Pro-abortionists Went 0 for 2 in Court Yesterday

In two unrelated court cases, judges dealt blows yesterday to the abortion industry.  A federal judge in Detroit dismissed an attempt by the ACLU to force Catholic hospitals to perform abortions, and a judge in Illinois upheld the First Amendment rights of a pro-life organization to distribute fliers exposing the gruesome business of dumping babies in landfills.

Detroit federal Judge Gershwin Drain says the American Civil Liberties Union and its members have no standing to sue Trinity Health Corp. In a 13-page decision Monday, he said the ACLU failed to explain what medical conditions would place their members at risk or if they are currently at risk.

The judge says any harm is "speculative."

An attorney for Trinity, Kevin Theriot, says no one should be forced to perform abortions. The ACLU says it's considering its next step.

The American Civil Liberties Union filed the lawsuit on behalf of its members last year, calling for an injunction against the anti-abortion policies of Trinity Health Corporation, a Livonia-based health care group with 90 hospitals that adhere to directives of the U.S. Conference of Catholic Bishops.

ACLU lawyers pointed specifically to one member who was denied abortion procedures at a Trinity hospital despite suffering "emergency complications during her pregnancy that required the termination of her pregnancy in order to stabilize her condition."

The lawsuit also argued that other pregnant members were "at risk of suffering similar harm should their pregnancies suffer complications in the future."

In his ruling, [Judge] Drain said the ACLU did not provide enough specific proof of harm to its members to give the organization standing to sue.

“Therefore, even assuming that the complaint contains sufficient factual matter to establish past actual harm — considering the vagueness of the allegation, this is dubious — the allegations of past exposure to defendants’ illegal conduct is not sufficient to create standing,” he wrote.

Alliance Defending Freedom [ADF] attorneys represent the Catholic Medical Association, the Christian Medical and Dental Associations, and the American Association of Pro-Life Obstetricians and Gynecologists, which the court allowed on March 10 to intervene in the case in defense of Trinity Health Corporation. Trinity Health operates 86 facilities in 21 states.

“No American should be forced to commit an abortion—least of all faith-based medical workers who went into the profession to follow their faith and save lives, not take them,” said ADF Senior Counsel Kevin Theriot. “No law requires religious hospitals and medical personnel to commit abortions against their faith and conscience, and, in fact, federal law directly prohibits the government from engaging in any such coercion. As we argued in our brief to the court, the ACLU had no standing to bring this suit and demand this kind of government coercion.”

“Those who doubt that anyone would ever try to force someone to commit an abortion need only look at this case,” explained ADF Senior Counsel Matt Bowman. “This is precisely what the ACLU sought to do. The court came to the right conclusion in putting an end to their quest. The ruling relies on important case law that our pro-life medical group clients cited showing that the ACLU’s case was based on pure speculation.”

“Forcing health care workers to act contrary to the very faith and ethical convictions that led them into the medical profession—to serve, help, and bring healing to people—is counterproductive, unnecessary, and against the law,” Bowman continued.

From "Judge refuses to stop anti-abortion fliers targeting CEO" by The Associated Press 4/11/16

Lake County [Illinois] Associate Judge Margaret Marcouiller ruled Monday that the Ohio-based group Created Equal can keep distributing fliers that show pictures of an aborted fetus and a Lake Forest [Illinois] resident, and also include the executive's home address.

The fliers have been left with neighbors of Charles Alutto, who heads Stericycle, a medical waste company.

Created Equal says Stericycle "enables baby killing" by transporting medical waste from a Planned Parenthood facility in Ohio

Marcouiller said Monday that "even insulting and outrageous speech must be tolerated."

Created Equal Executive Director Mark Harrington called the court ruling a victory and said the campaign, which includes fliers, mobile billboards and postcards, will continue.

"If Stericycle wants to stop our awareness campaign, they simply need to cease transporting and disposing of aborted babies for Planned Parenthood," Harrington said.

Despite denying the emergency order, the judge said she will take up the issue again and gave the plaintiffs two weeks to update and resubmit their complaint.

From "Stericycle loses bid to stop campaign exposing it for transporting aborted babies’ remains" by Ben Johnson, LifeSiteNews 4/11/16

Stericycle's “regulated medical waste acceptance policy” states that the company does not accept “complete human remains (including heads, full torsos, and fetuses).”

Mark Harrington, the national director of Created Equal says the company is playing a game of semantics.

“However, babies are not 'complete' after being dismembered, decapitated, and disemboweled in standard abortion methods,” Harrington said. “Their broken parts and torn tissue are categorized by Stericycle as 'pathological waste,'” which the company willingly transports.

He wrote a letter to Alutto on February 10 with a sample flier that would be handed out in his community to raise awareness of Stericycle's actions. It included Alutto's home address and business phone number. If the company would stop providing services to abortionists, Harrington said, he would not go forward with the campaign.

