School, Cops Threaten Bible-sharing 7-year-old

Administrators at Desert Rose Elementary School in Palmdale, California banned first-grader Caleb Zavala from sharing Bible verses (notes given to him by his mother, Christina Zavala) to classmates during lunchtime, and then the Los Angeles Deputy Sheriff was dispatched to the family home to further forbid the boy from sharing his faith with anyone, anywhere on school property because "someone might be offended."

When one child shared one of these notes with the first-grade teacher, telling her, "this is the most beautiful story I've ever seen," the teacher intervened. After publicly rebuking the Zavala boy, she called Mr. and Mrs. Zavala and, invoking separation of church and state, told them that their son was not allowed to share bible verses on school grounds. The teacher was unimpressed with Mrs. Zavala's correct interpretation of the Establishment Clause and stated that if they wanted to share bible, it would have to be outside the school gates.

According, Mrs. Zavala and her son proceeded to hand out bible verses and stories to her son's friends at the school gate for a brief period after school let out. According to the Zavala's many children congregated to receive the stories.

On May 9, 2016, when Mr. Jaime Zavala came to pick up his son and distribute bible verses, he was approached by School Principal Pagliagro. Pagliagro told Mr. Zavala that it was "against school policy" to hand the bible notes out at the school gate and they would have to move onto the sidewalk, which was a "public place." Jaime and his son complied and soon returned home. It was at 4:30 pm on that day that the LA Deputy Sheriff knocked on their door, telling them the school had called to report that the child and his parents had been sharing papers at school and that this was not permitted.

Mrs. Zavala made it a practice of including a Bible verse and encouraging note in her son’s lunch bag. The boy would tell his friends about the note and read them aloud at the lunch table.

It wasn’t long before children asked for copies of the notes and Mrs. Zavala obliged – including a brief note to explain the daily Bible verse.

“This is a clear, gross violation of the rights of a child,” said Horatio Mihet, a Liberty Counsel attorney representing the first-grader who attends Desert Rose Elementary School in Palmdale. They are also representing his parents, Christina and Jaime Zavala.

“It was outrageous and should shock the conscious of every freedom-loving American,” Mihet told me. “Apparently all the real criminals have been dealt with in Palmdale – and now they’re going after kids who share Bible verses during lunch time.”

The Liberty Counsel, a nonprofit litigation organization which specializes in defending religious freedom, has since sent a letter to the Palmdale School District to inform the administration of the correct interpretation of the clause establishing separation of church and state, arguing that pupils have the right to exercise freedom of speech through printed materials.

"Therefore, it was improper to ban student religious discussion during lunchtime. The district cannot suppress and censor this discussion, or the one-page notes consisting of Bible stories and verses placed by C's mother in C's lunch for his own personal enjoyment and edification; which he voluntarily chose to share with his little friends during non-instructional time; which interested classmates were free to accept or refuse, at their own discretion," the letter stated.

"The additional copies requested by C from his mother, for his friends (who had specifically requested them from him), are likewise protected, and fall into no classification of material that might be lawfully prohibited by the school district," it added.

Military Strips Bibles From 'Christian Terrorists'

In their continued battle against Christians, atheists of the Military Religious Freedom Foundation (MRFF) forced the removal of Bibles from memorial displays in VA hospitals and other military installations in recent months.  However, the MRFF's newest leader ran from the battle as he compared Bible-believing Christians to Muslim terrorists.

In February, after a phone call from the MRFF’s leader, volunteers at the VA medical center in Akron agreed to remove a New Testament Bible from a “Missing Man” memorial, a display honoring soldiers taken prisoner of war and those missing in action.

Late Wednesday afternoon, MRFF founder Michael “Mikey” Weinstein fired off a letter to the director of the Youngstown VA about another Bible at a Missing Man memorial there.

Depending on your perspective the Bible’s presence at the POW/MIA display table at the Akron Multiple Specialty Outpatient Clinic either turned the place into a Taliban military installation or it amounted to nothing but constitutionally protected religious expression.

The Kings James Bible and framed Scriptural quotations were removed in late February the day after Weinstein, acting on behalf of 11 clinic patients, complained to administrator Brian Reinhart. He argued the distinctly Christian place at the table was an unconstitutional establishment of religion and violated VA regulations.

