially the United States. The stated objective of the radical Islamists is to destroy America and impose Sharia law. It is hard to find common ground with such belief. Do we agree to less destruction if they will leave us alone? What more is there to understand about "you are infidels and deserving of death"? There doesn't appear to be any diplomatic wiggle-room there.

Minn. Governor Acknowledges God in America's Founding

Pawlenty used the snowstorm in Washington, D.C., last week to slam favorite conservative boogeymen House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid. “Even the United States Congress was closed, and I say — and I know you agree — any day, any day that Harry Reid and Nancy Pelosi can’t get to work is a good day for freedom, a good day for liberty and its a good day for people’s wallets.”

[CPAC,] a conference where there has not been a lot of talk about social issues, Mr. Pawlenty raised one as he laid out the principles conservatives should follow.

The first one is this: “God’s in charge,” he said. “God is in charge.” Mr. Pawlenty’s remarks drew a wave of applause. “There are some people who say, ‘Oh, you know, Pawlenty, don’t bring that up. You know, it’s politically incorrect.’”

“Hogwash,” Mr. Pawlenty said. “These are enshrined in the founding documents and perspective of our country. In the Declaration of Independence, it says we are endowed by our creator with certain unalienable rights. It doesn’t say we’re endowed by Washington, D.C., or endowed by the bureaucrats or endowed by state government; it’s by our creator that we are given these rights.”

NY Parents Arrested for Improper Homeschooling

A Montgomery County couple has been charged with four counts each of endangering the welfare of a child for allegedly home schooling their children improperly.

According to Sheriff Michael Amato, Richard W. Cressy, 47, and Margie A. Cressy, 41, of the town of Glen, were arrested as the result of an investigation conducted by his office and the county Department of Child Protective Services.

The investigation, he said, revealed that the Cressys were home schooling their four children, ages 8 to 14, without approval from the school district. Amato said that according to state education law, the curriculum has to be approved by the district superintendent before home schooling can take place.

The Superintendent of the Fonda-Fultonville Central School District, Richard Hoffman, confirmed the four children, ranging in age from 8 to 14, had not been registered with the school district for the last seven years.

Under state law, parents who choose to home school their children must register their curriculum with the local school district superintendent. The Cressys never submitted one in the seven years they lived in the Fonda-Fultonville Central School District, according to the Montgomery County Sheriff's Office, which began investigating the parents after receiving an anonymous tip.

Hoffman said the Cressys have since submitted a home-schooling curriculum, which he has approved.

In the first few days of a cross-country book tour to promote her memoir, the former Alaska governor's supporters have greeted her with a populist fervor unmatched in Internet-age Republican politics.

While it's too early to call it a campaign, Palin's brand of common sense conservatism crackles with the energy of a burgeoning political movement.

In "The Way Forward," the title of the final chapter of her memoir, she says that her persona and her political philosophy are based on common sense that were last espoused by Reagan, her political idol. The role of government, Palin writes, "is not to perfect us, but to protect us."

Some . . . see Palin's political philosophy as a stand against . . . "government control, dependence on the government and loss of liberty."

Palin appears to have tapped into a powerful strain of populism fueled by dissatisfaction with the economy and by fear that the Democratic Party that's running the country is made up of elites who aren't listening, said Dennis Goldford, a professor of politics at Drake University in Iowa.

The term coined by Palin in her book has been around for a while, said Greg Mueller, a conservative strategist and a veteran of Republican presidential campaigns. Palin, however, seems to have seized on something timely by putting her brand on common sense conservatism, he said.

Steven Zerbini, a 19-year-old college student and National Guardsman from Greensburg, Pa., offered his own definition of it.

"It's not bringing in a terrorist to civilian courts in New York City," Zerbini said, referring to confessed 9/11 mastermind Khalid Sheik Mohammed. "It's not raising taxes in a recession."

Czech President: Obama Wrong to Lead U.N. 'Church of Global Warming'

[President] Klaus said global warming has turned into a new religion, an ideology that threatens to undermine freedom and the world's economic and social order.