Atheists: Terror-victims Prayer Unconstitutional

Immediately after Shelby Township Supervisor Rick Stathakis, a metro Detroit, Michigan politician, posted a prayer for the victims of the Brussels terrorist attack on his personal Facebook page, local atheists wrote that an American citizen who holds a public position has no right to pray in public, including online.
"Mighty God, Shine your radiance into every corner of this dark and fallen world. Send your angel armies into Brussels, and heal the land. Hear the prayers of those who call to you, calm them with Your peace, and soothe the souls of those who lost loved ones in this attack. Amen. . . . God is our refuge and strength, an ever-present help in trouble."
-- Rick Stathakis' initial Facebook post

"My position of Township Supervisor does not preclude me from expressing my Christian beliefs just as it would not preclude you from expressing your views if you were elected to office. I am not using my office or standing in the community to make everyone or even anyone Christian. I am simply offering support for the victims. My hope is that this is a conversation between adults, who are presumptively not susceptible to religious indoctrination, who may freely enter and leave the conversation without comment and for any number of reasons. . . . Through two successful campaigns for office I have never made a secret of my Christian faith and my love of prayer. My faith and prayer have helped me through many challenges during public service."

His critics note that his Facebook page makes clear he is a government official, and they want him to keep God and prayer out of politics. Stathakis, who has stirred controversy in the past by having prayer before public meetings, isn’t budging, arguing there’s nothing unlawful or unethical about praying for terrorism victims.

So far, the post has gotten 148 likes, 12 shares and 30 comments -- the longest ones from a handful of critics who pounced on Stathakis for expressing his religious views.

“As a government official, it is unconstitutional for you to use your official position to promote the establishment of faith. It violates the most basic legal principles of the United States of America. In addition to being unconstitutional, it is highly offensive to your constituents. Please remove all religious references from government materials and keep your faith to yourself,” wrote one Facebook user, Rafael Saakyan.

Stathakis vowed to continue expressing his religious beliefs, and called his critics “misguided.”

“It’s my webpage. It’s my personal webpage,” Stathakis told WWJ’s Chrystal Knight. “And what’s really sad is it’s not about me, it’s about the people in Brussels. It was just a simple prayer asking God to be at their side, and all of a sudden now it’s become pointed at me.”

“I really don’t understand the uproar. I mean, it’s not the first prayer that I’ve had on my Facebook, it’s one of many,” he said. “And actually, we’ve been praying here in Shelby Township before all of our board meeting since I’ve been in office, November 2008.”

Despite all the negativity, Stathakis says he’s encouraged by the support he’s received and he feels those who oppose him are in the minority — and he plans to keep on praying.

“The First Amendment makes a very specific point to protect a private citizen’s freedom of speech. I am a private citizen as well,” he said. “My position as Shelby Township supervisor, I believe, does not preclude me from expressing my Christian beliefs.”

“As I state on my page, there is no secret in Shelby Township that I am an ardent Christian with a deep love of Christ and prayer,” Stathakis said. “Whether it is our invocation prior to each Shelby Township Board of Trustees meeting or our community’s role in founding the North Macomb National Day of Prayer observance, I will not shy away from expressing my Christian values, as they are as much a part of me as my love for the United States of America and Shelby Township.”

The First Amendment prohibits Congress from passing any law “respecting the establishment of religion or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”

Shelby Township Attorney Rob Huth [argues] that the prayer offered by Stathakis on his personal Facebook page “does not violate any provision of the Constitution.”

“(Stathakis) did not give up his right to pray for others just because he earned the title of supervisor,” Huth wrote in an email. “Frankly, as a Shelby Township resident I’ve enjoyed watching him stand up to those that don’t understand the law on this issue.”

Loud Muslim Prayer: Takeover of Michigan Town

The non-Muslim residents of Hamtramck, Michigan complained so much about the "noise" coming from the Islamic center loudspeakers (the Muslim call to prayer) that the Muslim residents organized an effort to gain a majority on the city council.  It appears the "noise" will remain.
“We were lied to.  We were told it would never be turned into a mosque.”

[At the] city council meeting, several residents of the Hamtramck Senior Plaza apartments on Holbrook complained about the volume level of the call to prayer coming from the Ideal Islamic Center, located across from the apartment complex.

[Resident Jeanette Powell] said the call or prayer was broadcast at 6 a.m. and found the volume “overbearing.”

The center on Holbrook was not the only mosque accused of broadcasting the call too loudly.

Susan Dunn, who is a candidate for city council, said the new mosque on St. Aubin St., the Abu-Bakr Al-Siddique Islamic Center, also broadcasts the call loudly. Dunn lives on Hewitt St., which is a block away from the center.

From "Muslims look to make a difference in Hamtramck" by Niraj Warikoo, Detroit Free Press 1/25/16

The week before Election Day in Hamtramck, hundreds of Muslims packed the City Council chambers.

They were outraged over a complaint made by council candidate Susan Dunn over the Islamic call to prayer that is broadcast outdoors from mosques, which she said were too loud.