The book was removed after the Military Religious Freedom Foundation, responding to complaints from service members stationed at the Ohio base, argued that the display should be moved to the base chapel or that it should honor POWs and MIAs of all religions and also those who have no religious affiliation.

MRFF demanded the base either move the display to the chapel, display books of multiple faiths and include one on atheist ideology, remove the Bible, or replace it with a “prop book” that would let viewers draw their own conclusions on what it represents.

The base chose to remove the Bible.

“We thoroughly assessed this particular situation and made the determination to remove the Bible,” said Marie Vanover, a spokeswoman for Wright-Patterson. “Mutual respect is an essential part of the Air Force culture and we must ensure we create an environment in which people can realize their highest potential, regardless of one's personal religious or other beliefs.”

The installation commander at Wright-Patterson [Air Force Base], Col. John M. Devillier, made the decision to remove the Bible from the display at the medical center last week “after thoroughly assessing the situation,” Wright-Patt spokeswoman Marie Vanover said. Devillier was not available for comment Monday.

Richard Thompson, president and chief counsel of the Ann Arbor, Mich.-headquartered Thomas More Law Center, objected to the removal.

“The courts have said ceremonial displays not meant to proselytize anyone is not considered an establishment of religion,” said Thompson. “It is there for someone to acknowledge or that person does not have to acknowledge it. … They can either accept the Bible being there or, if they are really offended by the Bible, they could turn away. “

Thompson said the base commander “capitulated” to the demand to remove the book.

“We cannot separate God and the Judeo-Christian principles upon which our country is founded from the military who dedicate their lives, who put themselves in harm’s way, when they are performing their duties,” Thompson said. “And certainly had the commanding officer wanted to fight this attempt to intimidate them from removing the Bible, we would have been happy to represent the organization without charge and I think would have won the case.”

On Monday, Jordan Ray, a retired Army captain who served multiple overseas tours, started his job with the Military Religious Freedom Foundation. On Tuesday, following Military.com's report about Bible's removal and Ray's role in it, he and his family were stunned and frightened by the threats made against them in online forums.

Mikey Weinstein, president of the organization, told Military.com he regretted Ray's resignation but understands it.

"My family, as well as MRFF's hundreds of paid and volunteer staff and countless supporters domestically and around the world know well what this kind of hostile reprisal and retribution from fundamentalist evangelical Christian extremists is like," he said.

In his letter of resignation, [Ray] said he continues to support what the foundation does in opposing extremist Christians who push their theology on others.

Illinois Fines Business $80K for Being Christian

Jim and Beth Walder, the owners of Timber Creek Bed & Breakfast near Paxton, Illinois, have been fined $80,000 by the state Human Rights Commission after being singled out in 2011 by homosexual men demanding their same-sex ceremony be officiated in the Walder's facility.  The Commission ordered the Walders to "cease and desist" from quoting the Bible to same-sex couples and welcome ceremonies of abomination in their facility in accordance with the Human Rights Act and pay the homosexuals $30,000 plus another $50,000 to the ACLU for legal fees.
"To be absolutely clear, we cannot host a same-sex wedding even though fines and penalties have been imposed by the Illinois Human Rights Commission. Our policy will not be changing. . . . We are not looking for a fight, but when immoral laws are purposely passed (or deemed constitutional) that blatantly conflict with God's Word and when the heavy hand of government tries to force us as Christians to embrace sinful behavior, we have a moral obligation to resist and stand for Biblical truth:  'It is better to obey God than men.' Acts 5:29."

[Michael R. Robinson, an] administrative law judge with the [Illinois] commission ordered TimberCreek Bed & Breakfast to pay $15,000 each to Todd and Mark Wathen for emotional distress.

TimberCreek, located about 100 miles south of Chicago, must also pay $50,000 in attorneys' fees and $1,218.35 in costs.

The Wathens had contacted TimberCreek in 2011 as they looked for possible locations for the ceremony.

TimberCreek owner Jim Walder had responded to the Wathens' inquiry with an email that said "homosexuality is immoral and unnatural," according to the American Civil Liberties Union of Illinois.

In September, [Judge] Robinson ruled that Jim Walder violated the civil rights of the Wathens when he denied them the opportunity to hold their civil-union ceremony at the B&B he co-owns with his wife — the TimberCreek Bed-and-Breakfast west of Paxton.

The landmark ruling marked the first time that the Human Rights Commission made clear that businesses in Illinois must serve the entire public and cannot pick and choose based on their personal religious views.