Czech President Vaclav Klaus sharply criticized a U.N. meeting on climate change on Tuesday at which U.S. President Barack Obama was among the top speakers, describing it as propagandistic and undignified.

Klaus said there were increasing doubts in the scientific community about whether humans are causing changes in the climate or whether the changes are simply naturally occurring phenomena.

But politicians, he said, seem to be moving closer to a consensus on climate change.

"The train can't be stopped and I consider that a huge mistake," Klaus said.

UK: Catholic Adoption Agency to Defy Gay 'Rights' Law

This is exactly what needs to happen here in America for Americans to understand that what's really at stake here is freedom itself.

A Roman Catholic adoption agency headed by Britain's most senior Catholic churchman is to defy the Government over its controversial gay equality laws.

The Westminster Catholic Children's Society, whose president is Cardinal Cormac Murphy-O'Connor, will ignore new rules that require it to place children with same-sex couples.

While other Catholic adoption agencies are caving in to the legislation by severing their ties with the Church or even closing, the Westminster Society will continue its policy of placing children only with married heterosexuals and single people.

Its stance will set the Cardinal - who welcomed Tony Blair into the Catholic Church last December - on a collision course with New Labour and the gay rights lobby.

California Teachers Association: Parents Shouldn't Have Right to Homeschool

The response of California's teachers' union to pro-family attempts to protect home schooling in that state has outraged one attorney who is working on the case.

Numerous organizations on both sides of the issue have filed friend-of-the-court briefs in the appeal of a California court's ruling that parents have no right to home school their children. But one reaction in particular caught the attention of pro-family attorney Brad Dacus, president of the Pacific Justice Institute.

"The California Teachers Association ... decided to file an amicus brief arguing before the court that parents should have no right over the education of their children, should not have a right to home school, and that these children should be literally forced to be put back into the public schools -- even though parents object," the attorney explains.

Dacus did a double-take when he read one specific charge made by the teachers' union. "In their brief, the teachers' union said that to allow parents to be able to home school without being credentialed teachers could result in 'educational anarchy,'" he shares.

LOS ANGELES — Michigan’s largest homosexual activist group says once marriage is legally redefined to include homosexual couples, business owners and even news media outlets who refuse to recognize such marriages should be jailed or sued and “publicly slapped,” a Jewish and openly bisexual columnist for the Los Angeles Daily News reported Monday.

Statements attributed in the column to homosexual lobbyist Sean Kosofsky, director of policy for the Detroit-based Triangle Foundation, were denounced Wednesday by American Family Association of Michigan President Gary Glenn, co-author of the Marriage Protection Amendment approved by voters in 2004 to constitutionally reaffirm the legal definition of marriage in Michigan as only between one man and one woman.

“The Triangle Foundation openly admits homosexual activists’ intentions, once they gain sufficient political power, to impose their radical social agenda on America by brute force, trampling cherished American values such as religious freedom, freedom of speech, academic freedom, and even freedom of the press if it stands in their way,” Glenn said.

Good News! UK Couple Who Won't Accept Homosexuality Win Right to Foster

Derby city council blocked an application from Eunice and Owen Johns to provide respite care for under-10s after they admitted they could never tell a child that being homosexual was acceptable.

However, the authority has backed down after the Johns, both devout Christians, threatened to seek a judicial review.

The couple, who have four grown-up children of their own, were celebrating on Sunday after learning by letter that they can resume the application process.

Who Will Speak Up for Crystal Dixon?

Thus far, no nationally known clergy have spoken out for university employee fired for publicly proclaiming what God says about homosexual behavior...

Earlier this week we reported that University of Toledo employee, Crystal Dixon, lost her job because she wrote a newspaper commentary that questioned whether homosexuality is a civil rights issue.

Any person who is somewhat familiar with Jesus and the bible can easily see through the farce that equates the homosexual agenda with the civil rights movement. One is a physical characteristic the other is a sexual practice. What bothers me most about this issue, and what I am waiting to see, is the church's reaction to it.