The following week, three Muslim candidates out of six were the top vote-getters, winning council seats. After their inauguration this month, Hamtramck became what is believed to be the first city in the U.S. with a Muslim-majority City Council.  Four of its six council members are Muslim, three of them immigrants.

The story of how that happened offers insight into the political ambitions of the city's Muslim community in a time of intense debate about Islam in the West. And it shows how diverse groups — from Polish Catholics to Bangladeshi Muslims to African-American Protestants — can get along, city leaders say.

[Local businesswoman Karen] Majewski, whose family emigrated from Poland in the early 20th century, admitted to a few concerns of her own. Business owners within 500 feet of one of Hamtramck’s four mosques can’t obtain a liquor license, she complained, a notable development in a place that flouted Prohibition-era laws by openly operating bars. The restrictions could thwart efforts to create an entertainment hub downtown, said the pro-commerce mayor.

And while Majewski advocated to allow mosques to issue calls to prayer, she understands why some longtime residents are struggling to adjust to the sound that echos through the city’s streets five times each day.

While the city’s Polish Catholic population has shrunk from 90 percent in 1970 to about 11 percent today, in part as the old residents have moved to more prosperous suburbs, Polish American culture still permeates the town.

Hamtramck’s exceedingly low home prices and relatively low crime rate have proved especially attractive to new immigrants, whose presence is visible everywhere. Most of the women strolling Joseph Campau Avenue wear hijabs, or headscarves, and niqabs, veils that leave only the area around the eyes open. Many of the markets advertise their wares in Arabic or Bengali, and some display signs telling customers that owners will return shortly — gone to pray, much in the same way Polish businesses once signaled that employees had gone to Mass.

Many longtime residents point to 2004 as the year they suspected that the town’s culture had shifted irrevocably. It was then that the city council gave permission to al-Islah Islamic Center to broadcast its call to prayer from speakers atop its roof.

. . . The city council’s approval of an ordinance to allow mosques to broadcast the Islamic call to prayer onto public streets made it one of the few cities in the United States to approve the practice, according to a 2004 story in the Detroit News. “This is about uniting our community,” Shabad Ahmed, the first and only Muslim member of the Hamtramck City Council, told the newspaper.

Fast forward to 2015, when the city of some 22,000 people physically surrounded by but politically separate from Detroit has elected a Muslim-majority city council, believed to be the first in the nation. On Tuesday, the city elected three new city council members, making the council four of six members of Muslim faith.

Dearborn, which is part of the Detroit metro area, attracts most of the national attention over its Arab population, but its Muslim population is not as concentrated as Hamtramck.

Sued for Playing Christian Music: Michigan Dentist

Tina M. Marshall, a dentist in Lake Orion, Michigan, is being sued in Oakland County by former employees Nancy Kordus, Kimberly Hinson, Tammy Kulis and Sara Bambard for violating Michigan’s Elliott Larsen Civil Rights Act.  The plaintiffs claim they were fired and discriminated against for objecting to Marshall's choice of Christian music played in the dental office and for their rejection of Marshall's prayers.

However, the story is much deeper than this lawsuit as investigative media sources allude to Marshall's association with co-defendant Craig Stasio, a local chiropractor and alleged "cult leader" who brainwashes young adults.

David Kotzian, who is representing the former Marshall employees, would not comment further on what damages his clients are seeking from the suit but referred to the complaint, which specifies “they are seeking damages for loss of past and future income and employment benefits, outrage, humiliation, embarrassment, mental anxiety, emotional distress, and loss of professional reputation.”

Lawyers for Marshall filed a response to the lawsuit in November, denying claims she forced her religious practices on her staff.

Her lawyer, Keith Jablonski, told The Washington Post this week his client is “being attacked in this lawsuit for her Christian beliefs, based solely on her desire to play religious music and radio stations in the dental office of the business that she owns.”

“We believe that when the facts, and not baseless allegations, are presented to a jury, we will establish that this group of former disgruntled employees are simply looking to profit off of their own prejudices towards Dr. Marshall and her Christian faith,” he said. “Dr. Marshall flatly denies engaging in any discriminatory employment practices.”

Marshall purchased the dental practice in 2008 but her religious practices were only incorporated at the office as she became part of a local ministry run by Craig Stasio in 2013.

During a restructuring of the dental office [orchestrated by Stasio], almost all of Marshall's previous employees were fired or resigned, apart from one dental hygienist who still works for the practice.

Of the plaintiffs, Hansin [sic] had worked for the practice, previously ran by Dr. Raphael Flajole, as a dental hygienist for about 32 years. Kordus began working for the practice as a dental assistant in about 1993, and Kulis at the front desk in 1994. The three became employees of Marshall when she purchased the practice in 2008. Bambard began working for Marshall in 2011 at the front desk.

According to the lawsuit Marshall began playing the Christian music after she and her daughter Brittney joined Stasio's ministry sometime in 2013.