Following a public hearing held last November in Springfield to consider damages to be awarded to the couple, ACLU attorneys for the Wathens filed briefs to support the couple's request for a "cease and desist" order and for Walder to pay damages for emotional distress, attorneys' fees and costs. Lawyers for the B&B failed to respond in a timely matter, leading to the judge's ruling.

“Evidently, religious freedom does not exist within the Illinois Religious Freedom Protection and Civil Union Act or the Illinois Religious Freedom and Marriage Fairness Act.

“In our opinion, neither the state of Illinois nor the U.S. Supreme Court has the authority to tamper with the definition of marriage. God alone created marriage and declared thousands of years ago that it was to be between a man and a woman. Not two men. Not two women. We may be out of step with an increasingly anti-Christian culture, but we are in compliance with God’s design, and that is what ultimately matters.”

University of Illinois law Professor Robin Wilson, an expert on the intersection of religious freedom and same-sex marriage, said the penalties the state could impose upon TimberCreek Bed-and-Breakfast owner Jim Walder include placing a lien on his personal estate.

"Every time he refuses," Wilson said, "the state can fine him again."

If Walder opts to fight the state ruling, Wilson said, he must file an appeal within 14 days. Since it was made by a single judge, Walder could request a rehearing by either a three-person panel or the full commission within 30 days. If six of the 13 commissioners grant a rehearing, the original order is nullified, pending the results of the rehearing.

If that doesn't go well, Walder "can jump right back over to the appellate court," Wilson said. In either case, though, "he's got hanging around his neck factual findings that they are going to assume are true," she said.

We politely disagree.  God is not confused.  His Word clearly illustrates and declares that marriage is between one man and one woman.  It also labels homosexuality as an abominable sin throughout the Old and New Testaments.  God's Word is the ultimate authority, infallible, and unchanging.  It is the same yesterday, today, and forever.  His Word cannot be changed by a vote of the Illinois General Assembly when it passed the Civil Unions Act or the Gay Marriage Bill.  Marriage is only appropriate God's way.  Sexuality is only appropriate God's way.

Consequently, we cannot host civil unions or gay marriages at TimberCreek Bed & Breakfast.  It is not an issue of fairness or equality, but an issue of right and wrong.  We cannot be part of what God condemns.  Be assured that we are not lawless, hateful, judgmental, bigoted, or activists by any definition.  We did not initiate the present controversy.  We are not the ones who voted to change the 6,000 year-old definition of marriage.  We are just small business owners trying to be consistent in following God's Word and living it out practically in our lives.  And we are not alone. . . .

Colorado Schools: Satanic, Atheist Books Provided

The Delta County School District has agreed to allow materials from the Western Colorado Atheists and Freethinkers and the Satanic Temple to be available for distribution to middle and high school students on April Fool's Day after the Wisconsin-based Freedom From Religion Foundation (FFRF) complained that Gideon Bibles were previously made available to students.

A district policy allows for the display of pamphlets about programs not related to school such as Boy Scouts or a 4-H. The district is now under fire for that policy because it also allows for Bibles and Satanic coloring books.

The rule permits any material to be made available to their students, as long as it doesn’t cross certain lines. Gideon's International recently set out free Bibles for students to take home. . . .

Assistant Superintendent Kurt Clay says there’s a lot of discussion in the district about this. He points out that no material is allowed to be handed out, only made available.

They’ve also been consulting their legal counsel about changing the policy. He doesn’t want to ban all material because it would prevent rural students from finding out about afterschool programs and sports teams. They’re still unsure if they can legally make a rule against just religious material.

Candi Cushman, education analyst at the Colorado Springs-based Focus on the Family, told The Christian Post that she felt "common-sense standards of decency should apply to these."

"From the images displayed on recent television reports on this story, it appears that some of the materials may be disparaging of other religious viewpoints and even lewd in their depictions," said Cushman.

Cushman of FOTF also told CP that it "is commendable that the school is making an effort to avoid unconstitutional discrimination in a public forum against a group simply because of its faith-based perspective."

"It would be unfortunate to let intimidation from groups — with an apparent agenda of shutting a public forum down — to succeed in censorship for all."