Dixon did have a rally at her church where 60 supporters showed up to encourage her and hear her statement. I am waiting to hear from the rest of her supporters who, by God, have been given a national platform as Christian leaders. Where are the national leaders who will speak out on behalf of a women who was fired for standing on God's moral principle and calling sin, sin?

Where is the pressure from those who sell millions of books and enjoy airtime on multiple radio stations? I just did a Google search on this subject and saw not one national Christian leader weighing in on the subject. Not one of them quoted a nationally known Christian leader or clergyman weighing in on the subject. Perhaps they are speaking out, but not getting media coverage?

I desperately hope that is the case, but what I fear is that the national leaders have not and will not weigh in. They may be too busy writing and selling books and/or preparing for their nationally syndicated radio programs...

The University of Toledo suspended an administrator for stating in a guest column in a local newspaper that choosing homosexual behavior is not the same as being black or handicapped.

Associate Vice President of Human Resources Crystal Dixon wrote in response to a newspaper editor's column criticizing a lack of equality for homosexuals that, "I take great umbrage at the notion that those choosing the homosexual lifestyle are 'civil rights victims.' Here's why. I cannot wake up tomorrow and not be a black woman.'"Her piece in the Toledo Free Press quickly got her a suspension from officials at the University of Toledo, who condemned her beliefs, according to a report in the newspaper...

Dixon wrote.


"I respectfully submit a different perspective for Miller and Toledo Free Press readers to consider. … First, human beings, regardless of their choices in life, are of ultimate value to God and should be viewed the same by others. At the same time, one's personal choices lead to outcomes either positive or negative," she said.

"As a black woman who happens to be an alumnus of the University of Toledo's Graduate School, an employee and business owner, I take great umbrage at the notion that those choosing the homosexual lifestyle are 'civil rights victims.' Here's why. I cannot wake up tomorrow and not be a black woman. I am genetically and biologically a black woman and very pleased to be so as my Creator intended. Daily, thousands of homosexuals make a life decision to leave the gay lifestyle evidenced by the growing population of PFOX (Parents and Friends of Ex Gays) and Exodus International just to name a few...

Dear Friends:

I want to first thank you for contacting me with your kind words, encouragement and prayers. I want to update you on what has happened. The President of the University of Toledo has terminated my employment following my speaking, as a citizen, of the Biblical view of the issue of homosexuality. He indicated in the media, that my viewpoints "aren't consistent with University stated values."

I will stand on my principles, the laws of our country and my Christian faith.

I and my legal team which includes local/lead counsel Attorney Thomas Sobecki and the Thomas More Law Center will be filing a lawsuit(s) on multiple fronts.

As a single individual, the cost of this fight appears to be mammoth, but I will not be deterred.

May the Lord continue to bless you and thank you again for your support, prayers and kindness shown to me in these challenging days.

CANADA: Ministry Fined $23,000 for Firing Homosexual Employee

Canadian ministry Christian Horizons has been fined more than $23,000 for firing an employee who was actively engaged in a homosexual relationship.

Christian Horizons is an evangelical ministry in Ontario that has cared for more than 1,400 people with developmental disabilities in 180 group homes. The group requires all employees to sign a contract agreeing to abstain from all sexual immorality, including homosexuality. When Christian Horizons fired a female employee who became involved with another woman, she complained to the Human Rights Tribunal of Ontario, which fined the ministry $23,000 and two years back pay.

Jordan Lorence with the Alliance Defense Fund believes the homosexual agenda will continue to persecute the Christian agenda as it gains power. He labels the Canada situation "a very significant threat to religious liberty."

In addition, contends the attorney, it is another example that "whether you're in Europe or Canada or the United States, when the homosexual activists gain control with their legislation, they show an increasingly authoritarian core to beat down any Christian or traditional-type opposition to their same-sex relationships and conduct."