The lawsuit also alleges that Marshall would pray over patients receiving dental treatment, hung religious pictures in her office, placed holy water at her front desk, and maintained a diary of religious activity that occurred at her practice. The front cover of the diary stated "The Lord is my shepherd, I shall not want."

Media coverage kicked in after chiropractor Dr. Craig Stasio of Centerline offered his business expertise in revamping the dentist office, including terminating employees' contracts and organizing internal departments.

Fox 2 News has also aired several stories on Stasio in 2014 and one on November 23, 2015 claiming he is a cult leader, that he is ripping families apart, and most recently, that he is trying to groom teens, or recruit them, to a Christian ministry.

[Also, Jim & Tina Marshall] recently purchased a two-floor laser tag facility in Clinton Township.

The Marshalls changed the name from Laser Edge to Laser Tag of Clinton Township, and hired Stasio to manage the business.

[Mrs.] Marshall laughed when asked if it was a recruitment center for teenagers to enter Stasio's religious ministry.

According to Marshall, her husband Jim had been "born again and spiritual" for years before meeting Stasio at a bible study in the Marshall's basement.

From "Mich. Parents Claim Massage Therapy Office Is a Front for Christian Cult" by Morgan Lee, Christian Post Reporter 3/14/14

In a WJBK-TV report released on Wednesday, correspondent Rob Wolchek investigated claims from more than 12 family members who allege that Dr. Craig Stasio, who owns and operates the Clinton Township-based Agape Massage Therapy & Chiropractic, persuaded their relatives to drop out of college and move into a commune filled with office employees.

According to the organization's Facebook page, they "are a Christian faith-based company offering both massage therapy and chiropractic services. Glory be to our Lord Jesus Christ!"

Wolchek sent two undercover reporters into Stasio's office to learn more about its employees.

Parents told WJBK-TV that their daughters have referred to Stasio as "the prophet." Sources also said that literature associated with the movement suggests that he believes in a three-year tribulation, "where the sign of the beast is a computer chip" and "most people that are churched will hold onto the law and perish in the fire."

Stasio refrained from speaking with Fox 2 News investigator Rob Wolchek in 2014, however has since denied being the leader of any cult, and other allegations including that he had influenced his followers to distance themselves from their families and previous ways of life.

The Oakland County Sheriff Department Orion Substation has looked into the previous news stories, and no incidents have been reported about the dentist office on Baldwin.

Stasio explained the "following" is a "fellowship" and even a "fraternity" consisting of 20 to 30 people gathering on almost a daily basis.

They are in their mid-twenties to sixties, who are Christians simply "getting together, eating, praying, worshiping, reading the Bible, and fellowshipping" in non-structured group gatherings.

A Facebook post to The Lake Orion Chat Room dated July 17 read that a few changes had come to a local dentist office, including "Craig Stasio the Cult Chiropractor doctor" who "came in last week with a whole new crew from his ministry to work in the office."

When asked if Jim Marshall felt like he was in a cult he said, "absolutely not. I don't know why people come up with that. When Jesus was here on earth they actually said he was in a cult, it's in the Bible. We follow Jesus Christ, he's the one in Heaven, not Craig Stasio."

Jim Marshall said they had hired Stasio as their consultant because he has over 20 years of business experience.

Several instances in Dr. Craig Stasio's past have left previous employees of Dr. Tina Marshall puzzled as to why she requested he restructure her business practice.

[Stasio recounted,] "I said to Tina, 'the only way this is going to work, where I'll have any capacity to help you, is they have to be under the impression that when I come in I have jurisdiction to do what I see I have jurisdiction to do."

According to the 2008 Disciplinary action report of the Michigan Bureau of Health Professionals, Craig Allen Stasio, D.C., was fined and put on probation May 13, 2008 for a violation of General Duty/Negligence.

One report from 2004 determined Stasio had engaged in sexual activity with a massage therapist, which Stasio also confirmed.

Stasio was taken to jail in Sterling Heights, and after being released hired a retired FBI investigator for the case, resulting in the prosecuting attorney dropping all charges. Stasio said he could prove he was not even in the same city as the massage therapist when she made the call, and had multiple witnesses and testimony.

Stasio turned to Christianity ten years ago after a "radical life changing supernatural encounter with God."

Both Jim and Tina Marshall said his past is of no importance, and trust him along with his recommendations.

Court Nixes Police Favoring Muslims vs. Christians

On June 15, 2012, Christian evangelists were ordered by police to leave the Arab International Festival in Dearborn, Michigan because some Muslims there perpetrated acts of violence against the Christians.  Last week, the 6th Circuit Appeals Court ruled in favor of Bible Believers against defendant Wayne County, Michigan.
“We find that defendants violated the Bible Believers’ First Amendment rights because there can be no legitimate dispute based on this record that the [police] effectuated a heckler’s veto by cutting off the Bible Believers’ protected speech in response to a hostile crowd’s reaction. . . . The video record evinces next to no attempt made by the officers to protect the Bible Believers or prevent the lawless actions of the [Muslim] audience.”