Evangelist Wins Lawsuit vs. San Fran. Police, ESPN

Gino Emmerich and a Christian law firm will be paid $10,000 because Emmerich was forced by San Francisco police and sports TV outlet ESPN to cease holding a “John 3:16” sign outside of the Giants ballpark in July 2014.  Emmerich was singled out for holding a Christian sign among a plethora of signs and expressions of free speech by others in a crowd.

A traveling minister who carried his “John 3:16” sign to Willie Mays Plaza at AT&T Park before a Giants game, and said he was told to leave or face arrest, has settled his lawsuit for $10,000.

Gino Emmerich sued the city of San Francisco, but the settlement funds — $2,500 to Emmerich and $7,500 to his lawyer — will come from ESPN, which was filming the pregame activities and hired city police to keep order, City Attorney Dennis Herrera’s office said Tuesday. As part of the settlement, the city agreed to review the status of the plaza and the extent of the public’s right to carry signs or express opinions there.

. . . an ESPN producer walked up with four uniformed police officers and told [Emmerich] he would be arrested if he displayed his sign.

After the producer left, Emmerich said he nevertheless held the sign up in front of an ESPN camera. One of the officers then grabbed him from behind and moved him out of camera range, where police issued another arrest warning and let him go. All the while, Emmerich said, fans were in the plaza, some displaying other types of signs, though none with religious messages.

A settlement has been reached in a First Amendment lawsuit filed by The Rutherford Institute against police officers who allegedly intimidated and threatened to arrest a man who was lawfully and peacefully exercising his First Amendment rights in the Willie Mays Plaza prior to a Giants v. Dodgers game by holding up a “John 3:16” religious sign in the public plaza in front of the San Francisco Giants ballpark. The lawsuit, filed in the U.S. District Court for the Northern District of California on behalf of Gino Emmerich, alleged that police officers violated Emmerich’s right to free speech and assembly when they forcefully removed him from Willie Mays Plaza, surrounded him and threatened him with arrest if he did not cease displaying his “John 3:16” sign. Under the settlement agreement, the City and County of San Francisco have agreed to conduct an investigation about the status of Willie Mays Plaza in connection with the rights of citizens to exercise their First Amendment rights there.

On Sunday, July 27, 2014, prior to the start of a Giants v. Dodgers baseball game, Gino Emmerich arrived at Willie Mays Plaza carrying a “John 3:16” sign, a religious reference to a central tenet of Christianity. Other people were in the plaza, some displaying signs and otherwise communicating messages. Also in the plaza was a makeshift broadcast booth put together for a live broadcast and discussion of the Giants v. Dodgers game for ESPN SportsCenter. . . . Emmerich stationed himself in view of the camera, behind the commentators, and held up his John 3:16 sign. While Emmerich was holding up his sign, a police officer grabbed him from behind by his shirt and neck and moved him out of the view of the camera. Once Emmerich was clear of the cameras, he was surrounded by four police officers and warned, “If you go over there and hold that sign again, we will arrest you and the sergeant will come over here and decide where we are going to take you.” Emmerich then left the plaza as to avoid the possibility of arrest and turned to The Rutherford Institute for help.

“Much of what used to be great about America—especially as it pertains to our love of freedom and our commitment to First Amendment activities—has been overshadowed by a greater desire for security and an inclination towards political correctness,” said John W. Whitehead, president of The Rutherford Institute and author of Battlefield America: The War on the American People. “That this incident, with its police intimidation tactics, overt discrimination and censorship, took place in a public plaza dedicated to Willie Mays, a legendary baseball player who lived through an era of police tactics, discrimination and censorship, is a powerful indictment of all that is wrong with America today.”

Go To Jail for Bible Speech: Univ. Texas Police

Several officers of the University of Texas Police Department (UTPD) at Austin issued a citation to Joshua Borchert, an intern with Campus Ministry USA, for using offensive words while preaching on a street across from University property.  The police officers told Borchert that he could face jail for using the words “penis” and “anus” in the context of warning passersby of sexually immoral behavior.

The university told TheDC that the officer was responding to students who claimed to be “verbally harassed” by the intern-preacher. The video shows the officer explaining that the intern’s use of “anal” and “penis” offended students, before issuing a citation for disorderly conduct. “After a lawyer representing Joshua called the chief of police, the chief called Joshua and apologized. The citation was withdrawn.” Brother Jed told TheDC.

Ari Cohn, a lawyer with the Foundation for Individual Rights in Education (FIRE) told TheDC that he found the video “deeply disturbing.” “Speech that simply offends others is protected by the First Amendment, and contrary to the officer’s statements, it is not the job of police to ‘do something’ about it. Issuing a disorderly conduct citation based on the content of speech violates decades of clear Supreme Court precedent,” Cohn said.

“Even worse is that while Brother Jed is not a campus community member, and was not even on campus property, the officer justified his decision with the fact that students on campus across the way were offended. The implications for campus expression are dire,” Cohn went on to say. “If offending someone on campus is now grounds for criminal citations, students wishing to express themselves will much more likely censor themselves, or simply refrain from speaking at all. Such a result is unacceptable, legally and morally, at a state university bound by the First Amendment.”

After reviewing a citation written to an evangelical preacher for disorderly conduct, the University of Texas Police Department voided the citation because it did not meet the requirements of the law.

“Our review further showed that the officers in training responded to a call for service in good faith and with respect for all parties involved, including the person(s) wishing to file charges as well those being accused,” UTPD Chief David Carter said in a statement.

The First Amendment of the U.S. Constitution gives all people the right to freedom of speech. Even hurtful and hateful speech is covered under the amendment, and police officers must defend everyone’s constitutional rights, Carter said.

Carter said if an individual was threatening a student with their speech, the police could and would take action against that person.

“I’m not protesting; I’m preaching the gospel of Jesus Christ,” said Kirsten Borchert, 20, from Lafayette, Indiana.

Borchert was at DePauw University “preaching” with The Campus Ministry USA, based out of Terre Haute. The confrontational evangelical Christian group travels from campus to campus “Preaching specifically about sin and hell, and how sin leads to hell,” she said.

“I don’t want you [students] to burn forever and ever and ever in the lake of fire,” said Joshua Borchert, 22, who was fully adorned in his Eagle Scout uniform.

[In response,] Students mobilized quickly.

“I saw that post on Facebook, and I saw that there were protesters here saying homophobic things,” said sophomore Marissa Higgs. “When I heard about it I was like, 'okay, I've got to go.' So I grabbed my five foot rainbow flag off my bed and ran here.”

President Brian Casey was on the scene almost immediately after the situation began to heat up. As the afternoon continued, many at the protest felt a sense of pride and community with their fellow classmates.

“I don’t know why the school can’t kick them out,” junior Hector Rivera said, “It’s a private institution, so at least I’m curious to know more like the policies and politics behind all this.”

“We’re presenting no danger,” said Brother Jed Smock, the man in charge of The Campus Ministry USA.

. . . after The Campus Ministry USA was escorted off of DePauw’s grounds, Casey sent an email to students, faculty and staff announcing an open forum to be held at 4 p.m. in Ubben Quadrangle to address the protests.

Casey, DePauw Student Body President Craig Carter, City of Greencastle Mayor Sue Murray and Vice President of Student Life Christopher Wells gave short speeches to the crowd.

“Today we got invaded by people who came here, by people who came here who tried to shake our cores, who tried to shake our values,” Carter said, “I’ve never been more proud to be a Tiger.”

Students called for justice, and proclaimed that they were unsafe on campus and that the university was not doing enough to protect them.

Kirsten [Borchert] threw her hands in the air, carrying a Bible up with them, as she exclaimed her message to the crowd gathered outside of the Student Union Building.

The students, who stood at a distance not long ago no longer allowed Kirsten her personal space. They surrounded her with questions and comments, yelling back as she shouted to a crowd that no longer cared what she had to say. They were visibly aggravated.

“We’re using [Kirsten] because she’s usually the calmer one,” Joshua [Borchert] said, dressed in his Eagle Scout uniform. “I tend to rile them up more. They wouldn’t want me out there right now.”

Students screamed obscenities as Kirsten preached against getting drunk.

Joshua didn’t mind the crowd screaming at his sister. He said he is used to it.

“We go through different stages and cycles. She does that to get their attention, and once she gets their attention then she can continue to calm them,” Joshua said. He then explained the five-stage technique used by the group to humble the students into a calm crowd that can then receive their message.

Joshua and Kirsten have preached at around 30 universities in about 20 different states, Joshua said.

“Our message is repent, and be free from sin. Because if these people don’t repent, then they’re headed for hell,” Kirsten had explained.

Feds Fire Pastor for Public Baptizing in Calif.