The case stems from a 2012 incident in which members of a group called Bible Believers were pelted with rocks while carrying a pig’s head and telling Dearborn Muslims at the street festival that they would “burn in hell.” Wayne County sheriff’s deputies told the evangelists to leave or be ticketed.

“From a constitutional standpoint, this should be an easy case to resolve,” said Judge Eric Clay, writing for the majority. “However, it is also easy to understand Dearborn’s desire to host a joyous festival celebrating the city’s Arab heritage in an atmosphere that is free of hate and negative influences.

“But the answer to disagreeable speech is not violent retaliation by offended listeners or ratification of the heckler’s veto through threat of arrest by the police,” Clay wrote.

Some [Muslim] members of the crowd responded by throwing plastic bottles, eggs and milk crates at the Bible Believers.

The 6th U.S. Circuit Court of Appeals in Cincinnati, Ohio, made its ruling based on the First Amendment, saying the evangelist group Bible Believers should have been protected even though its speech was loathsome and intolerant. The opinion also mentioned the obligation of police when confronted with constitutionally protected speech that threatens to incite violence.

“Bearing in mind the interspersed surges of ethnic, racial, and religious conflict that from time to time mar our national history, the constitutional lessons to be learned from the circumstances of this case are both timeless and markedly seasonable,” Judge Eric Clay wrote.

The opinion by the court on Wednesday overturned a lower-court judgment and sent the case back to a federal court in Detroit, where a judge will decide the damages.

An en banc federal appeals court [review by 15 judges] has ruled that Christian evangelists who were “preaching hate and denigration to a crowd of Muslims” may collect damages because police told them to leave.

Police conferred with the Wayne County corporation counsel and told the Bible Believers they would be cited for disorderly conduct if they did not leave. More than a dozen officers escorted the group members from the festival.

The Constitution, however, does not allow “an angry mob of riotous adolescents to dictate what religious beliefs and opinions could and could not be expressed,” the court said. . . .

The court said Wayne County “effectuated a constitutionally impermissible heckler’s veto,” violating the Christians’ rights to free speech, free exercise of religion and equal protection.

The case against Wayne County, Sheriff Benny Napoleon and members of the department [deputies Dennis Richardson and Mike Jaafar], originally was handled in Detroit by U.S. District Judge Patrick Duggan, who recently retired.

The full court agreed one year ago to reconsider the case after setting aside a 2-1 decision by a three-judge panel in August 2014.

In that opinion, the panel said sheriff’s deputies didn’t violate the evangelists’ free speech rights

Such rehearings are rare.

“We are reviewing the court’s opinion,” sheriff’s office spokeswoman Paula Bridges said in a statement Wednesday. “No decision has been made as to what next steps, if any, will be taken therefore we will refrain from comment at this time.”

The lawsuit was originally filed in Detroit federal court by Ruben Chavez, Arthur Fisher, and Joshua DeLosSantos, a group known as the Bible Believers.

U.S. District Judge Patrick Duggan threw out the case, and an earlier appeals ruling upheld that decision, but the Wednesday opinion overturns the first two, ordering the case back to the lower court for calculation of damages.

"The only references to violence or lawlessness on the part of the Bible Believers were messages such as, 'Islam is a Religion of Blood and Murder,' 'Turn or Burn,' and 'Your prophet is a pedophile.' These messages, however offensive, do not advocate for, encourage, condone, or even embrace imminent violence or lawlessness," the majority found in an opinion written but U.S. 6th Circuit Judge Eric L. Clay.

"Although it might be inferred that the Bible Believers' speech was intended to anger their target audience, the record is devoid of any indication that they intended imminent lawlessness to ensue. Quite to the contrary, the Bible Believers contacted Wayne County prior to their visit, requesting that the WCSO keep the public at bay so that the Bible Believers could 'engage in their peaceful expression.'"

"We took [his vehicle] back to the police department and later, we went back to the vehicle at the request of the individual we’re investigating, to retrieve some items," Lawson said. "At that point, that led us to obtain a search warrant to further search. That's when the bottles and evidence were found in the trunk area of the vehicle."

Lawson said the possible human tissue and drugs were found in 13 small containers and one larger one. Lawson said police took the potential human tissue to the Oakland County Medical Examiner's Office.

The doctor’s car was impounded two weeks ago when he struck and seriously injured a child in Orchard Lake, Michigan. Last week, police obtained a warrant to search the car for its “black box” data recorder. They then discovered the human tissue and medical supplies.

Roth’s practice, the Novi Laser and Aesthetic Center, was evicted from its office space last year. The practice touted its “safe” and “reliable” medical services.

“At the office of Dr. Michael A. Roth, our office philosophy is to provide safe, complete, convenient and reliable services within a comfortable atmosphere. With over 30 years of experience, Dr. Roth strives to provide the best possible care for his patients,” a web page for the doctor reads.