Roger Holly, a Baptist minister, was fired from his job as maintenance worker at the San Francisco Maritime National Historic Park because he unnoticeably baptized a park visitor in the Pacific Ocean during lunch.  Holly has since filed a federal lawsuit against the Department of the Interior for being fired by the National Park Service, and for being told not to discuss religion with the public and being restricted from reading his Bible at lunchtime.

He says he was out of uniform at the time and simply helped dunk the visitor into the ocean.

"The religious 'ceremony' Holly performed did not include any outward, objective display of religion, such as reading sacred texts, public prayer, sermonizing or the like," the complaint states. "It simply appeared that two persons were swimming in the ocean, much like other park visitors."

Holly says no other members of the public were involved or raised an issue about the baptism. He claims that one of his former coworkers, a Native American woman, is allowed to display spiritually symbolic feathers in her Park Service vehicle, but his supervisor, defendant Robert Kier, interrogated him about the baptism.

He is represented by Alan J. Reinach with the Church State Council, of Westlake Village.

Northern Illinois University (NIU) in DeKalb agrees with atheists that free Bibles have no place in guest rooms at its Holmes Student Center, and also agrees with homosexualists that designated accommodations are appropriate for students who are sexually confused (transgender) and those who claim various deviant sexual labels.

The added [gender-inclusive] housing option is one of many ways NIU is reaching out to students in the lesbian, gay, bisexual and transgender community. The acronym is sometimes extended to include queer, intersex and asexual. On a basic level, queer is a fluid label that acknowledges being outside societal norms in regard to gender or sexuality. Individuals born with ambiguous genitalia or bodies that appear neither typically male nor female identify as intersex. And people who are asexual do not experience sexual attraction.

[Molly Holmes] also oversees Transitions, a club that helps transgender students meet and learn from one another. It was inspired by a transgender student intern who had difficulty navigating resources on her own in 2011.

“Transitions has been a response for what students have asked,” Holmes said. “We hear that students come here because of that group.”

Annie Laurie Gaylor, co-president of the Freedom From Religion Foundation [FFRF], discovered a Bible in a drawer last month during a stay on the DeKalb campus where she had been invited to speak by the Secular Student Alliance. Upon her return home, the foundation's lawyer wrote a letter to the Holmes Student Center director requesting the books be removed.

The ubiquitous Bibles in bedside tables come from Gideons International, an evangelical group founded more than a century ago by two men who accidentally shared a hotel room and set out to spread the Gospel in hotels across the U.S.

For decades, Gaylor said, the Freedom From Religion Foundation has taken aim at the Bibles, especially in public accommodations such as state university hotels and park lodges. Some members when they travel carry stickers to slap on the covers of hotel room Bibles — sarcastic warnings that literal belief in the book could endanger the reader's health and life.

"Even if it takes three decades of education, we're finally persuading public officials," Gaylor said. "It's an anachronism. As this country becomes more and more secular, more and more people are offended. It's a constant mop-up job."

According to a representative with the Holmes Student Center, the bibles were removed in late October as requested by the university’s legal counsel.

Nicholas Bergman is president of NIU’s Secular Student Alliance. He says he is satisfied with the university’s response:

“The school is trying really hard to support that interfaith dialogue and sense of community between different religious groups. Only having the Bible in the hotel rooms seemed to be against that.”

Bergman says if visitors want to read the book, it is available elsewhere in the community.

"No one is making any guest open the Bible. No one is making them read it. In fact, the university is not 'providing bibles;' it is allowing a Christian group to place literature, the Bible, in hotel rooms much like a pizzeria may leave coupons," [American Center for Law and Justice] ACLJ Chief Counsel Jay Sekulow wrote on Thursday.

"They unbelievably claimed to be 'proselytized in the privacy of their own bedrooms.' Who knew a closed Bible's mere presence qualified as proselytizing. Yet, they called the Bible 'obnoxious' and claimed that the mere presence of the Bible in a state-run lodging was 'inappropriate and unconstitutional,'" the ACLJ described.

The ACLJ reminded the FFRF, however, that the Supreme Court has ruled that "adults should be able to withstand 'speech they find disagreeable,' without imagining that the Establishment Clause is violated every time they 'experience a sense of affront from the expression of contrary religious views.'"

"There is no coercion," Sekulow insisted. "There is no proselytizing happening here. Instead, it's once again clear that those holding themselves out to be freethinkers are threatening smaller institutions with constitutional claims that would fall flat in court. FFRF is in the business of making threats because they know that any time they go to court, they always lose."

Bible Verse Gets Georgia Athlete Disqualified

The Georgia High School Association (GHSA) negated the third-place finish of John Green, a senior Wolverine of West Forsyth High School (near Atlanta), in the state cross country championship race because he wore a headband printed with “Isaiah 40:30-31.”  Officials said Green's uniform violated a vague and rarely enforced rule, even though they had approved Green's appearance before the race.  Green was photographed wearing the same headband in last year's race, yet he was NOT disqualified.

On Saturday, West Forsyth’s John Green was the third runner out of 226 to cross the finish line in the Class AAAAAA state championship race at Carrollton High School. Soon after collapsing from his effort and offering, as well as receiving, high fives from opponents as they walked by the cool-down tent, Green found out he placed 226th out of 226.

Green was disqualified by GHSA officials for sporting a white, plain head band with “Isaiah 40:30-31” written across the front—the same head band the Forsyth County News has photo evidence of him wearing when he was not disqualified in last year’s state meet.

According to West head coach Clayton Tillery and others involved in the West program, two GHSA officials cleared Green’s headband before the race. Then, a third man who was not in an official uniform or credentialed made a comment about the headband at the starting line and walked away.

When I approached GHSA officials on Saturday to discuss the ruling I was told “it was a uniform violation,” but when I asked to see in a GHSA handbook where the rule is I was shooed away.

The GHSA links its cross country handbook, a seven-page document, to its website. There are two pages that discuss uniform protocol. Page 4, titled State Meet Cold Weather Reminders, permits “beanies, toboggans, ear covers” of a single color, as long as they only have “one logo” visible. There is no mention of headbands.

The bigger issue, however, was enforcement. Dozens of runners had headbands on, and, according to Tillery, there were other runners in the race who wore headbands with Bible verses and the like written across them. There was also no manufacturer logo on Green’s headband because last year, Tillery says, he ripped it off. There’s also the glaring issue of the third official not communicating clearly to Green or the coaches.

“We felt given the race course conditions, that John would not be able to run safely without something to keep his hair out of his face,” Coach Griffith said.

Since two of the race officials had already cleared the headband, they told him to turn it inside out and run the race. And when John crossed the finish line he was summarily disqualified – for breaking a rule that wasn’t on the books.

John had worn the headband since the start of the 2015 season.  He also wore the headband at region and sectional meets.  At no point was he ever told to take it off.

A flyer promoting a nationwide “Bring Your Bible To School Day” that was sent to thousands of parents by a local school district raised confusion with parents and students. The pamphlet even quotes scripture, reading “Let your light shine, – Matthew 5:16”.

Montrose, Delta and the District 51 school districts all say children are all allowed to bring their Bible to school, yet Pastor Randy Mills says Bring Your Bible to School Day should not focus on imposing your religion upon others.

“We’ve received a few calls from concerned families”, said district spokesman Daniel Thigpen. The report adds that school policy states materials that “discriminate against, attack, or denigrate any group on account of gender, race, color, religion, ancestry, national origin, disability, or any other unlawful consideration; or promote one group over another” are prohibited.

“Separation of church and state” is not a reason to ban student religious expression. Atheists would like Christians to believe that the US Constitution insists on this separation. This is a myth. Our founding fathers’ intention: freedom of religion, not freedom from religion; government (the state) should not control religion.

The Folsom Cordova Unified School District, still coping with community reaction to an email it sent to 20,000 parents publicizing “Bring Your Bible to School Day,” is sending another email flier advertising a Sunday atheism event at the state Capitol.

The district has already distributed the announcement via its third-party email service, Peachjar. It invites participants to “Freethought Day,” an afternoon celebration of science, First Amendment and nonreligious rights on the Capitol’s south lawn.

Folsom Cordova Board President Teresa Stanley said that the district’s legal counsel, in advising that the second flier also be emailed, warned that the district may not disparage or discriminate against any one group. The mailer included a another disclaimer stating that the school district was not a sponsor of the program.

Novella Coleman, an attorney with the ACLU of Northern California, said Thursday that the district likely violated the separation of church and state.