Roth has a history of malpractice allegations related to abortion practices.

Roth is well known to pro-life groups in Michigan, including one which has posted at least six malpractice complaints and judgments lodged against Roth from 1988 to 2015, some involving home abortions that led to alleged complications and allegedly botched procedures that later necessitated hysterectomies.

A state health inspector found during a January 2002 check that Roth’s drug-control license had expired more than 20 years previously and resulted in Roth being placed on professional probation for six months, fined $15,000 and barred from performing abortions outside of a clinical setting.

He also has been sanctioned for shoddy record-keeping and improprieties in prescribing medication, and in 2012 was fined $2,000 and sanctioned by a state disciplinary committee for a range of violations.

The New York Times quoted Roth in a 1988 story about the ethics of abortions based solely on the sex of a fetus. “I have no ethical problems with it,” Roth told TheNYT. “Absolutely not. I think that abortion should be available on demand.”

Roth has a history of alleged malpractice, public records obtained by abortiondocs.org show. He agreed to pay $200,000 for botching an abortion, and another in which the Michigan Board of Medicine fined him $2,000 for violating public health code in two abortions and for perforating a woman’s uterus.

Roth was evicted from his office space twice, records show, and as of December, 2014, was reportedly out of business. His wife filed for a restraining order against him as they went through a divorce in 2005.

ACLU Sues Catholic Hospitals to Force Abortions

The American Civil Liberties Union has filed a federal lawsuit against Trinity Health Corporation, a Catholic health system, for not performing abortions on five mothers with pregnancy complications.  The lawsuit claims that the type of medical conditions these women experienced often result in death of the unborn child as well as health risks to the mother and therefore the baby should be killed immediately without further consideration.

-- From "ACLU sues Catholic hospital chain over emergency abortions" by Liz Szabo, USA TODAY 10/1/15

According to the suit, each of the women had suffered a preterm, premature rupture of membranes, a condition in which the amniotic sac breaks and leaves no fluid around the fetus.

When this happens early in a pregnancy, it virtually always results in fetal death, said Sarah Prager, an associate professor of obstetrics and gynecology at the University of Washington, who is not involved in the lawsuit. Premature rupture of membranes is often caused by an infection. "This is a situation where there is virtually no chance that the fetus will survive," Prager said. "The miscarriage has started. It just hasn't completed."

Women in this situation are at high risk of serious infections and dangerous bleeding, Prager said. Terminating the pregnancy is considered the standard of care, Prager said.

According to the lawsuit, Trinity hospital staff refused to terminate the women's pregnancies. The women developed serious complications, including life-threatening infections, severe pain and hemorrhaging.

The ACLU claims that the Trinity Health Corporation, which is headquartered in Michigan, violates federal law by requiring its doctors to follow the Ethical and Religious Directives of the U.S. Conference of Catholic Bishops – instead of accepted medical practice.

"The case is really about ensuring that Catholic hospitals follow the same medical practices as all other hospitals," said Brooke Tucker of the ACLU of Michigan.

Tucker said the accepted standard of care in emergency treatment of miscarriages is to complete the miscarriage and terminate the doomed pregnancy to prevent further risk to the woman's health or life.

The American Civil Liberties Union and the American Civil Liberties Union of Michigan filed an amended complaint Friday against Trinity Health, headquartered in Livonia, in U.S. District Court in Detroit.

Trinity Health responded by issuing a statement that said, in part, “This case has no merit.”

“The Ethical and Religious Directives are entirely consistent with high-quality health care, and our clinicians continue to provide superb care throughout the communities we serve,” the statement went on to say. “We are proud that more than 25,000 licensed physicians work directly with our health system and share our commitment to people-centered care."

The ACLU says the federal Emergency Medical Treatment and Active Labor Act, or EMTALA, calls for appropriate emergency care, including abortion when warranted. It says that a public health educator in Michigan found at least five women who suffered miscarriages were denied urgent care because of Catholic directives.

A federal judge earlier this year dismissed a claim that a Catholic anti-abortion doctrine at Musekgon's Mercy Health Partners left her with improper care before she miscarried in 2010.

Trinity Health has 86 hospitals in 21 states, and 126 continuing care facilities, home health and hospice programs, and all-inclusive elderly care programs.

In Michigan, Trinity Health operates the Mercy Health system with five hospital campuses, 60 physician offices and more than 1,300 medical staff physicians as well as the Saint Joseph Mercy Health System with six hospitals, six outpatient health centers, seven urgent care facilities and more than 25 specialty centers.

The ACLU also threatened action last month against a Grand Blanc Catholic hospital for refusing a seriously ill woman's request to be sterilized during her scheduled C-section next month.

Genesys Regional Medical Center — part of Ascension Health, the nation’s largest Catholic health system — has refused to allow the obstetrician for Jessica Mann, 33, of Flushing, who has a life-threatening brain tumor and is pregnant, to perform a tubal ligation at the time of the cesarean procedure.