“We’re raising our child in an interfaith household. We have a strong sense of faith in our house, but we would never bring that into the school institution,” Slovak said. “It’s unbelievable the district is supporting something that blurs the line between public education and religion.”

The email was sufficiently disturbing, she said, that the couple kept their daughter out of school on Thursday “in protest of what the district is doing.”

Daniel Thigpen, spokesman for the [Folsom Cordova] district, said that the district has a policy that allows the distribution of some fliers by email from organizations that want to publicize activities for students and families. But he said the district “tried to make clear to our staff and our families is that this is not a district- or school-sponsored event in any fashion.” He said no students were required to participate.

Lesbians Sue Christian School for Biblical Beliefs

A lesbian "married couple" plan to file a civil rights lawsuit against a Christian school in San Diego, California for not enrolling their 5-year-old daughter based on the following from the school's handbook:
“Mt. Erie Christian Academy [MECA] is a religious, Bible-believing institution providing education in a distinct Christian environment, and it believes that its biblical role is to work in conjunction with the home to mold students to be Christ like. On those occasions in which the atmosphere or conduct within a particular home is counter to or in opposition to the biblical lifestyle that the school teaches, the school reserves the right, within its sole discretion, to refuse admission of an applicant or to discontinue enrollment of a student. This includes, but is not necessarily limited to, living in, condoning or supporting sexual immorality; practicing homosexual lifestyle or alternative gender identity; promoting such practices; or otherwise having the inability to support the moral principles of the school (Leviticus 20:13a; Romans 1:21-27; Matthew 19:4-6; I Corinthians 6:9-20).”

"The least Christian thing I could think of is turning away a child," Rev. MacArthur Flournoy of the Religion and Faith Program at the Human Rights Campaign said in a statement on HRC's website. "The message this school is sending to this child is that God is not there for her nor for her parents. There's absolutely nothing Godly in their actions."

Added Johanna Eager, Director of HRC Foundation’s Welcoming Schools program: “There is no doubt substantial harm is done to schools, children, teachers and families when a school tells a student that something is wrong with them or their family.”

Iredale said he believes that in the next five to 10 years, the U.S. Supreme Court will have to decide a case like the one involving Mt. Erie because of changing public policy regarding homosexuality.

Sheena said she's ready to fight for it.

Team 10 reached out to the National Center for Lesbian Rights.

"This type of policy is out of touch with reality," said Cathy Sakimura, deputy director and family law director for the NCLR.

Sakimura said barring Sheena's daughter from school could create a culture of fear among children at the school, allowing children to think it’s not OK to be LGBT or divorced. She hopes the Mt. Erie situation will start an important conversation within the church community, one that leans toward better acceptance. She said many parents within the church and school community may be ready to change the policies to better reflect that.

The school reportedly updated its handbook following the June Supreme Court ruling that made same-sex marriage a constitutional right.

The Christian school referenced the controversy in a Facebook post this week, writing: "We stand firmly behind our board's decision and ask that you support us through this time. We may receive some backlash from those who do not respect our Biblical perspective, however we will continue to provide a Christian education."

From "Faith-based schools face LGBT dilemmas" by Wayne Stender, WORLD News Service 10/5/15

In the months since the Supreme Court decided same-sex marriage should be legal throughout the United States, faith-based high schools have entered a new frontier. While some Christian schools are fighting to teach biblical views on sexuality, others have changed to fit in.

Solicitor General Donald Verrilli made comments before the Supreme Court foreshadowing legal problems for faith-based schools. When asked by Justice Samuel Alito if a faith-based school could lose its tax-exempt status over its views on same-sex marriage, Verrilli replied, "It's certainly going to be an issue. I don't deny that."

Joe Carter, editor for The Gospel Coalition, wrote last spring that the Supreme Court's decision on same-sex marriage could force some schools to either adjust views on sexuality or give-up non-profit status, making them for-profit schools. That could mean faith-based schools won't be in existence much longer.

Iredale: "If you have a religion that believed in human sacrifice or amputation of the arm or the hand for theft, would we permit that in the interest of permitting the free practice of one's religion? I don't think so, and one could argue that psychologically... this is as devastating to the little 5-year-old girl as some of those other vicious practices."

So, this news organization reaches out to an attorney who likens Christian practices to human sacrifice and amputation. Wow. Oh, and their other source? It's the deputy director and family law director for the National Center for Lesbian Rights, who said, "This type of policy is out of touch with reality."