“As a Catholic healthcare system, we follow the ethical and religious directives of the Church," Genesys spokeswoman Cindy Ficorelli said in a statement. "Beyond that, we can't comment on this patient's particular case.”

From "ACLU Files Lawsuit to Force Catholic Hospitals to Do Abortions" by Sarah Zagorski, LifeNews.com 10/2/15

As LifeNews previously reported, the ACLU has been big advocates for abortion and forcing Catholic hospitals to perform them even though it’s against their religious beliefs. In fact, [the] ACLU of Michigan recently lost a lawsuit where they were trying to force Catholic and other religiously affiliated hospitals to do abortions in cases where the mother’s life is supposedly in danger. The judge involved in the case, Robert Holmes Bell, dismissed it and said that Michigan federal courts had no jurisdiction over the bishops conference policy directive and had no business interfering with their religious doctorial decisions.

Then, earlier this year, the ACLU sued the Obama administration for documents it says will show that the United States Conference of Catholic Bishops (USCCB) is restricting access to abortions for unaccompanied immigrant children. In February 2014, the USCCB objected to a new regulation proposed by the Obama administration that would require contractors to provide access to contraception and abortion for unaccompanied immigrant children who have been raped.

In an official letter, the USCCB as well as World Relief, the National Association of Evangelicals and Catholic Relief Services, explained that the new regulation violates religious liberty, specifically the federal Religious Freedom Restoration Act [RFRA].

Mother Plans Sexual Mutilation of Son, Media Cheer

The mainstream media is ecstatic over a viral YouTube video from Detroit, Michigan by Erica Maison showing her 14-year-old son, Corey, when she gave him a surprise present:  Female hormone medication so that the boy can be prepared for surgery in a few years to remove his genitals.  Corey began pretending to be a girl, including at school, after his mother taught him about "transgender" children.
“We all just want to be loved and accepted by others. And that's all any transgender child wants, is to be loved and accepted fully by their parents.”

-- From "See This Transgender Teen's Emotional Response to a Life-Changing Gift" by Jennifer Hansler, ABC News 9/30/15

Last week, the transgender teen from Detroit received a life-changing gift inside a little pink and white box: her first dose of estrogen. And her emotional response, caught on camera by her mother, Erica Maison, has gone viral.

Erica said Corey has faced a number of hurdles in the past two-and-a-half years, especially when she “still looked like a boy and was dressing like a girl.” She was turned away from neighborhood parties and scolded for her attire. At school, Corey was bullied so much, Erica said, that she pulled her out in the fifth grade and homeschooled her. Finding medical professionals that specialize in transgender people, let alone transgender teens, was a challenge.

Erica said that things have gotten easier. She and Corey found the gender clinic at Lurie Children’s Hospital in Chicago, where Corey underwent hormone treatments to stop male puberty. Now with her estrogen treatments, Corey will be able to start female puberty.

Once Corey “looked more like a girl,” Erica said, things became “so much easier.” Corey dismissed her neighborhood bullies, and many of them stopped picking on her. Some even became her friends. Corey even felt comfortable enough to re-enroll in public school for 8th grade.

We have been waiting months for the readiness letter to be finalized and sent to Chicago, so had no idea on a timeline of when it would actually happen. Sorry I had to stop recording because we were both blubbering sobbing fools LOL. September 24th is a day I will remember for the rest of my life!” said Corey’s mom, Erica Maison writing on YouTube.

According to her mother, Corey is usually busy riding her penny skateboard, playing Call of Duty on her Xbox, and obsessing over makeup. “She has more than I ever had my entire life,” Erica told BuzzFeed. But this particular day was different. This was the day Corey would be permitted to begin hormone therapy.

[University of Michigan] spokeswoman Mary Masson said Cavalcoli has been a professor at the university for 13 years. He is an assistant professor of computational medicine and bioinformatics.

Authorities say Cavalcoli had made arrangements with an undercover FDLE agent who is assigned to the FBI Child Exploitation Task Force. Cavalcoli believed the agent was the boy's father, according to a federal complaint filed in the U.S. District Court's Southern District of Florida.

On Nov. 22, 2013, the agent conducted an undercover session on the Internet posing as a 55-year-old father with a son who was 13 in the southern Florida area.

The profile was posted on a social networking website that catered to men, a portion of which provided an area to discuss sexual fetishes, including child pornography and sexual activity with young boys.

Gay Agenda Forced on Christian Colleges by Supremes

In the wake of the U.S. Supreme Court blessing of the Gay Agenda, homosexualists are gearing up to launch legal assaults against Christians on all fronts.  In response to those threats, Christian colleges are girding up with lawyers — perhaps to defend themselves, or simply to surrender.

"In employment policy and practice, Hope College [in Holland, Michigan] has always followed the state's legal definition of marriage," school president, John Knapp, wrote in a statement. "Spouses are eligible for benefits, so long as their marriage is legally recognized the state of Michigan."

"Notre Dame is a Catholic university and endorses a Catholic view of marriage. However, it will follow the relevant civil law and begin to implement this change immediately," the university emailed to employees.

And on Tuesday, Baylor University — the world's largest Baptist university — dropped a ban on "homosexual acts" in its sexual conduct policy, according to the Houston Chronicle.

While before, Baylor's policy said homosexual acts were a misuse of "God's gift," it now says the university "will be guided by the biblical understanding that human sexuality is a gift from God and that physical sexual intimacy is to be expressed in the context of marital fidelity."

From "Hope College to extend spousal benefits to gay couples after high court ruling" by Amy Biolchini, Holland Michigan Sentinel 7/5/15

Hope provides benefits to spouses legally recognized by the state of Michigan, said Jennifer Fellinger, vice president for public affairs and marketing at Hope.

Prior to June 26, that meant if a Hope employee was married to someone of the same sex in another state, the couple would not receive the benefits that a heterosexual married couple would at Hope.

As a result of Michigan’s ban on same-sex marriage being overturned by the U.S. Supreme Court, a same-sex spouse of a Hope employee is now eligible for spousal benefits.

Hope is a private, Christian college affiliated with the Reformed Church in America. The RCA has historically stuck to a Biblical definition of marriage — between one man and one woman.

From "Two Christian Colleges Extend Employment Benefits to Same-Sex Spouses" by Samuel Smith, Christian Post Reporter 7/12/15

On Monday, Hope College President John Knapp sent an email to the Hope community explaining that while Hope will continue to offer benefits to spouses of employees recognized by the state, the Supreme Court's ruling has effectively changed the definition of marriages recognized by the state of Michigan to include same-sex couples.

Knapp explained that after consulting with members of the Hope community and other Christian educators, it was determined that it's in the best interest of the school to keep the same employment policy and extend benefits same-sex spouses recognized in Michigan.

Knapp also explains that although the school will extend benefits to same-sex spouses, that does not mean the school will open use of the Dimnent Chapel for same-sex wedding ceremonies.

Although employees' same-sex spouses will now receive benefits from Hope college, Hope's statement on sexuality still states: "This biblical witness calls us to a life of chastity among the unmarried and the sanctity of marriage between a man and a woman."

From "Why Baylor University’s sexual conduct policy no longer calls out ‘homosexual acts’" by Abby Ohlheiser, Washington Post 7/8/15

Baylor University, one of the nation’s most prominent Christian colleges, has dropped a phrase from its student policy on sexual misconduct that specifically forbade “homosexual acts.” Although the revised code does not appear to alter the school’s policy barring same-sex relationships, the change comes as many Christian colleges grapple with how to define their standards for student conduct.

In a document outlining how the school will apply the new policy, Baylor says that it will “be interpreted by the Baptist University in a manner consistent with the Baptist Faith and Message of 1963,” a reference to a doctrinal document from the Southern Baptist Convention. That document, among other things, defines marriage as “the uniting of one man and one woman in covenant commitment for a lifetime.”

Lori Fogleman, Baylor’s assistant vice president for media communications, said in an e-mail to The Washington Post on Monday that the changes “were made because we didn’t believe the language reflected Baylor’s caring community.” The new policy went into effect in May of this year.

In a dissent, Chief Justice John Roberts wrote that the [majority, ruling] decision's language did not go far enough. "Hard questions arise when people of faith exercise religion in ways that may be seen to conflict with the new right to same-sex marriage -- when, for example, a religious college provides married student housing only to opposite-sex married couples," Roberts wrote.

[Christian evangelical colleges], some legal experts believe, may now face challenges to their tax-exempt status or other government benefits. . . .

A campaign by the Americans United for Separation of Church and State launched after the Supreme Court decision seeks to thwart colleges and other religious institutions seeking exemption from the implications of the ruling. Its "Protect thy Neighbor" project is aimed among other things at preventing policies that would "allow government-funded grantees and contractors to use religion as a reason to hire, fire, and withhold services in taxpayer-funded programs".

According to the Christian Post, its executive director Rev Barry Lynn said: "We will work to put a stop to reckless definitions of 'religious freedom' that are really just excuses to infringe on the rights of others."

Lynn said: "Even now, I would not want to be a person at a fundamentalist academy who is trying to defend the practice, that is taking a reasonable amount of government funds and refusing to allow a same-sex married couple to live in the married student housing. I think even now, that would be on the edge of the indefensible."

Prior to the Supreme Court's ruling, Americans United worked to stop Religious Freedom Restoration Acts in Indiana, Arkansas and other states that could, but not necessarily would, provide businesses and individuals with greater religious protections from being forced to serve and participate in same-sex weddings.

In response to a question from The Christian Post, Lynn, who is an ordained minister for the Church of Christ, contended that Christian colleges refusing to provide married housing to married same-sex couples is akin to schools not allowing interracial married couples to occupy married housing.
